The following is a discussion of the law's major provisions. Section 1 is a general statement of findings, including the legislature's state- ment that the Kenai River is a resource of importance to the entire state. It recites a list of issues and conflicts. It further states that the river's most Important resources are its fisheries and wildlife. It concludes that a com- prehensive plan for the river and adjacent areas is ne9ded. Section 2, AS 41�.21.500 is a statement of purposes. The three purposes of the bill are to: 1. designate the river and selected state-owned uplands as a unit of the state park system; 2. protect and perpetuate the fishery and wildlife resources and habi- tat in the unit and adjacent area; and 3. manage recreational uses and development activities in the unit and adjacent area. AS 41.21.502 is the legal description. Subject to valid existing rights, it withdraws the area from the public domain and designates it for special pur- pose management as detailed in the previous section. 'This section also closes the area to mineral entry, except for oil and gas leasing. AS 41.21.504 assigns management authority to the Department of Natural Resources. It reiterates the jurisdiction of the Departments of Fish, and Game, Environmental Conservation, other state agencies, and municipalities. AS 41.21.506 requires that a comprehensive plan be prepared, in consultation with the borough, within two years of the law's effective date (June 2, 1986). It allows the planning study area to extend beyond the boundaries of the ` special management area to include other public and private lands. - The section also directs the adoption of regulations to implement the plan. The regulations must 1) designate and regulate incompatible uses, and 2) establish -1- a system for regulating sport fishing guides. The regulations cannot apply to non -state lands except with the approval by affected municipalities. AS 41.21.508 authorizes the state to acquire land adjacent to the special management area by various means. Eminent domain is specifically excluded. The state may also adjust the boundaries of the area by adding state-owned land and water. AS 41.21.510 deals with public involvement. It requires the appointment of an advisory board and discusses its composition. It directs the state. to consult with the board, other agencies, interest groups, and the public during the formulation and implementation of the plan. AS 41.21.512 authorizes the state to enter into cooperative agreements with other public agencies and private parties. AS 41.21.514 gives the state enforcement authority for the regulations adopted under this law or other applicable laws or regulations, including the authority to seek injunctions. WHEREAS, the Kenai City Council appropriated $15,000 per Resolution 84-120 to fund the referenced planning study of the Old Town area, and WHEREAS, the City of Kenai prepared and advertised a Request For Proposal pertaining to this project, and WHEREAS, the Kenai City Council identified the two most qualified consultants who submitted a formal proposal, and WHEREAS, the Kenai City Council held a work session on January 10, 1985 for the purpose of interviewing these two consultants (Kasprisin Design Group and Livingston Sloan) and discussing their proposals in greater detail, and WHEREAS, Kasprisin Design Group is the consultant best qualified to perform the requested services based upon the submitted written proposal and presentation offered to Council at the referenced work session, and i WHEREAS, Kasprisin Design Group has exhibited expertise in community planning/design projects involving small towns in i Alaska and the Pacific Northwest emphasizing redevelopment in historical and waterfront arese; committed qualified project personnel and resources to accomplish the required work tasks encompassed in the proposal; and demonstrated a knowledge of appropriate funding sources and development strategies related to the anticipated final product. OM WAGONER MAYOR i j ATTEST: Janet Whelan, City Clerk I V REQUEST FOR PROPOSAL REDEVELOPMENT PLANNING STUDY FOR KENAI ORIGINAL TOWNSITE AND EAST ADDITION CITY OF KENAI Introduction The planning study area consists of the Kenai Original Townsite and East Addition, Kenai Alaska (U.S.S. 2970 A and B and U.S.S. 3025 A do B). This is the oldest settlement area within the City and several historical sites are located within this boundary. The City of Kenai proposes to contract for the preparation of a planning study to analyze the development potential of the Old Town area. The objective of the study is to identify means by which the City can coordinate development in this area characterized by narrow rights -of -way, substandard sized lots and vacant properties. A budget of $15,000 has been established by the Kenai City Council to accomplish this project. Work Tasks A. Inventory and analysis of study area: 1. Land Use: Inventory and map existing land uses and categorize into the following classifications - single-family residential, multiple -family residential, commercial, industrial, public and vacant. All constructed and City -maintained streets are to be shown. Points of interest and landmarks also must be indicated. The existing bluff line within the study area needs to be established. 