Since our not -to -exceed price for the entire project is $18,500 lower than those selected (see attached cost breakdown), we think you should look into this matter prior to voting your approval. We attended your meeting on February 69 and it seemed that project funding was a concern on nearly all subjects discussed. As Mayor Wagoner indicated, the State is asking for budget cuts. Aside from the purely economic aspects, we would like to comment on some of the objections we heard from the city regarding our firm. They are listed here and elaborated on below. OceanTeoh is not a local firm. e The City doesn't want more engineering firms coming into the area. e All work will be done in Anchorage and not available for city review. A We only bid on the entire job and not each project separately. OceanTech is not a local firms As stated in our proposal, our firm has a great deal of oil related experience in the Kenai area, dating back to 1958. Operating under the name of F.M. Lindsey and Associates, we performed the location surveys for almost all of the oil platforms and associated pipelines in Cook Inlet. We provided the route survey and location for the Nikiski to Anchorage pipeline and we have performed maintenance monitoring surveys on the Cook Inlet pipelines continuously from 1965 to 1985. Our recent engineering work in the area includes the structural inspection and report on the Kenai Chevron Refinery dock and the design of a 2000 horsepower booster pump station at the Tesoro Alaska Refinery. Since before January, 1985, we have been doing work in the Kenai/Soldotna area for local development with Mr. John 2502 West Northern Lights Blvd. /Anchorage, Alaska 99503 / Telephone 907 / 248.3888 / Telex 26.485 . I OPMEnTech Gensel as our local representative (see attached price sheet _ as documentation). We have done a number of jobs for Alex Kime of Soldotna Realty, (see attached letter), specifl- callys o As -built survey for Mike Bezilla property o Re -subdivision of TR-A, Gibbons Subdivision on Mackey Lake Road o Engineering for a DEC Approval o Preliminary work on a 40 acre subdivision Currently, we are working on a boundary survey for Scott McKernan on Poppy Lane in the college area. We also have verbal commitments to do a number of as -built surveys this summer for a local building contractor. To date, all work has been done by local hire of permanent Kenai/Soldotna residents. It is also interesting to note that of the nine firms responding to the RFP, six of them have offices in Anchorage. This also includes the two firms chosen by the Public Works department. The City doesn't want more engineering firms Doming into the areas What this says is that local firms don't want any oompe- tition! Without elaboration on the free enterprise system, you can see by reviewing the bids that some competition may well be warranted in these times of declining revenues. In spite of this, we intend to work and establish our pros - once in the area permanently. We have an option to lease a part of the Kime Building and expect to have our office fully operational as soon as our telephone is installed by Glacier State. We have upcoming local development work and are strong contenders to obtain some of the gas compression design work on the Cook Inlet Platforms. We also feel that a local presence will strengthen our position with Tesoro Refinery. We think that our firm will provide a unique benefit to potential clients since we can provide civil, structural, mechanical and electrical disciplines all in house. All work will be done in Anchorage and not available for City re- views Our proposal states that our entire field survey crew consists of local residents and will be managed by Mr. John Gensel, a local resident since 1954. We have decided to hire a draftsman locally For our work and have placed an advertisement in the Peninsula Clarion. If 80% of the drafting is accomplished locally and the rest of the manpower allocation is factored Prom the chart in our proposal, over 75% of the work will be accomplished in your area. The plans will always be available at the Kime Building, and we are willing to bring them to City Hall for your review. We only bid on the entire Job and not each proJeot separately: We have a page in our RFP showing a detailed cost breakdown for each of the five jobs in the road areas. Since we gave a price for each job, our intent was to accept any or all of the work. In conclusion, we feel that our proposal should be given serious consideration by the City Council members. A close review, particularly of our manpower and cost charts will show that we put a lot of thought and effort into our estimate (based on our firm's 27 years of Alaskan experience) and we have presented you with a viable, cost-effective proposal. M5 December 27, 1984 TOs Engineering Firms Subjects Request for Engineering Proposals - January, 1985 Qentlemens The City of Kenai is seeking Engineering Proposals for the design projects entitleds 1. Marathon Road Relocation 2. Robin, Kenaitze, Eagle Rock, Sandpiper, Tern, S. Strawberry 3. Cook Inlet View Drive and Lilac 4. S. Spruce Street S. Juiissen, Basin View, Ames, Barabara