WHEREAS, the electorate of the City of Kenai approved a change in the City Charter on June 7, 1983 providing for 100% assessment, local improvement districts, and WHEREAS, the intent of the Charter amendment was to provide a means for owners of property desiring installation of one or more improvements authorized by the Kenai Municipal Code at no cost to City, and WHEREAS, the Kenai Municipal Code provides in Chapter 16 for a deliberate process to insure the rights of those not signstaries to the local improvement, assessment district petition are protected, and WHEREAS, the current deliberate process may preclude the improvements from being accomplished in a 100% assessment, local improvement, district due to building season constraints adjustments to the Kenai Municipal Code are warranted to expedite tf,.e approval process still maintaining protection for the community as a whole. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, as follows: Section 1: KMC 16.10.010 is hereby amended to add the following: (b) For 100% assessment districts the City Manager shall /within 30 days after filing of the petition make a survey of, and report on the proposed improvement(s) to the City Council concerning the estimated cost of the proposed improvement(s), prospective grants that might be secured to asuist in paying for the improvement, recommendation as to grant application, and the recommended improvement plan cost to be assessed against the property(ies) benefited. The report shall contain a description J 0 I defining the district and the properties to be assessed and shall n include a preliminary assessment roll as outlined in K14C 16.10.020. The proposed improvement district may be defined by: (1) metes and bounds description; or f (2) by a designation of the benefited properties to be I assessed by lot, block, and subdivision. PERSONS PRESENT SCHEDULED TO BE HEARD 8-1 Kevin Tsbler, Robert Anderson - Union Oil - Status of Shut-in Wells Robert Anderson, District Land Manager, Union Oil. He Introduced Ksvin Tabler, Land Mani and Ray Barnes, Operations Manager for the Cannery Loop Unit. Union Oil has 3 drilling sites In the City, 12 to inactive. Union Oil entered Into an exploratory agreement in 1976 with Pacific Lighting. They advanced money for work in 9 Cook Inlet areas. They wanted to find additional gas areas for their LNG project. They proposed to upend $35 Million. Union Oil contributed the land, geophysical ideas, etc. Councilman Wagoner arrived at this time (7s10 PM) Mr. Andersen continued, the Cannery Loop unit was the first successful unit, the 3rd drilled. It was a Government/UnLon 011 joint venture. The unit was approved in 1978. Unit 01 wss started and completed in 1979 on land owned by the City. This was of commercial value. They started Unit /2 on the Patch property in Feb. 1980. It was determined it might be wetlands, they received their wetlands permit in Dec. 1980. This we* a dry hole and was abandoned. Cannery Loop /3 was started and to active, there will be additional drilling. They did not find any oil. The agreement was to drill a new well one year after the old one. The 4th unit was extended to thin yeas, on the Coyle property. The price of oil has declined. Marathon, Union Oil, Pacific Lighting, Cook Inlet Regional Corp. all had Interests in it. The cost will be f8 Million. Marathon approved the drilling, but would not be involved. Pacific Lighting said they would not be able to handle the coot. Cook Inlet Regional Corp. was not able to contribute sore then $2 Million. Unlon"011 could not came up with the rout. They asked for a waiver ttll this year. 01 and /3 are In ouspended otatuo, plugged off from the surface. #2 has been plugged. The Oil and Gas Conservation Committee has approved them. Union Oil has committed their share of gas for 5 years to Pacific Lighting. In Unit O1, in 1984, they can take their share or pay for 2 more years or they can pay for not taking the gas. He has not recelv9d any commitment. Union Oil can find a market in 1984 if Pacific Lighting does not want It. They have no market at this time. PUBLIC COMMENIs 1, Loretto Brandon. Regarding the lease with Union Oil and Pacific Lighting, it seems Pacific Lighting has not been a good neighbor to the Peninsula. Mr. Anderson replied Union Oil had contracts for gas with Pacific Lighting, the terms of the contract expired and Union Oil did not renew. They have spent $35 Million. Union Oil is in a different relation regarding Cannery Loop than Marathon was. Mrs. Breeden asked if the City has entered into any negotiations for the natural gas franchise that will be up for renewal. And will there be special rates for residents of the City? Mayor Malston replied, there has been preliminary work done. Mrs. Breeden asked Mr. Anderson if he could say what area they were going into and when will it be put into production. Mr. Anderson replied it will go intu production when it is approved. There is a lease sale in Sept. with open State lands in that area. He added, if the company designated the area, everyone would know. They will establish the participating area by Dec. 1983. They are hamstrung till June 1984 because of the contract with Pacific Lighting. A portion of the Berglund, Kahl offenore lend may be participatory. Mrs. Breeden asked if they planned to drill unit 04 or just put into a participating unit. Mr. Anderson replied they plan to drill this year. After a 5 year term, the area will contract in size. Councilman Measles asked Mr. Anderson about the Union Oil letter dated June 21, 1983, asking that all wells be granted as one unit rather than