WHEREAS, the Kenai Advisory Planning & Zoning Commission held a public hearing on this matter on October 23, 19859 and WHEREAS, as a result of the public hearing and testimony given the r.) Section 81 The City of Kenai reserves for itself the perpetual'rigFt to ingress and egress over all plots for the purpose of maintenance, operations or any emergency work necessary to the operation of the Kenai Municipal Cemetery. ARTICLE Ili Maintenance of Cemetery. Section 1s The City of Kenai is responsible for the appeerana�the Kenai Municipal Cemetery. The maintenance of the cemetery shall be accomplished through a program adminiaterod by the Parke and Recreation Department. Section 21 The City of Kenai shall maintain the driveways, gates and ending of the Kenai Municipal Cemetery and may close such access facilities in periods of adverse conditions. Section 31 Planting of treee, shrubbery, plants or turf shall be plaanted# transplanted, plucked, picked or pruned within the Kenai Municipal Cemetery with the written consent of the Parke and Recreation Director or his authorized representative. The City of Kenai shall provide grass cutting at reasonable Intervals* raking, cleaning, grading and landscaping. Section 5s No materiel shall be allowed to remain in the Kenai u�pel Cemetery longer than is reasonably necessary for any construction work. During periods of break-up, no heavy hauling will be permitted. Within one year of interment, grave shell be restored to ground level and re -seeded. ARTTIC_4E IIIs Use of Groves. Section 11 The City Clerk shell assign a plot number to a specific plot In advance of the preparation of a grave whenever an interment or disinterment is to be made. Section 2s The City Clerk shell be provided with the appropriate State burial and transit permits before interment will be permitted. The burial lots can be used for no other purpose then interment. Section 3s Interment or disinterment shell be made in compliance with all State and City health and sanitation laws. ARTICLE Vs Reservation permits and mortuary responsibilities. Section 1s A reservation of burial apace in the Kenai Municipal Cemetery can be acquired by applying to the City Clerk and being assigned a platted plot or plots after having paid the appropriate fee. It is prohibited for the purchaser of sold plots to re -sell or assign the plots except to the City. Section 2s A mortuary conducting a funeral service may provide, place and remove greens, decorations or seating used for a burial and must provide necessary lowering devices. 3 i 1 7 -7 F action 3 Sloe i No person shall enter the Kenai Municipal Cemetery except pt through the established access routes. The cemetery will be open daily from 7t00 a.m. to 9100 p.m. during the months of May through October. The Contractor had to install tapping sleeves for connection of 6" branch watermains at Station 28+60 East Aliak to north and south right-of-ways. The plans instructed to verify exis- ting 12" X 6" cross which was proven to not exist upon exca- vating for verification and exposing existing 12" watermain from Station 28+80 to Station 28+70. 2. The Contractor was instructed to locate existing 12" water - main elevations on East Aliak to determine depth of 12" watermain below proposed finish grade. This information was required due to inconsistency of actual elevations compared to elevations shown do the plans when the watermain was exposed for past connections This information was used to determine if and where insulation of watermain should be placed. 3. The storm drain system was lowered from original design to allow for future extensions of system. Extra costa were incurred due to storm drain system being lowered from original design. Public Worke Dipreotor Kornelie reported the contractor wee supposed to be working today. Last week he promised the steep part would be out down. He turned in a petition to have the crown of the road brought up to 6 In. on the aide of the road. A slent will not do it. We need the crown brought up, the ditches filled in and black top. The water will not run off in the Spring. He asked where the plane for the road were, Mr. Howell had a set that was obsolete before he paid for them. The storm sewer hoe been extended 600 ft., the only intake in at the very end at Aliek. He suggested the ditches be tied in along the way. There is a need for more bell fields in Kenai. We heve.doubled in the loot 10 years. They had 400 kids. There are 16 men's and 10 women's teame plus Church and Civic Organizations teems. There are over 600 players on 3 fields. They had a herd time getting the fields for practice lest year. The school hoe put in a request for 2 softball fields it will take 2 years to complete. They will need a replacement for the dust bowl. DEC may not approve the dump site before Spring. Could the Beaver Loop perk be used? Mayor Wagoner said they will be working with the school district to make better use of the fields. He asked, how many are from Kenai, N. Kenai and Soldotne? Mrs. Osborne replied, they are just N. Meyer Wagoner noted it was not the City's fault if it did not most apace. Councilmen Ackerly suggested cooling the asphalt instead of leaving it porous. Engineer Nelson explained there are alternatives. The contractor has offered to core and take additional eemploo to see if the asphalt content was low over the area claimed. Brown, Finance Director e 114 DATE: November 26, 1985 SUBJECT: FAA request for repayment on Fencing and Equipment grant #6-02-0142-08 In 1961, the City received a grant from the FAA for fencing and equipment at the Kenai Airport. With regard to the fencing portion, the oroiect was 950;00n fnr Inetallatlnn of 19nA Fact of fenAal and $70,000 for reconstruction of 5,600 feet of existing