Craig Legal Secretary/Deputy Clerk DATE: December 12, 1990 RE: Tom Rohn - Agenda/December 19th Mr. Rohn visited City Hall today to express a complaint about the "Weekly Advisor" publication being thrown onto private driveways. He has an auger -type snow thrower which he uses to clear driveways by throwing snow onto the private property or yard area. The auger gets jammed with the newspapers that are buried in the snow and cannot be seen. He wants the Council to pass an ordinance which requires newspaper publications to be placed in boxes and restricted from being thrown in driveways. This is causing him loss of income because it takes several hours to remove the papers from his machine. Besides the damage to his equipment, he knows there are many people who don't even want those papers delivered to their homes and littering their property. He has already spoken to someone at the Clarion and they told him they have the legal right to throw the papers in the driveways. Upon approval of the application by the Department, a permit will be Issued for that calendar year. Activities may be conducted only after a permit has been Issued. The activity or activities authorized under the permit may be conducted during the entire calendar year unless the permit Is suspended or revoked by the Department. ELIGIBILITY REQUIREMENTS Only municipalities and qualifled organizations as defined in AS 05.15.210(28) and 15 AAC 105.010-.020, are eligible for a permit. To qualify, an organization must meet all of the following requirements: 1. It must be a bona fide civic or service organization or a bona fide religious, charitable, fraternal, labor, political, or educational organiza- tion, police orire department and company dog mushers' association, outboard motor association, or fishing derby or nonprofit trade associa- tion In Alaska. The organization may be a firm, corporation, company, association, or partnership. 2. The organization must operate without profit to Its members. This means that no private shareholder or individual may benefit from any part of the net earnings of the organization except as provided by law. (A certificate or letter of tax exemption Issued by the Internal Revenue Service Is evidence that the organization operates without profit to Its members.) 3. The organization must have been in existence continuously for a period of three years immediately before applying for a permit. This duration requirement must be met by the local organization. The number of years of existence of an affiliated or associated organization cannot be counted for this purpose. 4. The organization must have at least 25 Alaska members. DEDICATION OF NET PROCEEDS Charitable projects which an organization may sponsor Include education grants, training assistance or job counseling, food baskets, medical or health- care assistance, charitable functions and dinners for the community, eta Authorized uses Include promoting the welfare and well-being of the member- ship of the organization within Its own community. This means that a member may receive assistance In the form of various charitable donations which have been approved by the organizations board of directors. The qualifica- tions to receive the charitable donations must Include a requirement that all members of the organization within the community may qualify and receive the assistance. Authorized uses do not Include organizational par- ties, dinners, benefits, picnics, or social functions limited to members and their families. Dedicated net proceeds given to another qualified organization may not be used to pay any person for services rendered In connection with the activities from which the funds were derived. Permlttees may not erect, buy or lease buildings or land for their organiza- tion with the net proceeds unless these buildings are: (1) used exclusively for educational, civic, public, or religious purposes (such as hospitals, churches, schools, government buildings, or community centers); or (2) turned over to an appropriate nonprofit organization which qualifies as a tax-exempt organization under the Internal Revenue Code, Sec- tion 501(C)(3), or to a local, state or federal government. Detailed records of all disbursements must be kept for later audit review. These must be kept with the other accounting records for a period of three years. EXPENSES Only bona fide, reasonably necessary expenses may be Incurred or paid In connection with the operation of a permitted activity. This Includes the cost of goods, wares, merchandise, and personal services required to operate the activity. Personal services Include those performed by an employee of the permlttee, or by licensed operator hired by the permittee. Compensation to the operator may not be related to the receipts from the activity (AS 05.15.160). For specific Information about authorized expenses that may be deducted, see Form 08.4046 Annual Financial Statement, Schedule C - Game Related Expenses. ANNUAL STATEMENT AND ADDITIONAL FEE A statement accounting for all money generated from authorized games of chance and contests of skill for the year must be flied by March 151ollow- ing the end of the calendar year. The permittee shall also file with the finan- cial statement a copy of the forms required by the IRS for every person who received prizes, awards or money of $600 or more during the calendar year. If the gross receipts from the gaming activities were $20,000 or more, an ad- ditional fee of one percent of the net proceeds must be paid at the time of filing the annual financial statement (AS 05.15.020(b) and AS 05.15.080(b)). PENALTIES (AS 0515.200) A person who knowingly violates, or aids or solicits a person to violate, the laws governing games of chance and contests of skill, Is guilty of a viola- tion for the first offense. If convicted, that person may be fined up to $300. For the second and each subsequent offense, the person Is