Williams, Mayor City of Kenai DATE: November 20, 1990 RE: LEGISLATOR LUNCHEON The Kenai Peninsula Caucus has arranged for a late afternoon reception with the legislators for the Soldotna/Kenai/Nikiski area and the Kenai Peninsula Borough Assembly on December 11, 1990. On Monday, I met with Bill Brighton, Assemblyman Jack Brown and Councilman McComsey. We decided to arrange a luncheon for the legislators at Mr. D's, on December 11, 1990, between 12:00 and 1:30 p.m. Invitations have been mailed to the legislators, Kenai/Nikiski Borough Assembly Members, Board of Directors of the North Peninsula Chamber of Commerce, Kenai Chamber of Commerce, and the Borough Mayor. CITY OF KENAI RESOLUTION 90-72 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, REQUESTING THAT A BIKE TRAIL/SAFETY PATH BE PLANNED FOR NOW AND INCLUDED IN THE KENAI SPUR HIGHWAY WIDENING PROJECT. WHEREAS, the Kenai Spur Highway, from Milepost 0 to Milepost 10.6, between Kenai and Soldotna, is scheduled to be widened and upgraded by the State of Alaska; and, WHEREAS, there will be approximately 5.5 miles of roadway without a sidewalk or trail in the "rural" section; and, WHEREAS, a bike trail/safety path, which forms a continuous link between Kenai and Soldotna, would benefit residents of both communities, now and in the future; and, WHEREAS, planning and design need to occur at this stage, even if actual construction of the entire bike trail/safety path does not occur until a later date. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that Section 1: Those responsible for planning and design of the Kenai Spur Highway widening project shall include in the plan and design, a bike trail/safety path that will provide a continuous link between Kenai and Soldotna. Section 2: This resolution shall be distributed to the Department of Transportation Commissioner, Kenai Spur Highway Project Manager, Kenai Peninsula Highways Planner, Senator Paul Fischer, Representatives Mike Navarre and Gail Phillips. Freas, City Clerk October 25, 1990 John Williams, Mayor and Kenai City Council Fidalgo Street Kenai, Alaska Dear Mayor Williams and Councilmembers: The Unity Trail Committee, a core of central peninsula volunteers, plan a Spur Highway trail in conjunction with the 1992-93 Department of Transportation upgrade project. Members requested and received $100,000 in design costs from the 1990 legislature. The funds were subsequently cut by budget veto. As you consider the important capital projects intended for the City of Kenai; our organization asks that you support in concept, the planning of a pathway (approx. 5 miles) connecting the already planned urban sections along the highway. Our focus has always been on planning dollars for an add/alternate to the total road construction project. Federal highway dollars might be leveraged if several elements are present; 1) Data showing that sufficient traffic (other than automobile) use the route 2) Growth forecasts support that in twenty years (the life of this highway construction project) enough users will be present to qualify 3) That local governments conceptually support and approval of this state project Volunteers have conducted traffic count surveys. Once the results are compiled, user projections will be applied in accordance with Federal highways standards. No comprehensive trails plan exists in either city or the borough government leaving us asking each local government for concept support of this particular trail. Throughout Alaska trails have been constructed along major community highway accesses. Delta Junction, Tok and Glennallen communities all enjoy main highway route trails. Legislative pork barrel politics provided for these capital projects in earlier days. State and/or federal funding avenues are worth exploring for this project. The Unity Trail Committee maintains that the citizens of the central peninsula desire and deserve options consistent with modern lifestyles in other rural Alaska communities. This volunteer group has been working for nearly two years towards that end. Interest was sufficient to prompt hundreds of letters to area legislators asking that planning funds be given in 1990. Over 1700 petition signatures were collected during the same period. Dozens of those letters and hundreds of those signatures were Kenai people. While considering capital budget "wish list" for this legislative session we ask that you support planning dollars for this important state project. Mrs. Carter has been working with Senator Stevens to have the Blue Angels or Thunderbirds perform at this air show. The tentative date would be the week of August 10, 1991. The Airport Commission is seeking the Council's consent, at this time, to co- sponsor this event. The Bicentennial Commission does not foresee any financial obligation from the Airport Commission, just help in organizing and facilitating this event. ROLL CALL: The meeting was called to order by Chairman Eldridge at 7:10 p.m. Commissioners present were: Eldridge, Breeden, Maguire, Malberg, and Hallstead. Also present were Ad Hoc member Walker and Mr. Kornelis from the City of Kenai. 2. APPROVAL OF AGENDA: MAGUIRE MOVED TO APPROVE THE AGENDA AS WRITTEN. MALBERG SECONDED AND MOTION CARRIED. 