fence. For those amounts of money, the City was able to install and reconstruct more fence than the designated footage allowed in the grant. The FAA notified the City in December, 1982 and in February, 1983 that the footage in excess of the limits set out in the grant would not be eligible. They were very specific about this. In the September, 1982 letter, they went on to inform the City that we could amend the grant to increase the footage. This amendment would have to have been done prior to construction. The City apparently did not ask for a grant amendment. The FAA is asking for repayment of $21,366.75 (93.75% of $22,791.20). I have notified the State of Alaska about this and have asked if they will demand a refund of $712.23 (3.125% of $229791.20). At this point, I hardly think it's worthwhile to debate this issue with the FAA. The City has erred, and I can think of few defenses to present to the FAA. The best we can do now is to try to prevent this from happening again. The problem here seems to be that the City does not have a single individual responsible for a particular grant. This is especially true with Airport grants. In this case, the grant application was prepared by the Airport Manager (with help, I believes from the Public Works Dept.). The Public Works Dept. supervised the work. The Finance Dept. filed grant reimbursement requests. Note that the November, 1982 letter from FAA was written to the Airport Manager, but the February, 1983 letter was written to the City Engineer. The Finance Dept. became aware of these letters on November 14, 1985 (by the FAA). A year or two ago a Councilpereon requested street lights in various areas around town including some areas on Forest Drive, Main Street Loop, etc. Council looked at the individual spots and made a decision on some of them. We J subsequently contacted HEA and had them installed. 2. An individual in VIP approached the City Council for installation of street lights especially along bus routes in the City of Kenai. Council directed the Administration to approach the Burton Carver Bus Company and ask for ideal locations for lights along the bus routes. I contacted Burton Carver and received a list of 40 locations for street lights which I mailed out to City Electric, Air Tek, and HEA. A copy of this list is attached as Attachment A. 3. 1 received a cost to install the 40 street lights and submitted a letter dated March 15, 1985 for the Council Meeting of March 20, 1985. This letter is listed as Attachment A. The letter showed a capital cost estimate for the 40 poles at $56#000 with an annual cost of $349480 per year. That letter also pointed out that we need an additional $27,440 to replace the fixtures and ballasts on the street lights in Woodland, Redoubt Terrace, and Inlet View. At this Council Meeting, the Council directed us to reevaluate the annual cost estimates to determine if the estimate I received from City Electric is correct. 4. At the next Council Meeting of April 3, 1985, Charles A. Brown submitted a letter dated March 27, 1965 which is Attachment 6. Basically, this letter states that the figures J that I showed on the March 15, 1985 letter are correct. 1W 1 i C P ' Y , 5. Recently, I have taken the list that I received from Burton Carver and have found that the following street lights can be eliminated from the list. a. Fourth and McKinley - This could possibly be deleted since there is a yard light on a pole near the intersection that appears to have been installed by the residents near that corner. d. Brown, Finance Director DATES November 25, 1985 SUBJECT: Management Letter and Report on Compliance with Federal Grants Our auditors, Peat, Marwick, Mitchell b Co., have issued the two subject reports dated August 23, 1985. They were distributed to Council at the last Council meeting. Management Letter 1) The first comment is: "AIRPORT INVESTMENT AND LAND SALE RESERVES The C ty, maintains an airport investment reserve and a land sale reserve which represent restricted fund balances in the amount of collected and uncollected principal from sales of airport and nonsirport lands, respectively. These moneys are segregated because they cannot be spent for general operating purposes. These restricted fund balances are recorded in the General Fund (land sale reserve) and the Airport Land System Fund (airport investment reserve). Generally accepted accounting principles for governmental units require that assets with principal that must remain intact be accounted for in a non -expendable trust fund rather than in the fund which initially receives the cash. We recommend that the City revise its reporting as it relates to these reserves to comply with this presentation." The amounts reserved at 6-30-85 were $2,038,975 in the General Fund, and 06,020,082 in the Airport Land System. June 30, 1985 was the first year that the reserve has appeared on the General Fund balance sheet. The reserve first appeared on the Airport Land System balance sheet on June 30, 1981. The auditors are suggesting that we pull the cash, notes receivables, and fund balances out of these two "governmental funds" and create two new "non -expendable trust funds". I think there are arguments for and against this, but the weight of the arguments seem to support the auditor's position. The drawback of this will be that the Council, citizens, and FAA will not be able to determine the amount of reserves from land sales by looking at the General Fund or Airport Land System balance sheet. Instead, they will be shown in another balance sheet near the back of the Comprehensive Annual Financial Report. 