OF THE CITY OF KENAI, ALASKA, REPEALING AND RE-ENACTINGQdKMC TITLE 3, ON ANIMAL CONTROL TO ! INCREASE PENALTIES, CHANGE METHODS OF CAPTURE, AND ADD ADDITIONAL VIOLATIONS. ; WHEREAS, the present ordinance is not sufficient insofar as penalties, court appearances, and methods of capturing animals, and WHEREAS, the present maximum fine of $25 does not allow for imposition of reasonable fines in worse case situations, and WHEREAS, an increased maximum fine would provide a deterrent in more serious cases, and WHEREAS, mandatory court appearances will impress offenders with the seriousness of animal control violations, and i-. WHEREAS, the present cruelty laws do not cover certain aspects of cruelty violations, and WHEREAS, the present ordinance for impoundment does not cover a vicious dog, and f WHEREAS, other fees and charges for impounded animals are insufficient. WHEREAS, the present license requirement of six months of age for a dog does not correspond with the rabies vaccination of three months of age. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, as followss i Section 1: KMC 3.05.010 (9) is amended as follows: (9) "Im oundment" means: a The seizure of animals by the methods set forth in KMC 3.25.010(d). b Seizure of a vicious animal. 1 I 1 1 y . 1 r 1 (10) [9) "Officer" means a person charged by law with the duty to enforce provisions of this title. (11) [101 "To own" an animal includes having title, reeping, harboring, and having custody or control of an animal. (12) (11] "Person" includes individual, joint venture, partnership, corporation, or unincorporated association. (13) [12] "Restrain" means: (i) [a] physical confinement, as by leash, chain, fence, or building; or (ii) [b] under competent voice control when an animal is engaged in an activity or form of training regiiiring that it not be physically confined; or - (iii) [c] under competent voice control when an animal is on the property of its owner. (14) L131 "Sterile" means rendered incapable of re- - pro uction by surgical operation. (15) [14] "Vicious animal" means an animal which has Bitten or attacked a human being without provocation. _ y Section 2: KMC 3.05.060 is amended as follows: Penalties and Remedies: (a) Except as this section provides otherwise, a person who violates a provision of , this title, term, condition, or provision of a license " issued hereunder, or a City regulation promulgated under 1" this title shall, upon conviction, be subject to a fine of not more than $300 [$100]. (2) In a dition to, or as an alternative to the " criminal penalty aforementioned, any person violating any "•' f provisions of this title shall be subject to a civil penalty of not more than $300 [$100]. Each and every day that such violation continues shall be deemed a separate and distinct violation. In addition, a civil injunction or temporary restraining order may be obtained in order to obtain immediate compliance with the provisions of this chapter. �c) The City shall seek an award of reasonable (j attorney's fees and costs from the court in prosecuting such �I an action. Section 3: KMC 3.05.070 is hereby amended as follows: .� Citation Procedure: (a) [11 An officer may serve a summons and complaint in the form of a citation upon a person for violating a provision of this chapter, or a term, condition, or limitation of a license issued hereunder, or a ` City regulation promulgated under this title. (b) [2] A summons and complaint issued under this — section shall contain a notice directing the person to whom ? it is issued to appear to answer to the charge in the District Court for the Third Judicial District of the State =.� of Alaska at Kenai. 2 i i .1 I � i • K I (c) [3.] An officer who issues a summons and complaint under this section shall deposit the original and a copy of the citation with his immediate superior who shall forward the citation to the District Court for the Third Judicial District of the State of Alaska at Kenai. Thereafter, the summons and complaint may be disposed of only by official action. (d) [4.] A summons and complaint in the form of a citation that fulfills the requirements for a complaint under the District Court Rules of Criminal Procedure promulgated by the Supreme Court of the State of Alaska shall be deemed a lawful complaint for the purpose of prosecuting a violation of this title. Section 4: KMC 3.05.100 is hereby amended as follows: Fees: (a) [1.] The fee for a kennel, dog fancier's facility, or dog musher's facility shall be $5 per dog in the facility, up to a maximum of $25. (b) [2.] The fee for a dog license shall be $3 for a steri 7zzed dog and $5 for all other dogs. The fee for replacing a lost dog license tag with a duplicate shall be $.25. (c) [3.] The fee for redeeming an impounded animal shall be the sum of the impoundment and boarding fees specified in this subsection, provided that if, within 30 days of paying the impoundment and boarding fees, the owner of an impounded animal presents proof that the animal has been sterilized, the Animal Control Office shall refund to the owner the impoundment fee for the animal. The refund for