guilty of a class B misdemeanor. If convicted, that person may be fined up to $1,000, or sentenced to up to 90 days In jail, or both. A person who, with the Intent to mislead a public servant In the performance of the public servant's duty, submits a false statement In an application for a permit, Is guilty of unsworn falsification, a class A misdemeanor. It con- victed, that person may be fined up to $5,000, or sentenced to up to a year In jail, or both. Net proceeds from gaming activities must be dedicated within one year to the awarding of prizes, and to political, educational, civic, public, charitable, patriotic or religious uses In Alaska (AS 05.15.150). GAMES OF CHANCE AND CONTESTS OF SKILL PERMIT APPLICATION CHECKLIST This checklist is designed to help you make sure that the application is complete and all required documentation is submitted. Each number below corresponds with the numbers on the application. You should read the entire application and instructions before completing it to ensure that you under- stand what is required. 1. Therefore, Ordinance No. 1406-90 has been prepared for introduction at the November 21, 1990 City Council meeting. A public hearing is scheduled for December 5, and the effective date, if passed, will be January 5, 1991. Mr. Arness is the adjoining landowner of the referenced property and has requested to purchase the property. Attached are maps of the area. KMC 22.05.075 Property Sale to Adiacent Owners states: The Council may approve, by resolution, after public notice and an opportunity for public hearing, the sale and conveyance of a parcel of City property at its appraised value to the owner of the adjacent land whenever, in the judgment of the City Council, the parcel of land is of such small size, shape, or location that it could not be put to practical use by any other party and, in addition thereto, where there is no foreseeable need of the land for any future use by the City. Mr. Arness submitted an appraisal which has been reviewed by an appraiser the City selected. The review appraiser concurred in the value of $10,000. It is estimated the usable portion of the 1.063 acre site at 4,000 to 5,000 square feet. The site has no physical access, although the Spruce Street Road right-of-way is platted along the northwest corner. There are no public utilities. The property is zoned Conservation. There was no public comment. Councilwoman Monfor said for the $113 difference, she would like to keep this in Kenai. Police Chief Ross explained, he made the recommendation on the basis of low bid. 8e noted. neither bidder can guarantee cost because of now car costs. It may be back before Council. Councilman wise noted the word "substantially conforms." The memo says neither bid meets specs. Atty. Rogers explained, the defects have been waived by Public works. Be added. if Council is going to bid other than bid specs as low bid. he advised they throw out and re -bid without those they intend to delete. It would be better served to give preference in initiating the bid specs. Councilman Ackerly said if the price will be different in 6 months, we could throw out the bids and do later. Atty. Rogers explained the appropriation is for the amount of the bid. City Manager Brighton added, Administration is trying to L commit the funds in the 86-87 budget, which will expire June 30. If Council awards this, the money will be cassitted. If the figures come in different, they were not responsive anyway. Administration did not want to put the money in the new budget for cars. ROLL CALL Present: Joanna Hollier, Sam Huddleston, Elmer Seay, Fiocla Wilson, Francis Meeks, Georgetta Funk Absent: Roy Moore Also Present: Councilmember Linda Swarner, Kenai Senior Director Pat Porter, Fred Chambers of Heritage Place and interested senior citizens 2. APPROVAL OF MINUTES A motion was made by Sam Huddleston and seconded by Georgette Funk to approve the minutes of the last meeting. The motion was passed by unanimous consent. 3. OLD BUSINESS a) Congregate Housing Design Committee Sylvia Johnson was asked to report on the Congregate Housing Design Committee. The City has signed the contract with the architectural firm, Livingston Sloan, and at the last congregate housing meeting, the architects and the engineer met and discussed a checklist of basics. The committee members toured Chuda House to get some ideas on how that building was constructed. Sylvia explained that an additional $1,000,000 was going to have to be requested for the building project or else the size of the building would have to be reduced. The extra money is needed because of increased fuel costs. The square foot cost of construction has increased from $125.00 per square foot to $149.00 per square foot. b) Grandma Please Program The Grandma Please Program will be starting January 7th. There will be someone to answer the phone every school day from 3:00 p.m. to 6:00 p.m. This program will be available to all grade schools in Kenai. There are enough volunteers to start this program, but more are needed for the future. c) Heritage Place Proposal Fred Chambers, President of the Heritage Homes Nursing Board, spoke to the members in regard to the letter that was discussed at the last meeting. The Senior Center has been asked to support a resolution endorsing the concept of taking people from the long term care waiting list of Pioneer Homes to receive care at Heritage Place with 100% funding from the State of Alaska. This resolution is needed to show the legislators that the Senior Center and the City of Kenai are behind the idea. There was a lengthy discussion and many questions were asked of Mr. Chambers. It was decided by the members that this resolution would be approved only if the wording were changed to show that the legislature would provide additional funding for the cost of the program and that would only be for beds being used. This way no senior programs would be cut to provide funding for this resolution. The motion was made by Sam Huddleston and seconded by Francis Meeks that this resolution be approved after Pat Porter has retyped it to add the additional wording desired. The motion was carried unanimously. Mr. Chambers will then take the resolution to the City Council for approval. d) Public Announcements Director Porter reported that it has not seemed to be working very well trying to get a different person each day to make the noon announcements. It was decided that occasionally Pat, Lynn, or senior citizens would take a turn. The Music Box will be helping Director Porter with the speakers for the public address system. 