3. APPROVAL OF MINUTES OF OCTOBER 15, 1990: Breeden wanted to clarify Item f) under New Business, by deleting the portion of the last sentence after "her concerns over recent actions of the Board" and inserting: "and of the Board's reluctance to do anything within the water column." BREEDEN THEN MOVED FOR THE MINUTES TO BE APPROVED AS CORRECTED. MAGUIRE SECONDED. MOTION CARRIED. 4. OLD BUSINESS: a. Boardwalk Project update. The work of driving the pilings has started and should take about 3-5 days. There has been talk of using prison labor to assemble the boardwalk and the Chamber has donated some time to help also with the assembling of the boardwalk. b. Kenai River Boat Ramp update. The City is still waiting for the Corps of Engineers determination on the permit. The City must wait until the determination is made known before any further action can be taken. C. Lease Space for Retail Outlets. There was discussion regarding soliciting businesses to make services available to the fishing fleet and harbor visitors. BREEDEN MADE A MOTION TO HAVE KEITH KORNELIS LOOK INTO WHAT AREAS COULD BE USED FOR LEASE SPACE, DISCUSS WITH THE COUNCIL AS TO WHAT TYPE OF BUSINESSES SHOULD BE SOLICITED AND COME BACK TO THE COMMISSION WITH A PLAT OF THE AREA DETERMINED FOR LEASE SPACE WITH RATES FOR LEASING. MOTION DIED FOR LACK OF A SECOND. KENAI HARBOR COMMISSION November 5, 1990 Page - 2 - The Commission decided to continue to encourage and promote development of nearby private property to provide such marine -related services. 5. NEW BUSINESS• a. Chairman Eldridge wants to promote a Blessing of the Fleet for 1991 in coordination with the Bi-Centennial celebration. This event could take place just before the season starts and could include a parade of the vessels with local pastors blessing the fleet. ACTION TAKEN: BREEDEN MADE A MOTION FOR THE COMMISSION TO WORK JOINTLY WITH THE CITY COUNCIL AND BI-CENTENNIAL COMMITTEE TO HOLD AN EVENT OF THE BLESSING OF THE FLEET IN EARLY SUMMER. DON HALLSTEAD SECONDED. MOTION CARRIED. Chairman Eldridge will do more groundwork to come up with a more detailed plan stating specifically what the event would entail and see what fishing associations would want to be a part of the event. He will bring it back to the next meeting for Commission review before sending it on to City Council. b. Army Corps Permit Application - Reference #1-890390 Cook Inlet Processing, Mooring Buoys. ACTION TAKEN: COMMISSIONER HALLSTEAD MOVED TO APPROVE THE APPLICATION WITH THE FOLLOWING COMMENTS: 1) ON PAGE 2, UNDER SPECIAL AREA DESIGNATION: THIS AREA IS NOT WITHIN THE KENAI RIVER SPECIAL MANAGEMENT AREA. IT IS AN AREA MERITING SPECIAL ATTENTION WITHIN THE COASTAL ZONE MANAGEMENT PLAN; AND 2) PERMIT WILL BE APPROVED AS LONG AS IT DOES NOT INTERFERE WITH THE EXISTING NAVIGATIONAL PATTERNS OR WITH EXISTING BUOYS. MOTION SECONDED BY BREEDEN. HALLSTEAD AMENDED HIS MOTION TO ALSO INCLUDE A COMMENT TO RE-EVALUATE THE SIZE OF THE ANCHORS TO MAKE SURE IT IS ADEQUATE WEIGHT FOR THE CONDITIONS AND THE USE. BREEDEN SECONDED. AMENDED MOTION UNANIMOUSLY PASSED. C. Commission reviewed the Harbor Section of the Comprehensive Plan and the Commission's Five Year Plan. Additions and deletions were made as noted on the attachments to these minutes. KENAI HARBOR COMMISSION Page - 3 - November 5, 1990 6. CORRESPONDENCE: None 7. COMMISSION COMMENTS & QUESTIONS: Breeden made comment regarding the four vacancies on the Kenai River Board stating that selection has been made; however, the Division of Parks refuses to say who they are at this time. Walker wanted to confirmed that Jahrig had been absent from at least three meetings and urged the Commission to act on the Comprehensive Plan tonight so that it could be forwarded to the Planning and Zoning Commission and City Council. ACTION TAKEN: BREEDEN MOVED TO ACCEPT THE HARBOR PORTION OF THE COMPREHENSIVE PLAN AS NOTED ON THE ATTACHMENTS TO THESE MINUTES. HALLSTEAD SECONDED. BREEDEN AMENDED HER MOTION TO ALSO INCLUDE THE COMMISSION'S FIVE YEAR PLAN AS NOTED ON THE ATTACHED. HALLSTEAD SECONDED. MOTION CARRIED UNANIMOUSLY. S. CALL TO ORDER: The meeting was called to order by Chair Hues at 7:34 p.m. 2. ROLL CALL: Commissioners present were: Heus, Wetzel, Rodes, Turner, and Altland. Also present were Emily DeForest, Library Director; Coucilwoman Monfor, Ad Hoc; and Ethel Clausen, KPC Librarian. 3. APPROVAL OF AGENDA: Dr. Turner moved to approve the agenda by unanimous consent. DIRECTOR'S REPORT: Director DeForest reported arrangements have been made for the Book Sale to be on February 15 and 16, 1991. The City wants the update to the Comprehensive Plan prior to their meeting on November 28 so the Commission will need to act on it this meeting. The City Christmas party will be December 14 and the Library Christmas Open House will be December 13. 