Transfer of Funds Under $19000.00. 1 0' CITY OF KENAI %0d Cals" 4 4" WORUM KENAI, AUM SMI TELEPNONBM.7" MEMORANDUM TO: Keith Kornelis, Public Works ppDirector FROM: Jack LaShot, City Engineer 1�1Y DATE: November 19, 1986 U/ SUBJECT: KULA RENTALS - CLAIM OF EXTRA WORK KULA Rentals, who was hired to install a 4" sewer service to the Woodcock residence on East Aliak Street, has billed the City an additional $1,499.63, which I returned as unjustified. The original P.O. was in the amount of $6,427.00 and the City furnished all materials. This amount was a lump sum price for installation of the service line from the main to the property line, and not a lineal foot quote, although we may have estimated a distance. Service lines are typically installed in this manner, as the time and energy expended is proportional to the difficulty of the tie-in, working around other utilities, working in the water table, replacing the street, etc. This project took all or portions of four days to complete. The contractor had hoped to do the job in two days. Due to not adequately dewatering before attempting the tie-in, the contractor also had to call in more men and Bill Zubeck's large backhoe to help. At no time prior to these problems did the contractor mention being displeased about any discrepancy in the amount of pipe installed. The actual installation of this pipe was after the tie-in problem and could not have taken more than one hour to complete. He is attempting to charge the City $107.12/foot for this distance. Other points worthy of note are: 1. The purchase order was approved by the City Council on 9-17-86. The contractor finally arranged for the necessary bonding, insurance, and licenses in order to start on 11-7-86. During a normal freeze up the job would not have gotten started. L p V . K. Due to the problems the contractor was having while making the feet tie-in, the City allowed him to come straight up three j a out of the main line to help get above the water. This type of installation is normally not allowed. 3. We allowed the contractor to work through the weekend which is normally not allowed. Clyde Johnson and I were there most of the time to provide inspection and assistance. 4. The City provided the pipe, saddle, plug, post, barricadesp hauled gravel to patch the street and bladed it smooth. We 'I provided more than our share to complete the job. 5. 1 understand the contractor is unhappy because he did not receive payment quick enough. I told him that the finance department usually mails checks at the end of the week. Last week, due to Municipal league, I did not realize that checks would not be mailed until Monday. His check was mailed 7 days after completion of the project which would probably be considered timely by any standards. WHEREAS, the City Attorney is occasionally absent from the City due to personal leave or municipal business; and, WHEREAS, the City Council desires that effective legal representation be available both at Council Meetings and for regular working hours during the attorney's absences; and WHEREAS, no specific provision currently exists for designating an Acting City Attorney; and, WHEREAS, the City has in the past had, presently has, and may have in the future, a Legal Assistant who is a member of the „ Alaska State Bar and familiar with City of Kenai municipal issues I�) and litigation who could act as City Attorney. Loper, Planning Specialist SUBJECT: Ordinance 1171-86 - Amend Off -Road Operations of Motor Vehicles DATE: October 30, 1986 The Beautification Committee has long been aware of a growing problem in Kenai and the surrounding areas of damage, and in some cases destruction of both public and private property surfaces caused by off -road vehicles. The Committee has discussed the problem at length and offer the attached proposed amendment for your consideration as a possible solution to the problem. The committee is aware of the ordinance that was amended by the City of Soldotna last year with apparent success. As the ordinance now reads, off -road vehicles are allowed along rights -of -way unless posted. In order to restrict vehicles from ROW's, it would be necessary to post all ROW's with several signs. According to Parks Director Kayo McGillivray, signs have been posted in parks and along bike trails with no success. The signs are knocked down, ignored, or removed. Plus the fact that ROW's would become a forest of signs should this method be used. The Committee feels that to accomplish a successful goal of eliminating the vehicles from the ROW's for safety of the riders, pedestrians, and motorists who are put into a position of avoiding a careless rider, and in order for the private property owners and public lands to be restored, this method would best serve the public interests and perhaps be the easiest for the police department to enforce. As this proposed amendment is not a part of the Zoning Code, it is not necessary to appear before the Planning Commission prior to Council consideration, however, they have been made aware of the proposed amendment. DATE: August 25, 1986 This last summer problems were encountered enforcing the off road vehicle ordinance in city parks. The primary problem was that there was { lack of notice that off road vehicle use was prohibited. .. .'