I took over operation on May 1, 1982 with the understanding that I would have the leasehold and conce- ssion at the airport restaurant and that Mr. George Tarlas did not have nor did he renew his option for a new lease. We adviced him that he did not ha e a lease option and I gave him notice twice in June and August 1982 that I was taking over restaurant, he refus- ed to move, so we took him to court and judge accepted his friend's testimony and a letter written by his friend that he gave Mr Kochan- uski a letter on March 10, 1982 for a 5 year lease. As of this date January 5, 1982 I do not have access to or use of my restaurant and equipment which I purchase for a large sum and have lost tremendo `s revenues to provide a better operation at Kenai airport. T As you all know for the past 5 years leasehold at airport has not been profitable for the past operations such as Mr. Pecks, Mr. Gary Eitel and Kenneth Buttes (ACI), Mr. Anderson and Kochanuski (CIE) and presently myself, F;Bing Lee (CIE). With the highcost of the current lease plus labor, materials, supplies, taxes etc., it is virtually impossible to run a profitable operation � J r During the first part of December, 1982 I made a proposal to city manager William Brighton. My proposal to the City of Kenai is that a basic rate of $.70 (seventy cents) per square foot and 3% of gross sales will make it feasible for continued operation of bar and rest- aurant. We would like this RETROACTIVE to May 1, 1982 which would take a tremendous burden off my back. At present time I am paying $ $4,048.00 for 3000 sgftt it equals $1.35 per sgft.(370 sgft is being used in the walk-in cooler and ice machine area.) Mr. Kochanuski and I have made a new arrangement thereby reducing escrow payment which will help me operate the lounge with a western band and other forms of entertainment which will mellow the airport lounge. 8ofar people do like the western band. Lease DATE: December 29, 1982 A brief background of the lease and rental amounts of the bar and restaurant at the Airport Terminal followas Oct., 1977 - Start of lease with A.C.I. Rate is 10% of gross revenue, $1,000 minimum. Jan., 1979 - Assigned to Anderson and Kochinoski. June, 1980 - Assigned to C.I.E., Inc. ,a June, 1980 - Amended so that 1980-81 lease rate is $3,200/mo. Thereafter, beginning July 1 of each year, rent Is increased or decreased by aame percentage increase or decrease in year-to-year revenue. Thus, on July 1, 1981, the rent is to be changed by the same percentage change as 1980 gross revenue compared to 1979 gross revenue. July, 1981 - Amended so that 1979 base year gross revenue is computed as July, 1.979 through December, 1979 gross revenue multiplied by two. Used to compute the July 1, 1981 rental amount. June, 1982 - Corporate entity (C.I.E., Inc.) sold to F. Bing Lee. Full operation of the bar and restaurant began in March, 1978. Monthly rentals have been as follows: 1977-78 (beg. 3-78) $ 2,230 (ave.) 1978-79 2,140 (ave.) 1979-80 2,786 (ave.) 1980-81 3,200 1981-82 3,829 1982-83 4,023 Memo to City Council December 29, 1982 It should be noted that the amendment of June, 1980 was requested by the lessee. He desired this change so that the monthly rent would be predictable. Also, the amendment of July, 1981 was also requested by the lessee. This method of calculating the 1979 base year revenue resulted in reduced rent. If this amendment had not been approved by the City, the 1981-82 rent would have been $4.587/mo., and the 1982-83 rent would have been $4.819/mo. Therefore, the City has already.allowed a decrease in rent that at this time amounts to $796 per month. The other rates at the Terminal are attached for your review. The leased space contains approximately 2,900 sq. ft. I i r t: U . At this time I propose that a fair price per square foot at airport for a basic figure, for example .`.?0o @ sq1, I've purchased the lease of remaining 15 years and have an option for additional years with all lease improvements of an investment of over $200,000.00 with high cost of operation plus payments to city as well as previous owners. It is a back breaking operation. Reason is that I do not have the operation of restaurant at trie airport. I wish to excercise my sale with previous owner as well as City of Kenai immediately, I purchased all improvements and all equipments, I#ve given George Tarlas (owner of Concord Restaurant) a 30 day notice in September and October'l-"2 that I want to take over the restaurant. The city manager was aware of my actions in his office period. As it stands today Mr Tarlas claims he has ..a 5 year lease option which he exerclt0ed on March 10, 1982 with Mr Richard Kochan- uski as it wsa stated court. The judge