7. OLD BUSINESS: A. Library Goals and Objectives. Commissioners reviewed the Goals and Objectives line item by line item. Additions and deletions were noted and a new sheet will be typed by Chair Hues who will deliver it to the City. 8. NEW BUSINESS: A. Book Sale for 1991 will be February 15 and 16. Elsie and Mike Seaman have donated heated storage space for the books in a vacant apartment of theirs and 22 boxes of books for the sale have already been stored there. B. Mary Jean Lewis will be in charge of a "Buy a Book for Your Library for Christmas" program. Books will be purchased that the library wants and needs and those wishing to participate will help pay for them. Debbie Faulk is heading up an area -wide photo contest with the subject of reading. Photographs need to be in by the first of the year. KENAI ADVISORY LIBRARY COMMISSION Novmeber 6, 1990 Page -2- Josephine has retired after many, many years of service to the library. She was given a donation to help buy art supplies for her recently acquired hobby. Carla Cutty has been hired in her position. 9. COMMISSIONER'S COMMENTS & QUESTIONS: A few commissioners voiced their appreciation as to how well the Goals and Objectives were addressed at this work session. Everyone's help and support is appreciated, especially Director DePorest's efforts. 10. ADJOURNMENT: Commissioner Rodes moved to adjourn and Dr. Turner seconded. PUBLIC HEARINGS None 5. APPROVAL OF MINUTES - October 24, 1990 MOTION: Commissioner Scott moved for approval of minutes. Commissioner Bannock seconded. Passed by unanimous consent. 6. OLD BUSINESS a. James Arness - Request to purchase Proposed Tract B, Peterson Subdivision, Addition No. 1 Commissioner Scott said she felt that the lot in question was a prime area for development and asked what the City's policy was for disposal of Public Lands. Rim Howard reported that if there is interest in public lands, the parcel is brought before the Parks and Recreation and Planning and Zoning Commissions. These Commissions make recommendations to the City Council and then an Ordinance is prepared for Council and advertised in the paper. KENAI PLANNING & ZONING COMMISSION October 10, 1990 Page 2 Commissioner Scott noted that the Comp Plan map indicated that area may be used for a City park in the future, she asked Mr. Arness what his development plans for the property were. Mr. Arness said that he had no specific plans for the property, but would like to add it to his existing property by replatting those two sections together. Commissioner Bannock asked if there was public access to the parcel. Mr. Arness said that there is a trail that comes up from the beach but the property is bordered by private property on the remaining sides. There is some foot traffic but mostly between the church and the bluff, not through the lot. Commissioner Scott asked if Mr. Arness was aware of the Bicentennial Commission's intent to resurrect some of the old trails in that area as part of the proposed Bicentennial trail system? Mr. Arness said that he had never heard of that possibility. Commissioner Scott voiced concerned that the proposed site may be needed for trail systems or park expansion in the future. Commissioner Bannock noted that the only access to that site would be through private property so it would not be a good spot for a city trail system or park. Commissioner Bryson said that directly north of the property was city owned land and that there could be a trail system established in this area. He suggested that an easement could be retained by the City in the property if a trail system is eventually needed. MOTION: Commissioner Bannock moved to recommend to Council the sale of Proposed Tract B, Peterson Subdivision, Addition No. 1. Commissioner Glick seconded. Commissioner Scott asked Kayo McGillivary, Parks and Rec Director, what action the Parks and Rec Commission had taken on this item. KENAI PLANNING & ZONING COMMISSION October 10, 1990 Page 3 McGillivary said that Parks and Rec had recommended that the piece be sold to Mr. Arness. They had felt that there was a adequate trail system and access to the beach already in existance in that area. VOTE: YES: Bannock, Glick, Rehm NO: Scott, Bryson b. Comprehensive Plan Update Parks and Recreation: Kayo McGillivary gave a brief summary of the Parks and Rec section and noted changes to: 10 Parks, 9 Ballfields (5 adult, 4 youth). He said that the Plan might include acreage of proposed park lands, and also a brief synopsis of each park, equipment available, etc. Commissioner Scott noted that the Future section contained very little comment on plans to expand park areas. She wondered if there needed to be more specific plans incorporated in that section for further expansion of park areas if City population grows. McGillivary said that there was plenty of area designated to handle any additional population growth. Commissioner Scott said she felt that future trail systems should be addressed more extensively in the Plan. She has been working on the committee to get a trail between Soldotna and Kenai and feels that it would be helpful to have a plan written out to present to DOT. Kayo McGillivary agreed and said that he would get together with the planning staff to draft section on proposed trail system to incorporate into the Comp Plan. Commissioner Bryson suggested that the system run along all State maintained road systems within the City limits. Harbor Keith Kornelis, Harbormaster, presented the plan and asked for Commissioner's questions or comments. Commissioner Scott asked Kornelis to explain the boat mooring Site plan section. KENAI PLANNING & ZONING COMMISSION October 10, 1990 Page 4 Kornelis explained that the City has designated an area of the river as the mooring site, but the City does not issue permits. Permits are issued by the Corps of Engineers and the City gets a copy of those permits. This area is full at this time and there are no plans to expand on present mooring area. Commissioner Scott asked if the proposed boat launch off Beaver Loop needed to be more defined? She wondered how many vehicles the proposed site would accommodate. Lashot said that the current site, which has not been approved yet, would accommodate between 75 and 100 vehicles with trailers. 