� As we discussed it would be helpful if this prohibition was part of the established park rules posted at the entrance of municipal park. If Beaver Creek park is also an area where off road vehicles are to be prohibited the main entrances there should also be posted. FROM: Richard Ross, Chief of Police AIX— SUBJECr: Off Road Operations of Motor Vehicles Re: Ordinance 1171-86 DATE: October 30, 1986 I am in concurrence with the intent of the proposed ordinance 1171-86 as an attempt to regulate off -road vehicle usage so as to protect improved road right of ways. Attached is a proposed revision to KMC 13.40.020(a) that incorporates this change proposed by the Beautification Committee, and clearly states that off -road operations are prohibited upon improved right of ways. in 1981 we researched the possibility of a total ban on off -road vehicle usage in road right of ways. Attached is a copy of a legal opinion received when I inquired concerning a municipal ordinance prohibiting this conduct which is clearly allowed in 13AA 02.455 of state regulations. while it may not be possible to totally prohibit such operations, the attempt by the Beautification Committee to restrict it away from improved right of ways would appear reasonable and appropriate. It may meet that "valid" though "inconsistent" test referred to in the 1981 legal opinion. Off -road vehicle usage in outlying areas of the city where there is no development, and the right of ways are not improved• would not be changed by the attached proposed revision. As the right of ways became improved they would fall under the ordinance without further revision. If the ordinance is changed we will have new brochures printed up for distribution by the schools and officers. Media coverage of the changes will also be requested. Second Reading: November 19, 1986 Effective Date: January 1, 1987 Approved by Finance: Cq/j n. 11/10/86 111 1 i : Administration Suggested by , CITY OF KENAI ORDINANCE NO. 1174-86 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING KENAI MUNICIPAL CODE 16.20.020 TO CONFORM WITH CURRENT STATE STATUTORY REQUIREMENTS REGARDING FORECLOSURE OF ASSESSMENT LIENS. w WHEREAS, the present KMC 16.20.020 provides that liens upon properties may be enforced as provided in AS 29.53.200 through AS 29.53.390; and, WHEREAS, those statutes have been repealed and are no longer operative. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that KMC 16.20.020 shall be amended as follows: 16.20.020 Foreclosure of Assessment Liens: Assessments are liens upon the property assessed and are prior and paramount to all liens except municipal tax liens. They may be enforced as provided in Alaska Statutes, ESECTION 29.53.200 THROUGH SECTION 29.53.3901 Section 29.45.290 through Section 29.45.500. Upon default in a payment due on an assessment district financed by general obligation bonds, the City Council may enforce payment of principal and interest, and cost of collection in a civil action in the same manner and with the some effect as actions for the foreclosures of mortgages on real property. Foreclosure shall be against all property on which assessments are in default. The period of redemption shall be the same as in the case of mortgage foreclosures on real property. Monies received from actions taken against property for non-payment of assessment shall be credited to 1 41 the Sinking Fund. Upon default in a payment due on an assessment district financed by special assessment bonds, a bond holder or the City Council may also enforce payment of principal and interest and costa of collection in a civil action as herein above outlined. Item No. 40.07(1) : Additional Width to Asphalt Concrete Driveway ' Approaches. 1 -- The Summary of Approaches on sheet #9 of the drawings was incomplete and inaccurate. During' construction, extra width of driveway was added to some approaches in order to match what was existing before the project began. Existing approaches that were not listed in the summary also had to be added to the project. The wording of the a Contract Documents and the method of measurement for this work did not allow flexibility in changes to the widths of driveways or the addition of new approaches. Payment was based on a per each unit price for the width specified in the summary. Based on the contract documents, it was determined that extra compensation was warranted for added extra width of driveway. Extra width was calculated as follows: For driveways listed in the summary, the extra width consisted of that (L area over and above the'area called for on the Drawings. Flor driveways not listed in the summary, the extra width was calculated by comparing the average width of the driveways listed in the summary to the constructed width. Any width (times the length) over and above the average width was considered extra area. Negotiation with the Contractor established a unit price of $1.65/square foot For extra width to approaches. A total of 5282 extra square feet was constructed. The above work was done to satisfy residents' needs. Item No. 60.04(2) s Adjust Fire Hydrant, 6" Increments. A pay item for extension of fire hydrants was not included in the contract documents nor was the contractor required to install extensions to fire hydrants as an incidental item of work. One hydrant on the project required a two foot extension to raise it to the proper level. A price of $350.00/six inch increment was negotiated with the contractor based on bid tabs of previous work. Item No. 70.07 s Remove adsting Manhole. ! - - — -- - ------ Abandoned sanitary sewer manholes located on Cook Inlet View Drive were shown incorrectly on the drawings. Three manholes shown at an offset of 24' right of centerline actually fell in the right curb line (at about 19' right) and conflicted with construction of the proposed; curb and gutter. It was necessary to resolve this conflict immediately to avoid a potential claim for delay. A price of $1000.00/manhole was negotiated with the contractor to remove the cone sections of each manhole, grout the sewer pipe closed and fill the remaining barrel section with type III back fill and compact. t. is .. _ •� 3 # 01 a. . Page 5 of 6 Item No. 70.08 : Adjust Mainline Valve Box to Finish Grade. 