2. Land Ownership: Verify the ownership of all land parcels within the study area. Categorize by public (City, Borough, State or Federal) or private designation. B. Development plan and implementation: Formulate three alternative approaches to redevelopment within the study area. Analyze various development coordination approaches available to the City of Kenai for accomplishing such proposals. Councilmen Wise said we cannot come up with $400,000 to $500,000 to get a second floor, we will not get more money from the State. Mayor Wagoner noted the meeting to be held Jan. 3, Councilman Hall will represent the City. Councilman Ackerly suggested addressing collection of delinquent accounts, there to a substantial number. Finance Director Brown said they will be publishing delinquent accounts. He added, the Borough pays us as delinquent accounts are paid up. Councilman Wise noted, there is a provision that if you buy a business that has a delinquency, the buyer is liable for the delinquency. Finance Director Brown explained, this was discussed at length. The feeling wee that beck taxes are a debt of the business, not the individual. If it does not go with the business, the Borough cannot sue. Atty. Rogers said that is not necessarily true. Brown, Finance Director SUBJECT: Home Health Care A review of the file dealing with the $14,000 budget allocation for home health care reveals: 1) The letter dated April 4, 1984 from Peninsula Home Health Care, Inc. asks for reimbursement up to $14,300 for Kenai residents who are unable to pay. Neither the letter, nor the minutes of the April 4, 1984 Council meeting, reveal any direction as to whether the City Council intended to pay for administration or overhead costs. 2) At the April 18, 1984 Council meeting, Mayor Wagoner spoke in favor of supporting the program, indicating we could set aside $14,000 and pay out on a reimbursable basis. Again, there was no discussion concerning exactly which costs should be reimbursed. 3) My notes indicate that it was again discussed at the April 24, 1984 budget worksession. Council agreed to an allocation of $14,000 for reimbursement for Kenai residents. 4) The $14,000 was approved in the 1984-85 budget in the Legislative Department (P.9). The description was simply "Home health care -allocation". 5) It was discussed again at the November 7, 1984 Council meeting. The minutes reveal no new information with regard to reimbursement methods. b) The proposed contract was included in the January 2, 1985 Council packet. It calls for reimbursement, up to $14,000, for "charges for the services" to Kenai residents. I would interpret that to mean actual charges to the patient, whether or not it included overhead or administration. T _ Page Z On January 7, 1985, I called Allan Beiswenger, President of Peninsula Home Health Care, Inc. He informed me that their fees include administration and overhead, and that they expected that the full unpaid fees for Kenai residents would be subject to reimbursement by the City. He also said that there is little administrative or overhead costs at this time. They do not have a paid director (although they are looking for a part-time one), and the rent is donated. Major costs right now seem to include salaries for a nurse and office help, and physical therapists under contract. Other costs are for mileage, supplies, phone, etc. In summary, I find no evidence (nor do I recall) that the Council ever directed that we exclude administration and overhead from reimbursable costs. As part of the City of Kenai's concern for the welfare of all residents, whether It is having paved roads to drive on or in knowing they are being protected by a concerned police and fire department, we feel that it is part of their concern to assist the eom;nunity in staying well and having the necessary facilities to achiever this state of health and contentment. With all the other services available to its citizens, there is no place to go for extended care and until now, there has not been the option to stay at home to convalesce or in some cases, be able to stay home instead of entering the hospital or doming in for daily outpatient care. PHHC is now offering that option from its own locally owned and operated agency. We do not feel we are competing with the hospital or any other agency for business,I we are a supplement and alternative for those who prefer to remain in the comfort and security of their homes with the love and assistance of their families. It • has been proven that the rate of recovery and the quality of life improves when a patient is allowed to recover or die in his familiar surroundings. Many hospital stays can be shortened with the help of home health care. , The Municipality of Anchorage has been assisting Hone Health Care, Inc. for three years now on a diminishing grant as the agency's percentage of reimbursements itc- proves. In 1982 the Municipality supported•46% of all visits made by the agency. ` That rate is now down to 5-10%. Patients unable to pay are requested to file a financial report so