RESOLUTION NO. 88-64
A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA INITIATING A
SPECIAL ASSESSMENT IMPROVEMENT PROPOSAL FOR ROAD PAVING ON CANDLELIGHT
DRIVE, LINWOOD LANE, KAKNU WAY, KIANA LANE, BAKER STREET, AND LAWTON
DRIVE.
WHEREAS, the City intends to pave roads in the above -mentioned project
and desires to make an assessment against benefited real properties
adjacent to the project, and
WHEREAS, the Council directs that assessments shall be at 50% of actual
costs, with the assessed portion financed by the General Fund Capital
Improvement Reserve, and
WHEREAS, according to KMC 16.10.130, a future Council will set payment
terms after completion of the project; however, this Council intends
that property owners will be offered a selection of payment terms, such
as:
1) immediate lump -sum payment with no interest,
2) a ten-year payment schedule with interest, or
3) a lien against the property which would be due with interest
upon transfer or sale of the benefited property.
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA, that in accordance with KMC 16.05.040, a special assessment
improvement proposal for road paving on Candlelight Drive, Linwood
Lane, Kaknu Way, Kiana Lane, Baker Street and Lawton Drive is hereby
initiated, and that the City Manager is directed to investigate and
report on said proposal.
PASSED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA this 27th day of
July, 1988.

RE: Report Regarding Assessment Proposals for
Candlelight/Linwood and E. Aliak/Highbush
This report is prepared in accordance with RMC 16.10.010, and is
In anticipation of Council's adoption of the two resolutions
Initiating assessment districts for paving in the
Candlelight/Linwood area and East Aliak/Highbush area.
Preliminary assessment rolls have been prepared for each proposed
district. Lots proposed to be assessed are designated oy lot,
block and subdivision, as well as by parcel number.
CANDLELIGHT/ TNWOOD AREA
The proposal is to strip pave Candlelight Drive and Linwood Lane
between the Spur Highway and Lawton Drive, Lawton Drive between
Candlelight Drive and Tinker Lane, Raknu Way between Baker Street
and Tinker Lane, Riana Lane between Baker Street and Candlelight
Drive, and Baker Street between Kaknu Way and Riana Lane.
Total cost of the project is estimated at $673,000. The paving
Cost is estimated at $503,500.
EAST ALIAURIG BUSH
The proposal is to strip pave East Aliak Drive between Swires
Road and the Spur Highway, and Highbush Lane from the Spur
Highway south to its end (three government lots south of East
Aliak Drive).
Paving cost is estimated at $292,000 which is also the _total
project -cost.
CO ENDATION
The Administration supports the scope of the projects and agrees
with the need for paving these roads for the following reasons:
1. on every public opinion poll conducted by the City of Kenai,
road improvements rated number one as the most desireable
needed improvements within the city of Kenai.
Z. over the past three years in the area under consideration
for paving, there has been a substantial increase in
residential housing which has created more traffic
congestion in the area.
3. DEC now prohibits the oiling (used oil) of gravel roads
which has been a method used for many years to keep the dust
settled on gravel roads.
4. The area under consideration has the heaviest travelled
gravel roads inside the city of Kenai.
5. With the addition of Mountain View Elementary School and the
18-hole golf course in the area under consideration,
substantial increases in traffic have been generated by
these entities.
6. City Hall receives more complaints from the citizenry about
the lack of dust control on gravel roads than any other
single complaint during the year.
Based upon public discussion, the Administration believes that
the only way these jobs will be completed is if assessment
districts are formed, therefore the administration recommends a
50% assessment on the paving portion of the jobs. Grant monies
are available for unassessed portions and the general fund
capital improvement reserve is available for the assessed
portion.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA INCREASING
ESTIMATED REVENUES AND APPROPRIATIONS BY $673,000, IN THE CANDLELIGHT/
LINWOOD DRIVE 1988 STREET CAPITAL PROJECT.
WHEREAS, the City has designed road improvements in the Candlelight/
Linwood Drive area, and
WHEREAS, the City intends to assess the property owners at a rate of

Dear Kenai City Council Members,
We, as residents of 104 Linwood Lane for the past 18 years (in a log home
at the end of Linwood and now a new home at the corner of Linwood and
Lawton), want to inform you that we are audibly opposed to the assessments
for paving of those areas. We, along with many, feel we have more than
paid our dues and deserve the same luxeries you enjoy without assessments.
For 17 years, we have had to contend with City and contractor's trucks
"boiling dust" on Linwood, hauling sand from the City Sand Pit and
traveling at high rates of speed. Many of'these trucks were hauling by
the load, so te faster they sped# the more loads and more money they
made.
For many years, we have had to walk, on a city maintenance road), to Katnu
Way during breakup because CITY Sand Trucks broke down what road we had
left. Most of this occurecrhefore there was a Lawton Drive and a Kenai
City Golf Cdurse. Now we have Lawton Drive and a golf course. Instead
of boiling dust" on Linwood from sand trucks, —we have boiling dust on
Linwood and Lawton from vehicles, again traveling at a Prom
iggh.- speed going
to and ErVmm the golf course, and students going to and r the high school.
We cannot grow our gardens, our flowers ere dying, our throats are sore,
our new home is dusty, our log home has always been dusty, and will all
of these past and present happeining, have never complained. This is
beyond complaint., it'd downright anger. Eno`ugFis enough!
It's time you called fair•"Fair", not only for the certain "elite"
- subdivisions or "fair" to certain large property owners or large businesses,
but fair to ALL who have paid their dues.

TO: Assembly members and Mayor Williams:
My name is Charles Woodcock who resides at 1902 E. Aliak Drive,
Kenai, AK.
Progress is one of my main concerns. Going to Soldotna or
Anchorage to shop takes away a lot of revenue for Kenai. We want
to keep businesses and shoppers in our area.
Many new houses have been built off the Aliak, Highbush, Candle-
light, and Linwood roads. None of these have been paved. Please use
the money all ready available to pave these roads without assessment.
Aliak Drive is a main route for vehicles and much dust is created
as cars travel the road to and from homes and to the new Mountain View
School.
In 1986 my real property taxes were $462.53, in 1987 $545.35, and
in 1988 $484.00. This is an average of $484.00 per year. I am not
getting free paving.
Assessment is not necessary because the money is all ready there.
No one is getting something for nothing. The paving is not free.
Please vote no to assessing property owners for more money. Please
pave our roads with money all ready in hand and without further assess-
ments.

Dear Kenai City Council Members,
Mrs. Bailie, Mrs. Monfor, Mrs. Swarner, & Mr. Measless in
regards to planned assessments for paving of the Linwood area:
I have lived on Linwood Lane for 18 years, 14 of thosg with my
parents. After marriage, buying property at 112 Linwood and residing
there for the remaining 4 years to date.
We have seen many changes over the past 18 years, walking over
200 yards from our driveway to our parked cars during breakup. Before,
having dust from a golf course, (that we did not ask for), the city
sand trucks would haul sand, going as fast as they could, for days in
a row, causing huge holes and unbearable dust. Through all this, we
never complained about how bad the'roads were. Although we don't
mind the golf course, we do mind the tremendous increase in traffic.
We feel that since it is on city ouned land and paving is going to be done#
it should be paid for by the city.
Many other subdivisions and areas around the city have had their
streets paved at no charge. We are curious•as to why ours is considered
as "extra benefits". •We did not ask for the golf courses nor to have
pavement. If the city decides it should be paved then it is their
responsibility. If the city does not feel it is worth providing the
funds, then we do not want the street paved.
We urge you to please_ vote against the assessment of this area. ,