1� I intend to comply with the auditor's request, but I do not believe it will result in better financial disclosure. A P a 13 t Page 2 2) The second comment is: "ORDINANCE NUMBER 478-79 In 1979, pursuant to the aforementioned ordinance. the City made a transfer of $400,000 from the General Fund to the Water and Sewer Special Revenue Fund reserve for sewer treatment plant improvements. The ordinance provided that repayment be made out of future available revenues of the Special Revenue Fund and that such transfers for repayment are to be approved annually by the City Council. We recommend that the City review its planned die - position of amounts due the General Fund and, if transfers are expected to continue, record the liability in the f Special Revenue Fund." When the $400,000 transfer was made in 1979, the water and sewer fund had an unappropriated fund balance of $158,000. Had the liability been established in the Water and sewer Nad to repay the General Fund, the result would have been a $2420000 unappropriated deficit in the Water and Sewer Fund. Ordinance No. 478-79 was specifically drafted to avoid a deficit situation. I reviewed this with our auditors at the time. The question our current auditors are raising is the City's intention now. If we fully expect to repay the loan on schedule, then we should book the liability. The Water and Sewer fund unappropriated fund balance is $661,000. The remaining debt (principal only) is about 0301,000. Therefore, funds are available to book the liability without creating a deficit. r However, if we book the liability, we may be in violation of the City Charter, Section 6-2. This calls for all such debt from interfund I borrowing to be repaid before the end of the next fiscal year. If we intend to repay this debt, and I presume we do, then I suggest i paying it back now, rather than booking a liability. The Water and Sewer fund has the cash, and it will clean up our books somewhat. I also strongly recommend that the City avoid long-term interfund borrowing. 3) The third comment Let "RECORDING OF INTEREST INCOME All interest earned on City Inveatments is recorded in the General Fund, and interest earned on amounts in the Central Treasury for the Airport Land System Special Revenue, Federal Revenue Sharing Special Revenue and Airport Terminal Enterprise Funds is transferred to those funds. The transfers are re- corded as operating transfers. We recommend that the City record the transfers as interest income in the recipient funds." r J Page 3 This is simply an issue of presentation. It does not effect cash or fund balances. The auditors are recommending that we show the interest in the related funds as "revenues" rather than "transfers in". I really don't care one way or the other. In fact, prior to 1980, the City was recording interest in a revenue classification. Although the issue six years ago dealt with a debt service fund rather than the fund types in question now, the City did in fact, based upon the management letter comment, change its presentation in 1980 in the Federal Revenue Sharing Fund from a "revenue" classification to a "transfer in" classification. (It should be pointed out that Coopers 6 Lybrand audited both our 1979 and 1980 financial statements.) I have no problem complying with the auditor's request in our 6-30-86 financial statement. Report on Compliance with Terms and Conditions of Federal Grants, Contracts and Agreements Their only comment is: "The City completed construction work in conjunction with the Airport Fencing and Equipment Grant (ADAP 46-02-0142-8) in 1984; however, the grant closeout was not submitted until July 1985." We were supposed to file a final grant form within 90 days of completion of the project. We purchased two pieces of airport equipment, and had about 068,000 of grant funds left over. It was my understanding that the Airport Manager (this was in 1983 and 1984) was negotiating with FAA to allow us to buy another piece of equipment. I recall numerous conversations with the former Airport Manger regarding this. Apparently, he was unsuccessful in getting FAA approval for another equipment item. The question iss when was the project complete? it could be when we spent the last dollar that was actually spent. Or, it could be when we finally decided that we were not going to be successful in negotiating with FAA for the additional equipment. if the former position is taken, we were late. Denali State Park Developments Vreeman said that a brochure outlining the overall Curry Ridge plan should be ready by the first week in January. Vreeman also reviewed the information that was resented on Ocotober 30, when Neal Johannsen (State) and Janet McCabe from the National Park Service were present. The cost estimates entailed $20 million for the visitor center and access and 020-$30 million for a first class 150- 200 room hotel and an overhead cable tram. The preliminary plan suggests that the first $20 million would be public money while the hotel/tram development would be private money. The plan asks for 0200,000 dollars appropriated from the state which would be matched by the NPS and used to develop RFP process and preliminary engineering study. The target date for construction is the summer of 2987. Vreeman said there would be a public review in January. Cerenzie commented that the plan lacked concrete enough guidelines to attract interest of private sector. Dinneen suggested that a committee review the private sector requirements for drafting proposals for the RFP process. Biggins, Cerenzie, Hansen, Milhollin, Dyer were named to the committee. Tindall will look into NEPA requirements and Abbott will jostle the legislators. Dinneen entertained the idea of a tour of the site in January. A motion by Hansen to support the RDC resolution of the Denali state park development passed with Tindall abstaining. The next meeting was scheduled for November 27.