7. NEW BUSINESS 8. PLANNING 9. REPORTS a. City Council None. b. Borough Planning None. c. City Administration Lashot reported that Dan Canetta was preparing a base map that can be used in creation of the Land Use Plan. A-1. PLEDGE OF ALLEGIANCE Vice Mayor Measles led those assembled in the Pledge of Allegiance. A-2. ROLL CALL Roll was taken by the City Clerk. Present were: Smalley, Swarner, Measles, McComsey, Monfor, and Walker. Absent was Mayor Williams. A-3. AGENDA APPROVAL Vice Mayor Measles requested the following change to the agenda: REMOVE: Approval/Ashley Reed Contract - It was noted that Mayor Williams requested that this item be removed from the agenda by telephone conversation with the Clerk. Vice Mayor Measles noted the memorandum submitted by Clerk Freas to Public Works Director Kornelis which forwarded remarks by Mayor Williams. The Mayor remarked he disagreed with purchasing a 10-speed transmission on the multi -purpose truck. He stated that he felt that a manual transmission will create more mechanical problems than an automatic transmission. Also, he feels an automatic transmission will be much more convenient. The Mayor also stated that he thought the additional funds needed to purchase the vehicle as it was first bid could be taken from the Airport funds instead of General Fund contingency funds. Vice Mayor Measles stated that he agreed with the Mayor regarding the transmission. Councilman Smalley stated that the price is the same as originally bid, except for the change in price - brought by the manual transmission. It was asked if there is a possibility that extra monies be taken from the Airport funds. KENAI CITY COUNCIL MEETING MINUTES November 7, 1990 Page 3 Public Works Director Kornelis stated that he did not think there would be a problem as the truck will be used on the airport. Vice Mayor Measles stated that the contingency fund was for budgeted items, not unbudgeted. Councilman Walker stated that he is in favor of road improvement, etc., however he would not support of purchasing the truck because the bid is over budget. Vice Mayor Measles suggested tabling this resolution until Resolution 90-63 is heard. Councilman Smalley stated that he made one telephone call to a dealer. He was told that this is a specialized truck and will be specially built to the specifications of the City. Councilman McComsey also made calls regarding the truck. Councilmen McComsey and Smalley support the purchase of the truck. There is 180 day delivery time. Director Kornelis stated that he hopes the truck will be received by Spring to use the tanker to wash the roads and runway. Director Kornelis added that he knows that Finance Director Brown KENAI CITY COUNCIL MEETING MINUTES November 7, 1990 Page 4 is not in favor of using airport funds. Also, that the only item to change on the truck that would change the price by a considerable amount is the transmission. Director Kornelis added that he had checked on a price for a truck body on which to place a sander a few years ago. The price of the truck was $105,000. The cost of the attachments are not making the price that much higher. The axle weight could be cut down, but the extra weight of the tanker requires a large axle weight. He added that the budget price was a guess by himself and his mechanics. Councilman McComsey suggested amending the resolution and return to the original price bid. MOTION: Councilman McComsey MOVED to amend Resolution No. 90-63 to the original price of $137,585. Councilman Smalley SECONDED the motion. Councilman Walker objected to the amendment. Councilman Walker stated that he felt a better price could be received out of state. As the truck will not be received and used this winter, he feels there is plenty of time to shop around. Councilman McComsey stated that during his telephone calls to dealers, he was told that this is the only truck with the axle weight necessary. Councilman Walker stated that he knew of other trucks made with large axles for less money (Kenworth and Peterbilt). Director Kornelis listed those companies who took out the bid specifications. He stated they did not send the information to outside dealers. Fire Chief Burnett was asked from where the fire trucks are purchased. He stated mostly out of state. Councilman Walker stated that he believes the basic truck cost is too high. He believes the add-ons are reasonably priced. VOTE: Councilman McComsey called for the question. Vice Mayor Measles stated that the ordinance allows changes to the rates and regulations by the Harbormaster so that rather than being subject to approval of Council, the changes are in effect unless changed by