CHANGES TO THE AGENDA
ADD: B-1, Mr. Dennis Carlson has requested to speak to Council
regarding the City's sponsorship of ten flags placed on
holidays on Willow Street and Spur Highway. $30/flag,
$300 for ten flags. Council sponsored ten flags last
year.

From high-tech to high -touch, it was informat
by Jeff Fletcher
The latest in equipment, services, and
technologies for cities and towns was on
display on December 2-4, 1990 at the
National League of Cities' 67th annual
Congress of Cities and Exposition in
Houston, Texas. This year's exposition
was the largest in the history of the NLC
show„ with more than 300 exhibitors
occupying 31,800 square feet of floor
space in Houston's modern George R.
Brown Convention Center.
As always, the exhibit attracted a large,
interested, and influential group of city
elected and top appointed decision -mak-
ers, which makes it a "must" show for
suppliers of the municipal market.
Traffic in the exhibit hall was heavy
throughout the two and one-half days of
the show, as virtually all of the 4,150
registered delegates and approximately
2,800 guests attending the NLC meeting
made the most of their opportunities to
visit with exhibitors and see state-of-the-
art products and services that could ben-
efit their communities. A welcoming re-
ception and a luncheon for delegates
were held on the exhibit hall floor.
As in prior years, the exhibits in Hous-
ton were fun as well as informative. Del-
egates flocked to Chevron USA's "Wheel
of Fortune," enjoyed sleight-of-hand by
the magician from Browning -Ferris In-
dustries, and lined up to make street
signs with their own names on them at
3M Company's display showing reflec-
tive sign sheeting material.
Delegates also participated in
drawings for valuable products and ser-
vices held by many exhibitors, took
home literature by the bagful, and en-
joyed the selection of advertising attrac-
tions —bumper stickers, luggage tags,
magnets, pins, calendars, and plastic bag -
cutters —that were available as hand-
outs on the exhibit floor.

Network (A&E) Fourth Annual Cable
Television CityVideos Competition were
announced during the Congress of Cities.
Portland, Ore.; Broward County, Fla.;
Los Angeles and New York and their
respective cable systems were honored in
the category for systems serving more
than 50,000 subscribers.
Duncanville, Tex.; Dearborn, Mich.;
Tacoma, Wash. and Boulder, Colo. and
their systems were recognized in the
50,000-and-fewer-subscribers class.
Co -sponsored this year by NLC, A&E
and the National Cable Television Asso-
ciation, the competition challenges local
cable operators to join their municipal
leaders in creating a five-minute video
celebrating their community's innovative
efforts to improve its quality of life.
"Regeneration —A New Look at City
Life" was the theme.
First place winners in each category
received $5,000 cash awards; second
place, $3,000; third place, $2,000 and
fourth place, $1,000.
The field of entries was previously nar-
rowed to 20 finalists. Winners were cho-
sen by a panel of judges drawn from
cable television and city government pro-
fessionals.
Winners representing systems serving
more than 50,000 subscribers are:
First place: "Portland's Own: Pioneer
Courthouse Square," by Portland, Ore.
and Paragon Cable, which focuses on the
purchase of a historical town square by
local citizens.
Second place: "Regeneration," by
Continental Cablevision of Broward
County, Fla., about an ecological solution
to the problem of abandoned vessels in
intercoastal waterways.
Third place: "Hollywood Boulevart,"
by the Los Angeles Department of Tele-
communications and West Valley
Cablevision, which details a creative ef-
fort to redirect graffiti painters.
Fourth place: "NYC: Rebuilding
Lives," by the New York Department of
Housing Preservation and Development
and Paragon Cable of Manhattan, on
how urban renovation and relocation
bring new hope to homeless families.
Other finalists in this class are:
"Denver Calling," by the Denver Pub-
lic Library and Mile Hi Cablevision
"I Know I Can," by Columbus, Ohio
and Warner Cable Communications -Co-