payment can be made on a sliding scale. The amount provided (- for each resident of Anchorage was $3,55. If we allowed 462 of our projected visits of 928 this first year, we would need $32,016 to supplement those who could not n far services. PHHC was started in coopera- tion with the hospital in all except funding. A recent national analysis showed costs of a one month hospital stay at $6,000. Nursing Home care at $1,200 minimum and only $250 for home health care. The Directors and staff of PHHC have been encouraged by the community support and , assistance for the concept of being cared for in the home after or instead of hos- pitalization. The senior citizen population on the Kenai Peninsula over the past few years has increased. Besides the increased quality of life and health when one can recover at home with the family as a support system, the home health care has become a much preferred alternative to hospitalization or nursing home for Medicare and private insurance companies because of the large savings in reimburse i ments they have experienced with the growth of Home Health Care industry. As an example, in 1977 Blue Cross of Maryland has saved over $600,000 serving 324 people with an average of 9.6 fewer hospital inpatient days per case. This point has bee: pointed out by the hospital as a positive move so that they wouldn't feel the crun. for acute care beds. " There are many other statistics supporting the acceptance and support of home heal care as a viable alternative in extended health care to a facility that would be expensive to house patients and would also take them away from their families. We are not disputing the place for a nursing home in the Kenai-Soldotna area some tio- in the future. 10tat we feel we the residents of the Central Kenai Peninsula ap-a need now is a service that not only coordinates its care with the other health id social services in our area, but also provides a cost-efficient service to ti' c who can and cannot pay. We feel the people of our peninsula should be able to re- ceive health care when needed oven if it means with the assistance of our cities. Now many would feel more secure knowing they wouldn't have to so to Anchorage for certain care or could come home earlier if there was someone to assist them with their sick child or elderly parent at home. The petitioner, Edwin R. Lowry, has submitted a written appeal of this decision to the City A 'January 10, 1985. ovN- Per Kenai Municipal Code 14.20.290, the Kenai City Council, acting as the Board of Adjustment, is required to conduct a hearing within 30 days of appeal submittal (i.e., prior to February 9, 1985). Proposed Rezone of Lots 1&16, Blk 3, Kenai Townsite - John Williams Mr. John Williams explained that he, as a realtor has been approached by numerous persons interested in setting up their business in the vicinity of the described property and that he himself is interested J PLANNING COMMISSION January 9, 1985 Page 2 in purchasing the lots described. He has built his own realty office close by which is allowed in the present zone, and what Mr. Williams has come before the Commission for is a general opinion of rezoning the lots described from UR to CG. Mr. Williams further explained that the general development currently is tending to the CG classification. Chairman Lewis asked if this would not be a case of spot zoning or is it contiguous to the area. Mr. Williams felt that businesses already operating in the area have created enough traffic that it has apparently lost its residential character. The lots in the area are substandard for general development and in order to develop, a purchaser would have to buy several lots to meet zoning requirements for development. Commissioner Bryson stated that he is generally supportive, and that he is a part owner of one of the lots in question. The CG zoning would reflect the nature of the neighborhood. Jeff Labahn stated that the immediate obstacle would appear that since it is not located adjacent to an already existing CG would make it clearly spot zoning. The code requires that if it is not an enlarge- ment of an existing zone or if it is under one acre it would not be considered. More appropriate might be the conditional use approach, or, with the RFP approaching, wait for the overview of the entire area. The Commission reached a consensus that the entire area needed to be considered. Mr. Williams volunteered to approach the owners in the area to obtain a consensus of opinion for development. 