'tE IT FURTHER RESOLVED, that where the ordinance or resolution is put forward by the Administration,in the regular course of City buaines3s, that the word "Administration" be placed behind the above words, and where the Council as a whole has requested the preparation of an ordinance or resolution, the word Council" shall appear behind such words. AND BE IT FURTHER RESOLVED, that when any ordinance or resolution may be so amended that a party whose name appears thereon can no longer support it, that name will be lined out at the request of such party so that the ordinance or resolution will indicate the original proposer, but will alto indicate that said proposer no longer supports the same, PASSED BY THE. PERSONS PRESENT SCHEDULED TO BE HEARD 0-1 Harbor Commission Chairman John Williams - TAHS Boat Ramp Project Proposal fit, Williams said he had 2 items to discuss, re- lating to the memos distributed thin date. a. The removal of the derelict vessel, opggn ST. There nre 2 other boats in the area now tFiot hallo been put up for sale. The OPTIT41ST has boon there many years. b. Approval of the TARS proposal. The Wince, Corthell b Bryson proFossal has been not aside. The TARS proposal has boon roveiwed. The Harbor Commission recommendation is to Rio ahead with the TAMS proposal. 'Cho contract, ^483,000, irs higher than Witico, Carthcll L Dry:snn, but Winau, Ccrthell i Bryson in only cursory. TARS agreed to do this as an on -going contract with their ,:urrrnt contract. The Harbor t':9mmiaason feels all the work chculd be done together. Also, the high cost in for engineering design of a marine fueling system. That could be 1/2 of the total cost. Councilwoman Glick afOo4 Mr. Williams, on itom 0 of the Wince, Cortholi 4 Brynon proposal, what kind of a rendering in din..aned? Mr. Williams replied, they had reguouted a rendering of all in the area, Coyle's had already been surveyed, it will be brought together. Councilman Wine "aid he could not go for a proposal that in more than double the other. Council- man Wagoner explained there is not an approvable marine terminal in the a..,a. Councilwoman chick asked, wasn't the Harbor Commission going to contact the other facilities to see if other processors would be willing to give up their fueling facilities? 11r. Williams replied Bevy. Wpor was asked to do this. Also, TAMS has suggested this contract be a not -to - exceed cost. Councilwoman Glick noted this proposal with Wince, Cortholl b Bryson was 6 to 7 months ago. Did the Harbor Commission go back and check with them? Mr. Williams replied no. The Harbor Commission fools it should be with one contractor. VOTE (Posed): Yost O'Reilly, Click, Hall, Moaaloo, Wagoner Not Wise Atty. Delehay asked to address the derelict vessel, OPTIMIST. It takes 6 months to go through the pro- aed`ur�oa for this. This does not moan It cannot be moved, but it should be done very carefully so as not to damage it. If it is moved, it will fall apart. He has boon told it is owned by Don Wright, who felt it won historical and wanted it restored. It could be moved to City property and go through abandonment procedures. Councilman Wagoner asked, Is that on City property or Coyle property? Ruby Coyle replied, it is 1/2, 1/2. She added, it is a hazard and should be removed. MOTION I Councilman Wagoner moved, seconded by Councilman 11411, to direct Administration to remove, piece by piece, the OPTIMIST and haul it to the land fill. City Hanagor Brighton said the City hired an appraiser In case there was a lawsuit. He place the value at 0750. He is a marine surveyor. Councilman Wagoner added Hr. Wright has not noon it for several years. Motion pawed unanimously by roll call vote. 0-2 Diocusnion - Community Center Building Roger Mocks spoke. He reviewed the letter from the Historical Society passed out this date. It seems Mont of the objection of Council was the expense to rontore. The Historical :to.;ioty feein it !s historical. They cannot get Statc money till it in 30 yrs. old. They have talked to Juneau, and the answers seem favorabl•u for State grants in 2 y,iarz when it is 30 yearn old. Councilman wise said the water line broke when it was under loane. It is the City's responsibility to repair it. The Historical Society had every intention of renewing. The whole issue came up when the water repair was brought up. Tho loano should have boon extended. The terms of the lease are that the operation wart the responsibility of the Hlstorical Society. Mr. Hooks said they did not extend the leaso, they did not know, City Manager Brighton did call him, but he forgot. They renewed their liability insuranco as if they had a lease renewal, tie and the City tanager had agreed the repairs had to wait till Spring.They acted to good faith. City Manager Brighton said the lease has not expired. The lease was not on a basin of renewal, it was 01 for a certain number of years, The building can be torn down after 30 days notice, that notification han boon made, council- woman Click said the lease should be continued, the City has some responsibility. She had asked Atty. Delabay to IooY. into the legal documents on the transfer of land. Atty. Dolahay explained the land was act aside for a Library by the Civic tcague. There was a con- version clause, if it ceased being used as a library in 10 years, it would revert. The property sat aside for the library to be built in not where the Community Center in. So the