WHEREAS, the State of Alaska has awarded a grant to the City of Kenai in the amount of $2,900 for the purpose of providing institutional library services at the Kenai Jail Facility, and WHEREAS, these monies will provide personnel services, a microfiche reader with accessories, and other library materials. WHEREAS, proper accounting practices require that all appropriations of City monies be made by ordinance. The sale will be conducted by the Department of Natural Resources under the authority of Alaska Statute 38.05.180 and held pursuant to the State of Alaska's Five -Year Leasing Schedule. The proposed terms and conditions of the lease sale are contained in the attached information packet, which includes the public notice issued pursuant to Alaska Statute 38.05.345, Information to Bidders, bid form and lease form. On the day of the sale, May 13, 1981, bids will be accepted at the International Banquet House between 8 and 9 a.m. and opened between 9 and 10 a.m. At 10 a.m., a public reading of the bids will begin. WHEREAS, in codification an error was made in the penalties provision of Title 13, Offenses and Penalties, to make the penalty applicable to all offenses in this "chapter" leaving offenses in other chapters of Title 13 without penalty, and -- WHEREAS, RMC 13.30.100 provided for penalty for violations of the chapter on Traffic Offenses, which would be duplications and unnecessary if the first provision for penalty was made applicable to the whole title, and WHEREAS, these errors should be corrected to show that the penalty applies to all chapters of the title. Mr. Rochanuski and Mr. Tarlas will be at the City Council meeting of April 15, 1981, to answer any questions. This subject will also be discussed with them at the Ad hoc Airport Committee meeting on April 13. I have one recommendation regarding this matter: that the mandatory operating hours for the food facility be adjusted to 6:00 a.m, to 10:00 p.m. `1 The original lease with ACI (Eitel & Butters) called for 5:30 k_ a.m. to IO:00 p.m. On January 4, 1979, Council approved a request to alter those hours to 10:00 a.m. to 9:00 p.m. For the past few months the food facility has been opening at `I 8:00 — 8:30 a.m. and closing approximately 9:00 p.m, I have received numerous complaints and comments due to these hours. Brighton, City Manager FROM: Keith Kornelis, Director of Public Works SUBJECT: City of Kenai Airport Parking Attached are three different alternate methods concerning how to handle the City of Kenai's Airport Parking. Alternate No.1 places the citizens of the City of Kenai, who use the Terminal the most,in the most desirable area'for their short- term parking. It is illegal to park or leave your vehicle unattended in the driveway in front of the Terminal. This short- term parking should be set up for those coming to pick up passengers and only need to park for a short period of time. The City of Kenai has requested from the State Legislature direct appropriations for $100,000 to pave the short-term parking lot. This money would be sufficient to pave the short-term parking area and a portion of the rental car area as shown in,Alternate No. 1. If Alternate No. 3 was chosen,there would be sufficient funds only to do the center section since there would be an increased cost for curbs and gutters and fencing. Since this funding is coming from the State Legislature, it should be used for public interest not that of private, commercial enterprises such as car rental companies. The rental companies receive quite a few benefits from having their own parking, far more than what 1 feel they pay in- their 10 percent. Some of these benefits include free electrical plug ins for their vehicles; the cost of which can be quite high during certain times of the year. It also includes free snow removal for their parking area. It also includes a guaranteed reserved parking area which means that any vehicle parked in this area may be towed away. Another point is that No. 3 shows parking of the rental cars up front next to the Terminal Building and shows a walkway running down between the rental cars which would provide a very dangerous situation for pedestrians. Citizens parking their cars in the short-term parking lot would have to walk through the rental car area with vehicles parked directly 0 I • i i Wm. J. No. 3 shows another entrance and exit to the already too small area for parking in front of the Terminal area. This entrance and exit are very close to the corners of the parking lot and is another undesirable traffic feature. Speaking as the Public Works Director in charge of maintaining the parking lots, I find thatlio.3 is an extremely costly alternate especially for snow removal. The snow accumulation in the rental area on Alternate No. 3 would have to be loaded on dump trucks with loaders and hauled away. The suggestion has been made that our loader could simply push the snow down the aisle between the rental cars for the 200 feet of the center parking area and continue pushing the snow another 220 feet out beyond the next parking area. Both the -- Airport and Street Maintenance Foreman and I agree that this could not be done and that loading and hauling would have to be used for this area. This method of snow removal has not been done in the City of Kenai and would prove to be very expensive. It has been pointed out that people who rent cars have a tend-ncy to park them in the driveway in front of the Terminal and yet in talking with the Airport Officer and from my own observation most of the illegally parked cars in the driveway are those of private citizens. It seems to me that pushing the private citizens further back in the parking lot would increase and encourage more illegal parking in front of the Terminal. I feel that if more tickets were given out by both the police and the Airport Operations Officer possibly