sterilization shall be allowed only one for any animal. The boarding fee also shall include any other costs actually and reasonably incurred by the Animal Control Office in maintaining the animal, including, but not limited to, medical care. 3 e (5) Any impounded animal which by reason of its size, strength, dangerous propensities, or other char- acteristics cannot reasonably be kept in the Animal Control Shelter may be reclaimed upon payment of an impoundment fee of $25 plus the actual costs reasonably incurred by the Animal Control Office in impounding, transporting, and keeping the animal. (d) The fee for adopting an animal shall consist of a charge of $10 to defray the cost of vaccinating the animal to and help defray the cost of impounding and caring for the animal. Section 51 KMC 3.10.060 is amended as followas Cruelty to Animalss (a) [1.] No person may: Lal intentionally kill an animal; [b] intentionally injure, torment, poison, provoke, or otherwise abuse an animal; (3) [c] maintain an animal without providing food, = waUer, and shelter adequate to preserve the animal's , i health, or abandon an animal where it will not be provided proper food, water, shelter, and care; W [d] maintain an animal showing symptoms of an ' infectious or contagious disease without keeping the animal confined in a building or secure enclosure and = under proper care. [2] Subsection (a) [1] of this section does not apply �. tot - (1) [a] impounding, destruction, or other disposition of an animal in a humane manner as authorized by law; (2) [b] killing or injuring an animal where necessary to protect a human being or domesticated animal from death or bodily injury; (3) [c] the humane destruction of an animal by its owner or the owner's authorized agent. [3.] Animal fighting. �f. (1) [a] No person may cause an animal to fight another i animal or human being, whether for amusement of himself ;I y' or others or for financial gain; or ( [b] train, or keep for the purpose of training, an animal for exhibition in combat with an animal or human being, ri (3) [c] no person may permit his premises to be used for the purposes described in paragraph (c1) [3a] of this subsection, or be present as a spectator at an exhibition described in paragraph (c1) Da] of this subsection. 2- ►J A to") (d) [41 Accident involving injury to animal. 1 (1) (a) The driver of a vehicle involved in an accident resulting in injury to an animal shall stop the vehicle as close to the scene of the accident as possible and forthwith inform the owner of the animal of the injury if the animal's ownership is readily ascertainable, or inform the Animal Control Office of the injury if the animal's ownership is not readily ascertainable. (2) (b] A driver shall inform the appropriate person under paragraph (dl) of this subsection of the time and location of the accident, a description of the injured animal, and the apparent nature of the injury. .J o person may use a trap within the city limits an kill or mangle an animal. f Animal harassment, o person may allow any animal which he owns to molest or harass wild or domesticated animals. Section 6s KMC 3.20.010 is amended as follows: Requirement for Licenses: A person who owns a dog over the age of three L61 months, other than in the operation of a kennel, dog fancier's facility, or dog musher's facility, shall obtain a dog license for that dog pursuant to this chapter. Section 7% KMC 3.25.010 is amended as follows: Imeounding Procedure: (a) The following animals shall be subject to impoundmen z (1) an animal found at large; and (2) a dog not bearing a license tag as required by KMC 3.20.030. (3) a vicious animal (dog or other). (b) When an officer inds an animal subject to impoundment and the officer knows the identity of the animal's owner, the officer may cite the owner rather than impound the animal. (c) An officer may pursue an animal onto private property in the course of effecting an impoundment under this section. (d) Method of Impoundment: 1 An officer of this code may capture an animal by calling the animal at large to him. WHEREAS, the Kenai Peninsula Borough has amended their Code of Ordinances relating to elections, and WHEREAS, the City of Kenai elections coincide with the Borough elections, and WHEREAS, to ensure efficient handling of the election process, these two government entities should work with similar procedures. