WHEREAS, the City has received approximately $500 in donations and charges for lost and damaged books that has not been appropriated, and WHEREAS, the Librarian has asked that these monies be appropriated for the purchase of library books, and WHEREAS, proper accounting practices require that all appropriations of City monies be made by ordinance. WHEREAS, the Personnel Ordinance, KWC 23.55.020(a) and 23.55.050, specifies that the tables establishing salary structure by grade for classified employees and hourly rates for part-time employees may be replaced by ordinance, and WHEREAS, the proposed 1981-82 annual budget has been submitted with salaries by grade increased by ten (10) percent over the 1980-81 salaries, and with the part-time rates increased by ten (10%) percent. Motion passed unanimously by roll call vote. Councilman Wagoner said he will not make an amend- ment to the motion to preclude the City from leasing the vacant space to air carriers for purposes other than scheduled passenger service into the airport. City Manager Brighton asked Councilman Wagoner, if the case is that this one or both could be accom- odated for commuter service or air transportation in the portion just vacated, would your motion preclude this? Councilman Wagoner replied, yes, the reason he made the motion is, if we are doing the renovation project, he did not feel the City should not put in additional users that will further congest the area and complicate the project. Mayor O'Reilly asked Atty. Delahay to clarify the motion. MOTION, Amendment: Councilman Wagoner moved, seconded by Councilman Measles, that no space in the Kenai City Airport Terminal be leased for the purpose of commuter or scheduled passenger airline service, by any carriers not now using terminal space or sub -lease of pres- ently leased space, until the completion of the re- novation of the Kenai airport terminal tentatively scheduled to be completed on or before Feb. 1, 1982. PERSONS PRESENT SCHEDULED TO BE HEARD C-1 Alex Shadura - Traffic Control in City r z z �c M C fir KENAI CITY COUNCIL MAY 6, 1981 Pacre 3 1 Mr. Shadura noted the City is 20 years old now, and that no action has been taken about traffic control in the City. We have had many accidents. it is time for Council to take action. He realized the problem with a Federal highway going through the City. The Council should consider industrial traffic by-passing the City. If the City can't have stop lights, we should consider four-way stops. if the need is there, the City should consider talking to the government for help. There are many bad areass Beaver Loop i Spur Highway, Main L Spur, wildwood & Spur, in front of Larry's Club - the 55 mile zone should be behind that curve, and the left turn on Willow 6 Spur should be eliminated. The City should set up a committee and consider these problems. Council agreed that the comments should be referred to Police Chief Ross and City Manager Brighton for study and they could come back to Council with a report. C-2 Dave Donald & Randy Willis - Ambulance Service Dave Donald said they are a volunteer EMT (Emer- gency Medical Training) outside and inside Soldotna. They have recently petitioned for ambulance services, the Borough Clerk is counting signatures, they have more than they need. They have a money problem. They need more education and more people. All but Kenai and Mikiski are in their boundaries. with the addition of Kenai it will be 1.34 mills. The petition can go to the Borough, they can set the service area. The Borough can change boundaries, the oil platforms could be brought in also. This would reduce the mill rate. City Manager Brighton asked if they had considered combining all areas as one district? Mr. Willis replied, he had and he asked Borough Atty. Sarisky. They were cautious about the idea, Mr. Brighton noted if the service district was the same as the hospital, there might be a possibility all could be combined. Mr. Millis replied he had talked to Mkiski, they are not in- terested right now. Mayor O'Reilly asked what was the time schedule? Mr. Willis replied, the petition will go to the Borough Mayor this week (5-4-81), the ordinance will be drafted Sept. 1, it will be on the October ballot. Atty. Councilman Mueller said in the alternate development plan there are things that could be done by private enterprise and we should not be doing. The have put all overruns on this change order. Wayne Henderson of Quality Asphalt spoke. He ex- plained they disagreed with the quantity in item #14. Other items relate to change in road grade. Councilman Wagoner asked if all the items were done. Mr. Henderson replied yes, but not all have been approved by Council. Councilman Wagoner said we are doing this backwards, the change order should _ be approved first. Mr. Kornelis replied it was that or shut the project down, and telephone polls are not allowed for change orders. Regarding leased lots without construction started. When the leases were made, many did not have a deadline that construction should be started. Administration is redirecting letters apologizing. 2. Regarding the Cason lease. He has been told that this was our proposal to them. He thought Council was voting on an amendment to go to Planning L Zoning. It would appear to him that accepting the lease after 3 years of controversy, our settlement was considerably less than appraisal, then anyone could settle for less than was originally proposed. we are setting a bad precedent. Public Works Director Kornelis said regarding the water line to Grace Brethren Church. DEC says they will accept grants up to 50% of the non -Federal amount of water 6 sewer. There is a bill in the legislature that may bring this up to 75%. The City will be set upon by other assessment districts. Finance Director Brown noted there are many problems in the Code in starting assessment districts. 