Thin r©queet comes in light of a recent offer he hoe made to the City Manager regarding a release of Lot A-2A, Sprucewood Glen Subdivision, No. g for a payment of $1109969.00. As you note in your memo, "It seems like he owes more." Indeed, Mr. Lowry does owe more then a simple default for Tract A. In fact, he is in default on three oeparste parcels and the City hoe Initiated defaults and sales of all three of these proportion. On Tract F, he le currently over :9,000 in orrsarsl on Tract A. as he ouggeoto, he is cl000 to $409000 in erreara; and on Tract 6 d C, he is over $29,000 in orreare. In hie letter, Mr. Lowry montions only Tract A and suggests that If the City accepts hie release proposal, then (and the inference leg,only then) will he bring the errearege on that parcel currentsr. Lowry's intentions ea to the other parcels are quite unclear. be ouggoeto that by getting the $110,000 for the release and the $409000 in orreare, that the City will "net" some $190,000. At moot, it could be said thgt the City would net $110,000 because the $40,00D is already in arrears. This Is money due and owing the City now. To do otherwise impedes our efforts in the litigation and could result in further looses to the City. To allow Mr. Lowr- to release Lot A-2A of the Sprucewood Glen Subdivlsion, No. S while he to this for in arrears, sonde a clear message to the other people in tho'community that it Is perfectly acceptable to buy land from the City of Kenai, make only sporadic payments*, and then a year later, when you are in arrears, sell off a parcel to some outside intorost, bring everything current, and reap the benefit at the City'C expense. Mr. Lowry's euggeotion is clearly unaeceptabla to the Legal Department. I under- stand that the agency is seeking city funding to open an office in Homer and to cover citizens who have no insurance. This suggests to me a commitment to our area and a desire to provide consistent, timely follow-up to our requests for service. It would seem a highly worthwhile use for city funds, as a service to Homer residents in need. It is a source of not only satisfaction but comfort to have a -' available that bridges the gap between the expense of inpatient hospital care and no treatment at all, except what the patient can achieve on his own or when he can sporatically find his way Into the outpatient clinic. - I have been pleased with the scope of services available to the outpatients through home health care and think it would be a significant loss to the community if such services could not be continued.