clauso does not concern this build- ing. Councilwoman Glick suggoated a trade of land. Sir. Hooks said all they want in to keep tho old build- ing. Atty, Delahay explained the title to the piece on the cornor has reverted to the Civic League. There La nothing in the record that they gave all their land to the City. If there are any surviving members Of the Civic Longue, there are still ways to conduct action on this. NOTION s Councilwoman Glick moved, seconded by Councilman Hall, that the action of the duly 7, 1932 meeting be rescinded, Councilwoman Glick said a fine example of what can be done with old buildings in the Pine Arts building. It was in bad shape, Council felt it was worth ro- pairing. It is now an attractive building, this one can be also. Councilman Wagoner said it cost more than it should in the Pine Arts building, and this will be the same, Councilman Wine said we have an obligation to restore the water. The Historical Society has said they are adequately prepared to restore the building. They are not arsking for money at this time. Chairman Castimore informed the Commission that an encroachment violation Assisted in Redoubt Subdivioion, A 10' public easement has been blocked with personal property belonging; to sir. Measles which blocks the way for students using that easement to catch the school bus. This same complaint hat! been raised before and Chairman Caotimore asked the Commission to look into the matter. A Mr. Motz is planning to put a health spa in his home, enlarging his garage to do so. The Commission felt that since the business was not yet active, that a call to Mr. Mott explaining the code and the complaint should be requested to the City Manager. b. Discussion: P.tolin Subdivision Easement The Kenai Peninsula Borough is now requiring surveyors to include section line easements on all plats submitted for approval. Since this could present a cloud on any leases that are currently on land having a section line easement, the City will aak for vacation, of all section lane easements that lie within subdivisions. 6. NMI BUSINESS a. vacation Request: Portion of Fifth Avenue, Government Lot 7, Section 31, Lyman McBride Since Mr. McBride lives outside the state, Mr. Cliff Baker of Dowling Rice Associates was present to present the request. Mr. Baker explained that this request for vacation was made to clear a title for Mr. McBride who wished that his house be turned over to his son. The government lot was purchased in the early 1950's and the :.cure was built in 1952 before that area had been cleared and properly surveyed. Mr. !McBride built his house as accurately as he could within the survey indicators available and found later that he was sitting too close to the easement set aside. Mr. McBride is asking for the 5' vacation of the public easement not only to allow room for his house on the lot, but also to clear the title to the land. There are two more lots on the west side of the lot, however, no houses exist there and on the end of the public easement and nest to the last lot is the fence which borders the float plane basin. Across the easement to the north are all City owned lands. Mr. LaShot and Mr. Hackney were asked if the City would have any problems with the public easement should the request be granted, each indicated there would not be due to the unusual circumstances. There will never be a throughway there due to the float plane basin. Marla::: Commissioner Turner moved to approve the request of Mr. McBride based on the unuaal circumstances, that being the house being erected in that scanner before Kenai was a City, seconded by Commissioner Roth. vaTE: Motion passed with unanirtoua roll call vote. ■ KENAI PLANNING AND ZONING COMMISSION Page k Regular Meeting, September 8, 1982 Commissioner Turner asked that it be made a part of the minutes that the Commission has noted that a vacation request of this nature would not ordinarily be granted, however, given the unusual circumstances as stated, this particular request was approved. 7. Other Commissioner Smalley asked if anything had been done regarding the violations on the Quandt lease. The State department that has been handling the lease with the Quandts has stated that until they can prove that the Quandts have been in receipt of the letter, they can take no action, and the Quandts have been avoiding any contact with the State. MOTION: Commissioner Turner moved that the Planning and Zoning Commission requests Administration to provide a formal report on the status of the Quandt lease violation, seconded by Commissioner Smalley. VOTE: Motion passed with unanimous roll call vote The Commission wanted to impress that if the State could not pursue the matter, the City should move ahead. i.e. initially the letter stated that the City would push the matter to the point of prosecution. COMMISSIO.IS QUESTIONS AND CO.