4. PUBLIC HEARINGS a. PZ85-4s Variance for 150' Minimum Setback Requirement - Tract A-4 Sprucewood Glen SID #2 - Lowry/Partee Chairman Lewis opened the meeting to the public. Edwin Lowry, part owner of the property explained that this is one of the satelite sites that needs to be set closer to the highway to obtain maximum use of the property. The property line now is 130' from the centerline of the highway. Mr. Lowry cited businesses along Frontage Rd which are set closer than the 1501. Chairman Lewis asked if this site plan involves a change from the original concept shown the Commission, answer yes, the building is almost identically the same size but is set 20' back from the front line. By using that 20' strip, the building size will be increased. The parking layout will not be changed. Chairman Lewis read for the record, comments from Mr. Ron Malston which indicated that footings had been poured earlier in the year. Mr. Malston objected to the variance and went on to state that there J PLANNING COMMISSION J January 9, 1985 Page 3 should be a survey done before any construction is allowed to commence and hopes that the Commissions denial of this request will prompt developers and contractors to proceed more carefully in both the planning and construction phase of development. Chairman Lewis closed the public hearing and turned discussion to the Commissioners. Commissioner Smalley asked if a variance could be granted after the fact, answer from Jeff Labahn was that it should not be and the question has been before the Commission before. In this case, footings are not a completed structure which is a minor improvement and is cause for concern. A building permit has been issued by the• Inspector and while he does a footing inspection, he is not required varify the setback. The permit is issued with the setbacks required printed on it. Mr. Lowry stated that "we didn't mention there were any improvements there and certain not an after -the -fact, there is less than $800 in footings that are within the easement. It was our full intention to get a variance before we proceeded with the building otherwise, since we have the building permit, if we wanted to build and not ask your permission we would have already done that. We're here in good faith to do this, we're not talking economic distress." Jeff Labahn asked If a survey was done, and on what is the assumption based that you are into the setback, answer by using the corner stakes and taping. Addressing the three criteria, Commissioner Bryson stated that he feels there are no exceptional physical circumstances that apply to this property that would make approval of the variance appropriate. The strict applications would make hardships to the applicant, and this would not be detrimental to the public. "I think if the purpose of a variance is to approve a situation before it occurs, and this in fact has occurred. Jeff Labahn stated that basically, the developer of the property has proceeded at his own risk and the owner will have to bare the results of the decision. Commissioner Bryson, addressing item b stated, "is predicated upon the applicant having made no overt action that would have caused damage to himself and the damage that is being petition is caused by himself." Ed Lowry stated that we can't build the size of the building we want because we are bordered by the mall site. "As far as any hardship, that was done at our own risk." Commissioner Oleson asked if Mr. Lowry had an original building plan for this site before moving ahead with the mall, answer, no. "We planned the mall site to accommodate any type of building and parking. Originally, the site was to have a 4800 sq ft building. Mr. Lowry referred to other variances granted for setbacks on the Spur Highway near Wildwood Dr. Commissioner Bryson stated that while they have been granted but usually before the �r..... , .. _ s�r � _ - -- -- -- �w�wew!e r PLANNING COMMISSION r I January 9, 1985 Page 4 fact taking into account the development in the area. Jef Labahn agreed stating each variance must be considered on an individual, case by case basis. MOTIONS Commissioner Smalley moved approval of PZ85-4 granting the variance for Tract A4 Sprucewood Glen to Lowry/Partee, seconded by Commissioner Osborne. VOTE: Motion failed with Commissioners Bryson, Oleson, Osborne, and Smalley voting no; Chairman Lewis and Commissioners Zubeck voting yes. To clarify vote, Commissioner Smalley stated "that 'exceptional physical circumstances' are not met since when the land was first leased and then sold, Mr. Lowry had a building design. Things keep changing and changing, coming back, and now the building is expanded. This falls into his responsibility. Item b is not met because the unnecessary hardship is created by himself." Commissioner Oleson and Commissioner Osborne agreed, Commissioner Bryson's was on item a. b. PZ84-96 Amended: Amend Kenai Zoning Code to Establish RR1 do RS1 Zone Chairman Lewis opened comments to the public. A member of the audience stated that Mr. Rick Baldwin was on his way from Anchorage to address the item. Since there were no further comments and there were members of the public in attendance requesting a delay until Mr. Baldwin could be in attendance, Chairman Lewis called a recess. Mr. Baldwin still not in attendance, the Commission will go on with the next item and come back to W . c. PZ85-5: Rezone Richka Creek S/0 from C to RS Chairman Lewis opened the meeting to the public. Tom Boedeker, adjacent property owner came forward to request the rezoning be disapproved. "In examining the property it is quite clear that it is unsuitable for anything more than a single family residence. From previous discussion it is noted that there is no single family zone in Kenai. The lot size would be such that a 6-plex could be constructed and would be inappropriate. The