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, as followss Section 1s KMC 6.05.08O is amended as followss City Clerk to Prepare and Furnish Ballotss (a) The City Mark Shall prepare and furnishall official ballots in City elections. The provisions of State law relating to the preparation and furnishing of ballots in State elections shall govern the preparation and furnishing of ballots in City elections insofar as they are applicable and are not in conflict with the City Charter or ordinance; and the City Clerk shall perform the functions in regard thereto pres- cribed by law for the Director of Elections in regard thereto in Sta a elections insofa as it is appropriate. Brown, Finance Director DATE: May 31, 1984 SUBJECT: Ordinance # 944-84, Interest on Assessments At the May 16, 1984 Council Meeting, Councilman Wise inquired about the rate of interest on assessments. The next day, he and I had further conversation on the subject. The problem with the City Code is more of confusion and poor wording than anything else. KMC 16.10.130 already allows Council to set any rate of interest it deems proper when confirming an assessment roll. The confusion is really in KMC 1.75.010 (b). That paragraph is meant to set a rate of interest on delinquent accounts. Unfortunately, the word "unpaid" is used, rather than the word "delinquent." "Unpaid" could be interpreted to mean assessment installments that have not yet came due, as well as delinquent installments. The way the Code reads now: 1) The interest rate on installment assessments is set by Council. 2) The penalty rate on delinquent installments is 10%. 3) The interest rate on delinquent installments is 10%. The stay I:m, asking the Code to be changed: 1) The interest rate on installment assessments is set by Council. 2) The penalty rate on delinquent installments is 10%. 3) The interest rate on delinquent installments is set by Council (hopefully, this would be set at the same rate as on the installment at 41 above). Therefore, this ordinance does very little, except to clarify language in the Code. The only change is striking the fixed rate of interest of 10% on delinquent payments. Today, I talked with Councilman Wise again. He is thinking about changing the Code so that the interest rate is linked in some manner to the market. If Council wants to pursue that, please introduce Ordinance 0 944-84 on June 6, 1984, but set the public hearing for July 5, 1984. Notion passed unanimously by roll call vote. 8. PERSONS PRESENT SCHEDULED TO BE HEARD / 8-1 Donald D. Graham, Box 416, Kenai, Alsoka. He received a letter from the Finance Department on a special assessment totalling $3,085.57. The letter stated that if he did not pay this amount within 20 days foreclosure would result. He came to the City in 1958. When the City incorporated he did not went to get into the City. Later the City put in water In his area. He attended the public hearing on this and wss one of the people that protested. The next day he received a bill in the mail. Another person at the hearing received his bill the same day an the hearing. The former Council did not treat them fairly. Mr. Graham stated that he also received a letter from the State saying they would not rehire his as a teacher because he was over 65. He does not have the money to pay this. Does not feel he owes this as he has not used the services. Mayor Wagoner asked if the purpose of his presentation was to ask Council to waive the assessment bill presently owing. Don Graham stated that he hasn't used them. Mayor Wagoner stated that there are a lot of people charged for water and sewer without using it. This assessment was litigated in J court. A class action suit was brought against the City by some individuals, it was settled, and the City was allowed to go ahead with the assessment district. The Council does not have the authority to alleviate this problem. KENAI rITY COUNCIL June 6, 1984 Page 2 Attorney Rogers said the Code states that when property is situated near water and newer, they are charged for this service whether they are hooked up or not. The property value has increased becou?je of these services being available. He referred Mr. Graham to KMC 1.75.O10(a) and (b) on the penalty and interest charged on thin assessment. Mayor Wagoner suggested Mr. Graham talk with Mr. Brown in the Finance Department. Attorney Rogers suggested that Mr. Graham pay the amount under protest now to avoid any further penalty and interest and if the City found a refund was in order, he would get his money back. Mr. Graham said he would be out of town July 4 through July 25. He will make arrangements to see Mr. Brown. C. PUBLIC HEARINGS C-1 Ordinance 936-84 - Establishing a Special Assessment Fund entitled "Stellar Drive". MOTIONS Councilman Ackerly moved, seconded by Councilman Measles, to adopt the ordinance. C-2 Ordinance 937.84 - Adopting the Annual Budget for 1984-85 MOTION$ Councilman Measles moved, seconded by Councilman Ackerly, to adopt the ordinance. PUBLIC COMMENTs Father Targonsky objected to the adoption of this ordinance unless the City included $2,000 to the Russian Orthodox Church for a tour guide. He has volunteered in the past but can't volunteer this season. He needs a job to support his family but if he were given a salary, he would rather be the tour guide for the Church. Since the Church has been named a historical ovelety, it would be to the benefit of the City to grant his request as it is a tourist attraction. About 2,000 people tour the church a year. Mayor Wagoner suggested charging fi for the tour but Father Targonsky said the church decided they did not went to charge anything. Mayor Wagoner said the City has to be conservative on requests of this nature because if they granted one, they would have to grant these for everybody. He suggested going to the Chamber of