-VE:ITS Commissioner Lewis informed the Commission that the Mayor had asked that he pass along to the members that a meeting has been scheduled for the 25th of September that will include the City Council and all r f 1 L 3 � /� KENAI PLANNING, AND ZONING COMMISSION Page 5 7 Regular Meeting, September 8, 1982 Commission members. This will be an informal meeting for the purpose of discussing mutual concerns. A letter will be sent out with the details. Dr. Turner asked the status of creation of townhouse ordinances. It was determined that more material was needed, especially recommend- ations from the Fire Chief and Building Inspector, and that a work session be planned for the first meeting in October to be held just before the regular meeting. Commissioner Turner asked what the status was of the Lowery Lease. After checking on the original application by Mr. Lowery, it was determined that the letter stating the time table set 1983 as the target dates rather than 1982. The Commission asked that it be made a part of the record that the intent of the Commission was that some type of clearing or construction begin in 1982, but the current time, if the lease payments were being made, no action would be taken. The next concern was with the Capital Improvements lists. Dr. Turner felt that more attention should be given to the lists and that they should be more strongly adhered to. It was also suggested that requests be submitted to the Commission by City Administration and the other Commissions as soon as possible. MOTION: Commissionor Turner moved, seconded by Commissioner Smalley that City Administration, Department Heads. and other Commissioners begin compiling requests for Capital Improvements for the Planning and Zoning Commission as soon as possible. GUEST SPEAKERS Chairman Nacenoary and Director McCillivrary from the Parka and Recreation Commission attended not so much to opeak, but to , establish an interchange between the commissions within the City. Chairman Williams for the benefit of Chairman Necessary, Director McGilliv•ary, and commission members Chairman Williams reported that he had visited the Planning and Zoning Commission meeting and filled them in on how the Harbor Commission stood with the two major projects, in particular the boat ramp project as the area is also part of the parks system, including the need to think about water and sower facilities in the future, particularly as both the harbor and boat ramp projects progress. Chairman Williama also explained part of the funding problems for the two projects and their source. S. OLD BUSINESS a. TAMS proposal for the Boat Ramp Project The Commission discussed the proposal from TARS, indicating the large difference in the cost of the Wince, Corthell, Bryson proposal, however, it was decided that the scope of services done by TAMS made up the difference in cost. Chairman Williams called for comments from rho Commission and it was agreed by all members present that the public need was very definite and that the project should proceed at the earliest. Bill Brighton was asked about his trip to Petersburg regarding the camping facilities for cannery workers and it was agreed by the Commission that the camping area at the boat ramp was not intended for cannery workers but for fishormen and their families and persons f using the boat launch. { The discussion then turned to the fueling facilities and it was determined that a survey be conducted of the local canneries to f learn their feelings about the City handling fueling facilities. }POTION: Commissioner Dragseth moved to prefsent the TA14S proposal for the Kenai Boat Ramp project to the Kenai City Council requesting approval, seconded by Commissioner Thompson. VOTES 'notion passed with unanimous consent v KENAI ADVISORY HARBOR CONHISSION Page 3 Regular Meeting, August 31, 1982 b. Discussion: Clearing of Site - "F.V. Optimist" Comments by the Commissioners included the fact that the boat was in such shape as to be a menace to public hearlth and safety and that it should be moved with no further delays. MOTION: Commissioner Quesnel moved to request the Kenai City Council direct the City Administration to remove the derelict vessel in it's entirety in that this vessel is a menace to the health and well- being of the citizens of Kenai, seoncded by Commissioner Dragseth. VOTE: Motion passed with unanimous consent. 9. NEW BUSINESS None 10. PERSONS PRESENT NOT SCHEDULED TO BE HEARD None 11. ADJOURNMENT There being no further business;, the meeting was adjourned. This pickup will be used for storing and transporting items such as surveying equipment, tripods, measuring tapes, flagging, tools, shovels, etc, This will provide not only a means for the items to stay dry but for additional security. . 2, Shoff_- Parts Washer - $600 This is a tank with circulating pump that is used as a means for cleaning parts, It is needed in the unit repair room of the shop whsre we repair transmissions, engines, etc. It will save a considerable amount of time and labor. Wo do have an existing small parts washer next to the Tube room. We fool that this parts washer will more than pay for itself in the amount of time presently being spent cleaning the parts. 