allowed the option at this time; it is open to us to reopen the case with additional a which Mr Kochanuski has provided and stated in court. We need help of City to evict Mr Tarlas and like to discuss this matter thoroughly at todays meeting. By now, you may have seen our news releases indicating we are purchasing and developing a 7 acre property on the Sterling Highway in Soldotna. Although we are now committed in Soldotna. I did want to give you some background on our decision. Our evaluation of the Kenai/Soldotna area goes back to early 1977, . or perhaps even before that. We had meetings and correspondence with 1 Kenai City Manager, Mr. John Wise, in early 1977. We also met with the National Bank of Alaska in Kenai in 1978. and investigated dozens of sites offered to us since then. In 1979 we corresponded with acting Kenai City Manager, Mr. Charles Brown, regarding the City property i at Kenai Spur Highway and Beaver Loop Road. We also corresponded With Mr. Bill Brighton, City Manager of Kenai, in late 1980. However, we lost interest in that particular property because of the high price, the necessity for a public auction arrangement, and the fact that the acreage was far more than Safeway required. Over these past years we have concluded that the Peninsula definitely 4 would need a new Safeway store at some time. We think Kenai is a very fine place and acknowledged that there are more people in that sector now than there are in Soldotna. However, we build stores not only for today, but for twenty, thirty and forty year projections. Our company feels that long range. the customer potential will be greater in Soldotna and we definitely prefer the exposure to Sterling Highway, which affords access up and down the Peninsula. Any instrument requiring execution by the City shall be signed by the City Manager and attested by the City Clerk. The form of any instrument shall be approved by the City Attorney. (Ord 312) 22.05.025 Conveyance_ to_ Encourag_eNew _Indust.ria-I Enterprises: (a) Notwithstanding any other provisions of this chapter, where it is found that encouragement of a new industrial enterprise would increase the economic stability of the City of Kenai and would be beneficial to the City of Kenai, the City Council by resolution 'so finding may direct conveyance of one or more parcels of City land by the City Manager to such industrial enterprise upon such terms as to price, conditions of conveyance, and with such contingencies as may be set forth in said resolution. (b) In the event the land directed to be conveyed under sub -section (a) above consists in part or in whole of airport lands, then the resolution ordering its conveyance will not be effective until the City Council by ordinance has appropriated from the general fund to be dedicated to the Airport Investment Reserve the difference between the appraised fair market value of said airport lands and the purchase price, if any, set forth in said resolution. (Ord 612) 22.05.030 &UN: (a) All lands, except tax --foreclosed lands, to which the City of Kenai ho?cls title which are not restricted from sale by the Deed of conveyance to the City, or which have been released from such restrictions, which the City Council has determined are not required for a public purppose, shall be available for sale by the City and shall be inventoried and said inventory shall be made available to the public at no cost, except that lands which have been leased shall not be sold unless the Lessee has made a written request to the city to place the land for sale in which case the Lessee shall have an option to purchase at the current appraised value with all unearned tease payments to be credited to the purchase price. Land(s) restricted by deed of release as to sale conditions are available for sale only under those -terms and conditions. (b) Sales -of lands pursuant to Sub -section (a) above may be made at not less than fair market value, subject to 22.05.025. Fair market value shall be established by an independent appraiser and shall have been prepared (dated) within six months: MPrior to or following an offer to purchase. (Ords 312, 612) 22.05.040 SALES PROCEDURE: (a) Offer to purchase. An offer to purchase available for sale c ty land(s) shall include in addition to a description of the land(s) a $1,000 deposit. Receipt by the city of the offer to purchase entitles the applicant to an option to pucchase the land(s) at the appraised or to be obtained appraised value within sixtylti (60) days after notice of said value. The City shall, if necessary, plat lands requested and obtain an independent appraisal within six 16) months. If the City fails to provide an appraisal of Ya value or properly