Commerce but Father Targonsky said that the Chamber was on a small budget and could not help him. No further public comment. Their subdivisions include underground utilities and covonantu. the L.I.O. program In a good way to provide utilitioo. Inlet Moods will include paving, curbs and gutters, street lighting and protective covenants on tree removal, With the Tesoro plant expansion forthcoming, the City will need another largo subdivision. The relative cost of the L.I.O. in 58% of the proposed sale price of the lot. We would like to get a 20 year payback. City Manager Brighton Bald we are not limited to a 10 year payback. The bonds would be sold on the basis of how long the payback period woo. Mike McLane said the builders are responsible for the soaeooments as they run with the land. City Manager Brighton said we nuked the citizens of Kenai for the right to sell $4 million in bonda. If we use that amount, we will ask the citizens for another $4 million bond Issue. Councilman Measles said that on a 20 year bond it would affect the City's ability to sell the bonds and it would be at a higher rate. City Attorney Rogers said that we changed the Code and are passing those costa on to the assessment district. Mayor Wagoner wanted to know if we would have to come back with another ordinance getting Council's approval to sell $2.5 million in bonds. It is unsafe for earn & school buses to park there as the Fire trucks can't get through. No said there are a lot of vacant lots that perhaps the people could park In instead. Said no parking should be extended to Cook so there is a bottle neck at Peninsula and Cook, Ron Malaton spoke opposing the no parking recommendation, He did not feel It Man a hazard. Mayor Wagoner said that the City Manager requested the Public Works Department submit a grant to the Federal Government as a type of urban renewal project to look at some of the small lots in the Old Town area and sea if the City could buy these lots and rouse them for off street parking, He asked Mr. Walston if that would be fssaible to try and Mr. Holston said it would be a good ides. Mayor Wagoner said that if off street parking were provided and Main .Street woo deemed to be a safety hazard with parking on both aides of the rood, we would prohibit parking on one side only and still have parking available for customers. City Manager Brighton wanted to know if Chief Ross had expresoed a concern on safety along this street. Public Works Director Kornolio said that during snow removal the City had a problem. Councilwoman Bailie said she found it extremely dangerous to go onto Main Street passed the Rainbow Bar and said that she had to pull out into the road in order to see if there was any traffic coming down Main Street. She felt that off road parking should be extended all the way to Cook. City Manager Brighton cold a compromise to the parking problem would be to restrict parking on one aide only. There are several businesses along Frontage Road that have no parking and use Frontage. The Council has taken a firm stand on landscaping plans and other items pertaining to development in the City and we should get together with P 6 Z for a discussion. June 27 at 6 p.m. was not for the work session. The subject of the meeting is landscaping approval versus occupancy permitol and Section 36. The City Clerk will send a notice prior to the meeting. City Manager Brighton questioned if the Wade lease ap- plication had to go before P 8 1 again at this work session. PUBLIC COMMENT: Frank Getty, 208 Candlelight, Kenai. His dog got snarred with a wolf snare with practically decapitated him. Me called Al Thompson from Fish A Game. If children were going through there crone country skiing and got trapped in the snare, they could not release themself and would die in the cold. It is very important that the banning of trapping within the city limits be included within the animal control ordinance. Bill Godek. Animal Control Officer, Under Section 1, he stated that impoundment needs to be defined, espee ally the kinds of animals we can seize such as a vicious animal. He sokod that Restrain be changed to include "under competent voice control" on the owner's property, so that an owner has better control over his animal. Under Section 2, Penalties, he would like to nee the maximum fine ss o�$500. Under the present code, if the owner so chosen, he can pay a'$25 Fine and not go to court. The Finance Director said we had $221,000 remaining from other projects and by adding the 1.4 million given, we could accomplish thane road projects this year. After we picked up everything that was already engineered, we had approximately $500,080 left which is why we picked VIP, which is not engineered. II City Manager Brighton suggested that we should amend the ordinance by eliminating VIP and have the Public Works Department put figures on each one of the streets in this area and bring this report back to the next Council meeting for your review. Perhaps we can find additional money. Mayor Wagoner wanted to know if either the South Highbush project or VIP were engineered. Public Works