builder that built my home did some damage to the bluff overlooking the ravens. Its taken nearly 2 summers to begin to rectify the damage that has been done to that slope. If you allow any kind of density your going to have damage to the slope adjacent to this property also. There is n PLANNING COMMISSION January 9, 1985 Page 5 a reason that the land is zoned conservation, it is conservation under the land use plan, and I think this Commission should look very hard at a situation before they recommend rezoning against the Land Use classification. The nature of the ravens is such that it should not be a prime development property and I think you should deny the rezone request. Father Targonsky came forward and stated that the church is a property owner in the vicinity and that they are also against the rezoning. "We don't want to see that much development, they should develop other areas, we want to see it left conservation. It would be an asset to the church, there are apartments behind the church now and it detracts from a historical landmark on the Kenai Peninsula." I Verla Jones, adjacent property owner, requests that it be disapproved. j Mrs. Jones lives on the edge of the ravens. While they did not build the house, Mrs. Jones feels it should not have been built so close. This area is used extensively by children in the neighborhood. In the summer time the whole ravene is used as a giant playground and wants to see it kept that way. Jack Sipperly, adjacent property owner would like to see the rezoning go through. There is a 25' setback from the top of the gully which would alleviate any erosion or damage to that area, we have a good conservation area and I agree we should keep it where the creek goes through. ' Alan Jones, an adjacent property owner, objects to the rezoning l stating that it is not compatible to the area and the land use plan. It would have an undesirable impact upon the adjacent property. There being no further comments, Chairman Lewis brought discussion back to the Commission. Commissioner Smalley stated that when this property came up before, a �i few of the Commissioners objections were to the fact that it did not seem to be in compliance with the land use plan, that as a conservation zone there was perhaps future use for recreation, not a necessarily 10 years down the road but 15 or 20 as Kenai grows. Commissioner Bryson suggested, hypothetically the lot were rezoned to RS1, Jeff Labahn answered that assuming the lot were still City, it would be limited to no more than a duplex. Commissioner Smalley stated that, after listening to the general consensus of the speakers, they have voiced concern over the density, the numbers of buildings, and so on, it would appear that an RS1 would be appropriate if it should ever come about. PLANNING COMMISSION January 9, 1985 Page 6 Tom Baedeker stated that at the present time the lot is one lot but its size would allow it to be subdivided into several lots, each of which could support a duplex or more. Jeff Labahn answered that due to configuration it probably couldn't be subdivided down to more than 2 lots. Tom Baedeker asked if the lot was conveyed to someone else in the existing zoning classification the City would not have any control over rezoning, it would be the owner of the lot, answer yes. Council- man Wise suggested a deed restriction be filed with the plat stating that it not be subdivided and/or the number of families. Chairman Lewis asked Father Targonsky if he was aware of the location of this rezoning, answer yes. Commissioner Bryson explained that the lot in question is about a half mile from the church referenced. MOTION: Commissioner Smalley moved approval of PZ65-5: rezone Lot 11A, Richka Creek S/D from C to RS with covenants limiting any subdivision of said parcel of property and limiting any construction on the property to single family or single duplex, seconded by Commissioner Zubeck. Commissioner Smalley stated that his reason for the limits would be to meet the concerns of those adjacent property owners. For the record, Commissioner Bryson stated that if we were starting from ground zero I would be opposed as I was before to the rezoning of this lot out of conservation, but the question is out of our hands. The Commission further discussed development of the property. MOTION AMENDMENTS Commissioner Bryson moved to amend the original motion to allow subdivision of the property in accordance with the RS zone but maintain the structural restrictions of the original motion, seconded by Commissioner Smalley. VOTE AMENDMENT: Motion passed unanimously. VOTE MAIN MOTION: Motion passed with Chairman Lewis and Commissioners Bryson, Oleson, Osborne, and Smalley voting yes; Commissioner Zubeck voting no. NOTE: Mr. Baldwin has returned and discussion returns to item 4-b. Mrs. Joan Buzzell came forward and asked many questions for clarification and upon some answers from the Commission, stated that she is in favor of the proposal. Raymond Rogers, a resident on Cinderella Street, states that he is in favor of the resolution with the exception of the size of the lot. Specifically the 7200 sq ft. In his area the water table is so high 