this problem could be alleviated or at least cut down. Tickets given to rental cars could and would be passed on to the actual renter through the car rental agency. To summarize, I feel that the Council of the City of Kenai made a correct decision in adopting Alternate No. 1 as a future scheme a for Airport parking. I also agree with the change from the original drawing which placed the rental car parking entrance -, on the northside of the area instead of on the west. I feel that j if the Council should choose to reconsider and go along with Alternate No. 3 that they should also consider a few other items such as either having the rental car agencies pay for the improvements for the area or increase their 10 percent rental for the area since this would vastly improve their present conditions. The rental agencies should also be reponsible for removing their own snow in this highly congested area. If Alternate No. 3 is chosen I feel that money received from the ° 1 State Legislature that will go into the City's general fund should not be spent to make improvements for a private enterprise a. even though that private enterprise produces revenue for the -- Airport Fund. The above comments are meant to be only for information and I will respect whatever decision Council makes. This commuter service will be subcontracted to Evergreen Helicopters and operated with their aircraft and personnel, at least for the time being. In the future, assuming adequate facilities and passenger traffic, we will also be considering jet service to Kenai. In order to provide this service, we will need space at the terminal facility. Our thinking at present is to lease office rooms 920 and 21 and about 80 square feet for a ticket counter. We prefer to lease the space currently used by Dollar Rent-A-Car. However, if it is not available, the next alternative would be to use the space currently occupied by the vending machines. These spaces have been marked as Alternatives A and 8, respectively, on the attached diagram. We also understand that we can jointly use the hold room area with Wien; we can provide our own security equip- ment if necessary. The lease should provide a right to relocate when new or other te=inal space becomes available. It is our intent to lease this space in Alaska Airlines name, but with the signage to reflect Evergreen's involvement in the commuter service. ' April 7, 1981 W Dear Set Netters As you knaw, the City of Kenai has been granted patent to the area knowAas Alaska Tideland Survey (ATS) 272 from the State of Alaska pursuant to A.S. 38.05.035 on the 6th of January, 1977. (Kenai Recording District, Book 107, Page 167.) Included in this conveyance are all Shore Fisheries Leases within ATS272. Our records show that you are currently the owner of one of these leases within our jurisdiction. The Kenai Advisory Harbor Commission is,currently reviewing these leases and is preparing recommendations to the City Council on how they should be administered. Areas being discussed relate to the annual fees, preference rights, lengths of lease, whether or not sites should be leased, adoption of a lease, possible amendment of Ordinance 455-78 (Kenai Tidelands Ordinance), application procedures, and others. We would appreciate any advice or information you may have which would assist us in making viable recommendations to the City Council relating to these Shore Fisheries Leases (Set Net Pe=its). The City may grant permits for the place- ment o rishing set nets on City -owned tidelands. Users of such permits are bound by the rules imposed by the Alaska Board of Fish & Game. The number of set -net permits granted will be influenced by environmental and economic considerations. 8. option Rights. First option shall be granted to the upland permit holder over other nonpreferenco applicants for the use of tideland and contiguous sub- merged land seaward of the upland property and which is needed by such owner for the purpose of act -netting, provided that the permit granted pursuant to such option may be no longer than the length of the original set -net permit or lease for the use of the upland tract. The reasoning behind granting such a first option is to avoid the inequity, confrontation.and strife that may result where the upland set-netter is cut off from fishing runs by set -nets placed seaward of his nets. C. Conditions. in order to benefit the greatest number, wh le still being aware of the need to preserve the environment and its food supply, the following conditions attach to all set -net permitp issued by the J City which shall additionally be set forth in each permit issued. ' 1. Two permits per individual. No one individual may hold more than two set -net permits of any kind from the City, and in no event shall such permit site contain in excess of the number of units of legal gear allowed by the Alaska Board of Fish and Game in the region in which the City tidelands are located. 2. In a dissputo concerning ones or more uet-riot permit sites, the protesting party may request the manager to reestablish by survey the boundary lines of each tract or tracts in question. The manager may require that a survey be performed to determine the original location of the houndarl lines in dispute. The party or parties at fault shall pay the cost of the entire survey, or, failing to do so, the permit of the party at fault shall be revoked. D. Classification of Set -Nat Areas. Before granting any set -net permit, the City Council by resolution previously advertised in a newspaper of general circulation no loss than five days before the date of hearing and with the approval of the Harbor and Planning & Zoning Commissions, shall classify the area to be utilized for such permits except that where there are existing upland permittees of set -net permits than there shall be no advertising required where said