Director Kornelie said they were not, but if it were engineered either one of them could be substantially completed this year since there is no paving involved in either project. City Manager Brighton said that at the next Council meeting the Administration will have prices on the „ engineering costs for South Highbush, Davidson, Bumblebee, East Aliak, Swires, and Highbush. Mayor Wagoner said that the Council should not have to be the one to make the decision that it should be the recommendation of Admin- j istration as to how far the money will go. We would be looking at redwood at $64 a square root; for instance, sign 01 would cost approximately $3,600. Mayor Wagoner said that a nice base should be added for the sign. We will have a battle with D.O.T. to put up the sign as we need a permit. There is a state siqn on the highway presently. He would like to see the new sign located where the old one used to be. Councilwoman Monfor said simplicity should be the key with flowers used to accent it. ' • MOtIONs Councilwoman Monfor moved, seconded by Councilwoman Rallis, to accept the second sign as our "Welcome to Kenai" sign and design a base to hold some landscaping. Motion passed unanimously by roll call vote. G-10 FSS Facility Lease City Attorney Roqers said he had been in contact with the FSS people. He has written assurance that they will take over maintenance for the second 20 year term. We had two choices to give them fee interest, or the option of renewing for another 20 years. City Manager Brighton opted for the second 20 year tern. The Administration andLt►he Legal Department recommend that the Council accept this contract. Mayor Wagoner said he did not know what the value of a building would be after 40 years and said it might be better for the City to give them a building. Councilman Monales wanted to know if it was stipulated in the contract that the building had to he a flight service station and City Attorney Rogers said he believed it was. He also said that the renewal option for the second 20 year term was on the same terms as the first contract and to do otherwise would not be in the scope of the agreement. If thin facility had to go for rebid, we might not be able to gat it. MOTIONS Councilman Ackerly moved, seconded by Councilman Measles, that the City of Kenai enter into a 20 year lease with the FAA for a flight service station. This lease will have a 2nd 20 year lease option with all the maintenance being the responsibility of the FAA. Councilwoman Bailie said we need to keep on good terms with , FAA. Councilman Measles said that during that second 20 , year lease there probably would be more employees than the first 20 years. Mayor Wagoner said that their projections were that it would start out at 80 to 90 employees with a reduction in later years. Councilman Wise objected because the cost to the City is far outweighed. It will be a loan of revenue of at least T, $150,000 plus the money we will loan at no interest to the Federal Government over a 20 year period. Our coat will be about $200,000 a year for thin facility and he can't see 80 employees generating that much economic benefits to the City. This is a proposal from Bill Nelson to incorporate all the drawings and plena into one project. This would also include a small parking area for the Bernie Huss Memorial Fitness Trail and the court house driveway. Mr. Nelson would like us to extend his contract. By doing this we will save more than the $2,900 coat of extending his contract. MOTIONS Councilman Measles moved, seconded by Councilwoman Bailie, for approval of extending -the contract for Was. J. Veloon 3 Associates have expended more time than they had anticipated and are asking for an additional $4.000. Corporation to Beluge Development Corporation - Lot 5, Block 2, CIIAP Subdivision City Attorney Rogers said it is an assignment but there had been an assignment from Beluga to E.N.C. There is now a contingent assignment. It will be made for security purposes only and will not be recorded but escrowed. If a default in payments develops that assignment would be recorded. Our Code provides for assignment* for security purposes. You would be approving an assignment that may never have legal affect because it will be escrowed. This is a 50 year lease that has already run 20 years. We use a standard consent form and we will probably redo this consent for signature. G-14 Discussion - Assignment of Lease from Roger Moll to Peninsula Savings & Loan MOTIONS Councilman Wise moved, seconded by Councilwoman Monfor, for approval of the assignment of lease from Roger Noll to Peninsula Savings & Loan. This assignment is to have individual sureties signing on behalf of the financial institution, and the signature of Roger Noll. City Attorney Rogers said we will not be uning these forms. Mr. Noll did not sign these documents. We have informed ATG of this already. We will need individual sureties signing on behalf of the financial institution that is assuming the lease. Motion passed by unanimous consent. H-1 City Manager 1. The House passed a $70 million municipal assistance bill and the Senate passed a W million municipal assistance bill. The higher figure has been encouraged and the compromise was $81 million, An additional $140,000 will come to the City of Kenai. 