7. Councilwoman Glick said on Aug. 14-15, 1981, the Municipal League Board.of Directors will be having their meeting in Kenai. S. Councilman Malston said regarding the water and sewer assessment districts, Council should give direction to Administration to start the mechanics. Over the years we have heard numerous "local" people explain the problem and give us their ideas on how to stop the erosion and how much it would cost. What we haven't had, to my knowledge, is an investigation, or report, of the problem by the Corps or any other professional engineering firm, lie would like to request your office investigate this situation so we can compile a feasible and viable development plan to protect our bluff property. It is our understanding that your office could participate in this project since public lands are involved, in this situation we have already had to relocate a sewer line which was becoming exposed by the bluff erosion, and one of our streets and a "public viewpoint" are being threatened. But perhaps one of the most serious aspects of this erosion is the eventual destruction of many historical buildings in Old Town Kenai, Most of the original village is located on the existing bluff, We would certainiv appreciate any assistance your office could provide to help ua address this "bluff erosion" problem, sincerely, Wm. Pair Market Value is defined as •the highest price estimated in terms of money which a property will bring it exposed tot $ale on the open market allowing a reasonable period of time to find a purchaser who buys with knowledge of all the uses to which it is adapted and for which it is capable of being used." This Pair Market value will be based on the unimproved condition of the land plus the value of improvements it any, paid by the City subsequent to the date of this Lease ;filch would affect the value of the property. At each five (5) year interval, the City will have the fair market value determined by a qualified independent appraiser. The redetermined lease rate, annual rent, under this provision shall be limited to a fifty (504) percent increase in the prior lease rate through the renegotation in 2003 after which the Set cap provision shall no longer apply and the lease rate shall be redetermined every five years on the basis of fair market evaluation as indicated above. It the Lessee does not accept the above appraisal as the fair market value so of July 1 of the redetermination year, Lessee shall give notice to City of such refusal within 30 days after delivery to L*asee of the appraised valuation and the rental rate derived therefrom, and within 10 days after such notice of refusal, the Lessee or the representative of the Lessee will meet with the representative of the City to neiect an impartial appraiser from the regular Alaska vembership of the 3 UJ 3'- Society of Real Estate Appraisers or the American Institute of Real Estate Appraiser$, or the ouccesnor body of either group who has been properly designated X.A.Z. or S.R.E.A., or S.R.P.A., or any future similar designation which donotes proficiency in the appraisal of commercial property and is recognized as such by either of the above two groups or their successor bodies. If the City and Lessee cannot agree on an appraiser an above provided, the City and Lessee shall each submit the name of an a praiser from either of the above groups who holds any of the above -required designations but who has not rendered an appraisal on the property subject hereto within one year prior to selection, the names wll be placed in a container, and one will be drawn by lot. The parties hereby agree that the appraiser agreed upon or so selected will be retained for the redetermination appralfiall that each party will pay one-half of the fee and expenses of the appraisal, that the appraiser will be Informed that he or she is being jointly retained by the parties, and that the appraisal rendered will be binding on both parties for that specific redetermination of rental rate, which shall be effective as of July 1 of the redetermination year. 10. PTHAetcirras (a) For the purpose of interim or pormanant financing or refinancing from time to time of the improvements to be placed upon the loaned promises, and for no other purpose, Lessee, after giving written notice thereof to the City, may encumber by mortgage, deed of trust, assignment or other appropriate inatrumont, Lessee's interest in the leased premises and in and to this Lease, provided such encumbrance pertains only to such loaaohold interest and does not pertain to or create any interest in City's title to the leased promises. If such mortgage, deed of trust, or assignment shall be hold by a bank or other established lending or financial institution (which terms shall include an established insurance company and qualified pension or profit sharing trust) and such institution shall acquiro the Lessee's interest in such Lease as a result of a sale under said encumbrance pursuant to a foreclosure or other remedy of the secured party, or through any transfer in lieu of foreclosure, or through settlement of or arising out of any pending or contemplated foreclosure action, such lending Institution shall have the privilege of transferring its interest In such Lease to a nominee or a wholly owned subsidiary corporation with the prior consent of the City, provided, however, such transferee shall assume all of the covenants and conditions required to be performed by the Lessee, whereupon such lending institution shall be relieved of anp further liability under such lease from