This contrast, executed on the day of,
1985, constitutes written documenlatlon of t or employment
agreement previously negotiated end agreed t on the evening of
May 7, 1985 between the City of Kenai, acting by and through the
Kenai City Council, all of whom were present, and Timothy J.
Rogers, for the position of City Attorney during the three fiscal
year* beginning July 1, 1905, July 1, 1986 and July 1, 1987 at an
annual salary of $80,000.00.
The compensation during the three-year term Get forth immediately
above shall be paid according to the City of Kenai's regular
schedule of salary dispereement and shell be in addition to all
benefits regularly given to mangement personnel employed by the
City of Kenai as well as any benefits, prerequisites, or
additional compensation or benefits which Timothy J. Rogers has
enjoyed to date, and which it to agreed he shall continue to
enjoy, in his position as City Attorney.
It to specifically understood and agreed that this contract is
subject to all terms and conditions of the Kenai Municipal Code
and the Charter of the City of Kenai its existing on the date
hereof.
In addition, it is agreed that the City Attorney shall be
allocated one Kenai Municipal Airport airplane transient parking
space as designated from time to time by the Airport Manager for
his sole use and benefit for the duration of the aforementioned
term.

The parties agree that upon discharge or at the conclusion of the
term of this contract, whichever comes first, the City shall pay
a Gum equal to three months compensation within ten days of such
event. Severance pay shell not be paid should the attorney
remain in continuous employment of the City beyond the term of
this contract.
Timothy J. Rogers agrees to continue carrying out all dutlea
required of the City Attorney for the City of Kenai, and further
agrees that in the event he should voluntarily discontinue his
employment an City Attorney during the term hereof, he shall
first give sixty (60) days prior notice but shell not be denied
any entitlement that may be provided under the laws of the City
of Kenai, federal government, or the State of Alaska as a result
of such voluntary discontinuance.

Subject: Request for 90-day delay in Assessment Foreclosures
A request was made at the 4/20/88 Council meeting for a 90-day delay
in the assessment foreclosure proceedings that have recently been
published in the Clarion.
As our attorney has indicated, if we delay foreclosure on some
parcels, we probably should delay on all parcels, then start over with
the procedure in 90 days.
I agree with Council that there are positive aspects of working with
the debtors. However, you've heard all of the positive aspects
already; I'll only deal with the negatives.
1) Foreclosure is the only effective tool at our option to force
payment of assessments. If word gets out that the City is not serious
about foreclosure, then I can only suspect that future collections
will be more difficult.
2) It cost the City about $2,000 (not counting City salaries) to
take the foreclosure proceedings this far. If we do it again, figure
another $2,000. That cost is added to the redemption price, or the
minimum bid price if we sell the parcels. Therefore, starting over
will penalize those owners who have not requested a delay because it
will increase their redemption price. Alternatively, if we sell the
lots, the higher minimum bid price will make the lots harder to
market.

RE: Special Assessment Foreclosures
In response to numerous questions from the Council regarding
procedures and rights of redemption as to realty which is the
subject of the special assessment foreclosure, I have prepared
the following which should answer most asked and anticipated
questions.
Special assessments are liens second only to municipal tax liens,
AS 29.46.080, which are collected pursuant to AS 29.45.320-470.
Initially, a petition for judgment and a certified copy of the
foreclosure list is filed with the Superior Court and must
contain the information dictated by AS 29.45.330:
a. List of interested parties in alphabetical order.
b. Last known -owner.
c. Property description for assessment roil purposes.
d. Years and amounts of delinquencies.
e. Penalty and interest due.
f. A statement that the list is available for public
inspection at "the Clerk's office" (the statute does
not specify whether it is the Court Clerk's office or
the City Clerk's office).
g. A statement that the list has been presented to
Superior Court with a petition for judgment and decree.
--The next step is to publish this foreclosure list -once -a -week for -
four (4) consecutive weeks in a newspaper of local circulation.

Within ten days of the first publication, as set for in the
above -paragraph, notice is sent by certified mail to the last
known address of the owner. This notice is a copy of the
foreclosure list which advises the owner that the foreclosure
list and the petition for judgment have been filed in the Court.
The notice also must describe the property and list the amount
due.
Thirty (30) days after the last publication .of the foreclosure
list, if there have been no sufficient objections, a motion is
filed for judgment and a decree. This proposed judgment shall
provide a blank to be filled in by the Court showing the date
that the judgment and decree of foreclosure is signed.
Next there is a waiting period during which properties may be
redeemed for one year and ten days from the date written by -the
Court in the judgment decree and foreclosure list. Thus, this
one year and ten day period marks the anniversary of the judgment
and decree by the Court. A redemption period expiration notice
is then published in the newspaper of local circulation pursuant
to A8 49.45.220 which notice should contain:
a. Date of redemption.
b. Date of expiration of the redemption period which date
will be thirty (30) days after the first publication of
redemption period expiration notice.
c. A warning that all properties sold under the judgment
and decree, unless redeemed, shall be deeded to the
municipality immediately upon expiration of the
redemption period and that every right of interest that
a person has in the property will be forever forfeited
to the municipality.
Within five (5) days of the first publication of the notice of
expiration and redemption period, a copy of the notice published
in the paper is mailed, certified return receipt, to each record
owner and all holders of mortgages or other liens of record on
the property.
After the expiration of the redemption period (thirty days after
the first publication of the notice of redemption period
expiration), a request for a Clerk's Deed is filed with the
Court.
Upon receipt of the Clerk's Deed, it is recorded and a
calendaring notice and internal calendaring notice is made that
in two (2) years, these properties are to be sold. The two-year
waiting period prior to sale insures that challenges to the sale
by former record owners are completely barred.

Two (a) years from the filing of the Clerk's Deed, an ordinance
is prepared declaring that the properties are needed for a public
purpose. The properties' legal description should be set out in
the ordinance. Further, the legal description should be
published four (4) times in the paper of local circulation along
With a notice of the ordinance hearing listing the properties by
legal description with the former owner's name.
The City Clerk then mails, within five (5) days of the first
publication, a copy of the notice of publication of the ordinance
to the former record owners as they appear on the assessment
roil.
Subsequent to the publication described above and enactment of
the ordinance, the properties may be sold. However, the record
owner has the right to repurchase prior to the effective date of
the ordinance.
All property acquired by a municipality pursuant to a special
assessment foreclosure, should be sold for cash. No terms!

records and had all permanent records of Council and