2. Senator Kerttulo woo aucceonful in getting Senator Faiks from Anchorage to put $1.9 million In that capital improvement bill for our harbor project. Plan on going to Juneau tomorrow since they may be adjourning this weekend. • H-2 City Attorney 1. CIE matter - we are trying to get a consent to get into the airport bar so it will be ready shortly after June 24. The final hearing is June 24. The figure to fix up the airport bar was around $20,000. We will make as few alterations as possible. Maybe we could have a work session or discuss it at the next Council meeting so as soon as we have the clearance from the Court, we can get the Request for Proposals out. Mayor Wagoner thought that of a previous work session we had decided to put it out for bid "so is" and the successful bidder would make the alterations that he wanted. City Attorney Rogers asked if it was the consensus of Council that we would not upend any money, but simply take proposals and lot the successful bidder do their own remodelling for a short term period of 3 to 3 1/2 years. Council so concurred. 2. Legal Assistant - He has been interviewing for this position and he hopes to make a selection on or before the 15th of June. Most of the individuals would not be available until the first of August. 3. O-8 - Ordinance 945-84 suggested that this ordinance be amended by adding a Section 2 as added in Ordinance 927-84. There has been competitive interest in this land which is why he is asking for this amendment. 4. He may go to Juneau with the City Manager tomorrow. 5. Cable TV is in limbo. We have their response and they are not willing to get off dead center. I anticipate giving Council an Ordinance to that affect. • H-3 Mayor 1. He went to the Department of Transportation while in Juneau to discuss the possibility of a 4-lane highway from Soldotno to Kenai. He has asked the Administration to draft a resolution for the next Council meeting endorsing this concept. 2. When Ron Ralston was Mayor was there a gentleman's agreement that the government would show the Council the design concept prior to building? He would like the records researched on thin building plan. Councilman Wise said we need an ordinance on the site plan for all development. Mayor Wagoner said we need to discuss this with Planning h Zoning. 3. For the record, a letter was submitted this date by Poth Parsons to the City Council. This was In referene to ordinance 335. She claims that this ordinance was written especially for the Parsons homestead which exempted them. The ordinance nays that the assessments will not be due until the property changes hands. Since the property changed hands on flay 1, the assessments should not be due on the date the City Attorney claimed. '(1 .e' J . An individual in Thompson Park wanted to know how much gravel will be extracted from the pit? Public Works ' Director Kornolio said we plan on using the sand out of the pit for the Thompson park project, the gravel portion will be used on all City streets. This project is for thin season only. We also plan on cleaning out the pit. 5. Would like to see the Administration draw up a com- mendation to the Fire Department for the quick action in putting out the fire the other day. 6. Street names on Section 36. The Borough said they did not like to have a duplicate street name borough -wide. Since the zoning will be handled by the City of Kenai, we will try to force through some of the names that are not duplicates for the City of Kenai, the street names should be able to be duplicated. With the consent of Council he would direct Administration to draft a resolution renaming the streets as previously otated. 7. We have been offered a donation by Don Johnson for -� display and care of his entire wildlife collection of mounts, everything imaginable. Does the City wants to pursue thin collection? Pat Porter wants to expand the Fort Kenny Museum since all we have is a Musk Oxon and I think it would be groat. We are fixing up the back yard and the cabins are being turned into homesteaders' cabins. It woo the consensus of Council to go ahead with the donation. H-4 City Clerk Deputy City Clerk Dore advised that her tenure as the deputy city clerk would be over in seven working days, for which she woo happy. Lounsbury 3 Associates and located 501.0" south of the present Terminal Building, together with fuel line location under and across the General Aircraft Apron as outlined on Standard Oil Company of California Drawing CB-111332-0 dated August 27, 1968 and described as Plot Ar Piping Plan - Jet fueling facilities, Western Airlines, Airport, Kenai, Alaska. Such survey and drawing to become part of this permit, for the term of four (4) years from the lot day of July, 1984, to the lot day of July, 1988, at the annual rental of $392.73 payable yearly in advance of the first day of each permit year of said term. The rental specified herein is calculated at the rate of 3,900 square