Council. Attorney Graves added that this will allow the fuel rates to be changed by the Harbormaster as quickly as fuel distributors change the rates, without having to go to Council to approve each time. Councilwoman Monfor stated that she will vote against the resolution as Councilman Walker made some very good points during the previous discussion on Resolution No. 90-63. She added that she thought Public Works Director Kornelis should look for a better price out-of-state. Vice Mayor Measles stated that they had passed a resolution awarding the bid. Now the Council must decide from where to get the extra money. Councilwoman Monfor asked if this resolution fails, what would happen. Vice Mayor Measles stated that if the Council does not want to purchase the multi -purpose truck, then they should rescind their previous motion which awarded the truck. RENAI CITY COUNCIL MEETING MINUTES November 7, 1990 Page 8 Councilwoman Swarner stated that she sees the need for the truck, however, she would like the money to come from other funds instead of the contingency fund. Vice Mayor Measles stated that the resolution can be amended to where the Council wants to take the money. Councilwoman Monfor withdrew her earlier comments. Councilman Smalley asked Airport Manager Ernst his feelings about taking the money from the airport fund. Airport Manager Ernst stated that he agrees with the Finance Director in that it is not the policy to take partial funding from another department. As far as use at the airport, the airport has a sander. They rarely use other trucks. Occasionally they use other sanders. He stated the decision is up to the Council. Councilman Smalley noted that the multi -purpose truck might be used to wash the runway if the volcano blows. Mr. Ernst stated that he did not wash the runway in the Spring. He added that he is in the process of getting AIP funding for a sweeper for the airport. He will be submitting the grant application soon. Vice Mayor Measles stated that he has a problem with jumping to other City funds to take care of this overrun. He stated that he believes the logical place to obtain the extra funds is from the contingency fund in the general fund budget. Councilman Smalley agreed. The money should have been budgeted from the airport funding. The body of the truck created the price tag. Acting Finance Director Parnell stated that there is $65,000 contingency money in the general fund. MOTION: Councilman Smalley MOVED to amend the budget transfer amount from $6,163 to $17,585 and Councilman McComsey SECONDED the motion. Councilman Walker stated that he is not ready to spend 25% of the annual contingency money from the general fund budget. They will be meeting with Mr. Livingston of Livingston -Slone on Tuesday. Councilwoman Swarner added that the appreciation dinner will be held for Council at the Senior Center on November 29, 1990. She added that the wall is down inside the Center. D-2. Airport Commission Vice Mayor Measles reported that the previous meeting minutes are in the packet. The next meeting is set for November 15, 1990. D-3. Harbor Commission Councilman Walker reported that the Harbor Commission met on Monday. The Commission approved placement of buoys in the Kenai River. They discussed the Comprehensive Plan and sent their portion on to the Planning & Zoning Commission. They also discussed a "blessing of the fleet" in conjunction with the Bicentennial celebration in the Spring. They are proposing serving coffee, etc. Councilwoman Monfor stated that the Bicentennial Committee has a subcommittee planning something similar. She will discuss it at their next meeting. Councilman Walker stated the Commission has not discussed any money amount to proceed with this idea. Councilwoman Swarner stated that the Commission has money in the budget. Attorney Graves stated that the Commission needs to be careful in regard to spending City money on a religious activity. It has the potential to be similar to the problem of placing nativity scenes at public buildings, etc. KENAI CITY COUNCIL MEETING MINUTES November 71 1990 Page 10 D-4. Library Commission Councilwoman Monfor reported that they Commission met on Tuesday. They worked on their goals and objectives. The Library Open House is planned for December 13, 1990 from 2:00 - 6:00 p.m. D-5. Parks & Recreation Commission Director McGillivray reported that the Commission is to meet next Tuesday. He also reported that the gate is up at the Oiler Park. Councilman Smalley asked if the student member had attended their last meeting. Director McGillivray stated no. Councilman Smalley will talk with the student again. Director McGillivray stated that the student has not been officially appointed by the Mayor. D-6. Planning & Zoning Commission Councilman Smalley reported that minutes from their last three meetings were included in the packet. The minutes of October 24, 1990 are the most recent. He reported that the Commission discussed the Comprehensive Plan and are working on it. Also, he reported that the Commission postponed action on the sale of the property on the bluff to Mr. Arness. The Commission wants time to walk the property to be sure that the sale will not block the trail on the bluff. Councilman Smalley