"Misericordia—Chicago's Precious

tries Limited, a report on a gallery for
local artists created by volunteers.
Third place: "There's No Place
Like.. .'School," by Tacoma, Wash., TCI
and Viacom Cablevision of Pierce
County, about a school for homeless chil-
dren which provides a full array of sup-
port services.
Fourth place: "Depot Project" by TCI
Cablevision of Colorado -Boulder, which
shows how local community and busi-
ness support saved a 19th century rail-
road station.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA INCREASING
ESTIMATED REVENUES AND APPROPRIATIONS BY $500 IN THE GENERAL FUND AS A
RESULT OF A LIBRARY GRANT.
WHEREAS, the State of Alaska has awarded the City of Kenai a grant in
the amount of $500 for library books.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,

ORDINANCE NO. 1408-90
AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA INCREASING
ESTIMATED REVENUES AND APPROPRIATIONS BY $33,100 IN THE GENERAL FUND
FOR THE PURCHASE OF PROPERTY AT THE KENAI SENIOR CITIZENS CENTER.
WHEREAS, in 1989, the City of Kenai constructed a parking lot at the
Senior Citizens Center, which crossed a lot line of Lot 2, Spur
Subdivision No. 3, and
WHEREAS, in 1990, the City expanded the dining area of the Senior
Citizens Center, which also crossed a lot line of Lot 2, and
WHEREAS, the City has obtained an appraisal of these additional land
areas, which total 16,553 square feet, and
WHEREAS, the Federal Aviation Administration has concurred with the
appraised value of $33,100, and
WHEREAS, the General Fund should purchase this property from the
Airport.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA that estimated revenues and appropriations be increased as
follows:

referenced property. The purpose of this appraisal report is to estimate the
current market value of the fee simple estate of the subject property for sales
purposes.
Based on the inspection of th- subject property and the investigation and
analysis undertaken, I have formed the opinion that as of October 11, 1990, and
subject to the assumptions and limiting conditions set forth in this report,
the current market value of the subject is:
$33,100 - THIRTY THREE THOUSAND ONE HUNDRED DOLLARS
The estimate of value is based on an inspection of the property, an
investigation and analysis as set forth in the attached appraisal report, and

RE: Appraisal Authorization - A Portion of Lot 2A, Spur
Subdivision No. 9 (Resubdivision of Lot 2, Spur Subdivision
No. 3)
Dear Mr. Pattison:
The enclosed appraisal report is submitted for your agency's
review and approval. The City has read the appraisal report and
agrees with the just compensation established.
The City of Kenai purchased Lot 2, Spur Subdivision #3 for the
location of the Kenai Senior Citizens' Center. The sale took
place in August, 1982 and the General Fund paid the Airport Land
System $36,000 for the property. In the summer of 1989, the City
constructed a parking lot which crossed over the lot line to the
north. This summer, the City began an addition to the dining
room which has crossed over the lot line to the west. The lot is
being replatted; the new lot will be called Lot 2A, Spur
Subdivision No. 9. The City General Fund intends to purchase the
assembled property from the Airport Land System.
Please advise me in writing if this appraisal meets with your
approval. Thank you for your attention in this matter.

ORDINANCE NO. 1409-90
AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA AMENDING
KMC 20.05.080, CHANGING THE AMOUNT OF PUBLIC LIABILITY INSURANCE
COVERAGE REQUIRED OF PASSENGER VEHICLES -FOR -HIRE.
WHEREAS, the current amounts of public liability insurance set
forth in KMC 20.05.080 are set at a level which makes it
difficult for operators of passenger vehicles -for -hire to obtain;
and
WHEREAS, the Kenai City Council has determined that the levels of
public liability insurance of passenger vehicles -for -hire may be
amended without appreciably affecting public safety; and
WHEREAS, the Kenai City Council has determined that it is in the
best interest of the city to amend the amount of public liability
insurance required for operators of passenger vehicles -for -hire;
NOW, THEREFORE, IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF
KENAI, ALASKA that KMC 22.05.080 is hereby amended as follows:
20.05.080 Public Liability Insurance: An operator shall file
with the City Clerk evidence of insurance certifying the operator
insured for liability for damages on account of bodily injury or
death, or for damages to property resulting from the ownership,
maintenance, or use of any Passenger Vehicle -for -Hire. The limit
of such insurance policy shall not be less than $300,000 for
combined sinale limit for all bodilv inlurv. death. or uronerty