3, Shop - Forks for 966 Loader - $1,800 At the present time we have been borrowing, when available, a fork lift from Haliburton or Dowell.The fork lift is used for loading and unloading drums, culverts, pallets, parts, etc. We need it to get items out of vans or off of flat beds. We also would use it for moving items around the City Yard and for loading and removing trees and other items in the sand pit, We are very much In the need of a fork lift but by simply spending a small amount for these forks for the 960, we can get by, Attached is a copy of the forks that we have in mind. Changing; the tires on some of the larger equiment is very difficult and presently takes from four to o1g9t hours, 1t 19 hopefui that with this machine that this time will be cut down to less than one hour. As a rough estimate, I would say that we change agproximatoly two tires por month for the larger equipment, Thhis tire changer would e a roller press type that would break the bead. S. Shop - Start -All Battery - 12,900 This is a starting; unit that is used for starting equipment that has a dead or low battery. It has four generators and It provides six to thirty two volts. We w!il use it to start equipment and the emergency generator. At the present time, we have an old starting unit that is over 10 yoars old,and this would be a replacement for it. 6. Streets - Flatbed Truck - $25,000 This flatbod is very badly needed to replace our old 1968 International flatbed. This is the only one that we have and it presently has a blown enoino and is not worth repairing, We use the flathod truck for hauling trash, pulling the asphalt roeyclor, hauling asphalt for recycling, hauling signs, culverts, barricades, and many other general purpaso hauling, This is a rather extensively used piece of equipment and our operation has boon hindered in the month and a half since the flatbed has been broken down. 7. Streets - Small Comprossor and Air Tools, Small equipment Warehouse $1,500 This is to provide the ability to use air tools in the Small Equipment Warehouse for repair and maintenance of small equipment, r pumps, motors, etc: The City does have a compressor in the Shop and also one in the Warm Storage Building No. 1. 8. Streets - Small Compactor - $1,900 This is to provide a Vibro Plate Wacker for compaction. The City requires contractors to compact within the street right of ways whenever they work within the right of way and yet the City does not own a compactor, This vihro plate compactor combines travel speed, centrifugal force, amplitude, and vibrations: per minute to give a maximum compaction result on granular and mixed soils. It is ideal for road patchwork, compaction around tanks next to walls, slab base preparation and similar other uues, A picture of this vihro plate compactor is attached, � A r� Memo to 1Vm. J. This explanation was attached to the March 17, 1982 Public Works Roquoatg for New Buildings, Machinery and Equipment List. The September 8, 1981 Workse%sion of the Council had much discussion on thin item. An old construction rule is that when a piece of equipment cost% more than 10 percent of its cost to maintain and upkeep that piece of equipment, then it is time to replace it. Our present IlUll is for past that point. Renting a dozer is one alternative solution t-) this problem. Availability when needed can be a problem if wo plan to rent a dozer. Also we need to plan ahead and place additional funds in the rental account for Streets and Airport. 10, Streets - Calcium Pump - $1,000 This is to replace the old calcium pump whizh is shot. We pump calcium e.loride into our heavy equipment tires. This gives us more traction, helps keep the tires from freezing, and give:s us more stability for operating equipment. 11. Streets - Street Sweeper - $95,000 The City of Kenai has increased the amount of paved streets considerably within the last few years, Spur Frontage Road, FAA Road, Fidalgo, Barnacle, Bidarka, Caviar, Main Street Loop, First, Birch, Fourth, Lawton, Tinker, Walker, Ropers, Forest Drive Extended, Gill Street are all streets that have been paved within the last two years, This last year we hired Anderson Sweeping to sweep the Airport and streets, We $wept the City streets twice this year and spent over $10,000. If the City owned the street sweeper, I am certain that we would be called upon many more times throughout the year for additional sweeping. As was pointed out at the worksession, a street sweeper takes a considerable amount of labor. This labor is not only for operation of the machine but also for repair and maintenance. Streets - Convert: 61d Crash Truck to Sanding ]Unit - $3,000 The only problem with the old crash truck is th.; plumbing. The truck is essentially in fairly good shape. The City Shop Crew hag spent a considerable amount of time repairing and working on the plumbing .n this truck. The plumbing portion has never worked properly. It would be a shame to give away this good truck as a fire fighting vehicle when it is very badly needed as ,s vehicle for our .sanding unit. Nc had planned to in, -tall a new sanding unit on the frame of one of our old dump trucks but the problem is our old dump trucks are rot in very good shape. $3,000 is only a rough c5tirsate, it would be for iron and ;fetal to install a catwalk, a chute for the Gander, lights, blinkers, floodlights, flasher, beacon, and s.elding materials to make the FA Memo to Wal, J. Street% - Gravel - $209000 Tito City of Kenai has in the past taken the funds for gravel for rop,tir and maintenance for our City Streets out of Pederal. Revenue Sharing, This year when the budget was submitted, we again anticipated taking gravel out of Pederel Revenue Sharing, The request is for a minimal amount of gravel this year, We are hoping to receive 4,000 C.Y. at an estimated price of $S/c,y. At this time, the City doers not ppossess a stockpile of gravel for the repair and maintenance of tho City streets, 14, Sewer - Lower Lift Stations on Lawton and Walker - $6,000 The top of the Lift Stations at these two locatio:is is over six foet above the surrounding grade. The funds requested would lower the lift stations adjusting for :he pump rails and metal covers, In