WHEREAS, the City of Kenai's Ordinance #479-79 is a comprehensive ordinanco regulating the excavations in streets and public right-of-ways, and WHEREAS, Ordinance #479-79 means that utility companies and contractors are required to obtain a yearly excavation license for excavation work within the City's right-of-ways and an Individual Project Permit for each project which includes a completed form and a sketch or drawing showing the location of the work which is to be done, and WHEREAS, it is the desire of the City of Kenai to establish assigned utility locations within the City's right- of-ways. WHEREAS, pursuant to KMC 10.15.050, the City Attorney has renumbered and renamed certain sections so as to be more clearly undoratood. Thio entire title will be included in a Code supplement. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA AS FOLLOYJSs Section 1s KMC 18.15.010 is hereby amended to read so fo owe s EXCAVATIONS IN CITY STREETS RY CONTRACTORS OR UTILITY COMPA •.s a o utility company, person, or legal entity con uc ng any oxcava ing activitiieee shall perform any work in or under public lands or public, right[S]-of-ways or in any public utility oaeement'[S] within the City witYout first having been chanted, (1) a yearly license therefor as out forth in KMC 18.20, tsnd (2) a permit for the individual exeevatiors or street oponing contemplated as not forth in KMC 18.25. The applicable certificate of insurance shall clearly indicate that the property damage liability coverage includes hazards from underground work, explosion, collapse and damage to underground wires, conduits, pipes, fittings, mains, sewers and a similar document of indemnity required pursuant to the provisions of KMC 18.20.040 has been incorporated into and made part of the applicable insurance policy. (2) The Certificate of Insurance provided must contain the following clause (or a similar clause m`ang the same provisions)s "In the event of cancellation of the above contract of insurance, the Company of Under- writers will give not less than thirty (30) days' advance notice by mail to the party to whom this certificate is issued, at the address herein, which shall be sufficient proof of notice. This program supercedes and replaces the cancellation clause printed in the form, if any." If the form of certificate used by the contractor's insurer does not contain a cancellation notice complying with the above, then the above clause must be substituted for the clause in the form. (3) Workmen's compensation insurance in accordance with the laws of the State of Alaska. Section s KMC 18.25.020 is hereby amended as followss Applications (a) Applications for such a permit shall be made to the Pubirc Works Department on forms provided by the department setting forth in a verified format the fol- lowings (1) Name and address of the party doing the work. (2) Name and address of the party for whom the work is being done. (3) Location of the work area. (4) Whether a detour of traffic will be necessary. Section Ss KMC 18.25.090 is hereby repealed and re-enacted as fo oT owas Connection with CitX Utilities: (a) No permit shall be issued for the purpose or hooking into City utilities (water and cower) except upon prior receipt of all inspection fees and permits required by the City. Property owners desiring to connect to water and sewer mains, laterals, or trunks shall make application for such connection and pay all inspection fees at the main office of the City. It will be the reoponoibility of the Contractor to furnish or supply all materials necesoary to make the connection and to perform all necossary engineering design, engineering management, engineering inspection, all coils analysis and compaction tenting by a certified lab, all surveying by a registered land ourveyor, pipe testing, excavating, pipelaying, back - filling, compacting, and to restore the roadway to its original condition. If we take it far enough back, the Council did endorse my original certificate almost three years ago, when t withdrew my certificate two other companies filed, one Multivisions which I supported, the other Peninsula Cablevisions. Peninsula Cablevisions is wholly owned out of Washington. They have no local people whatsoever. That was the Couneil's decision to support them. Fins. At the time of the award of the certificate pfultivisions, of which Inlstvisions is a wholly owned subsidiary, was SO per cent owned by Assam and Daniels and Associates, approximately 40 per aent each. The rest of the ownership has always been local, twenty per cent, tut that's not where the issue Use, who owns it. what the issue is, who controls it? Councilman Wife asked if this would affect the setnettere in this - location, it would not, Mr, Ed Cali asked to be hoard from the public. Mr. Call ! owwns property in Buoh Lanes Subdivision which borders the proposed Beetion 36 development. Mr. Call stated that he felt that there should be no further development in the City of Kenai until all property owners are treated the same, i.e., there is free water and newer for some people in the Candlelight/Linwood area for example, while other persons such 4a himself are still paying asnossments. Further, that there had boon, at one time, land not aside for schools, it was explained to Mr. Call that there was a piece of Section ' 36 on the other aide of the Spur highway that was currently t owned by the Borough who would probably use it for that purpose, For further clarification, Councilman wise explained that Section 36 was being developed in this manner to make the maximum use of existing water and sewer, i p Mr. Calvin Quandt arcked to speak, stating that he also owns land in Auah Lonna Subdivision and protests development of the adjoining land, Lilac Lane is a mesa and is not taken care of, but Walker Lane doers, Only a select group get taken care of. MOTION AMENDMENTS Commissioner Osborne moved that the property west of the Spur Highway changed to RS zone be limited to single family dwellings rather than multi -family. Motion amendment died for lack of second. VOTE MAIN MOTIONS Motion passed unanimously