noted to Vice Mayor Measles that Commissioner Scott stated that there is preliminary planning grant money available for projects such as the ice rink. Mr. Measles stated that he is aware. Councilwoman Monfor asked Councilman Smalley if the gun shop/log house on Tinker Lane has a permit to have the business there. Councilman Smalley stated that he was on the Commission at the time and he remembers that they approved a permit for a museum and gun restoration shop. He does not remember if the permit included the sale of ammunition. Councilwoman Monfor asked about the key shop on the Spur Highway and the Candle Shop on Robin Street. Public Works Director Kornelis stated that he checked with the Building Official and they are in compliance. Director Kornelis will have the Building Official check on the gun shop. Discussion - Mobile Homes Ordinance purchase orders Councilman Smalley to the request for Councilwoman Monfor stated that she requested this item be placed on the agenda as she had received telephone calls regarding a mobile home/trailer which was placed on a lot in Thompson Park. She stated that she believed that it was the intent of the Council at the time the ordinance was first placed in the Code to disallow any new placement of trailers inside the City. Councilman Smalley stated that the ordinance would allow trailers during construction or if it is used as a storage building and if they are not hooked up to water and sewer. A question is whether it is considered a modular or a mobile home. Councilman Walker stated that he received similar complaints. He went to the park and checked on the trailer. He spoke with the owner. The owner claims that the trailer is used as a storage facility. It is a storage facility until somebody lives in it or it is hooked up to water and sewer. Discussion followed regarding the difference between a modular or trailer. The difference being whether it is a stick frame or if it has panelling on the walls, etc. -- the way the facility is built. Director Kornelis added that the Building official inspected the facility. It is being stored. It is empty. Director Kornelis stated that the facility is similar to those used on the Slope. They are used as sleeping facilities. They do not have sinks, toilets, etc. included in them. Councilwoman Monfor stated that she believes the intent was to keep trailers out of the City. KENAI CITY COUNCIL MEETING MINUTES November 7, 1990 Page 13 Councilman Smalley requested Attorney Graves to check into it. Determine whether this structure is in violation of the ordinance and what changes can be made to affect the intent of Council. Clarify the wording. Councilman Walker noted that even if the ordinance is changed to affect the intent of Council, this trailer would be grandfathered. H-4. Approval - Contract for Lobbying Services/Ashley Reed & Associates, Inc. Councilwoman Monfor stated her objection to tabling the approval of the contract for another two weeks. The Council has known about the possible renewing of the contract since July. The price is a bargain. She believes that Mr. Reed does good work. She does not believe that the changes in the legislature will be that significant. Councilman McComsey asked what Mr. Reed has done for the City. Councilwoman Monfor answered that he was instrumental in procuring the funds for the congregate housing facility. He worked, along with Attorney Rogers, to keep things in committee or killed in committees. Sometimes you must consider what has been saved by the City, not just what the City received, to decide whether he has been effective. Councilman Walker stated that he is not against the approval. He believes that it has been delayed this long, it will not hurt for it to be delayed another two weeks. It is about 80% complete. b. The H-piling for the retaining wall at the boardwalk is done. C. HEA is to begin work on the underground for street lights next week. Director Kornelis will be meeting with HEA tomorrow. Councilwoman Swarner asked about the apartment building on Cook Inlet Drive that is partially torn down. Director Kornelis stated that he understands the person tearing the building down works one week on, one week off, on the Slope. Director Kornelis will check with the Building Official. Councilwoman Swarner stated that there is a junk car at the Old Time Grocery. Another, with an orange tag, on Ash Street. Director Kornelis stated that he is working with the Police Department to work out a method to mark and remove. I-7. Airport Manager No report. Fire Chief Burnett reported that the Harbor View will be burned on November 13, 1990 at 3:00 p.m. provided the DEC does not stop them. He does not anticipate any problem. ITEM J: DISCUSSION J-1. He encourages Administration that if the November 27, 1990 deadline goes unnoticed, the building be torn down. Reasonable, necessary and normal expenses associated directly with the duties of the Agreement are the responsibility of the CONSULTANT. No claims for expenses are contemplated by this contract. However, should the City Council require CONSULTANT'S services outside of Alaska, on behalf of the CITY, reasonable, necessary and normal expenses associated directly with such request shall be reimbursed upon submission of appropriate receipts or documentation. 