A local governing body as defined under AS O4.21.080(10) may protest the
approval of the application(s) pursuant to AS O4.11.480 by furnishing the
board and the applicant with a clear and concise written statement of
reasons in support of a protest of the application within 30 days of
receipt of this notice. If a protest is filed, the board will not
approve the application unless it finds that the protest is arbitrary,
capricious and unreasonable. Instead, in accordance with
AS O4.11.510(b), the board will notify the applicant that the application
is denied for the reasons stated in the protest. The applicant is
entitled to an informal conference with either the director or the board
and, if not satisfied by the informal conference, is entitled to a formal
hearing in accordance with AS 44.62.330-44.62.630. IF THE APPLICANT
REQUESTS A HEARING, THE MUNICIPALITY MUST COME FORWARD AT THE HEARING
WITH EVIDENCE AND ARGUMENT IN SUPPORT OF THE PROTEST.
Under AS O4.11.420(a), the board may not issued a license or permit for
premises in a municipality where a zoning regulation or ordinance
prohibits the sale or consumption of alcoholic beverages, unless a
variance of the regulation or ordinance has been approved.
Under AS O4.11.420(b), municipalities mast inform the board of zoning
regulations or ordinances which prohibit the sale or consumption of
alcoholic beverages.
If you wish to protest the application referenced above, please do so in
the prescribed manner and within the prescribed time. Please show proof
of service upon the applicant. Under regulation 15 AAC 104.145(c), the
board will grant a local governing body an extension of 30 days in which

The agenda was approved with the deletion of Item 3.
Dr. Paul Turner was unable to attend this meeting but
will approach the Commission at the January meeting.
3. APPROVAL OF MINUTES;
Pat Porter requested through Mr. McGillivray to delete her
title as Senior Citizen Director since she came to the
Commission as a concerned citizen and not as the Senior
Citizen Director. Commissioners Carlson and Boedeker
corrected the spelling of their names. The minutes were
then approved as corrected.
4. DIRECTOR'S REPORT:
a. Tot Time. Director McGillivray reported that the Tot
Time on Tuesday mornings seems to be going well with
approximately 20 tots and moms participating in the
program each week.
b. Batter's Boxes. Director Mcgillivray discussed the
batter's boxes that were put in this year and reported
the same company now has an even better design called a
Deluxe Jox Box which comes in two pieces but fits
together as one solid piece when assembled. These new
boxes run about $695 and he hopes to get three of them
depending on the budget. He will be approaching the
Little League for some financial assistance in
obtaining these new boxes. The ones put in this season
seemed to work out good and held up very well in the rain.
C. Gym Schedule. Commissioners reviewed the current Gym
Schedule and were generally happy with it.

d. Live and Learn. After discussing the letter from the
Richardsons regarding a summer camp for adolescent
boys, it was decided that this was not the type of
program to be getting involved with because of the
liability. It was decided to pass the letter back to
the Chamber.
5. OLD BUSINESS:
a. Comprehensive Plan Update. Commissioners reviewed a
map showing the bike trails, proposed bike trails,
current recreation sites and future recreation sites.
Most everything the Commission recommended was turned
over for the Comprehensive Plan.
b. Men's Basketball League. The Rec Center has received
nine rosters so far and more are on their way. The
league should soon be set up.
6. NEW BUSINESS:
a. Small Town Institute, Fallon, NV. While Director
McGillivray was at the Regional Meetings, he received
positive comments from those who had attended this
seminar structured for small towns and communities.
Most conferences are geared for large cities and
communities, and he feels this may be a good seminar to
attend in April, 1991.
b. Commissioners reviewed the Parent Information Sheet for
the Teen Center Ski Trips. Director McGillivray stated
this year they may team up with Soldotna High since Mr.
McCard has access to vans and it would provide a larger
base to pool from for the trips.
C. Recreation Program - U of A Fairbanks. Director
McGillivray commented on his meeting with the Vice
Chancellor who was very enthused about getting a
Recreation Program within the university system. He
passed around a proposed curriculum that has been

Mr. Bookey wants to expand his present camping area and has

City Council has already been approached and his application

Chairman Hultberg informed the Commission that the Chamber
of Commerce will be sponsoring a snow sculpturing event in
January and they could use some help. The area between
McDonald's and the Frontier Building will be the site and
they will.be using 8'x8' blocks of ice.