existing setnet permittees exercise their option to apply for such permit sites pursuant to Section 5(b) above. The land shall be surveyed and platted into individual tracts to be utilized for set -net permits. The cost of surveying, platting, advertising and other out-of-pocket expenses incurred in properly classifying the land shall be reimbursed by the eventual permittees, if any, or shall be paid for directly by option holders. The Council at the time of considering the resolution shall determine the permit fee to be charged for set -net permits and mare that determination part of -the resolution to be passed. E. Notice. Notice of the classification of the lands avai�lilc for set -net permits, the time period for the acceptance of applicationu, and the permit fee shall be posted on the City nulletilt board ten (10) days prior to the acceptance of applications therefore. In ad- dition, notice of, the classification shall be printed in a newspaper of general circulation within the area ten (10) days prior to the time for acceptance of application.^.. Set -not permittee will pay their proportion- ate share of the survey platting and other classification expenses incurred by the City. However, this is a matter that the Council should study carefully in its assessment of just what responsibilities should be placed in department heads and City officers. However, if all members of the Council have an opportunity to study it before the meeting on April 15, and if there is no objection, it might be added to the agenda for introduction at that time. Even then it would be May 6th before it could be passed and June 6th before it would be effective, but that might cover a large.number of minor transfers in the last month of the fiscal year to prevent them from having to come before the Council. Davis, Administrative Coordinator DATEs April 14, 1981 SUBJECTS DOT/PP Port Facilities Gran:: Due to recent activities related to the Port Facilities Development Grant Feasibility Stuff, as approved by the City i Council along with its related Resolution 81-10 on January 24,'1981, the DOT/PP has requested the inclusion of an alternative develop- ment plan. The specific "recent developments" referred to are i the on-again/off-again situation surrounding the Robert Roper purchase of lease agreement, and the preliminary "wet" small boat harbor cost estimates included in CH2M•Hill's Draft, Task (� Order No. 1, Conceptual Design report, 6 It is the understanding of DOT/PF that our study describes a project which is based on the development of a "wet" small boat harbor located on Tracts 8 z C (Mr. Roper's leases). Due to this understanding, they do not feel comfortable with awarding the referenced grant since those recent developments indicate that this project may not be "feasible", and their guidelines specifically state that the grant will be made for a "feasible" project. On the Senate side, it was referred to the CRA Committee. SB 168 - CAPITAL GRANTS PROGRAM: By a vote of 18 - 0, the Senate on Wednesday adopted this bill which provides grants of $1,000 per capita to municipalities for capital projects. CSSB 168 am has been referred to CRA and Finance in the House. IN COMMITTEE HB 31 - DISPOSAL OF STATE & Mi1NICIPAL LAND: House Resources adopted a committee s stitute which requires the natural resources commissioner and each municipality to designate 20% of its entitlement, which the state will dispose of according to its sale and give away procedures. This designation must be made before patents will be issued for any of the municipality's remaining entitlement. If the commissioner and municipality cannot agree, the commissioner makes the decision, and the state will pay for surveying the 200. After the state sells the land, a partial assignment of land sale receipts shall be made to the municipality. The state may issue patents for land that is scheduled for disposal or a public purpose. This "out" clause is at the discretion of the commissioner. CSHB 31 has a further referral to Finance. HB 131 - STATE AID FOR HOSPITALS 8 HEALTH FACILITIES: After the abortion amend- ---ment was added to this bill, House BESS was able to hold the bill in committee instead of moving it on to Finance as reported in last week's bulletin. On Monday, the committee deleted the amendment which would have prohibited payments to hospitals that permit abortions to be performed. HB 131 was then reported out with individual recommendations: Clocksin and Cato - do pass, Martin - no recommen- dation unless amended, and Beirne - no recommendation. It has a further referral to Finance. La in committee - continued HB 331 - PORT FACILITIES OUTSIDE MUNICIPALITIES: After making minor changes, House CRA passed out this bill which adds "port facilities" to the list of extra- territorial jurisdiction powers of municipalities. HB 331 was referred to Rules j for placement on the calendar. SENATE BILLS CSSB 236 - MUNICIPAL ASSISTANCE: The CRA Committee has come up with a committee substitute which deletes the requirement that a municipality reduce its tax revenues by 50%. The CS -changes present law only by requiring that the Depart- ment of Revenue distribute the money in the municipal assistance fund on the last day of the fiscal year for which the appropriation to the fund is made. The CS is now in the Senate Finance Committee. SB 3S3 - G.O. BONDS FOR SCHOOLS: Introduced by Gilman, Dankworth and Kerttula, this bill authorizes advance funding to retire outstanding G.O. Bonds issued by municipalities for schools. Referred to CRA and Finance. SB 368 - LOCAL SERVICE ROADS $ TRAILS: Introduced by Gilman and Kerttula, this bill allows more flexibility for local governments in the upgrading of secondary roads; allows local governments to enter into construction agreements and to do their own design and engineering studies for the construction of roads.