feet at $.1007 per square foot, or $392.73. In addition to the rents specified above, the User agrees to pay to the City fees as hereinafter provided: The fuel flowage fees as outlined in Section 10.130 of the Kenai Municipal Airport Rules and Regulationes the wholesale distributor of all aviation fuel shall pay the City a fee of 2 cents per gallon for all avistion gasoline, 1-1/2 cents per gallon for all jet fuel, and 5 cents per gallon for all aviation oil delivered outside the City for use on the Kenai Municipal Airport, provided that the above fuels and oils are to be used in any type of aircraft. The fee shall be paid on a regular monthly basis by the wholesaler and a.list of the bulk gallonage delivered to each individual on forms supplied by the City along with a copy of the invoice for each delivery must be submitted. Exceptions are made to fuels sold to the United States Government Agencies dispensing petroleum for their agencies' use. The User also agrees to pay any fees as may be outlined in any future revisions to the above mentioned Section or renumbered section thereof, said fees to be payable In a customary manner by User's suppliers. Any or all persona, or real property placed or used upon lands or in facilities in violation of the preceding ,prohibitions may be removed and/or impounded by the City and when so removed and/or impounded, such property may be redeemed by the owner thereof only upon the payment to the City of the costs of removal plus storage charges of $10.00 per day in the case of each aircraft of not more than 6,000 pounds gross weight, or $50.00 per dayy in the case of structure or each aircraft in excese of 6,000 pounds gross weight, or in the case of any other kind of property in an amount not to exceed $50.00 per day. 4. The User agrees to pay the annual rental and fees specified and not to assign its permit or any part, nor let, nor sublet, either by grant or implication, the whole part of the premises or any part without written consent of the City; provided, however, the foregoing shall not prevent User's performance and exercise of any and all rights granted hereunder y or through its duly appointed Airport Dealer or agent. 5. The User agrees to keep the premises clean and in goo order at its own expense, suffering no strip or waste thereof no-, removingq any material therefrom without written consent of the City. At the expiration of the term fixed, or any sooner determination of the permit, the User will peaceably and quietly quit and surrender the premises to the City. 6. Checks, bank drafts or postal money orders will be made payable to the City of Kenai Municipal Airport and delivered to the City Administration Building, Kenai, Alaska, 7. Any construction if permitted by amendment hereof, shall be neat and presentable and compatible with its use and surroundings. Prior to placing of fill material, the User shall submit a plan of proposed development of property to the City who shall approve in writing all major permanent improvements. B. This is sufficient width to allow for on street parking. Problems in this area ware addressed in a memorandum to public works on 2-23-84. The problem at that time was that the road- way surface had boon aeverly restricted because of snow accumulation outside the curbs. Because this has been a wintertime problem in the past, and minor accidents have occurred in the area, it was suggested that no parking on one or both sides of the roadway might hav© to be considerod in the future. From a safety point of view this is not nomessary south of the Overland-Frontago Road intersection, the road- way surface can be ooneistently maintained to its full width. There should be no parking on the West side of Main Street for at least 40 feet south of the curb intersection and Overland Street. This would enhance visibility for vehicles turning left from Overland Street onto Main Street. Parking on both sides of Main Street north of overland Street and Frontage Road intersections has not boon a problem in the past, except during same special events* however, it should be prohibitted as it soverly obmao wes visibility and Poses a hazard to vehicles entering Main Street from Overland or Frontage Road, as woll as problem for vehicles entering from tho Kenai Spur when there is congestion in this area. This material, he says, would be considered "hazardous waste", for which there is no disposable site in Alaska. It coats about $200 per barrel to ship it outside for disposal had we had to. It is my opinion that the City and our ambulance j personnel would be better served by the emergency room staff on duty at the Hospital and it is my recommendation that the City of Kenai contract our EMS advisory support with Dr. Cooper and his emergency room staff. This is unfortunate for all parties involved and puts the Fire Department in a rather awkward position. 