Mayor Williams called the meeting to order at approximately 7:08
p.m. in the Council Chambers in the Kenai City Hall Building.

B. SCHEDULED PUBLIC COMMENT (10 Minutes)
B-1. Tom Rohn - Newspapers in driveways.
Mr. Richard Dominick substituted for Mr. Rohn. Mr. Dominick
stated that he and Mr. Rohn have a business clearing driveways in
the winter. They use a large snow blower. They have had
difficulties with newspapers jamming their equipment because the
papers are not able to be seen many times because of the snow.
Mr. Dominick was speaking primarily of the unsolicited Ad -Visor,
delivered by The Peninsula Clarion. Mr. Dominick stated that
they have complained to the Clarion, but have had little result
from their complaints. They are requesting the Council to pass
an ordinance to restrict unsolicited newspaper delivery.
Councilman Walker suggested that newspaper boxes be placed at
homes and the papers be placed in the boxes. Mr. Dominick stated
that some houses do have boxes, but the papers are not placed in
them. Mr. Dominick added that they requested papers not be
delivered at different addresses and they are still delivered.
He does not believe newspaper boxes will solve the problem.
Councilman Smalley stated that on his street, he has seen
hundreds of the papers in the ditch. They are plowed into the
ditch when the plows go through. Councilman Smalley suggested
that instead of an ordinance, the carrier make sure the papers
are placed on porches, etc.

Mayor Williams stated that there are laws which protect
newspapers from being considered as trash. Mayor Williams stated
that Mr. Dominick should deal directly with the newspaper. Mr.
Dominick stated -they have tried, but have not been successful.
City Manager Brighton suggested that if the paper is not wanted,
the person should call and ask that it not be delivered. Marion
Nelson stated that she lives in Nikiski, and has requested that
this newspaper not be delivered to her. She stated that it does
stop until there is a new driver and it starts all over again.
Councilman Walker suggested that the resident go pick up the
paper. Councilman Smalley stated that the paper is delivered
around 3:30 a.m. and many times it snows on top of the paper and
cannot be seen.
Mr. Gerald Bruckman spoke to the Council. Mr. Bruckman stated
that he has called the newspaper and they have been sympathetic
and he has requested that the deliveries stop. He does not feel
that it is the resident's responsibility to pick up unwanted,
unsolicited deliveries. He believes that when it is unwanted,
etc., it is litter. There should be some legal recourse for
dealing with litter, or public nuisance. He believes the City
should pass an ordinance to control the situation.
Councilman Smalley suggested that the resident write a letter to
the newspaper owner stating the delivery stop. The resident will
then have grounds for litigation if the delivery continues.
Ms.orr�� "� 312 Stellar Street, spoke to Council. She is
the Circulation Manager of The Peninsula Clarion. She stated
that she has received telephone calls regarding the delivery of
the Ad -Visor. She stated that the paper is under new management
and that she has some suggestions that she will be making to the
new management regarding this concern. Ms. Kernan stated that
she keeps a list of requests to stop delivery and passes this
information on to the drivers each week. She highlights new
requests for drivers. She stated that those requests for no
delivery are only a small percentage of the amount of copies
delivered.
Mayor Williams suggested that the newspaper work with the public
regarding this problem. Councilman Smalley suggested that the
Clarion print an article informing the public that if the