having each one separate, plus any additional wells. Mr. Anderson explained it would be advantageous to have all coming up simultaneously so they can address them as one. The amendment would cover this. Atty. Rogers noted one problem in this is that in no case does the City want to extend for more than one year. The Code has limitations. Motion passed by unanimous consent. • C-2 Ordinance 870-03 - Establishing a Public Use Easement Along Candlelight Drive Extension through City -Owned Lands MOTIONS Councilwoman Glick moved, seconded by Councilwoman Bailie, to adopt the ordinance. City Manager Brighton explained, this has been considered by the Recreation Commission. The street divides s park -designated property. Administration recommends the Council do nothing with the road regarding an easement, but the developer be allowed to use the road. By giving an easement, it could never be used as one unit. Councilman 1 Wise asked if there was an essement, City Manager Brighton replied no. Councilman Wise asked, how does the power line go down? Mr. Brighton replied, it is for utilities, it is designed for a road and just used that way. Public Works Director Kornelis said there is no recorded easement that he is aware of. PUBLIC COMMENTS a. Jill Burnett. There are power and phone lines there. The road has been in use for 15 years, and has been maintained for snpw removal. Mr. Kornelis said for 3 or 4 years the City entered into the pit there, but that was not for down the road. It has not been used since. There is no access to the pit now. The developer is making access, it may have been maintained for a short time. City Manager Brighton explained it is not Administration's intent to preclude the owner from using the street, but if Council gives an easement, it cannot be joined at a future date. b. Recreation Commissioner Hansen. This will be a widely used area in the future. It is ideal for cross-country skiing. The Recreation Commission has no objection to permissive use by Mr. Burnett without an easement. They asked Atty. Rogers to review if it had been used for easements, it appears it has been used primarily by the City. If the road is allowed to be continued to be used, it could be theirs. There is access to the property where a road could be built. Councilman Wagoner suggested the City look at the feasibility of re -platting to put the park at one side or the other. C. Jill Burnett. The road referred to that could be - developed is just a cow -path. It would cost such to 1 develop. for thew to be provided only temporary access would be unsatisfactory. It is imperative they have something permanent. The road has been used for 15 years, there was a family there originally. Councilman ' Wise said the gully that bisects the land is fairly deep. Councilman Wagoner noted the wall already has 6" of insulation. Public Works Director Kornelis explained there is a distinct and disturbing sound from balls hitting the court. The contractor suggested styrofoam instead of fiberglass. He wanted to do the walls while the hard wood floors were being aged. He said he would do them as a risk If Council did not approve. If it is done later, the wall would have to be torn down. Mr. Kornells recommended approval. Councilwoman Glick asked, the contractor has already done this? Mr. Kornells replied, yes, it should be done by now. If it is not approved, he will be stuck with the costs. Councilwoman Glick said if they do it, they feel they have us over a barrel. Councilwoman Glick said she noted there are some vehicles at the long term parking area of the airport that have been there a long time, will the ordinance handle this? Atty. j Rogers replied yes - this and some other problems regarding ' vehicles parked for sale. It also amends some airport regulations. The authority is diminished from the Airport Manager and centralized on the Police Dept. He reviewed some suggested changes. MOTION$ Councilwoman Glick moved, seconded by Councilman Measles, to approve the lease application. David Baumeister, ERA Helicopters, spoke. He intended to start operations Aug. 1, with Alaska Airlines. There would be 5 flights a day. They will be flying twin otters, larger plants - if needed - at a later date. They serve Valdez now. Councilwoman Glick asked for Administration recommendation. City Manager Brighton said, they recommended adoption of the lease. Councilman Via* asked if. they are taking all the spaces. Mr. Brighton replied, 1/2 of the remaining space. Councilman Wagoner noted this brings up something that has not been done. When Architect Gintoll did research regarding SesAir coming in, the consultants sold there is a way of restricting the number of commuters using the terminal by adopting an ordinance covering that. This has not been done. We are getting to the point of saturation with commuter flights. Competition is good, but with too many, it will be a detrimental situ9tion to several carriers. City Manager Brighton said he will pursue the ordinance. He added, it is the prerogative of the airlines if they want to come in. Hs would like to see all the expansion spaces occupied. Councilman Wagoner said we should be able to deny people till we make proper accommodations for those already there. It was not to restrict private enterprise. Carter Sr. City Manager Brighton said Mr. Carter has proposed to buy his presently leased land. Administration had an appraisal and they hired their own appraiser. This In different than the norm. Land Manager Labohn noted their appraisal hen 3 sets of figures for late 9 & 10. On lot 9, the appraisal is booed on property as if