4. NEW BUSINESS a) Board Vacancy The six year terms of Fiocla Wilson and Roy Moore will expire in January and two new members will need to be appointed. The committee has received applications from Pauline Gross, Paul Padilla, Jeanine Benedict, Dorothy Lee, Gordon Sledge and Gordon Leavey. After a written ballot, three names were chosen for recommendation to the Mayor for appointment. b) Community Involvement/Service Clubs Director Porter asked the committee if they supported the idea of having a senior belong to every service club as a means of community involvement. Examples were the Lions Club, the Rotary, etc. Director Porter will ask in her next newsletter which, if any, of the seniors already belong to any of these groups and this matter will be discussed at the next meeting. c) Volunteer Committee/Volunteer of the Month Three quarters of the people recently surveyed thought that the Senior Center should have a volunteer of the month. A volunteer committee would make recommendations each month for one person to be honored for the services and time that they give to the Senior Center. This matter was discussed and it will be tabled until the next meeting. 5. ADJOURNMENT There being no further business, a motion was made by Sam Huddleston and seconded by Georgetta Funk to adjourn. KENAI CITY COUNCIL MEETING MINUTES December 5, 1990 Page 2 A-4 CONSENT AGENDA Vice Mayor Measles stated that removal of H-6 (Approval of Games of Chance and Skill Application/MOOSE Lodge) from the Consent Agenda may be appropriate in order that the item be discussed. MOTION: Councilwoman Monfor MOVED to remove Item H-6, approval of Games of Chance and Skill Application for the Peninsula Moose Lodge, from the Consent Agenda. There were no objections. SO ORDERED. There were no other changes to the Consent Agenda. The Consent Agenda was APPROVED AS AMENDED. B. SCHEDULED PUBLIC COMMENT (10 Minutes) B-1. Guy Hibbert, AAA Taxi Mr. Hibbert addressed Council in regard to the letter which he and the Kenai Peninsula Cab Company had received from Clerk Freas stating that their liability insurance was not adequate as required by the Kenai Municipal Code. (Clerk Freas supplied Council with a memorandum and attachments prior to the meeting for background information. The Code requires $350,000 insurance for injury to one person, $500,000 injury to more than one person, and $100,000 property damage. Both AAA Taxi and Kenai Peninsula Cab Company have $100,000, $300,000, and $50,000 coverage.) Mr. Hibbert stated that according to the letter received from Clerk Freas, his company has not been in compliance with the Code for four years. Mr. Hibbert stated further that his insurance carrier has informed him (a copy of his insurance carrier's letter was distributed to Council) that obtaining the amount of insurance required will be difficult. Their carrier is not willing to increase the limits. They would have to seek out a new carrier. The cost will increase, which will be substantial and may put them out of business. Mr. Hibbert stated he pays $2,000 per car per year at this time. Discussion followed. Vice Mayor Measles brought to the Council's attention information provided by Attorney Graves, that the Anchorage Code requires $300,000 combined single limit for all - bodily injury or property damage and $100,000 for all persons injured or dead in any one accident caused by an uninsured KENAI CITY COUNCIL MEETING MINUTES December 5, 1990 Page 3 motorist. Anchorage's code also differentiates limits for six - and -under -person vehicles and seven -and -over -person vehicles. Councilman Smalley asked if there is a possibility that the City can investigate the insurance coverage requirements further. It may be decided that the KMC requirements for insurance for taxicabs should be amended. Attorney Graves asked if he should prepare an ordinance reflecting a change. Councilman Smalley stated that he should investigate and prepare a memorandum indicating information he has found. Councilwoman Swarner suggested the memo be mailed to Council. Mr. Hibbert stated that if Council stays with the $500,000 amount, his cost per car will increase 35%. Councilman Smalley added that he would support Attorney Graves bringing an ordinance to Council at the December 19, 1990 meeting to lower the rates to $300,000. Councilman Walker added that due to the affordability and availability, the Council should address the matter at this time in order that the taxi permits are not pulled due to non- compliance. Amending the Code will take eight weeks. Attorney Graves suggested that Council direct Clerk Freas not to take any action at this time until Council has time to investigate the matter. Mr. Hibbert asked if the Council was allowing the cab companies to operate in the City at this time with their insurance as it is? Vice Mayor Measles stated that the City will not take action (with their insurance amounts) to prevent them from operating until Council either passes an ordinance to amend the Code or tells them to get other insurance. Councilman Smalley asked if Council "looks the other way," if this would create a liability for the City. Attorney Graves stated that there is a potential. Councilman Smalley asked if an emergency