any default after sue t► transfer. Such lending institution or the nominee or wholly owned subsidiary corporation to which it may have transferred such Lease, or any other lending institution which may at any time acquire such Lease, shall be relieved of any further liability under such Least from and after a transfer of such Lease. (b) A leasehold mortgagee, beneficiary of a deed of trust or security assignee, shall have and be subrogated to any and all rights of the Lessee with respect to the curing of any default hereunder by Lessee. (c) tf the holder of any such mortgage, or the beneficiary of any such deed of trust, or the security assignee shall give the City before any default shall have occurred in the Lease, a written notice containing the name and post office address of such holder, the City shall thereafter give to such holder a copy of each notice of default by the Lessee at the same time as any notice of default shall be given by the City to the Lease:, and the City will not thereafter accept any surrender or enter into any modification of this Lease without the prior written consent of the holder of any first mortgage, beneficial interest under a first deed of trust, or security assignee, in this Lease. He said there is nothing in the offer that would put Mr. Cason in any position differant than any other -- lease. He would like to make a counter -proposal to June 30, 2036. I am disappointed that the Council dismissed my arguments that the short term of the above Lease made use of the property for anything but tie -down rentals impractical, and that the land i should be valued on that basis. i appreciate the suggestion offered by the Council member that Mr. Cason might wish to cancel the remaining seven years of the Lease and negotiate an annual lease at a lesser rate for tie -downs only. Obviously, the City takes the position that with eight years left on the Lease, it can be used for something more than tie -down space. You are aware, and the Council is aware, that no financial institution in its right mind would finance a building on that )ot with only eight year, left on the Lease. The Council x am sure realizes; that the Lease is of too short a duration for long-term commercial development. it apparently Peals as though it is of too long a duration to allow the rents to be determined merely on the basis of the revenues that it would generate from tie -downs, To that end, the offer to shorten the Lease in return for a lower rental rate is understandable. In an effort to settler the matter, my cliont has authorized me to propose a corollary to your proposal that the Lease be shortened. In essence, my client's offer is as follows: I. He will agree to the four cents per square foot commencing July 1, 1978. , 2. The term of the Lease will be extended to June 30, 2036. 3. The Lease would be amended so that it would conform with the newest revision of the City's standard lease form, as revised per our agreement. 4. -The suit of City vs. Cason, Civil Action No. 3KH-79-106 would be dismissed with each side to bear its own costs and attorney's fees, and the trial set for January 11, 1982 would be vacated. S. All rental payments owed by virtue of the new lease rate would be paid within thirty days of the City's acceptance of this offer of settlement. I hope that the foregoing offer is sufficient to break the present impasse. Please note that it is not an admission by Mr. Cason that the Lease in its current condition is worth four cents per square foot, any inference to that effect being specifically denied. You may rest assured and sleep well in that the budget requested by the Mayor more than fulfills the requirements of Title 29 for the Borough's planning functions. The Borough has, and has requested in the budget, funds for four planners and also for secretaries, draftsman, typists, surveyor, etc, As a bit of mind resting comparison, when Johnny Johnson was Assembly President we only funded one planning position which employee (Sam Best) was head of the department which then also included solid waste, capital improvements and economic development. As I had previously stated to the city mayors, the Borough will not be furnishing a planner for each city to attend their planning meetings, etc., but our planning department will be available to aid and help with any technical problems that may occur. Rest assured that, as the Borough and not the city is charged with the planning functions by Title 29, we shall live up to our responsibilities and handle our authorities. It is'6ow possible to obtain several channels of video entertainment in such remote locations as construction camps and offshore oil rigs from Prudhoe Bay to Kodiak. Programming available now presents a wife selection of Movies, dews, Television Series shows,and Live Sport- ing Events. The cost is less than that expended on videotaped systems. Addition- ally, programming is not delayed and is available twenty-four (24) hours daily. Reception is accomplished by installation of a Television Receive Only (TVRO) Earth Station which is trained on the Satcome I satellite. The signals are trans- mitted from uplink facilities in the lower 1148" through the satellite and down to the (TVRO). From there it is amplified, modulated, and then distributed through cable systems as an RF (antenna) signal, or in some cases it can be rebroadcast over Low Power T.V. systems. After site selection, a link analysis and frequency coordination should be performed to determine the size needed for optimum reca:74vn. Reception can be improved by increasing the size of the antenna or by improv:-- :ne electronics. TVRO earth stations are reliable and will perform for long periods without a problem.