3. It is the recommendation of the City Administration, the Parks and Recreation Commission and the Planning and Zoning Commission that the above referenced property be sold. Therefore, Ordinance No. 1406-90 has been prepared for introduction at the November 21, 1990 City Council meeting. A public hearing is scheduled for December 5, and the effective date, if passed, will be January 5, 1991. Mr. Arness is the adjoining landowner of the referenced property and has requested to purchase the property. Attached are maps of the area. KMC 22.05.075 Property Sale to Adjacent Owners states: The Council may approve, by resolution, after public notice and an opportunity for public hearing, the sale and conveyance of a parcel of City property at its appraised value to the owner of the adjacent land whenever, in the judgment of the City Council, the parcel of land is of such small size, shape, or location that it could not be put to practical use by any other party and, in addition thereto, where there is no foreseeable need of the land for any future use by the City. Mr. Arness submitted an appraisal which has been reviewed by an appraiser the City selected. The review appraiser concurred in the value of $101000. It is estimated the usable portion of the 1.063 acre site at 4,000 to 5,000 square feet. The site has no physical access, although the Spruce Street Road right-of-way is platted along the northwest corner. There are no public utilities. The property is zoned Conservation. Her month -end report will be turned after September 5, 1990. Music Chairman, Lois Gordon distributed song sheets and let us in "Grand Old Flag". Debbie Foster asked for a chairman for the Open House on Sept. 3, 1990 and Josie Hudson volunteered. Helpers signed up on the passed sheet. The men are to buy the food and the women will prepare it. Debbie Foster and Josie Hudson volunteered to be the "Shut In Helpers" for the month of Sept. Their list of visits to be made at this date include, Elsie Moore in Providence Hospital and Grace Wallingford at the same facility, Elsie Marrs in Anchorage. Lila Rozak has sent a card to Elsie Marrs as no flowers are allowed. Also, Kathy Lockbalum in Alaska Native Hospital in Anchorage is to be visited. June Moore has offered to also help with visits but will need help with transportation. Josie Hudson has been given $40.00 for the purchase of film at Costco for use in the Hostorians Book. Binkley Soldotna, AK 99664 RE: REIMBURSABLE CUSTOMS AGENT Dear Don: atnsK> • Main • Policr • Harb, • Fire (907) 224-3445 • Telecopier (907) 224-3248 The City Council, at its regular meeting last night, moved to decline further city participation in the Reimbursable Customs Agent program for the Kenai Peninsula Borough for the present time. As you may be aware, since the City of Seward began working a number of years ago toward acquiring a resident customs agent for the Kenai Peninsula a number of changes within customs have occurred which have actually resulted in the realization of many of the goals the city was attempting to reach through this effort. For example, when Seward commenced its efforts toward a Reimbursable Customs Agent we were trying to entice major foreign -fishing -fleet use of the city's newly constructed Syncrolift shiplift. As you know, since that time enforcement of the Magnuson Act has driven most of the foreign fishing fleet from Alaskan waters. The success of the Americanization of the fleet has given Seward what it was hoping to realize from increased custom service, in that many of the American vessels in this fisheries are utilizing the port of Seward for maintenance services. Another change which has substantially affected the need for a Reimbursable Customs Agent is radio preliminary entry now used by over 90 percent of the vessels calling on Seward. This has eliminated the need for customs inspections on most vessels using Kenai Peninsula ports today. This service has particularly benefitted the Polish fishing fleet which uses Seward as its port of call. Finally, it was thought that a resident customs agent on the peninsula would facilitate the attraction of peninsula ports to the cruise ship industry. However, the cruise ships fall under a special exemption in the law which allows customs to limit the number of inspections to 15 in any calendar year if the ship stays on a set port -of -call schedule. This has allowed most of the cruise ships calling on Seward to not have any involvement with customs after the first or second sailing of the year. MAYOR DONALD E. GILMAN REIMBURSABLE CUSTOMS AGENT Page 2 We do believe that many of the changes that have occurred within customs over the last three to four years have, in part, been as a direct result of the work you have provided, along with that of Senator Stevens, on this matter. I am told that the cooperative attitude and level of service provided by customs has improved substantially, and we can only attribute much of this to the efforts of the Kenai Peninsula Borough and Senator Stevens with regard to the Reimbursable Agent Program. Your hard work in this area has not gone unnoticed by the City of Seward, and we are most appreciative of all you have done