enactment can be made for the eight weeks in order to make the City and taxis legal. Attorney Graves stated that he did not think that at this meeting they can make any emergency enactment because of the lack of information to make the necessary findings that an emergency exists. He stated that he can investigate whether it is necessary to declare an emergency action for the next meeting. Councilman Smalley suggested a memorandum of agreement between the City and the taxi companies citing the situation and that the City is investigating the RENAI CITY COUNCIL MEETING MINUTES December S. 1990 Page 4 possibility of a change in the policy. Also, that the City will allow the companies to operate for the next eight weeks as they are now until a decision is made. Mr. Hibbert added that he has been carrying $300,000 since 1985. Vice Mayor Measles suggested that Council direct the Clerk to send another letter to the taxi operators informing them again that their insurance coverage is not adequate according to Code and because this matter is just been brought to Council's attention and because of the time required to obtain the necessary insurance, they have sixteen weeks to come into compliance. That will give Council the eight weeks, if Council wishes to make any changes. This will not forgive the operators for being out of compliance, but will give them time to come into compliance. MOTION: - Councilwoman Monfor MOVED that the letter, as stated by Vice Mayor Measles, be executed and Councilwoman Swarner SECONDED the motion. Councilman Smalley requested UNANIMOUS CONSENT. Resolution No. 90-75 - Repealing Resolution No. 90-69 and Adopting a New City of Kenai, Alaska 1991-92 Capital Improvement Project (CIP) Priority List for Request for State Grants. MOTION: Councilwoman Swarner MOVED for approval of Substitute Resolution No. 90-75 and Councilman Smalley SECONDED the motion. There was no public comment. Councilwoman Monfor suggested that since the North Peninsula Recreation Area were not interested at this time in jointly building the ice rink, that the ice rink be moved in position to 113C" and place the Boat Ramp at position "3A." Councilwoman Swarner stated that the Congregate Housing Committee had met with the architect and engineer and they reported that their estimator has indicated that construction costs have increased to $145/s.f. Director Porter added that construction costs have increased all over the state, not just for this project. Councilman Walker stated that he understood from the letter that there are additional planning costs and that they should be a set amount. He stated that other City projects have come in on budget. Director Kornelis stated that the brochures have not yet been printed. Councilman Walker suggested that Item 2(D), Water and Sewer Improvements, be increased from $2,000,000 to $2,500,000, raising KENAI CITY COUNCIL MEETING MINUTES December 5, 1990 Page 6 the total amount to $12,300,000. He believes that there will be more sewer and water projects that will require more funding. Councilwoman Swarner stated that the planning costs for the Congregate Housing Project have not increased. Councilman Walker stated that is what he read in the letter and what the newspaper had intimated. Councilwoman Swarner stated that you cannot always believe what you read in the newspaper. MOTION: Councilman Walker MOVED to amend Item 2(D) from $2,000,000 to $2,500,000, with a total from $11,800,000 to $12,300,000. Councilwoman Monfor SECONDED the motion. Council on Aging Councilwoman Swarner reported that the Council on Aging met this date. The Council will be submitting three names for placement to two positions on the Council. The Council is proceeding with the "Grandma Please" program. The Council on Aging discussed a resolution to be brought to Council supporting the Heritage Place RENAI CITY COUNCIL MEETING MINUTES December 5, 1990 Page 7 being used as a Pioneer Home. This will allow funding from the state for some of the beds now available. A City Appreciation Breakfast will be held on December 28, 1990 for all employees. Please call Pat Porter if you can attend. Director Porter added that the City Appreciation Dinner for Council was held last week. If any Council Members did not attend, please come by the Center and pick up your poinsettia and inspect the dining room addition while you are there. D-2. Airport Commission Councilman Measles stated that the minutes of the last meeting are included in the packet. He was not present at the meeting. Airport Manager Ernst stated that he was not present at the meeting either. However, he has learned that the next meeting has been set for the second week of January. D-3. Harbor Commission Councilman Walker stated that their next meeting is scheduled for December 10, 1990. D-4. Library Commission Councilwoman Monfor reported that the Library Commission met on December 4, 1990. The Commission wished to invite the Council and Administration to the Library Open House scheduled for December 13, 1990. MOTION: Councilwoman Monfor MOVED to donate $100 from the Legislative Miscellaneous fund to help fund the open house. Councilwoman Monfor requested UNANIMOUS CONSENT. Councilman Smalley SECONDED the motion. There were no objections. SO ORDERED. Councilwoman Monfor added that at their meeting, the Commission also approved the goals and objectives of the Commission and the Comprehensive Plan for the Library. Their next meeting will be held the first Tuesday in February. Councilwoman Monfor also stated that a person can purchase a book at the Library in the name of a friend or relative, and donate the book to the Library. KENAI CITY COUNCIL MEETING MINUTES December S. 1990 Page 8 D-5. Parks & Recreation Commission Director McGillivray stated that the minutes of their last meeting are included in the packet. The Commission will meet next on Tuesday, December 11, 1990. Councilwoman Swarner commented in regard to Item 5A in the Parks & Recreation Commission minutes. She stated her appreciation for the lighted star that employee Dan Young made to place at the gazebo at the Lief Hansen Memorial Park. She also stated that perhaps the City should have an "Employee of the Month/Week" type of award to recognize employees' work efforts. D-6. Planning & Zoning Commission Councilman Smalley stated that although he was not in attendance, the meeting minutes are included in the packet. Councilman - Smalley reported that he spoke with two of the Commissioners and found that the Commission worked mostly on the Comprehensive Plan. The Plan should be brought to Council in the near future. D-7. Miscellaneous Commissions and Committees No reports. ITEM E: MINUTES E-1. Regular Meeting of November 21, 1990. Approved by Consent Agenda. ITEM F: CORRESPONDENCE F-1. 