owned in fee simple. That is the way we normally have an appraisal. Lot 9 is $85,000, $3.17 sq. ft. Lot 10 is $98,000, $3.33 sq.ft. The other figures are based on $2.60 and $2.00 sq. ft. and deducting the lease hold estate from fee simple. Those are lesser figures. Normally we would ask for fee simple figures. Mr. Carter is asking for the lesser figure. Also, the 1983 assessment listed is actually 1981 assessment. The Borough is 3 years behind. Also, in a more recent appraisal in that area, lot 11 was $2.60 sq. ft. in March 1983, lot 5 was $2.61 sq. ft. Mr. Carter to asking for a negotiated sale. Mr. Labohn Interprets the report at $3.17 and $3.33 sq. ft. He added, the City only has appraisal on lot 10, at about $2.50 sq. ft. They will get one on lot 9. We have a self-poworod sanding unit that we set into a dump truck that we use for sanding but there are many problems with this such ass 1. The sander is placed in the dump bod which is fairly high off the ground causing problemn with sand and rocks being thrown out higher which can hit vehicles. 2. The dump truck is wide, and hard to maneuver on narrow streets. 3. The dump truck is 2 wheel drive and can get stuck fairly easy. 4. There are timen when we want to use the dump.truck but can't because the candor is in it. We have looked into buying a unit that would solves the above four problems and the cost in $21,500. Tho n anding unit we have costa 06,100 which would make the unit as a whole worth almost $30,000. In January the City was considering the disposal of the crash truck and received bids - the highent of which was only $8,767.32 from Chimley. The City Council turned down all bids (which were extremely low) and decided to wait until .July to reconsider diapooal of the crash truck, This crash truck if converted into a Bander would solve the above four problems that Public Works hats with our pronent sandinq operations. vie would bolt the nolf-powered sander to the frame of the crash truck which would lower the sanding unit. The crash truck in narrower than this dump truck and has 4 wheel drive. The only direct cost that the City would have is $1,000 for material to build a cat walk on both eiders of the pander. I believe the record will show that InletVisions' parent company, Multi - Visions, Ltd., has far excooded any technical legal requiremonts or directives in terms of providing servicos to the Anchorage community. I am confident that the same will be said of Inlet - Visions in the Kenai/Soldotna aron. The attitude on the part of, tho'City Administration from our earliest meetings has been that, unless InlotVisions can somehow be legally regulated, taxed or otherwise eompolod by force of law, the Company will somehow attempt to shirk its community responsibilities. Lased on my personal experience with this Company and, I believe, the clear record to data, nothing could be farther from the truth. At the recent Council work session, all of the ILV repro- sentativos present made the commitment that, regardless of any attempts to coerce action on the part of InlotVisions, the Company would nevertheloss use its boat efforts to moot with community leaders and to voluntarily look for ways to serve the people of Kenai. However, I sincerely believe the statements that I made before tho City Council at the recent work session to the effect that continued attempts to force action on the part of InlotVisions through legal maneuvering can only jeopardize the ability to cooperate in good faith to voluntarily serve the people of Kenai and Soldotna. As indicated to the Council, the Company's sincere commitment to community service does not mean that we will always agree with every proposal or idea advanced by the City or others. Like any other business, rovenuon and costa must be considered if the buninoon in to he viable. ILV can and will, however, cooperate in good faith with the Administration, Council and any other community loaders to exchange ideas and to considcr proposals. As reflected by our efforts over the past several months and by our request for the recent work nession with the Council, Inlet - Visions has attempted to avoid legal confrontation with the City wherever possible. However, your most recont letter loavan little doubt that you propose to aggroosively work toward an onerous local regulatory control over the Company which will provoke confrontation rnthor than compromise. To my knoWle<lgo no other community in the State of Alaska has soon fit to try to impose upon its cable television operator the port of all per- vasive regulatory controls outlined in your letter. Additionally, the time and resources consumed in such an effort can only dotract from the morn important business of completing the cable system and (hopefully) working cooperatively with com- munity leaders to enhance the value of the system to the people of Kenai. Moreover, I believe that even brief research will indicate to you that most, if not all, of the items outlined in your most recent letter are beyond the legal authority of a muni- cipality in Alaska to impose on a public utility such as Inlet - Visions. If the City attempts to impose the regulatory controls outlined in your letter, ILV will pursue all available remedies through the Alaska Public Utilities Commission. I wish to make it clear both to you and to members of the Council however that this action in no way detracts from the commitments made before the Council at the recent work session to work on a cooperative and voluntary basis to identify ways in which InletVisions can become a productive and valuable member of the local community.