Commissioner Bryson wished it to be made a matter of record that there is nothing wrong with addressing the density of the property, however it should be dealt with at the development stage. b. Resolution PZ83-60, Rezone Portion of Government Lots 42 and 51 lying south of Kenai Spur Highway between Linwood Lane and Candlelight Drive - from Suburban Residential (RS) to General Commercial (CG) - James H. Doyle a Mr. Doyle came forward to answer y questions from Commission and public. Chairman Lewis asked Mr. Doyle if the land that is proposed for rezoning includes his business and further if it includes any property not his own, Mr. Doyle answered that it was his property, that his business is included by none other. Commissioner Bryson stated that the surrounding area is primarily residential and if Mr. Doyle had any plans for enlarging his business, Mr. Doyle answered no. Chairman Lewis asked Mr. Labahn if this were not clearly spot zoning, `f Mr. Labahn answered yes, however, it is also a non- conforming use as the business has existed some time prior to the zoning ordinances and that this rezoning gives the owner flexibility in the use of his land. Chairman Lewis asked a hypothetical questions what if Mr. Doyle decides to sell or lease his land, this zoning goes with the land not ` the applicant, therefore would the new owner be able to put ' any of business on this lotf answer yes. Lease Applications Portion of Lot 2, Spur S/D No. 1 Edwin Lowry Jeff Labahn explained that this is a returning item from the last meeting at the request of the Commission. Mr. Lowry's plat was reviewed at the last meeting raising some questions. The critical element at this time is the that the potential lessee will not be allowed to continue the development until plans are approved both for the commercial and residential aspects and improvements for water, sewer, and roads are met. The cost of the surveying, etc. will be split between the lessee and the City of Kenai. Chairman Lewis asked if the property would have to be rezoned before allowing the residential development, Mr. Labahn explained that the development would be restricted to an urban residential zone. Commissioner Bryson asked if Mr. Lowry would not be circumventing the procedures if he were allowed to develop without the rezoning. MOTIONS Commissioner Smalley moved to direct administration to initiate the rezoning process to rezone lots 1 - 13, Block 1, Spur S/D No. 1 references lease application of Edwin Lowry, from General Commercial to Urban Residential, seconded by Commissioner Bryson. VOTES Motion passed unanimously. Jeff Labahn explained that Ms. Cunningham had been contacted to bring the material requested by the Commission to this meeting. Submitted and before the Commission were two letters of non -objection from the two ladies at the last meeting from the East Kenai Church of Christ, a drawing of the church and property in question not drawn to scale, and a letter stating that Ms. Cunningham would not operate the dance studio. There still remains the question of access and circulation within the lots the City of Kenai would be remiss if the CUP were granted, it would in effect grant the use of private property. Commissioner Smalley stated that it would be in her best interest to have a legal document granting permission from the church for the use of their property since persona within the church change. It was noted by the Commission that Mrs. Doris Reynolds, aunt to Carolyn Cunningham was shown to be the actual applicant, that Carolyn Cunningham has been acting on her behalf. , MOTIONt Commissioner Bryson moved to approve PZ83-54 addressing item 7, approval to be contingent upon receipt of written approval from the East Kenai Church of Christ for use of the property access and filing of same, seconded by Commissioner Monfor. Jeff Labahn asked Commissioner Bryson his intent, Commissioner Bryson explained that his intent was that it be an easement between the applicant property and church property and not for public use. 6. NEW BUSINESS a. Discussions_Planned tlnit DeveloPment - Chris Revnolds Chris Reynolds is a property owner in VIP Subdivision. it came to her attention, when a group of apartments was constructed in her area, that there are only two types of residential zoning and that both types allow for multi -family dwellings to be developed in subdivisions where single family dwellings are already established. Mrs. Reynolds expressed the desire to have an ordinance i" r • 1 KENAI PLANNING & ZONING COMMISSION Regular Meeting, September 14, 1983 introduced which would protect the single family home owner with a vacant lot next door from having a multi -family dwelling built there. A zone ahould be not aside for single family dwellings, one for multi -family dwellings and one that would allow both. Mrs. Reynolds pointed out that there was no notice that multi -family dwelling units were to built there, Chairman Lewis explained that under the code, there is no hearing or notification required. Councilman wise stated that a 1977 proposition waa submitted to the Borough which would amend the zoning code to limit uses of property, however it was defeated, the rationale being that the owners of large parcels wanted the freedom to develop it as they wiahod without restrictions on number of units. Mr. Calvin Quandt spoke, stating that the City of Kenai has too many restrictions already and is "ehaning people out to Soldotna". Mr. Norm Samples, property owner in Central Heights S/D stated that he had purchased his home some time ago when the subdivision was all dingle family residences, however there are ooveral apartment buildings there now and also wants to see some restrictions to protect those persons who buy single family homes and expect the neighborhood to remain that way. Mr. Sample further stated that he had aeon the plans for the development of Spur No. 1 is feels that the traffic created by the number of units going in is prohibitive. This is the lot that had been leased over a year ago, was cleared, and then left for that year. Section 36 proposals were to