Interested firms are asked to submit eight (8) copies of their proposal. Specific information would as a minimum includes specialized experience, individual work assignments, project approach, project scope, project schedule, and not -to -exceed figures. All projects may be included in one proposal package with specific information for each project. Also include a separate cost figure for project construction management, inspection, and surveying (if available with your firm), to be used for budget purposes and possible future negotiation to provide these services. This part of the proposal may influence the selection of engineer for design services. A copy of each firm's proposal will go to each of the City of Kenai's Council Members with the remaining copy retained by the City Administration, The Public Works Committee, comprised of four Council Members, may meet to discuss the proposals. The Public works Committee may evaluate the proposals and make a . If recommendation to the Council as a whole. The Public works Administration will also make a recommendation. The firm will be chosen by a resolution passed by the complete Council. DEADLINE FOR SUBNITTING PROPOSALS The deadline for submitting proposals is January 29, 1965, at 5 p.m. local time. Please submit your proposals in a sealed envelope marked in the left-hand corner with "Engineering, January, 1955." All of the engineering proposals will remain in their sealed envelopes until this time. Even though this is not a bid proposal but a proposal for professional services, we want to keep all the firms on an equal basis and prevent any influence that a proposal may have on others if opened earlier. PROPOSAL CONTENT include information for each of the following items organized in a logical, clear way, in order for the Public works Committee to make a proper evaluation. 1. The firm's specialized experience in the type of work required. Include a record of the firm in accomplishing work on other similar projects in the required time. 2. List the qualifications and experience of the individuals who are going to actually perform the work on this project, include the complete resumes of the individuals that your firm is going to assign to the project if awarded. 3. Give the geographical location or locations where the work on this project will be performed. Also include information to (... indicate your firm's knowledge of our local situation. 4. Give an explanation of how your firm will approach this project and how this project would fit into your firm's list of priorities in your current workload. . 5. Give your firm's proposed work schedule showing major items to be accomplished and dates you plan on accomplishing them. Give a manpower allocation to each work task for each project. 6. Give the rates at which your firm proposes to do the work with a not -to -exceed figure for the project as a whole with a breakdown to show the expense and effort needed for each work task to show how the total figure was arrived at. The city is responsible for all ground maintenance which is handled through the City Shop and the City Buildings and Grounds Department. The cemetery like all parks throughout the city is also included in the City Beautification Program. This involves the planting and upkeep of the flower beds scattered throughout the cemetery. APPLICABILITY OF REGULATIONS These regulations apply to every person utilizing the facilities of the Valdez Memorial Park, all mortuaries, organizations of any type and visitors. Plants, Shrubs, Trees, Turf, Landscaging & Improvements No trees, shrubbery, plants or turf shall be planted, trans- planted, plucked, picked, or pruned within the Valdez Memorial Park without the written consent -of the Parks & Recreation Director or his authorized representative. The Director or his authorized representative shall have the authority to accomplish any of the above operations upon any lot when he may deem it necessary or advisable. The City of Valdez, shall provides grass cutting at reasonable intervals, raking, clean- ing, grading, and landscaping. 2. Permanent Obstructions on Burial Lot Prohibited No enclosure of any kind, such as a fence, coping, hedge, " or ditch shall be permitted around or about any grave or burial lot and no burial lot shall be raised above the established grade. If any monument or other structure, or any inscription be placed in or upon any lot which shall be determined by the Parks and Recreation Director to be offensive, improper, or injurious to the appearance to the surrounding lots or grounds, he shall I f have the right to enter upon such a lot and cause the removal of said offensive or improper object or objects. 3. Movable Obstructions on Burial Lot Wooden benches, boxes, shelves, toys and other articles upon a grave or burial lot shall not be permitted, being inconsis- tent with the concept of a memorial park and with the modern concept and usage in cemeteries. Temporary decorations are } permitted during religious, national and state holidays. r . 