delivery is not desired to contact the newspaper for it to stop.
Ms. Kernan stated that they have attempted to inform the public
in the past and will continue to do so.
B-2. Pete Ehrhardt - Peninsula Moose Lodge/Games of Chance
and Contests of Skill Permit Application
Mr. Ehrhardt introduced himself as an attorney representing the
Peninsula Moose Lodge. Mr. Ehrhardt introduced Mr. Darl Baier
and Mr. Larry Duvalt, members and officers of the Lodge, seated
in the audience.
Mr. Ehrhardt requested Council to reconsider the tabling of the
action on the Games of Chance and Contests of Skill Permit
Application for the Moose Lodge and adopt a motion to place it
back on the agenda. Mr. Ehrhardt stated that the Lodge has
approximately 1,000 members and to date, through pull tabs, have
contributed over $60,000 to charitable organizations in the area.
About 15% of their income from pull tabs goes into the Lodge for
the Club, and the rest is donated. The tabling of the motion
mainly hurts those charitable organizations to which they donate
and hurts the community as a whole. He believes that the
Council's action is unfair to the Lodge. The State's action
regarding the alleged illegal gambling is pending at this time.
The State has not charged the Lodge as yet or found them guilty
of illegal gambling. Also, whatever the State gambling decision
is, it is not related to pull tabs. The City ordinance requires
a State permit. There are other permit applications on the
agenda awaiting action by Council this evening. Mr. Ehrhardt
requested that their permit be placed on the agenda.
Mayor Williams informed the Council of the amount of income
received by organizations within the City through pull tabs. He
requested that the Council do a letter of non -objection for this
permit. It is the State's responsibility to decide whether the
Lodge's permit is acceptable in regard to the alleged illegal
gambling question.
Councilman Smalley asked the opinion of Acting City Attorney
Graves. Mr. Graves stated that when he talked with Chief Ross,
he indicated that the decision of whether to prosecute will be
made in mid -January. Chief Ross thinks it would be better to put
this permit application on the agenda in February.
Councilman Smalley asked if this permit has anything to do with
the potential litigation of the Lodge and the State. Attorney

Graves stated that at this time it is alleged illegal gambling of
other types. Pull tabs are acceptable under this permit.
Councilman Walker asked if the Lodge is found to have had illegal
gambling, would this permit be revoked at that time. Attorney
Graves stated that at this time he only knows what has been in
the paper and will not make any allegations.
MOTION:
Councilman Walker MOVED to remove the permit from the table and
would also instruct Administration to draw up a letter of non -
objection. Councilwoman Monfor SECONDED the motion.
City Manager Brighton added that probably the only legal
consequence, if the City objects to the permit, is that the
permit will probably not be issued. With the City's support, the
permit will come sooner. Mr. Ehrhardt stated that bingo, raffles
and pull tabs are not under investigation.

Councilwoman Monfor MOVED for adoption of Ordinance No. 1406-90
and Councilwoman Swarner SECONDED the motion.
There was no public comment. Councilman Smalley stated that the
Planning & Zoning Commission suggested that the property be split
with the City keeping the bottom half of the property because
there are trails available for hikers. The Commission's major
objection was the question of access.
Mr. James Arness stated to Council that access is not a concern.
A few people use it. Most people use the Spruce Street for
access at the beach. To the East, people use the old road going
to the Inlet for access. He is not wanting to stop any access.
Councilman Smalley stated that he does not have a problem with
the sale. He was stating the concern of the Planning & Zoning
Commission.
Mayor Williams referred to K.Howard's 11/15/90 memo to Council in
which she stated the findings of the Parks & Recreation
Commission, City Administration and Planning & Zoning Commission.
All recommended that the property be sold.

ITEM D: COMMISSION/COMMITTEE REPORTS
D-1. Council on Aging
Councilwoman Swarner reported that the minutes of the Council on
Aging's last meeting were included in the packet. There are two
openings on the Council on Aging and three names, included in a
memorandum from President Joanna Hollier, have been recommended
to the Council. Mayor Williams recommended Mr. Paul Padilla and
Ms. Pauline Gross to the Council for placement on the Council on
Aging. There were no objections from Council.
Councilwoman Swarner also reported that Congregate Housing Design
Committee Member Kathy Gardner has not been attending a number of
meetings due to her work scheduled. The Committee is requesting
that Mr. Roger Meeks be appointed to the Committee to replace Ms.
Gardner. There were no objections from Council.
Councilwoman Swarner stated that there will be a meeting of the
Congregate Housing Design Committee on December 20, 1990 at 10:00
a.m. at the Senior Center. The architect will be bringing
schematics for the Committee to review.