be submitted by 9/6/83. Eight proposals were submitted, Mr. Labahn has not had a chance to review them. The proposals are to be awarded at the next Council meeting. The 9/28/83 oil and gas sales includes some lands within the city limits. The Council has asked the Commission to render a recommendation on lands for exchange. Councilman wise recommended that the Commission ask administration to locate the borrow pit that was used for the evergreen project. To his knowledge it was created with an eye to future expansion of the float plane basin, however Council was never briefed on the project. REPORTS It a„ City Counci l Rego_ Councilman Wise reported thats the Council awarded two contracts, one for airport parking lot improvements and the airport ramp overlay; awarded a contract for $60,000 for paving the airport parking lot; the ordinance pertaining to building permits was table at the request of Councilman Wise for referral back to the Commission. Councilman Wise is asking for discussions with the homebuilders association. And the Commission is invited to the Council work session on Thursday for Capital Improvement projects. b. Borough Plannin,2 Report Commissioner Bryson reported that: there were no plats from the City, however there was approval for a storage of class C explosives at the end of Halbouty Road, and the rezoning of Section 36 passed on to the Borough Assembly, and discussion on recreation subdivisions. DEC is "pulling their hair out" over these subdivisions. c. City Administration Report Some updates from Jeffs the lease agreement for Edwin Lowry was executed for a portion of Spur S/D No. 1. The submitted lease application was vague in some matters so public works department and the land manager got togethor and amended the lease agreement to cover the concerns of the Commission and the administration. A routine inspection was performed by the city today and one violation was found to have occurred. Mr. Lowry had excavated a portion of the water & sewer lines on the leased property, The lease stipulated that no work regarding water & sewer should be accomplished until plans are submitted and approved by the City of Kenai and the ADLC. Although the plans were submitted today no approval by the City or the State had been granted. it is anticipated that Mr. Lowry's site will be inspected on a regular basis. n - . KENAI PLANNING & ZONING COMMISSION Regular Meetinge September 28, 1983 The bowling alley lease is signed. There are still problems with his materials, however plans are moving ahead. He probably will not have anything going this year. Fisherman's Packing has dropped the lease on the lot to the west and are planning to file for the land to the north. A request to purchase the corner lot on Spur Highway and Bridge Access Road has been received, it is not known yet what they want to build there. The lands that were under consideration along Spruce (gov't lots 131, 165, & 166) to CIRI instead of to the City. A letter has been written to the Homebuilders Association regarding the ordinance for building permits discussed earlier. Jeff Labahn is open to getting together with the Commission to inspect sites that are before the Commission or are of concern. 9. PLANNING a. KENAI ADVISORY HARBOR COMMISSION Special Meeting, September 13, 19832 The sedimention study is completed, the final dip being taken in June end the report is at the printers. The conclusions show that the original findings were correct, and that they are about half of the findings of the Corps estimate. A sedimentation study was done in Dillingham which has very similar conditions as Kenai, comparisons were done and the results confirmed the findings of the TAMS staff. TAMS estmates that about 500 commercial boats are in the Kenai area, of that 500, some will stay with cannery docking, some will not be willing to pay, some are transient and will not need docking until summer leaving about 200 small boats that will need the facility. There will be fingers on the floats that will accomodate up to 4 boats mooring alongside each other to handle more than 200 should the occasion arise. TAMS estimate that about 200-250 recreation boats will want to use the facility. TAMS brought forward 5 different layouts of harbor designs for the Commission to review. While several were good, some were discarded for different reasons, one being the well on the Coyle property and another the gas line which runs (^. through the property. TA14S estimated 1.8 million dollars to move it. One of the key factors in the harbor designs was the maintenance and dredging. In designs 1,2,& 3, the neck of the harbor would allow for minimal silt flow into the basin and easy dredging in the spring. The body felt that a cat to push the silt out in the spring would be sufficient. Also discussed was leaving enough room at one and of the basin for possibly a restaurant and a small shop or store. 8. He indicated that the agency had been trying to dispose of the property and impr- ovements over the last several years since the Mocao Range headquatters was relocated to Soldotna. In the peat, U.S. Fish & Wildlife Service has negotiated with the Kenai Native Association for the property, however, no agreement hoe ever been reached. Therefore, the U.S. Fish 6 Wildlife Service has approximately 60 days to initiate some negotiation with other parties regarding the conveyance of the property. He stated that, unless meaningful negotiations are initiated within the 60 day period, the G.L.H. will convey the lands automatically to the Cook Inlet Region, Inc. He indicated that the federal government would be willing to negotiate a sale of the property with the City of Kenai. He stated that the U.S. Fish h Wildlife Service is not bound to dispose of the property at fair market value but rather would diapooe of it to the highest bidder, whether or not it was above or below the fair market value. Mr. Rice encouraged the City to contact the U.S. Fish 6 Wildlife Service if, in fact, they are interested in negotiating for the property, Mr. Riess' telephone number is 786-3372, located in Anchorage.