4. Construction, Repairs or Hauling No material shall be allowed to remain in the Valdez Memorial Park longer than is reasonably necessary for any construction i work. No work shall be started on Saturday if it cannot be completed on the same day. No heavy hauling will be permitted in wet weather. There will be no construction or maintenance performed on Sundays or holidays. "• 5. Maintenance of Cemetery ! ' The City o Valdez is responsible for the appearance of the Valdez Memorial Park. Roads and Driveways The City of Valdez shall maintain the driveways, gates and fencinq of the Valdez Memorial Park and may close such access facilities in periods of adverse conditions. 7. Grave Preparation All openings, closing, plot preparation, interments, dis- interments, and removals shall be made by the city. 8. Green S ace Buffer To ma nta n the character of the park, the city shall maintain a two hundred (200) foot green space buffer around the perimeter. ARTICLE #_2- USE OF GRAVES 1. Individual Grave Markers a.)Types Suitable grave markers set in concrete base shall be used in the Valdez Memorial Park. b.)Installations All .foundations for grave markers shall be installed at the head of the grave by and at the expense of the subject party. c.)No more than one grave markep per lot shall be allowed. 2. Interment or Disinterment a. Not ce to the Director shall be given a minimum of 24 hours in advance for the preparation of a grave whenever an interment or disinterment is to be made. b.)The Director shall be provided with the appropriate State burial and transit permits before interment will be permitted. c.)The burial lots can be used for no other purpose than interment. d.)No interment, disinterment or reinterment shall be made on a Sunday, except in emergency situations and unless approved by the Director. e.)Interment or disinterment shall be made by the City of Valdez in compliance with all State and City Health and Sanitation Laws. f.)No more than two infant coffins may be placed in a single five foot by ten foot burial lot. 3. Reservation Permits A reservation of burial space in the Valdez Memorial Park is limited to those persons having a relative already buried in the Park. The reserved siface assigned may be adjacent to that relative's grave. A person may, upon showing good cause and exceptional circumstances, be issued a reservation in another location upon approval of the Parks and Recreation Director. The Cemetery grounds are sacred, devoted to the interment of the dead, and it is incumbent on all visitors to conduct themselves with becoming propriety. 4. Casual visitors to the cemetery who are not members of a funeral procession are directed not to -intrude upon a funeral service or to loiter about an open grave. ARTICLE #4 ADMINISTRATION 1. The Parks and Recreation Director and his or her design- ated representative shall. enforce all cemetery regulations and ordinances and shall exclude from the cemetery any person violating them. He or his designated representative shall have immediate supervision and control of the conduct of funeral traffic, employees and visitors. 2. The Director shall maintain necessary records, files, and maps as required by the state, to protect the health and welfare of the community and to ensure continuity in operation. ARTICLE #5 OPENING AND CLOSING TIMES I. No person shall enter the Valdez Memorial Park except through the established access routes. The cemetery will be open daily from 6:00 a.m. to 10:00 p.m. during the months g of May through October. During the months of November through April the park will be open for burials only. ' ARTICLE #6 SPEED LIMIT AND TRAPPIC IN THE CEMETERY 1. Seed Limit. Vehicles shall not be operated in the Valdez Memor al Park at speed greater than five (5) miles per hour. 2. Motor Vehicle Parking Prohibited. Vehicles shall not park or come to a full stop in front of an open grave unless such vehicle is used by persons attending the funeral service using said grave. Vehicle parking is restricted to roadways only. 3. Pedestrians. All persons within the Valdez Memorial Park shall refrain from traversing on the graves by using only avenues, walks, alleys and roads. Damages incurred directly or collaterally and caused by or resulting from the elements,.an act of God, the common enemy, thieves, vandals, malicious mischief, strikers, explosions, unavoidable accidents, invasions, insurrections, riots, or order of any military or civil authority shall be excluded from the City of Valdez's responsibility. ARTICLE A 8 SPECIFIED RIGHTS RETAINED BY THE CITY OF VALDEZ 1. The City of Valdez reserves the right at any time to en- large# reduce, replat or change the boundaries or grading of the city tracts in the Valdez Memorial Park or any part there- of; to modify or change location of or move or regrade roads, drives or walks or any part thereof; to lay, maintain and operate or alter or change pipelines or gutters or sprinkling systems, drainage or otherwise. Prior written notice to tract holders will be given by the city, should such work in- fringe upon the holders of tracts. 2. The City of Valdez reserves for itself the perpetual rigi}t to ingress and egress over all plots for the purpose of main- tenance operations or any emergency work necessary to the operation of the Valdez Memorial Park. 3.