'there was no price established for this work on this project. Three valve boxes required adjustment to finish grade. One of these was not shown on the drawings but occurred in the paved right lane of Lilac Lane. The remaining two valve boxes were shown outside of paved areas, therefore no adjustment was anticipated. The actual location of these valve boxes was in the left curb line of Cook Inlet View Drive and in the radius of the strip paving for Illiamna Road. Due to the relocation of Illiamna Road, these two valve boxes required adjustment two different times. A price of $250.00/adjustment was negotiated with the contractor for each adjustment made. Item No. 1(A) : Grade Change in Storm Sewer on Lilac Lane. During the installation of the storm sewer on Lilac Lane, a conflict was encountered with an existing water main which perpendicularly crossed the alignment of the proposed storm sewer. If installed at the grades shown on the drawings, the storm sewer would intersect the water main directly at the center of the pipe. New grades for the storm sewer had to be field calculated/designed in order to resolve this conflict. The Special Provisions of the specifications clearly exclude main lines from the utilities conflict payment item. Based on the forgoing and the fact that the conflict was not shown on the drawings, we recommend that payment be made for this item. Item No. 2(A) : Force Account Work : Raise Sewer Service. During the installation of the storm sewer on Lilac Lane, a conflict was encountered with an existing residental sewer service which perpendicularly crossed the alignment of the storm sewer. To resolve this conflict, the contractor had to raise the sewer service well beyond the right-of-way line. This work was accomplished as directed by City personnel. This work was done by force account. This change order reflects the equipment and labor, according to our records, that was required to perform this work. - Item No. 3 (A) : Force Account Work : Relocate I•lliamna Road. The location of the Illiamna Road right-of-way was not shown in the correct location on the drawings. This error was identified after the road was approximately 90% constructed. As a result, 66 if of curb and gutter had to be removed and replaced with valley gutter. The location of the strip paving for Illiamna Road was moved so that it is directly across the intersection from Lilac Lane. This involved additional unusable excavation and backf ill of type III and type I materials. Extra grading to insure positive drainage from adjacent properties was also involved. This work was the result of an error on the drawings and resulted in additional mobilization costs and inefficicy on the part of the Contractor. This work was done by force account. The change order reflects the equipment, labor and materials that was required to perform this work according to our records. 114 L L Item No. CA) : Adjustment to Contract Quantities. This work has been completed and we recommend that the project be accepted by the City and final payment be made to the Contractor. The enclosed final estimate and change order delineate the final project cost. The narrative included as an attachment to the change order explains the individual items that are included in the change order. As in previous projects, this final change order adjusts the final contract amount to match the total amount of payments (ok total amount earned). This verifies that the Contractor accepts the final payment and acknowledges that the final contract amount is as shown on the final payment and on the final change order. The final change order includes extra costs as discussed with you on previous occasions. It is our opinion that the items that are shown on the change order are fair to the Contractor and in conformance with the project documents. We were able to settle all of the disputed L L M items in favor of the city. As of this date, the Contractor has not submitted the final payment documentation to be eligible for final payment. Neither the city administra- tor nor any councilman shall sell or barter anything to the city, tt or make any contract with the city, or purchase anything from the city other than those things which the city offers generally to the public (as for example, utility services), and then only on the same terms as are offered to the public, unless an invitation to submit sealed bids is published, and the city accepts the ' .r sealed bid which is most advantageous to the city; provided that the council by ordinance may authorise such sales, contracts, or • purchases involving a consideration of not more than $500 in value, to be made without such bids at prices or rates prevailing in the community and without favoritism or discrimination. Any such officer violating this section, upon conviction thereof, shall thereby forfeit his office. Any violation of this section, with the knowledge, express or implied, of the person or corporation contracting with the city, shall render the contract voidable by the city administrator or the council. I have discussed this with the Acting City Attorney and conclude that: 1) An ordinance allowing purchases of up to $500 from Councilmembers does not exist. It may be desirable, however. 