Freas, City Clerk City of Kenai DATE: September 5, 1991 RE: PROPOSED SPECIAL ELECTION At the September 4, 1991 Council Meeting, you discussed with Council the possibility of holding a special election in early February. You stated that if the Carr's people are able to give Council some favorable and solid cost information at the Work Session on September 9, 1991, Council may then proceed with bringing the discussions to the citizens. You suggested holding a Town Hall. meeting on October 9, 1991, after sending 75-100 letters to potential users of the facility encouraging them to attend. You also suggested that the petition be ready to distribute to the desiring citizens attending the Town Hall meeting to begin collecting signatures. If Carr's comes forward with the necessary information and Council decides whether or not to proceed with the project, the following calendar of events is required. October 9, 1991 - Town Hall Meeting and distribution of petitions. November 9, 1991 - Petitions must be returned to the Clerk. December 9, 1991 - Petition signatures must be verified. -1- December 18, 1991 - Introduction of an Ordinance authorizing a Special Election or passage of a Resolution authorizing a special Election (Charter allows either one). December 19-20, 1991 - If a resolution is passed, authorizing a Special Election, Pre -clearance request mailed to the Justice Department. Allow 60-75 days from date mailed. January 2?, 1992 - The first Wednesday of the month is January 1, a holiday. I am assuming Council may move the meeting to January 2, 1992. If an ordinance was introduced at the December 18, 1991 meeting, it will be before Council for public hearing at this meeting. January 3-4, 1992 - Assuming an ordinance has been passed, Pre -clearance request mailed to the Justice Department. Allow at least 60 days for clearance, preferably 75 days. Count starts from date mailed to the Justice Department. March 4, 1992 - 75 days passed from December 20 - Special Election Day. 1644 March 19, 1992 - 75 days passed from January 4 - Special Election Day. In speaking with Attorney Graves, it was pointed out to me that the Charter, §11-1(c) also states, ordinances dedicating revenues, ordinances making, repealing, transferring, or otherwise changing appropriations, and special ordinances, shall not be subject to either the initiative or the referendum. The above has not yet been investigated. clf -2- INITIATIVE The undersigned wish to place a ballot initiative at a Special Election which will allow the renovation of the old Kenai Carr's Mall and provide a One Percent (1%) increase in sales tax in order to pay for the renovation over a amount of years.