10, PLANNING COMMISSION January 9, 1985 Page 7 that a lot that small would be unfeasible to build on. A 12,000 sq ft lot would still be a small lot, but would be better and suggests there be an addition to the resolution pertaining to this 12,000 sq ft size. Chairman Lewis corrected the footage to 12,500 sq ft. Mr. Rogers stated that as far as the restrictions on the number of dwellings, everyone agrees this is desirable. Jeff Labahn suggested proposed an R52 designation which would have the exact same language as R51 but instead of 12,500 sq ft with water & sewer, 7200 sq ft with water & sewer. The Commission agreed and the land manager will amend the resolution. Mr. Rick Baldwin came forward and complimented the Commission on the work that was done on the resolution. Mr. Baldwin agreed with the suggestion of adding the third designation of RS2. Chairman Lewis stated that the Commission is in agreement with his original concept. MOTIONS Commissioner Smalley moved "approval of PZ84-96 Amendeds Amending the Kenai Zoning Code to provide for 1 & 2 family residential areas consisting of an RR1, RS1, and RS2, with the RS2 district spelled out as: minimum lot area 7200 sq ft with public water and/or sewer 20,000 sq. ft. limited to single family or duplex; minimum yard front of 25ft, side 5ft, rear 20ft, the lot width of 60 ft, maximum lot coverage of 30%, maximum height 35ft", seconded by Commissioner Oleson. Conditional Use Permit Extension for Day Care - Sheeran Candace Sheeran came forward and explained that she is requesting the extension due to impending funding from the state legislature, the time of which is indefinite. Ms. Sheeran stated that the present location is no problem, she could remain at this location indefinitly. VOTE: Motion passed unanimously. Ms. Sheeran pointed out that one of the conditions discussed originally was that she fence the back yard for the kids to play outdoors. At the present time there is no fence, however, the kids do not play outdoors. b. Community Center Committee Resolution 84-2 The Community Center Committee asked that two resolutions be passed on to the Planning Commission, 84-1 and 84-2. 1401ION: Commissioner Smalley moved to recommend that the Planning Commission supports both resolutions of the Community Center Committee, seconded by Commissioner Osborne. Landscape Ordinance/Review Committee Jeff Labahn explained that some issues need to be resolved before moving ahead. The issues are outlined in his memo as I through IV. The Commission discussed each issue adding one more and set a work session to be held with the Council at their convenience. A suggestion has been made for a committee which would review not only landscaping but site plans. 7. NEW BUSINESS a. Lease Applications Tracts B-1 6 B-2, CIIAP S/D #4 - Retail Mall - John W. Howard Jeff Labahn explained that the lease had expired and the code requires that in order to retain the lease, the applicant needs to go through the same application procedures. Nothing has changed on the application and site plan except the schedule for construction and completion. MOTIONs Commissioner Bryson moved approval of the lease application as described with the inclusion of landscaping details, seconded by Commissioner Oleson. VOTE: Motion passed unanimously. c. Vacation of 66' ROW on south boundary of Toveson S/D - Luebke, Haberthur., Toveson It was noted that the street names were wrong, Davidson Drive should be to the west of the lots and the present Davidson should be Highbush. Concurrently, no part of the Davidson Drive ROW be vacated. The purpose of the vacation is to allow for more efficient development of the properties adjacent. The Commission recognized that a access to the beach would be lost and felt a 10' public access be created in the portion that would be Westward Street to provide the public pedestrian access. A Commissioner needs to be appointed or volunteer for the selection committee which deals with the comprehensive plan project. This subject is now being considered by the state, borough, cities, advisory board, and other participants. Definition of the study area will help determine the scope and extent of the plan's recommendations. The study area issue is the subject of this newsletter. Language of the iav establishing the Kenai River Special Management Area is discussed. Some of the m �zderstandings and misconceptions surrounding this issue are identified. Legislative intent. The statute concerning the comprehensive plan, AS 41.21.506, is quite specific. It says, in part: "Within two years from the effective date of -this Act, the commissioner shall develop and adopt a comprehensive management plan for the Kenai River Special Management Area in consultation with the Kenai Peninsula Borough. The plan may include the land adjacent to the (special management area) whether the land is owned by the state or privately owned and may include other land considered appropriate by the commissioner and the Kenai Peninsula Borough." Discussion, clarification. There is a distinction between the boundaries of the special management area and the boundaries of the planning project. The special management area is state-owned