2) The prohibition from purchasing from Councilmembers also includes business and corporations owned by Councilmembers. I feel confident that this includes any business in which a Councilmember has a substantial (to the business, not to the Councilmember) ownership interest. For instance, 10% ownership is a substantial portion of a business. One thousand shares of IBM is not a substantial portion of that corporation, even though it may be of greater monetary worth to the Councilmember than the 10% interest described in the preceding paragraph. Therefore, the City doesn't have to stop buying IBM equipment because a Councilmember happens to own shares of that publicly held corporation. 3) The prohibition does not seem to extend to a Councilmember's spouse. The City maintains approximately 50 individual funds and account groups which are to be included in the scope of the audit of the records maintained by the City: 1 General Fund 8 Special Revenue 3 Debt Service 25 Capital Projects 7 Special Assessment 1 Enterprise 2 Nonexpendable Trust 1 Agency 1 Long Term Debt Group of Accounts 1 Fixed Asset Group of Accounts The auditor will express an opinion on the combined, combining, individual fund, and account group financial statements. The auditor is also expected to perform auditing procedures on the Combined Schedules, Schedule of Federal Grant Activity, and Schedule of State Grant Activity, and express an opinion in relation to the combined financial statements. The auditor will perform a Federal single Audit in accordance with the Single Audit Act of 1984, OMB Circular A-128, and other documents relevant to federal single audits. L The City expects the scope of the auditor's reports and opinions to be similar to those issued on pages 15 and 16 of the City's June 30, 1986 Comprehensive Annual Financial Report (CAFR), and those issued by Peat, Man -rick, Mitchell and Co. in the Federal and State Single Audit Reports, Year Ended June 30, 1986. Copies of these two documents are enclosed to give you a clear understanding of the scope of the engagement. The City's cognizant federal agency is the U.S. Department of Trans- portation, and the auditor will work with that agency during and subsequent to the audit to satisfy federal requirements. In light of the compliance and internal control reporting required by sinqle audits, the City will not require a management letter. However. the auditor may issue a management letter if he or she desires. The CAFR is prepared, tvped, and printed by the City. In preparation for the audit, the City will prepare working trial balances of all funds, detail workpapers on all significant balance sheet and revenue accounts, detail workpapers on significant (non -personnel related) expenditure accounts, and other schedules and workpapers as requested by the auditor. The City will prepare and type all confirmations at the auditor's direction. The City will assist the auditor as necessary during the audit by locatinq documentation at the auditor's request. Dear Mr. Horwaths �• The Eagles Club in the City of Kenai is making arrangements to _1 extend the municipal water system to their building in Thompson Park. Mr. Tommy Thompson, representing the Eagles Club, talked to Cho City Council and received assurances that the City would �- consider doing the engineering design work for this water line extension. Unfortunately, because of the design time, review -time, bidding time, etc. the water line can not be completed before freeze up* `f The City of Kenai is requesting that ADEC lend a helping hand in this situation by allowing the Eagles Club to open their kitchen s facility now using their existing well. It is our understanding that the water quality meets or exceeds all ADEC requirements and - that the separation distance between the well/septic system is the only problem (since opening the new kitchen would change the - requirements from the existing conditions). - s If the City of Kenai can be of any assistance, please do not hesitate to call me. Mayor Williams thanked Chairman Johnson and the !. Council on Aging and expressed his wish to be involved in the Council and will be kept informed through the representative of the City Council in attendance. F _ _ 1 1 KENAI MAYOR'S COUNCIL ON AGING ..,:. November 10, 1986 ' Mayor Williams also informed the Council on Aging of the major work session on the 26th of this month. Concerning vacancies, he has four names that have been .. nominated from the City Council. They area Pat Mueller, Patricia Partee, Dorothy Lee and Fiolfila Wilson. Pat Mueller was stricken, as she is an employee. it was asked if the Mayor had any information regarding funding on the Congregate Housing. Mayor Williams said that he has talked with Senator Fisher and will be in touch with the Legislature on that when he's in Juneau. The Mayor indicated the City I is ready with the land if funding from the State is K available. This would more or less be a pilot program for the State if it were to be funded. Congregate Housing vs Pioneer Home concept was :. discussed. Pioneer Home includes more advanced care and I the Congregate Housing will be more of Senior Citizen type housing where most Seniors are able to take care ;. of themselves, however, there would be someone there all the time. Director Porter of the Senior Citizens Center explained �'. it's individual living, but it's also congregate a; living, like a type of hotel living. `f 4. COMMITTEE REPORTS V _{ _.... a. Director Porter reminded the Council on -- - -- ------ Aging of the Bazaar that will be held on Friday and Saturday after Thanksgiving at the Kenai High School. Wood Shop. _ - Director Porter indicated that they had an instructor, Ms. Bickey, a retired school teacher, come and that there was very little interest in the Wood Shop Class. `r About four ladies were interested and now there are only two showing interest. Director Porter spoke with -' - - --- Tom Brown and he has some very positive ideas for " improving the shop where people might use it more. - Tom Brown said that the machines could be rearranged and better positioned. Be indicated the machines need f to be anchored better so as to avoid the vibrations for a better and safer use. Clarence Ladd said that he is very much concerned about the wood shop and would like to see it continued. Also, he suggested that a committee be formed. He said there « was also a shortage of tools. Tom Brown suggested creating more interest in wood shop { and having someone who is familiar with a wood shop to take care of machines. Betty Warren asked if we had a list of tools that were needed and if the tools were marked with the Center's name. Director Porter suggested a check out system for tools. Discussion was held regarding the number of people adjusting machines for their own use makes the machines ". seem out of line. A person in charge of adjusting machines would help to alleviate this problem. Contact with the Clarion "Familiar Faces" to create -�' more interest and make people more aware of the Wood Shop was discussed. Director Porter said she would - - - -"- contact a reporter for some P.R. i- Clarence Ladd suggested the Wood Shop could be used for s: repairs at the Center, for instance the car port and other needed repairs from time to time. Petition on bulletin board. _ The petition was left on the board for approximately one month. On one side was a sign list for people who wanted the brush cut, and the other side for people who wanted the brush left natural. There were thirty-nine _n. (39) people who wanted the brush left natural and no one signed to have it cut. The consensus is to leave it ... g. Day Care Guidelines. Director of Day Care brought over guidelinesy and, some members of the Council went over them with her and approved the guidelines. This was for day to day operations of the Day Care Center, taking clients grievances and problems ' they may have. The Director has done a very good job. S. NEW BUSINESS a. North Road Pick Ups. President Johnson addressed this to Director Porter. Director Porter was not sure how to generate more interest in the North _. Road area. Currently, the Center is bringing in three (3) people per week. Kasilof has been no problem at all, good participation in that area. The van consistently goes out to the North Road area, (to the end), and calls are made to each individual consistently. Director Porter just wanted to bring the problem to the attention of the Council. Friendly Visitor visits quite often and all avenues have been tried to generate interest and ascertain the reason for so little participation in North Road area. President Johnson also asked if anything was heard about the van. Director Porter said, no, they're turning in all the necessary paperwork. Should hear something soon. - t b. Foundations. Director Porter sent for handbook -=-�— - z from Texas on Federal Funding sources for our Senior - - -- -- --- - -- -- `. Citizens Programs. The program that Chuguach has set up F f was discussed. President Johnson asked Mr. Jackson if he would serve on a committee to set up a foundation, and he said that he is willing to do this. Handbook has forms, plans and procedures. President Johnson asked - for volunteers for this project. The motion was seconded. The motion carried by unanimous consent. 6. PUBLIC COMMENT a. Clarence Ladd. Comment was made regarding agenda. Clarence noted that he felt there was poor communication. President Johnson asked Clarence to continue, that she and all the Council were willing to listen. Director Porter thought that Clarence wanted to discuss Board Appointments. Betty Warren moved to give Clarence five or ten minutes or whatever time he needed (motion lost in discussion), At this time Clarence continued his comments. Clarence Ladd would like to see more men on the board. He also commented on the yard lights being turned off at the Center. He felt the lights should be on. He felt he wasn't heard on several items such as the work shop. He noted that the drive way approach should be put on the agenda and brought to the attention of the City Council. He suggested a gravel path to Front Street so that people could walk. Also, the parking space was too small and too far from the building. b. Tom BrosIn. Tom Brown was interested in knowing how the Board Members were chosen. President Johnson replied that a notice was posted on the bulletin board for the last three months (approximately), asking people to indicate there interest. The list of people then goes to the Mayor and then they are appointed and approved by the City Council. M I i Id I Mr. Brown stated his qualifications and indicated his interest. He would like to pick up a form and a copy of the By -Laws to consider this further. - ---- ---- Clarence Ladd asked who was being replaced and when -- -- - - -- ---- - terms expired. Is this Mayor going to change the By -Laws? President Johnson stated that they attended a work shop ^^ two years ago to set up certain standards, to be 3 a. uniform and to establish the By -Laws. There will be no changes in the By -Laws. 3 Director Porter stated that a By -Law may be changed, but had to go before the City Council for approval. t President Johnson asked for any further discussion. :.
