In our inventory of Mental Health Lands which the state has conveyed to third
parties, it came to our attention that a land exchange, ADL 29326, between the
city and the state is still incomplete. The City of Kenai received lands from
the state under the terms of an exchange agreement, but the State of Alaska
has never received lands in return from the City of Kenai.
A letter dated August 19, 1965, from the City Manager of Kenai to the Alaska
Division of Lands suggested a land exchange between the City of Kenai and the
state as a possible method of acquiring lands for park purposes. The lands
the city desired had been acquired by the state under the Mental Health
Enabling Act.
On October 14, 19659 the state informed the City Manager that if an exchange
of lands was to take place, it would be on an equal value exchange basis. it
appears the City of Kenai accepted such an exchange. On January 18, 19669 the
mental health lands involved in the exchange were appraised at3,000. On
May 18, 1967 an adjustment was made to this appraisal to delete a 5 acre
parcel to be used as an armory site. The adjusted value was $40 835.00 for
the remaining 81.67 acres. A hand written note from the Kenai City Manager
dated June 16, 19679 pleads for evidence of title to the desired lands so
Kenai could proceed with a planned park development. On June 199 19679 State
Patent No. 523 was issued to the City of Kenai for approximately 86.79 ♦/.
acres which included the armory site. The armory site was later conveyed back
to the state under OSL 624. The cover letter attached to the patent reminds
the city that they will be required to convey lands of equal value to the
State of Alaska to replace the lands removed from the mental health trust.
This exchange was never completed and the mental health trust has never been
reimbursed as promised -by the City -of Kenai. During the course -of the past
twenty years the state has been deprived the benefit of replacement lands or
any appreciation of those lands. Resolution of this matter is urgent because
of our responsibility to the mental health trust.

The state requests that the City of Kenai nominate several tracts of land as
potential replacement lands. Those nominations would then be presented to the
Interim Mental Health Trust Commission for acceptance. The state then would
specify lands which would be equal in value to $409835 in 1966 dollars and
when conveyed to the state for reinstatement to the mental health trust, would
fulfill the city's obligation to complete the exchange.

Municipal Park
This park actually has two areas of heavy use. The camper park
off Forest Drive has two restroome, twenty-eight camper stalls,
nineteen picnic tables, nine camp stoves, nine cooking pits and
two hydrant outlets for water access. There is oleo a large
shelter house in the area with a look -out point to Cook Inlet
nearby. A playground area just off the entry has been installed.
There are climbing etructurso, (metal and wooden) a merry-go-
round, teeter -totter, and riding animals.
This playground is used early in the summer and also late but
when the park is full, people in the area are reluctant to let
their children go to the area to play. The park has housed some
basic undesirables in the past. Trash and garbage are a major
problem in the summer, but with the new ordinance enacted this
year this should improve somewhat.
On the other side of the ravine and still in "Municipal Park" are
the ball fields. In 1979 there were two Little League fields and
one regulation (Old Oiler Park) field. All three were in great
need of maintenance. All the old wooden fences were removed,
except for the outfield on the regulation field, and replaced i
with chain link. The backstops have been repaired and much work
has gone into improving the infields. We have also added another
Little League field that has greatly reduced the weer and tear on
existing fields. New bleachers have been added and the old
wooden ones removed. The concession stand was renovated last
year and needed improvements were made to that building. There
is still some bleacher and press box work to be done.

As I indicated in our telephone conversation today, the Fish and Wildlife
Service is interested in an exchange with the City of Kenai of the former
refuge headquarters property for the area known as the Kenai River Flats.
If you have a similar interest in pursuing this matter, I suggest that as a
first step you or the Kenai City Manager write a letter to the Realty Division
of the Fish and Wildlife Service in Anchorage stating your interest. I have
been in contact with Mr. Ben Lukas of that office, and he would welcome the
opportunity to meet with you at your convenience to discuss this issue and
bring you up to date on the actions that have already taken place. After an
Initial informational meeting, involvement of the City Council would seem to
be the appropriate subsequent action.

City of Kenai in this matter.
