ADJOURNMENT Q� I I COUNCIL MEETING OF t m C-1 Suggested bys Administration CITY OF KENAI ORDINANCE NO. 868-83 0� AN ORDINANCE OF THE COUNCIL OF THE CITY ENAI, ALASKA, TO AMEND KMC 16.05.A-1-0 TO BRING THAT S C4443OF D THE CODE INTO C014PLIANCE WITH THE CHARTER OF THE CITY OF KENAI AS A14ENDED BY A SPECIAL ELECTION OF JUNE 7, 1983, WHICH ELECTION A14ENDED SECTION 7-3 OF THE CHARTER OF THE CITY OF KENAI. WHEREAS, the voters of the City of Kenai amended Section 7-3 of the Charter of the City of Kenai In a special election on June 7, 1983, and WHEREAS, the aforementioned Charter amendment requires that certain code sections be changed so as to reflect the change in the Charter. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, as followss J Section 1: That KMC 16.05.41-0(b) is amended as follows: All benefited real property, including that which is exempt from taxation in accordance with law, shall be liable for the cost of public improvements assessed unless specifically exempted from assessments for public improvements by law. No asoasaments shall be levied in excess of 25% of the fair market value of the property after giving effect to the benefit accruing from the work or action for which assessed., except where all benefited property owners waive the above 2 0 limitation and arree to accept on a proportional basis o or the cos3 rn of improvements. Section 2: That KMC 16.05.n30 is amended no follows: Requirements of Petition: The petition shalt include a deucriptiors of the proposed improvements. Unless all benefited graperty owners' signatures are rc uired virtue of Kt G ,IJ ,1 , tLilhe petition shall be signed by the owsseru of 5Uo or more of the prnperties which will be benefited by the proposed improvement. WHEREAS, the State of Alaska has offered the City of Kenai a grant award of $120,300 to cover the project period January 1, 1983, through December 31, 1983, and WHEREAS, the City's required matching in -kind support consists of $21,229, and WHEREAS, in order to comply with the City of Kenai's accounting practices, monies for the period January 1, 1983 through June 30, 1983 were appropriated in the amount of $76,508 and the remaining monies for the period July 1, 1983 through December 31, 1983 will be appropriated at this time. WHEREAS, proper accounting practices require that all ap- propriations of City monies be made by ordinance. SOX $80 KENAI, ALAEKA 99611 TELEPHONE 283 • 7533 June 8, 1983 MEMORANDUM TO: Tim Rogers, City Attorney FROM: Dana Gerstlauer, Administrative Assistantl�' RE: Union Oil - Cannery Loop Units #1 and #3 Following is a summary of the status of the drilling permits for the above referenced wells: Unit Number 1 The original drilling permit was issued to Union Oil on 1-17-79. The well was shut-in on 6-27-79. The City was notified of this shut-in, which by the code provision extends the permit through 6-27-80. Union Oil requested an extension in writing on 4-7-80, which was granted by Council but only extended the permit to 1-17-81. The permit should have been extended through 6-27-81 (the anniversary date of the renewal should fall on the date of the shut-in, not the date of the original permit). Resolution 81-3 was passed extending the permit through 1-17-82 (again, this should have been extended through 6-27-82). On 9-29-82, Union Oil requested an extension, which was granted through 6-27-83. This last extension was not brought before Council for approval, but was approved by Administration. The only time that a permit was not in effect was from 6-28-82 through 9-29-82, a period of 91 days. Unit Number 3 The original drilling permit was issued on 1-7-81, which ran through 1-7-82. No request was ever received for an extension, nor was notification received of shut-in. Union Oil requested an extension of the shut-in on 5-26-83. Unit No. 3 The drilling permit for this well expired on January 7, 1982. We have received your May 26, 1983 request for extension of this permit. A violation exists for the period January 8, 1982 through the date of your request, a total of 503 days. Per KMC 5.35.250 (copy attached) the penalty for these violations is a fine of not less than $5 nor more than $100 per day per violation. I've tried to work the costs down after talking with the surveyors by eliminating part of the street grade staking. This is possible due to relatively flat grades and gravel streets and should not detract from the final product. The costs are very close (McLane's - $97,800.00, Malone's -$98,000.00) and are submitted by well established firms. I recommend McLane's for the work as they have the crews on hand to quickly take on the project if needed. Malone's may have to hire additional people to accomplish the work. When our firm submitted the not -to -exceed cost on April 27, 1983, our interpretation of sub items b and d was slope staking be required on 50 and 25-foot intervals. However, if this is not the case and slope staking can be done on the full stations, and at grade changes, a reduced cost of $7,200.00 would result for the City. If the slope staking requirement was clarified to mean full stations and at the point of grade changes, McLane and sociates, nc., would revise the not -to -exceed cost to $97,800.00 r this project. Eddy currents created by north winds coming over the roof deposit snow on thro landing and steps. The 12 foot canopy should protect same since they p 3ect only 7' out from the building. The arctic foyer will serve to