lowering the lift stati.ns, we will increase the ease of maintaining and operating our sewer system, It will make it easier to pull pumps and work and clean the lift stations. It will also improve the surrounding City -owned property by making the area look better, 15, Water - Van to Store the Emergency Generator Located at the 3M Tank - $4,000 During the construction of the 3M Callon Water .Storage Tank, ADIX requested that the City of Kenai place the emergency generator in an enclosure, Unfortunately at that time, we did not have sufficient funds nor felt that it was necessary. Since that time we have found that the enclosure is a necessity for proper operation of the emergency generator. Funds will be used to purchase a van to use as an enclosure for the emergency generator, The emergency generator plus the fuel tank, electrical arparatus, and the battery would be placed in the enclosed van. Tie Ci.ty's newly acquired tractor that is used to haul sludgy at the Sewer Treatment Plant can be used to move the van easily, At this time the generator batteries are stored Inside the Underground Pumphouse which is heated. The leads to the generator from the battery are very long, thus reducing the starting amperage for the generator, Because the generator is placed on - a slab or, the ground, we have problems with snow drifts hampering +he intake of the generator. Sewer - ilreakcr„ and 131to - $1,400 The City of Kenai doea have a jack hammer, but we need the breaker and bits to go along with It, 11e would use it to break the palrement necessary for water and sewer repair work, for cutting concrete, and for repair and installations in ,+anholco, 19, Water -Clean and paint Two Water Tanko - $16,400 The city of i(enai did attempt to paint these two tanks a couple of yearns ago, but we found that we cannot do the professional lab that to needed. There is a lot of condensation on the :anks which keeps the tanks wet at all times, This causes problems that even if there is a pin hole exposure of metals there is deterioration. These funds would be to have a professional painting company to come in and clean ald sand the existing tanks down to bare metal. They would then paint the tanks with a special type of paint designed for this type of application, 20, Water and Sewer - Water and Sewer Warning Sys►tem - $55,000 During FYSI-82 the'City of Kenai provided funds through the Federal Revenue Sharing Program to purchase a new warning system. Shop - Ili -Ton Floor .Jack - $350 The City of Kenai does have two 4-ton jacks, Unfortunately, one of the jacks is used constantly in the Warm Storage Building by tf:e Street Crew for changing tires, chains, chain links, cutting edges, and other miscellaneous uses. It takes alot of time and effort to pull one of the floor jacks from the Warm Storage Building over into the .Shop especially during the wintertime when it takes a pickup to make the move, When the other floor jack is being used on a piece of equipment, we have mechanics that are waiting for the use of the jack. Ay purchasing a small 1%-Ton floor jack, we will save more time, money and effort by not having to wait for the use o:' the larger jacks, 22, Animal Control - Animal Cage for the Pickup - $2,100 The present animal control cage on our existing vehicle, not only looks bad but is impractical for use by the Animal Control Office~. The funds would be used to replace the old wooden box with a new smaller welded aluminum one, The Animal Control Officer and this vehicle is constantly patroling the City, He is in public view most of the working time. As such, I feel that his vehicle and the Animal Control Cage on the vehicle should be Gno that the City of Kenai is proud of, I feel that the items that the Public Works Dept, has requested are not frills but are basic needs that the department has. The number f of people working in the Public Works Dept, has not changed for over seven years. During this time we have increased considerably the amount of roads, water and sewer lines, animal control respponsibilities, } and equipment maintenance responsibilitie4. I feel that the duties and responsibilities of the Public Works Dept, has increased significantly without any adjustment in personnel, The items that we requested in Federal Revenue Sharing will hopefully help the maintenance and operation of the Public Works Dept, of the City. Most of these items will help reduce or make more efficient the maintenance and operational duties of the Public; Works and therefore very badly needed. Simple Xerox copies in an inexpensive binder will suffice. If a firm has a standard brochure that they have available, they need to also provide eight (8) copies of it. A copy of each firm's proposal will go to each of the City of Kenai's Council members with the remaining copy retained by the City Administration. The Public forks Committee, comprisod of three Council members, will meet to discuss the proposals. If there are a groat number of proposals, the Public Works Committee will reevaluate the proposals and then make a recommendation to the Council as a whole. The firm will be chosen by a resolution passed by the complete Council. DEADLINE FOR SUBMITTING PROPOSALS The deadline for submitting proposals is October 15, 1982, at 10 a.m, local time. The road will still have a gravel surface after the improvements. Additive or Deductive Alternates may be used for some of the improvements.