In this regard. I think this hard work has, in fact, allowed us to realize a resolution of many of the concerns we had with customs service to our port and the other ports of the Kenai Peninsula. ALASKA STATE CHAMBER OF COMMERCE 32nd CONVENTION October 2,3,4,5 1991 By now, you must have heard we (Kenai & Soldotna) will be hosting the 1991 State Chamber Convention. We already have a promising group of volunteers that have initiated the planning stages, but we need to have your participation as well, and begin working now. Following are a list of committees we will need to form to host the convention. These have been suggested by our organizational chairs. Each committee will work on its own, sending one representative, or committee chair to the general meetings. We hope to keep the general meetings few in number and fairly brief, in order to afford more time to actual committee endeavors. Please contact the Kenai Chamber at 283-7989 or the Soldotna Chamber at 262-9814 to let them know which committee(s) you would like to work on. The key to success for our hosting the convention will be involvement by as many community members as possible. We will have an enormous amount of fun during the convention and our communities will benefit in many ways. Don't be left out. COMMITTEES: CONVENTION CATEGORIES: Sports Center Meeting Facility: Coordination & Communication of meetings for the plenary sessions. The main convention needs to be adjacent to the Trade -Show, and open from Thursday through possibly Saturday. Need to set up for 250 to 300 people, or more. Trade -Show: St. John Connection manager, Layne St. John will most likely be coordinating this. We need to have a small committee at his disposal for liason & assistance with the Sports Center. Expect over 100 booths. Armory or Other Meal Meeting Facility: Communication & Coordination of facility/ies for breakfasts, lunches and dinners. The main meals have the attendance of between 200 and 300 people. Catering Committee: Work closely with the above committee, negotiating with area caterers &/or restaurants. Entertainment Committee: Also working with above committees for music, entertainment, decorations and awards banquet. May be several sub -committees to handle each program. One sub -committee should coordinate with the KENAI BICENTENNIAL COMMITTEE, which we hope will be one of the main focuses for events during the convention. Receptions Committee: Most receptions will be hosted, but need meeting spaces for various receptions. Communication with Sponsors Committee: Work with the meal & event sponsors, which will be Chambers of Seattle, Tacoma, Portland, Yukon Territories, So. California & possibly others. Dinner in the Home Committee: Will be coordinating with area families to host between 5 & 15 convention delegates for dinner, transportation from the prior reception and registration for the event. Remember there will be about 200 to 250 convention delegates participating. This is a highly regarded event. Theme/Speakers: Close coordination with the State Chamber on this one will be handled by the general orgainizing committee. Registration: UAF Conferences & Institutes, Nancy Bachner, will be arranging most of the incidentals, such as registration, name tags, banners, speakers & lighting. Media/Marketing: Coordinate with local media publicizing the convention, trade show and events, promoting local participation. Marketing committee may assist general organizers with general publicity and mail -outs. HOUSING AND TRANSPORTATION: Housing: (Two sub -committees) Hotels: & Bed & Breakfasts: Act as liason for information packets on registration, price & facilties listings. The delegates will be registering directly with the facilities. We will need about 400 guest accomodations. Air Transportion: Probably a travel agency to work with main commuters for group fares & information distribution. Much of this coordination will be directly with the State Chamber office. Ground Transportation: Will need to coordinate with the Gray Line of Alaska, and possibly community sources for transportation of delegates from each housing facility to the meeting/reception/meal sites & back. Will be an intricate/time consuming schedule for the drivers. HOSPITALITY: Welcoming Committee: Should be welcoming delegates at the airport. May also be coordinating the cups with candy/ goodies & Kenai/Soldotna info in the delegate's rooms. (Suggest coordination with housing committee) Should also arrange with local VIP's such as mayors, etc. for addressing opening plenary sessions/receptions. Goodie Bags: About 300 or so goodie bags need to be put together with products/information/discount coupons from as many area merchants as possible. Important here to include all peninsula chambers, including Homer and Seward. Spousal Entertainment/Tours: During the convetion, spouses may want to do something else. The gun shop was granted a home occupation permit in May, 1987. There is no prohibition of selling ammunition listed in the letter to Mr. Thornton. We were unable to locate the minutes for the meeting when this was discussed. The Fire Marshall and I very carefully determined the amount of black power he could have in the shop and how it had to be stored.