prevent cold winds from being a "wind tunnel" each time the exterior door is opened. We will replace the existing hollow metal door, aluminum frame (which was recent- ly badly damaged by abuse) and glass with a welded steel frame. (Hardware will be replaced under a previous change order). Total Cost $9,388.00 Item 3. Electrical Deficiency Requested by Architect A code deficiency exists which was not descernable during the design phase. Determination was not made until the electrical contractor pulled the panels apart to connect it to thu new service. The 100 amp panel in the kitchen is connected to a Z00 am breaker with 175 amp rated conductors (wires). According to the National Electrical Code, conductors and panel rating cannot be. less than the breaker which protects them. As install_d, if there is an overload, the 200 amp breaker will not open before the 175 amp rated wit-gs could over tic -at and burn, causing a fire. The chance installs a 150 amp bres:s'rer with 200 asrh bus rated panel. Brown SUBJECT: Bidding Requirement - City Purchases DATE: May 19, 1983 Several Department Heads have expressed that they believe the bidding limit of $3,500 that to now in effect is too low. That is, a higher figure should be set that would allow the City to purchase more items without asking for formal bids. Generally, I think their arguments have much merit. We have to request sealed bids on itci6a (cr rc;,airs or services) that cost as little as $3,501. This often results in Little more than wasted time and additional paperwork. 1 believe there are many cases where the bidding process at those low price levels does not provide any better prices than simple negotiation. I contacted four other cities, and found that our policy was the most restrictive with regard to the bidding requirement. Of the three cities I contacted that are about the same size as Kenai, only one has formal bidding requirements for non -capital project purchases (at a $5,000 level). Tile other two have no requirements in their city codes. One of those citien does bid in many cases anyway as a "standard procedure", the other doesn't bid, even on such items as road graders and fire engines. Anchorage was thg 4th city I called. and they hid on itemn cunting over $25,000, I suggest that wn amend KM(,* 7.15.050 (a) (1) to change the $3,500 figure to 310,000. Brown, Finance Director DATE: June 8, 1983 SUBJECT: C.O. Bond Salo Now that the charter change has passed, some thought should be given to the source of financing of special assessment districts. I propose that the City offer to the voters at the October, 1983 election the question of selling G.O. Bonds to finance special assessment districts. I believe the proceeds of the sale should be restricted to be used only for those portions of projects that are actually anseaaed. (If parts of a project are not assessed, either because of the 25% rule or Council action, then othor monies must be used.) The information I have strongly indicates that Special Assessment Bonds (that are not backed by the full faith and credit of the City) are nearly unmarketable, and that the City should attempt to sell G.O. Bonda. I talked with the Director of the Alaska Municipal Bond Bank, Perry Davis. They have authority to incur indebtedness of $150,000,000, and they have r reached that limit. They are trying to get legislative approval for an additional $50,000,000. His information is that n Senates Finance Committoe hearing is scheduled for June 10, 1983 on this matter. If they get the authority, he predicts they'll have a sale on August 1, 1983, with money becoming available about September 1. However, he now has requests for about $40,000,000. They will not accept our request until we have authority to issue debt. He suggested that some of the requests he now has may not result in sales (possibly because the cities may not want to wait, and may enter the market themselves). I would say that our chances of being able to utilize the Bond Bank are good, but that was cannot rely on Lt. I'll check back with theta in a month to determine if the situation 1149 changed. I also reviewed the procedures we followed in the sale of the City Hall Bonds, and called Tim Middleton of Wohlforth 6 Flint (bond counsel). I believe we should retain them in July to start the process of the election, Basically the process is: 1) Resolution authorizing election 2) Publication of election 3) Passage by voters 4) Ordinance authorizing, sale of bonds 5) Publication of Ordinance hearing, 6) Resolution authorizing execution of loan agreement with bond bank ( if sold to Bond Bank) 7) Bond sale I I I `' 1, 1 Memo to City council June 8, 1983 Tim Middleton suggested that any restrictions on the proceeds such as those discussed in the 2nd paragraph above, be included in the Ordinance authorizing the sale of bonds, and not in the Resolution calling for the election (or on the ballot). i believe we should ask for authority to sell, perhaps, $4,000,000 in bonds. We would not need to sell all at once. By Ordinance (step li4 above), Council could approve a current sale of only, say, $1,500,000. This would reduce the chances of an arbitrage problem if we did not use the money quickly. As a final note, i should add that if we cannot use the Bond Dank and have to go into the market ourselves, we will incur high costs for such a small issue. FLOOR ACTION 88 137 - Lobbyins Acts On Wednesday, the Senate amended this bill to remove