plotted land(s) within six (6) months after receipt pf the application to purchase the applicant may at his option void the offer to puchase and obtain a full refund of the deposit at 10% interest or extend the offer to purchase retaining an option on the property. If the applicant fails to exeecise the option to purchase at the appraised value within sixty (60) days of notification of value the offer and option will be void and the deposit fprfeited. We have combined the two systems to the extent per- mitted by code. We have found the only overlap on the previous submittal to be a heat detector in the boiler room. In accordance with the State Fire code, only fire protection systems can be on the fire protection panel. Hence, two monitoring panels will be required, both will be connected to a third panel, which will be monitored by South Central Communications. The proposal from South Central Security includes a monthly monitoring fee of $20.00. We were told that this would remain at that amount for a period of 12 months, however, that information does not appear in the Proposal. We suggest the City negotiate the monitoring fee and the length of time the fee remains unchanged. Regarding the Snow Jax; we feel it is important to include these. They are in- tended to keep accumulated snow from dumping in large quantities on to the deck, in the event of warm temperatures while there exists large quantities of snow on the roof. We have checked with the manufacturer and found the cost of the Snow Jax to be approximately $3.00 each, F.O.B. the factory in Pennsylvania. The additional cost is for 130 pieces of 2"x 4" blocking between the roof trusses, under the roof sheathing, the grommeted fasteners, sealant and labor to install all of the above. It also includes a small amount for the Contractor's overhead and profit. We had estimated the cost to be $2,600.00. (e) Land Disposal (Corr, Crapuchettes, Glick) Mr. Corr reported the Land Committee will meet on November 18 in the afternoon to discuss the future Moose Point land sale. H. AGENDA APPROVAL The agenda was approved following the clerk's announcement that Item K (a) is provided on the table tonight in substitute form, replacing the Res. 82-208 which was in the packet. I. ORDINANCE HEARINGS (a) Ord. 82-77 (Revised) "Establishing the Anchor Point re an mergency service Area to Provide Fire ! Protection and Ambulance Services, and Providing for an Elected Board" (McBride, Corr, Glanville) - 1 - KENAI PENINSULA BOROUGH ASSEMBLY REGULAR MEETING OF NOVEMBER it 1982 The ordinance was read by title only as copies were available for the public. Prior to opening the subject to public hearing, President McCloud presented a brief history of two committee hearings in the Anchor Point area where citizens spoke in favor or against the proposed service area. Public hearing was then declared open. Speaking in favor of the ordinance were Bob Craig, Carroll Mead, John, Joe $ Elizabeth Aprill. All speakers favored presenting the question to the voters to decide the issue. Mayor Cooper, Homer, questioned the boundaries as shown on one of the maps which indicated the proposed service area would include a portion of the Homer Spit area. It was the concensus of those present that it was not the intention to extend the boundary down the Inlet to include the Homer Spit. Noted for the record was the receipt of a letter from Richard Schollenberg, Anchor Point, opposing the fire service area and stating it could benefit only a few in close proximity to town, while many other taxpayers would be supporting the service area without benefit of the service. A letter from Ms. Shirley Wilson reported the proposed service area would result in higher taxes with little or no benefit to the taxpayers. Anchor Point population is spread out over a large area which would necessitate several substations and increased taxation. Letter from Paul and Pamela Voeller stated because of their location, fire protection could not be provided, however, they would be taxed for the service and insurance rates for remote areas would not be reduced. They suggested limiting the service area to within S miles of downtown Anchor Point. A letter from Jerry Anderson, Homer, owner of property in Anchor Point, opposed the formation stating if the area to be taxed were reduced to three miles, he would withdraw objection. He could derive no benefit from the service area. As no one else wished to speak, public hearing was closed. MR. ARNESS MOVED FOR ENACTMENT OF ORDINANCE 82-77. The boundaries of the proposed service area were discussed. Mr. Best reported the ordinance now indicates the boundaries would include all lands and waters within the precinct easterly of