11lo do really appreciate all of the work, time and effort that t)r. Hanson has expended, not only as our paid medical advisor, but before he was paid and worked with us on a voluntary basis. However, to get the most value for the services rendered and to make our operation as efficient and gractical as possible, using the Hospital Emergency Room seems to e our best alternative. Dr. Cooper or one of the Emergency Room doctors sees each patient that we transport to the Hospital - even if it is one of Dr. Hanson's patients - we have to notify the hospital that we are bringing in a patient, what condition and what treatment we are giving the patient. It is not only redundant but also time consuming to try to page up Dr. Hansen and give him all the details and then immediately turn around and go through the whole routine once again with the Hospital. The Emergency Room octor immediately critiques the ambulance crew, points out any problems or lets them know that they made all the right decisions. Dr. Hansen never sees 95t of the cases we handle, his reviews only relate to what is written on the run report - this leaves a lot to be desired. Dr. Cooper, on the other hand sees 601 to 751 of all cases admitted to the Hospital. If he hasn't seen them personnaly, he has charge of the doctors that did see the patient and can bring them in for our critiques. There is very little or no advantage to the nearness of Dr. Hanson's clinic; out of 290 runs in 1983, we only took 9 patients there. If a patient wants to go to the clinic all we have to do is request a phone patch and ask if nr. Vansen will accept the patient. From a practical stand point, using the Hospital Emergency Room doctors is most advantageous. Renewing our contract with nr. Iiansen will not hurt us any, but it would not be as beneficial either. The House was required to return and did so briefly Monday, June 4 only to adjourn "sine die" again at 4s43 p.m. Several issues were left unresolved even though the Senate continued to meet and pass what bills they received from the House that they felt they could accept. Three major issues left both houses at an impasse and wondering if resolution and adjournment were possible without a special session. The Governor offered to most with the leadership of both houses and act as a mediator. This type of new "conference committee" was unprecedented. After three meetings, over two days, some agreement was reached and both houses will be in session today to see if the votes are there and adjournment is possible. Basically the House leadership agreed to accept the Senate version of the Railroad Management gill, the Senate leadership agreed to accept the House version of the energy legislation (no Susitna clause and a continuing appropriation) and they compromised on an amended capital bill wing SB 409 as the vehicle. The compromise capital projects bill will have a cap of $365 million, reduce the Governor's requests for corrections and the railroad by $12.7 and $7.5 million, respectively, and make up any excesses by equally shared cuts - Senate, House, and Governor. Adjournment to possible Friday or Saturday, but the votes may not be there, and the Governor can still exercise his veto power. 80 375 - Land Moroaal-and Managements The bill passed the Senate on reconsideration Saturday, June 2, 18-0. HD 679 - Municipal Bond Banks The bill, which raises the authorized amount from $200 million to $300 million, passed the House May 31 and was returned to the Senate Rules Committee by the Senate Tuesday, June S. Federal Revenue Sharing Down an Average of 39%s The League has received preliminary reports that federal general revenue sharing allocations for this entitlement period which starts in October (federal fiscal year) have been released and, on the average, are 39% lower for Alaskan communitiesi The cuts vary by community secording to the application of the formula but reported examples include Anchorage cut 32%, Fairbanks 88%, and Juneau 9a;. Notices went out to communities last week. Quoting Judy Slejer in Anchorage, 'what the State giveth (in municipal assistance etc.), the fads taketh away". Federal revenue sharing is bared on two different formulas. One for the state share and then one for the coxawnittes getting a portion of the state share. Therefore, the general revenue sharing amounts vary widely from year to year. For this entitlement period, however, the state is receiving less for their share because 11 Legislative Bulletin 1145 - page. 7. the price of oil to down and, therefore, severance tax reeeipta are down. Also, the aggregate ineama in Alaska has increased 15%, nationwide it has only increased 5%. The tax effort in Alaska has been reduced 16.4%, but nationwide it has increased 6.7%. Judy Major of Anchorage estimates that when the federal revenue sharing cuts are balanced with the seats municipal assistance funds received over and above the Covernor's requested amounts (05 million), if he signs NB 511, will only be a net gain of approximately $730,000. The League will be looking into the allocations and formi$Ias further, but check your mailboxes. This is an issue that should be brought to the attvntion of our Washington Delegation, our State Legislators, and State Administration, especially in light of the Governor's shared revenue task force headed by Commissioner Ciotti.