the APOC exemption for officers and employees only "if a substantial or regular portion of the activities for which the officer or employee was hired snd receives compensation is for the direct purpose of influencing legislative action". The purpose of the Senate amendment (underlined words) is to clarify that officers, like elected officials and city managers, will still be exempt. CSSB 137 (Financ0am passed the Senate, 13-6. HB 251 - School Debt and FSPPs On Thursday, the Senate adopted the Rules Committee Substitute, which changes the cut-off section on W-6 reimbursement of school debt to read, "authorized .. . before July 1, 1983, instead of "issued_' . . .before July 1, 1983". The bill decreases to 50% the percentage of reimbursement for school debt authorized after July 1, 1983. It also increases the Department cf Education approval authority for school bonds and basically maintains the current public school foundation program for another year while the department develops a new program. Bond Debt Limitss Introduced by Halford, Kelly, Sturguiewski, and Pettyjohn, this bill limits a municipality from issuing new general obligation bonds if the existing debt is more than $25,000 per capita or more than 10% of the assessed value of the property. According to the sponsors, ' the North Slope Borough and Nenans (because of a combined revenue/general obligation port bond) currently t exceed the proposed limit, and Valdes is approaching the limit. The purpose of the bill is to avoid defaults that would adversely impact the financial ratings of other municipalities and the state. The Senate expects to adopt its version of the budget on Wednesday, with the House/Senate conference committee going to work shortly afterwards. Listed below are several issues that are crucial to local governments. Please contact Your legislators and indicate your supports PY 83 Revenue Sharing Supplemental: COB 98 (Finance), which is now in House Finance, contains $2.9 Million to make up the shortfall in this program. It is our understanding that the Legislature intended to fully fund revenue sharing for PY 83, but a shortfall resulted from a larger than expected number of miles being eligible for the $2,500 per mile entitlement in the Chapter 89 Miscellaneous Services portion of revenue sharing. As a result, all of the Chapter 89 entitlements (roads, ice roads, hospital and health facility operating assistance, cost of living adjustments, and volunteer fire departments in the unorganised borough) will be prorated about 81% without the supplemental contained in CSSB 98 (Finance). FY 83 Municipal Assistance Supplementals CSSB 98 (Finance), in House Finance, also contains $25 million to mass up the shortfall in funding for this program that resulted when FY 83 funding got caught in the middle between the old program of an amount "equal to or greater than 10V of the proceeds of the corporate income tax (including special oil and gas tax) and the new program of an amount "equal to or greater than 30l" of the proceeds of the corporate income tax (special oil 6 gas tax repealed). A compromise number of $16 million has been suggested and has been supported by the administration. That number would bring the FY 83 funding up to the FY 82 level of $87.4 million. Since the municipal assistance fund basically is distributed per capita, a $25 million appropriation would result in about $56 per person for each municipality; $lb million, about $36 per person. PY 84 Mmsiciyal Assistance Appropriations The "Shared Thies" section of the Revenue Department's operating budget contains $70.5 million for the FY 84 Municipal Assistance Fund, but should be raised to $81 million. The $81 million figure represents 30% of corporate income tax proceeds, according to updated estimates by the Department of Revemse; $70.5 million, 30% of earlier estimates. The law authorises the legislature to appropriate an amount "equal to or greater than 30V of the previous year's corporate income tax proceeds. 1 I I i . Legislative Bulletin #21 - page 2 PY 83 School Debt Supplementals CSSB 62 (Finance), in House Finance, contains $6.5 million, half of the I; $13 million school debt shortfall, along with a number of other supplemental appropriations. The short- -- =- fall was the result of an incorrect allocation of $7.5 million tobacco tax funds and $5.5 million increase in actual entitlement over what had been estimated, FY 84 School Debt Aoprorriationt CSSS HB 105 (Finance), the Iiouse version of the budget, contains $59.8 million for school debt in tha Department of Education operating budget. The Senate has assured us that the full estimated entitlement of $90.8 will be in the Senate's version of the capital budget, but it's not there as of this writing. DEC Matching Grants for Water and Sewers Although there are a lot of municipal grants for specific water and sewer projects, there is only $4 million for DEC's matching grant program. Originally, there had been $28 million as the state's match for projects that are bid ready and an additional unallocated $16 million for PY 84. No one is quite sure how many of the projects that were to be funded by the $28 million and $26 million appropriations are included as specific municipal grants in the budget. Budget Conference Committees Rumor has it that Al Aders, Bob Bettisworth, and its Duncan will be the House conferees; on the Senate side, John Sackett, Don Bennett, and one of the Anchorage Senators.