the westerly mean high water line of Cook Inlet, however, the boundaries can be amended to delete the westerly line, leaving only the lands within the precinct on the east side of the Inlet. He indicated several possibilities. There was a general concensus to reduce the size of the water area to be covered in order to eliminate the Homer Spit. Mr. Best reported the revised boundary lines could be provided for the ordinance, however, he did not have the exact legal description available. MR. CORR MOVED TO AMEND THE ORDINANCE TO EXTEND THE BOUNDARIES OF THE SERVICE AREA TO THE WESTERLY SHORE OF COOK INLET AS DESCRIBED BY MR. BEST. Mr. Arness stated the amendment seems to deal with a tract not a proposed tract as indicated in Section 1. MRS. MC GAHAN REQUESTED HER AMENDMENT INCLUDE DELETION OF THE WORD "PROPOSED" IN SECTION 1. THERE WAS NO OBJECTION TO THE INCLUSION. A UNANIMOUS BALLOT WAS CAST ON THE AMENDMENT. AS PERSONS WERE PRESENT TO BE HEARD PUBLIC HEARING WAS OPENED ON THE INTRODUCTION OF ORD. 82-87. 1. Marianne Snowden, Homer reported her lengthy comments are on record from the Planning Commission meetings, however, she wished to inquire if there was a deadline on recording the plat. Mr. Best anticipated the plat would be recorded as soon as possible following public hearing. He added, hearing is scheduled for January 4, 1983. 2. Robert Gray, Homer, reported he would be affected by the zoning change. He reported the Homer Advisory Planning Commission and the Borough Planning Commission supported a contention that the property in question be divided by the centerline of the utility access alleyway easement so that the northern portion facing the Sterling Highway be rezoned commercial and the remaining portion to the south be retained in its present residential zoning classification. He supported this compromise. 3. John Hendrix, Homer, protested the rezoning of Tract 1 of Bluff Park Sub. having purchased a home which borders the property. lie reported when he purchased the property he knew what the zoning around it would be and did not expect to take a loss from someone else's gain. He reported the rezoning will affect residential property values within the area. Mayor Cooper, Homer reported the City of Homer is going through a transition period as far as zoning is concerned. He understood that if dr. Gangl had not applied for the rezoning, it would already be commercial as the City of Homer adopted a new zoning ordinance on September 27 and this entire lot was zoned commercial. - 3 - KENAI PENINSULA BOROUGH ASSEMBLY REGULAR MEETING OF NOVEMBER 11, 1982 Mr. Gray reported that if Mr. Cooper's understanding is correct then the Homer Zoning Ordinance is flawed. This indicates the property was changed to commercial without notice or hearing. Mr. Best commented that Mr. Gangl instigated the rezoning of the property prior to enactment on September 27 of the Homer Zoning Ordinance. If the assembly does not enact the proposed ordinance then the question is returned to the City of Homer. The reason the ordinance is before the assembly is because the action was started prior to the new Homer zoning ordinance being enacted and it was believed the normal process should be carried through. Mrs. Glick made reference to Page 119 and stated the area from the alley to the top or northern portion of the map of Tract 1 A is zoned commercial according to the Homer Zoning Code, and the area from the alley down to Waddell is zoned residential. The request to the Planning Commission originally was to zone the small portion from the broken line to the westerly portion to square up Tract 1 A being rezoned commercial and also Tract 1 B was in the original request. After considerable testimony the Planning Commission recommended the rezoning of Tract A as squared up to commercial. The Commission felt that the action was instigated prior to Homer taking over zoning powers, and there were requests from the public to proceed with the ordinance to the assembly as this more unbiased body would be making the decision. MR. CRAWFORD MOVED TO REMAND THE ORDINANCE BACK TO THE PLANNING COMMISSION. Mayor Cooper suggested the borough and city attorneys discuss the issue and report to both municipalities. Mayor Thompson reported there were S sites under consideration, and following hearings, only 2 appeared suitable. The Moose Range site was the most favorable, however, there were objections to that site as well and the request was turned down by the Congressional delegation. The Sterling Special Waste Site users are taking care of a great deal of their waste materials, and less is being put into the site, so the borough may not need to consider a larger site in the near future.