11/27/90 North Peninsula Recreation Service Area regarding proposed ice rink. Vice Mayor Measles brought Council's attention to the letter included in the packet from the North Peninsula Recreation Service Area in which they stated that they are not interested in promoting the building of an ice rink at this time. Councilman Smalley stated that Vice Mayor Measles, and his committee, should get in touch with Mr. Brown regarding this subject. KENAI CITY COUNCIL MEETING MINUTES December 5, 1990 Page 9 ITEM G: OLD BUSINESS G-1. Discussion - Carr-Gottstein Foods/Lease Tracts B-1 & B-2 Cook Inlet Industrial Air Park A memorandum was included in the packet from Director Kornelis to City Manager Brighton. The memorandum states that two purchase orders have been prepared for soils and ground water testing of the Carr-Gottstein Foods lease land. The Agreement between Carr- Gottstein and the City of Kenai indirectly approved one of the purchase orders. However, Director Kornelis wanted to bring to Council's attention that Wince-Corthell-Bryson's study found that possible contaminants are in the old Marathon Road right-of-way. They are probably from oiling the road. A teleconference between Director Kornelis, City Manager Brighton, Phil Bryson and a Carr's representative, and Carr's engineering firm representative from Dowl Engineering was held. Dowl Engineering stated that further testing needs to be completed at an additional cost of $10,000. This additional testing is not covered by the Carr-Gottstein Agreement. Discussion followed. Councilman Walker stated that the purchase orders do not reflect monies that have not been spent yet. Director Kornelis stated that Attorney Rogers had requested an environmental assessment. Carr-Gottstein wanted Dowl Engineering to do water analysis at a cost of $15,000. The City was to split that cost. This was included in the agreement between Carr- Gottstein and the City. Recently Carr-Gottstein requested further testing at a cost of $10,000. This cost is to be split with the City. There are two purchase orders in the packet. One for the initial cost which was not technically approved as a purchase order as the purchase order was not physically done. The Agreement approved the expenditure, however. The second purchase order is for the additional $5,000 (the City's half of the cost for additional testing by Dowl). Director Kornelis added that Carr-Gottstein wants to insure that there are no contaminants on the property. Attorney Graves added that banks now are asking for additional information prior to lending. Their rules are more stringent. Councilman Walker stated that it seems that $36,000 is a lot of testing for that sized property. Attorney Graves added that KENAI CITY COUNCIL MEETING MINUTES December 5, 1990 Page 10 initially, when Attorney Rogers requested the assessment, he made several telephone calls to inquire about costs. He was told from $25,000 to $35,000 are normal costs. It is a very expensive process. Councilman Walker stated that he did not support the expenditure the first time, and will not this time. Councilwoman Monfor stated that she did not disagree with Councilman Walker regarding the costs, however, she believes that they must look at the whole picture and the return to the City. This makes this expenditure look small. She supports spending the funds. Councilman Smalley stated that he supports spending the money for the additional testing. He does not disagree with Councilman Walker either, however, the City will be provided with additional information which may be needed in the future. He sees it as worthwhile for the City. There was no further discussion. G-2. Approval - Draft Letter to HEA Regarding HEA Bill/Repair of Existing Street Lights and Placement of New Street Lights Director Kornelis included in the packet a draft letter which Council requested be sent to HEA and their Board Members in regard to repair of existing street lights and the placement of the new street lights. Director Kornelis is asking for approval of the draft letter by Council. Director Kornelis states in his letter that during conversations with Mr. Vaughn of HEA, that placement of new lights should begin the week of December 10, 1990. Councilman Walker stated that he has spoken with Norm Story of HEA. Mr. Story has promised that he will address this situation through the Board of Directors of HEA. Mr. Story was not in his office today when Councilman Walker telephoned. Councilman Walker does not know if Mr. Story has contacted the Board as yet. Councilman Walker believes that Director Kornelis should wait and see if progress is made during the week of December 10, 1990. If no progress, then send the letter. Councilwoman Monfor recommended holding the letter until Director Kornelis receives confirmation that work is beginning. She approves the letter as it is written. Director Kornelis stated yes, he feels there has been progress. Until there is notification from the Lodge that their problems are cleared up, the City should either table the approval or hold the application. Approval - Purchase of Advertising Space - Creative Maps of Alaska There was a memorandum from Mayor Williams in the packet indicating the costs to the City for the cartoon maps. Councilwoman Monfor stated that she believes that the map is a great way to promote the City of Kenai and the Bicentennial celebration. Mr. Ashfield spoke to Council. Mr. Ashfield stated that there was some misinformation in the memorandum from the Mayor. He stated that price estimated during his discussion with City Manager Brighton was $2,250.50. There will be 15 City buildings/locations represented. He will charge the City one- half the cost for those locations, which is $2,250.50. The back of the map will have a calendar of events for the Bicentennial. 