and -managed. The plan will cover the boundaries of the special management area. The question then becomes whether the plan considers other areas outside the special management area. The law.allows the state and the borough to jointly draw the planning area to include lands and waters beyond the special management area boundaries. This provision was included because the river and its resources are affected by land use and development activities outside the ordinary high water mark. Three important points should be understood. First, areas outside the special management area should only be included in the plan if they affect the river, its habitat values, and its public u­.values. Second, an area's inclusion in the planning study area does not necessarily mean ac.utional regulations will be imposed on it. Third, the Division of Parks and Outdoor Recreation has no regulatory authority outside the special management area. Any plan recommendations concerning private lands could only be implemented by the borough or cities. Brighton, -City Manager FROM: Keith Kornelis, Director of Public Works RE: Resolution No. 85-05 I am sorry, but I gave you some incorrect information at last night's Council Meeting concerning the old Sander Unit we are replacing. The old sander's gas engine went out about seven years ago. I incorrectly said that the sander's body was the only problem, and the gas engine was OK. Because of problems with the gas engine when it went out, power to run the sander was switched over to running off the truck's PTO. We have found that solution to be even worse. Because of these reasons and because of constantly having to return to fill a gas tank, our Master Mechanic and Street Foreman recommend using the diesel engine, which is what we specified. Public Works also feels that a diesel engine would last two or three times longer than the gas engine and be much more economical to run. The diesel engine would run directly off the truck fuel tank thus eliminating having to constantly fill a small gas tank and encouraging fuel contamination. We have been sanding our streets almost every day, all day and sometimes all night. Our street crew and mechanics are familiar with our equipment, their problems, and the likely solutions to these problems. They work with the equipment daily. Our Street Foreman and our Master Mechanic have been with the City of Kenai working on and with our equipment for close to ten years. Because of their first-hand knowledge, I seek out and respect their recommendations. I am sorry that I did not have more information last night about the problems we had with the old gas engine instead of merely their and my recommendation. I have ordered the sanding unit with the gas engine as directed by Council. We really need this new unit with the weather we are having this year and do appreciate Council appropriating the money for it. Divided by 7 months, (the Construction Contract time) makes 6 monthly payments of $985.00 and one at $990.00. It is becoming more and more apparent that due to construction procedures to date; and to the quality of some of the subcontractors work, the project will require more than one weekly job site visit on which we based our fee. To elaborate; i Procedures: The Contractor has been working Saturdays and Sundays on work requiring observation e.g. backfill, concrete, masonry, grouting and paving. Quality of Work: The masonry subcontractor has repeated errors we had previously reported; e.g. improper grouting methods etc. He needs to be watched! Sanding took place during that day although itn offeetiveness was minimized since the parking lot was full. On'January 2, conditions were excellents however, on January 8, after light rain on January 7-8. the pave- ment surface at CPGH was treacherous throughout the day. Is it necessary that, because we live in Alaska, wo subject our citizens to probable physical harm and possible death because we do not Band even the Most critical of parking surfaces? Aro we so rugged that we need exppage ourselves to this? Nonsense. ��e have plenty of sand and truaka. The coat is moderate. The'oper- ation simple. The consequences obvious. Let me acknowledge that, my wire is employed at the hospital and my daughter attends K Beach Elementary. reason enough, for'sure, to cause my concern. But it hardly stopa here. During the afternoon of January 8, I witnessed a mother with newborn in arms trying to negotiate hospital ice. How many infanta were so carried that day and other like days? How many elderly had to make that walk? How many ill? And the problem is not, ,just with the hospital for it exists state wide. It is time we do something. A copy of this letter is being sent to our local, mayors and our representatives in Juneau. I propose ordinances requiring, at a minimum, tho sanding of parking areas at hospitals, nursing homes, day care centers and ecbools as quickly as icing conditions are apparent, it in hoped that a majority of this community agrees and will oupport such legislation. From a practical standpoint, lawsuitn will be fewer.. The humanitarian aspect, however. 1A what. counts. It is imp000lble to sand everywhere at once.