90% of the areas' businesses have bought advertising space, including the rigs in the Inlet, Nikiski, and Captain Cook Park. Also, the City will receive 700 maps. MOTION: Councilman Smalley MOVED for approval of purchasing the advertising with Creative Maps for $2,250.50. Councilwoman Monfor requested a friendly amendment to take the funding from the Legislative miscellaneous fund. Councilman Smalley accepted the friendly amendment. Discussion - AML On -Site Registration/Timothy J.•Rogers MOTION: Councilwoman Monfor MOVED that the Council direct Administration to write a letter to AML stating to submit the bill to Mr. Rogers. Councilwoman Swarner SECONDED the motion. Councilman Smalley stated that he agrees that AML should write the letter as on the back of the registration there is no signature from anyone from the City approving the City paying for the registration. Councilman Walker requested that, prior to KENAI CITY COUNCIL MEETING MINUTES December 5, 1990 Page 14 writing this letter, everyone probe their memories and check the records to see if at some point in time it was intimated to Mr. Rogers that the City would pay the AML fee since he was still serving on the Legislative Committee. Councilwoman Swarner stated that committee positions end when you are no longer employed or are no longer elected. Councilman Walker stated that was an acceptable answer. Councilwoman Monfor asked that this statement be put into the record. Councilwoman Monfor stated that it would be different if, this had been discussed prior to AML and it would definitely be different if this was going to be of some benefit to the citizens of Kenai, whose tax money we are using, and she sees no benefit that will be gotten by the citizens of Kenai and that is why she feels this individual should be directed by the billing agency to pay the fee. - There was no further discussion. Public Works Director Mr. Kornelis stated that he has been requested by GCI and HEA to provide equipment and labor to make 15 blocks of ice to be done at the City's convenience for an ice sculpture competition from January 26-February 2, 1991. The blocks of ice would be placed on the FAA field. Councilman Smalley stated that he would like to contact those people who use the field for winter football games to see if there would be a problem. Councilman Smalley will contact and give information to Mr. Kornelis. Mr. Kornelis informed that he will bring information before Council at the next meeting in regard to extra costs involved with the sewer treatment plant project. He has received a letter from CH2M-Hill indicating a design fee increase. He is comparing the letter with the contract. Mr. Kornelis added that he attached some articles for Council's information to C-5 in regard to the sewer treatment plant. I-7. Airport Manager No report. ITEM J: DISCUSSION J-1. The tidelands in question were transferred to the City from the state in 1977. The land is subject to the public trust doctrine. CWC Fisheries, Inc. v. Bunker, 755 P.2d 1115 (Alaska 1988). That doctrine provides the public holds the property in trust for the public subject to continuing public trust easements for purposes of navigation, fisheries or commerce. The patents received by the city were subject to some existing tidelands leases for set net sites. The leases were renewed by the City under terms identical to the ones previously set by the state, rather than the terms outlined in KMC 11.20. KMC 11.20 sets forth the policy for leasing tidelands property owned by the City. KMC 11.20.020 states in part: All classified tide and contiguous submerged land within the limits of the City to which the City holds title may be leased as hereinafter provided... Under that provision the tidelands owned by the City are to be leased pursuant to the requirements of KMC 11.20. Review of the provisions in KMC 11.20 do not reveal any exception to the leasing requirements for tidelands leases for set net fishing sites. Indeed, KMC 11.20.700(1) lists the uses for which tidelands may be leased under the code. One of the listed uses is for fishing. It therefore appears the drafters of the chapter intended for set net fishing site leases to be covered under the code. Page 2 - Memorandum November 16, 1990 Wm. J. In summary, it is my opinion that the tidelands leases for set net sites are covered under the provisions of KMC 11.20. Please find attached a copy of their proposal dated March 1, 1990 and their most recent request for additional funds dated December 14, 1990. CHzM Hill recently did a construction cost estimate on the project which came in at $1,450,000. Bob Bears, Kenai STP, and myself have spent a considerable amount of time on this project in an effort to reduce costs and still achieve a desirable result. Based on a construction cost estimate of $1,450,000, CH2M Hill originally requested an increase of $78,295 to $136,931. After a lengthy discussion with CH2M Hill we feel that we can reach our goal of a low cost properly operated disinfection facility for a construction cost of $1,025,000. CH2M Hill's letter of December 14, explains the negotiations which resulted in lowering the increase to $29,655. I think that we have increased the scope of work on the design contract somewhat (construction cost increased from $550,000 to $1,025,000), and recommend that the City increase the engineering design contract by an additional $29,655. if the Council has no objection we can proceed with an ordinance appropriatinq the additional funds needed for the project. In March of this year, we contracted with the City of Kenai to provide study and design services for required disinfection improvements at the wastewater treatment facility. A disinfection study and a power cost study were both completed at the cost of $6,500 and $7,800, respectively. We are continuing to assist the City with the power cost issue as additional data is obtained from Homer Electric. The contracted fee for the disinfection study, the design of chlorination facilities, and the power cost study was set at $57,300 in my March 1 letter to you. At the time we entered into our contract we did not know which disinfection method we would be using. Therefore, our contract was approved for $64,800 for the ultraviolet method of disinfection. As of the end of November we had spent approximately $17,727 on the predesign effort. The predesign effort was used to reach agreement on the size, configuration, equipment and capacity of the new facilities. We also completed a order -of - magnitude cost estimate for the construction of the facilities. As we discussed, some of items which increase the design and construction costs will significantly reduce the operation and maintenance costs over the life of the project. Some of the plant features which will reduce O&M costs and provide a more operator -friendly facility are as follows: • W3 pumping system W3 pumping system housing • Drainage pumps • Symmetrical chlorine contact chamber for easy cleaning • Improvements to parshall flume After the most recent conversation with you and Bob Bears, we estimated the construction cost to be $1,025,000. DESIGN COSTS The original construction estimate for the chlorination method of disinfection that existed at the time of our design fee negotiation was for a total construction cost of $550,000. At that time we based our design fee on a percent of construction based on similar types of projects. Our design fee of $43,000 is 7.82 percent of the original construction cost estimate. This is lower than normal for a project of this type and complexity, but is still within the normal range. The range for this type and size of project is usually 6 to 10 percent. As the predesign has progressed, it became clear that the scope and size of the pro- ject has increased significantly and that the original design fee would not be sufficient to design the current project. We discussed ways to lower both the design and con- struction cost and succeeded in lowering the construction estimate approximately $400,000. During our December 12 phone conversation we agreed that a design fee equal to 7.82 percent of the revised construction cost estimate is reasonable and fair to both parties. Based on the revised construction estimate of $1,025,000, this calculates to be a fee of $80,155. Last week they also visited Chuda House to see their elderly housing facility. The have met with the Architect, Civil/Structural Engineer, and Mechanical and Electrical Engineer. These professionals gave the committee a check list of alternatives for the project such as the type of heating system and piping. In most cases the committee chose one of the least expensive alternates. I have attached a spread sheet showing the estimated project budget and a graph showing the tentative time schedule. At the present time we are in the schematic design phase of the project. The Architect is working on different floor plan alternatives and elevations. Project No. 3-02-0142-04 (Float Plane Facility) dated August 21, 1987. Actual work on this project was started in March of 1988 and finally closed -out October 31, 1990. The City started condemnation proceedings against the owners of the land in 1986 after no agreement on value could be reached. The court granted the City possession on February 23, 1987. Since that time the courts have been trying to determine the value of the property and on May 22, 1990 the Master of the court brought down a judgement of $156,000.00. The City has subsequently paid the amount in full plus one half the court costs. Thank you for your consideration in getting this project to grant. Special 'appreciation to Amy Grainge and Lorraine King for folding ballots and nomination forms, stuffing envelopes and preparing them for mailing. By now you have noticed the Christmas Street Decorations have gone up. We would like to thank Mavis Blazy, Dave Collins, Mike Sipes, John Torgerson, John Vaughan and the City of Soldotna Maintenance Crew for braving the cold weather and brightening up our community. The Chamber/Visitor Center will be lit in holiday spirit thanks to Mavis Blazy, Dennis Clark, Betty and Jim Harris who have provided the manpower and time to decorate our wonderful facility. CONVENTION ALERT By now, you must have heard we (Soldotna and Kenai) will be hosting the 1991 Alaska State Chamber of Commerce Convention. We already have a promising group of volunteers that have initiated the planning stages, but we need to have your participation as well, and begin working now. Included in this Newsletter is a list of committees needed to host the convention. Each committee will work on its own, sending one representative or committee chair to the general meetings. Please contact the Soldotna Chamber @ 262-9814 or the Kenai Chamber @ 283-7989 to let us know which committee(s) you would like to work on. The key to success for our hosting the convention will be involvement by as many community members as possible. We will have an enormous amount of fun during the convention and our communities will benefit in many ways...Don't be left out! 32nd CONVENTION October 2,31415 1991 COMMITTEES: CONVENTION CATEGORIES: Sports Center Meeting Facility: Coordination & Communication of meetings for the plenary sessions. The main convention needs to be adjacent to the Trade-Show,.and open from Thursday through possibly Saturday. Need to set up for 250 to 300 people, or more. Trade -Show: St. John Connection manager, Layne St. John will most likely be coordinating this. We need to have a small committee at his disposal for liason & assistance with the Sports Center. Expect over 100 booths. Armory or Other Meal Meeting Facility: Communication & Coordination of facility/ies for breakfasts, lunches and dinners. The main meals have the attendance of between 200- and 300 people. Catering Committee: Work closely with the above committee, negotiating with area caterers &/or restaurants. Entertainment Committee: Also working with above committees for music, entertainment, decorations and awards banquet. May be several sub -committees to handle each program. One sub -committee should coordinate with the KENAI BICENTENNIAL COMMITTEE, which we hope will be one of the main focuses for events during the convention. Receptions Committee: Most receptions will be hosted, but need meeting spaces for various receptions. Communication with Sponsors Committee: Work with the meal event sponsors, which will be Chambers of Seattle, Tacoma, Portland, Yukon Territories, So. California & possibly others. Dinner in the Home Committee: Will be coordinating with area families to host between 5 & 15 convention delegates for dinner, transportation from the prior reception and registration for the event. Remember there will be about 200 to 250 convention delegates participating. This is a highly regarded event. Theme/Speakers: Close coordination with the State Chamber on this one will be handled by the general orgainizing committee. Registration: UAF Conferences & Institutes, Nancy Bachner, will be arranging most of the incidentals, such as registration, name tags, banners, speakers & lighting. Media/Marketing: Coordinate with local media publicizing the convention, trade show and events, promoting local participation. Marketing committee may assist general organizers with general publicity and mail -outs. HOUSING AND TRANSPORTATION: ousin : (Two sub -committees) Hotels: & Bed & Breakfasts: Act as liason for information packets on registration, price & facilties listings. The delegates will be registering directly with the facilities. We will need about 400 guest accomodations. Air Transportion: Probably a travel agency to work with main commuters for group fares & information distribution. Much of this coordination will be directly with the State Chamber office. r Ground Transportation: Will need to coordinate with the Gray Line of Alaska, and possibly community sources for transportation of delegates from each housing facility to the meeting/reception/meal sites & back. Will be an intricate/time consuming schedule for the drivers. HOSPITALITY: Welcoming committee: Should be welcoming delegates at the airport. May also be coordinating the cups with candy/ goodies & Kenai/Soldotna info in the delegate's rooms. (Suggest coordination with housing committee) Should also arrange with local VIP's such as mayors, etc. for addressing opening plenary sessions/receptions. Goodie Bacts: About 300 or so goodie bags need to be put together with products/information/discount coupons from as many area merchants as possible. Important here to include all peninsula chambers, including Homer and Seward. Spousal Entertainment Tours: During the convetion, spouses may want to do something else. Tours: Coordination with area guides/fishing/flightseeing/ museums, also should include things in Seward & Homer. I can offer the following as progress on the repair of old lights and the construction schedule .for the new lights recently requested. Most of the new street light requests have been processed through Engineering, designed, and are released to construction. our construction department expects to begin construction on the overhead lights the week of December 10, 1990. The new lights to be installed, as well as the repair of old lights in the Woodland Subdivision, will begin as soon as we receive the screw foundations necessary for the installation of the additional new lights and the 120 volt ballast, which are on order, to complete the repairs of the existing lights. We are expediting the materials needed for this job, and hope to begin the repairs during the week of December 10. In addition, there are several underground served lights which can be installed with Corflo, and construction will begin on those immediately following the installation of the overhead lights. Mr. Walker, there are definite priorities placed upon this job, and we will do everything possible to install and/or repair as many lights as possible for service to the City of Kenai. There are many things which have hampered the expeditious handling of this request, not the least of which was Homer Electric's and of the season push to complete all construction activities where consumer meters were involved. Also, I understand the repair of old Lights has been an on -going problem for Homer Electric and the City of Kenai. The original agreement apparently involved the city of Kenai furnishing parts and Homer Electric would repair the lights that was originally purchased by the City of Kenai. I understand we have reviewed the above steps with Mr. Kornelis at the City. Our Operations Department has informed me that most of the lights which you referenced had repair tickets on, but yet were not repaired, have now been repaired. Some of the problem exists because we had not reported back to the City that those repairs had been accomplished. Since our last conversation, I believe we have given written notice to the City of Kenai on all lights repaired.