Council requested that Clerk Freas send appointment letters to
Paul Padilla, Pauline Gross and Roger Meeks. Also, a letter of
thank -you to Kathy Gardner for her past endeavors with the
Congregate Housing Committee and for continued participation.
D-2. Airport Commission
There was no quorum at the last meeting, thus no report.
D-3. Harbor Commission
Councilman Walker reported that there was no quorum for the last
meeting. They also need to replace one member due to lack of
meeting participation. Clerk Freas was directed to write a
letter of thank you to Mr. Jahrig for his endeavors on the Harbor
Commission.
D-4. Library Commission
Councilwoman Monfor reported that the minutes of their last
meeting were included in the packet. Councilwoman Monfor also
stated that the Open House was very nice.
D-5. Parks & Recreation Commission
Director McGillivray that the minutes of the Commission's meeting
of December 18, 1990 will be in the next packet. Mr. McGillivray
also reported to Council that the wall -mounted hair dryers
discussed at the previous meeting can cost approximately $350-600
for heavy-duty models. A less sturdy model, like those in
hotels/motels cost approximately $106.
Councilman Smalley stated that the dryers at the ice rink in
Soldotna cost $350-400 and are still working fine. Councilman
Smalley believes that if it is decided to purchase dryers, the
sturdier ones should be what is purchased. Mayor Williams
suggested that the cost of the purchase and installation of such
an item should be factored in to the next budget.
Mr. McGillivray also reported to Council as to the costs of
hosting the 1992 State Parks and Recreation Conference. He had
reported at a past meeting that he would like to apply for the
conference to be held in Kenai. He was asked to bring back
information as to costs to the City, etc. Mr. McGillivray
reported that of the last five confererences held, the cost to
the home community has been minimal. The outlay by the City

would be approximately $200. The registration fees pay for
meals, etc. The municipalities pay for their people to attend.
Usually 60-100 people come to the conferences.
Councilman Smalley recommended that Mr. McGillivray submit an
application.

G-1. Approval - Assignment of Lease/Carr-Gottstein Foods
Company to Allan Norville.
Mr. Agni, Development Manager for Carr-Gottstein Foods Company
(CG Foods) and Mr. Alan Norville were in attendance. Mr. Agni
spoke to Council and referred to the letter passed out to Council
prior to the meeting from Mr. Michael Moxness, CG Foods attorney.
The letter had attached Assignment and Assumption and Consent and
Approval forms.
Mr. Agni stated that Mr. Norville approached CG Foods to develop
the property and new store in Kenai. In order to proceed, Mr.
Norville needs to have an assignment of the lease to procure
financing and architectural and engineering permits. CG Foods is
in agreement with Mr. Norville's proposal. If Mr. Norville does

not perform, the lease returns to CG Foods. Mr. Norville is a
professional real estate developer. Mr. Norville has been a
Kenai Peninsula resident since the 19801s.
Councilman Smalley asked Attorney Graves for his legal opinion.
Attorney Graves stated that he did not have any particular
problems with the assignment. Attorney Graves stated that the
most important clause in the document for the City's purposes is
on Page Four. That clause states that CG Foods is not being
released from the Ground Lease if Mr. Norville does not perform.
MOTION:
Councilman Smalley MOVED for approval of the Assignment of lease
of Carr-Gottstein Foods Company to Allan Norville as submitted.
Councilwoman Monfor SECONDED the motion.
Councilman Walker stated that he was not comfortable with that
portion of the Consent and Approval (page 4) where the City
consents to "any reassignment of the Lessee's rights, title and
interests..." Councilman Walker asked if CG Foods can reassign
the lease without Council's approval. Attorney Graves stated
that phrase allows the lease to be reassigned to CG Foods after
completion of the project.
Mayor Williams stated that he understands it to mean that the
assignment is anticipated at a later date and will be between
Norville and CG Foods. Councilman Walker stated that he wanted
his question on record.

H-9. Discussion - Tidelands Leasing Provisions of KMC 11.20.
Mayor Williams stated that Administration has brought to
Council's attention that there is a vast amount of revenue to be
gained with proper leasing of the City tidelands/setnet sites.
Mayor Williams suggested that dialogue should begin with the
setnet people as to how to handle the illegality. Councilwoman
Monfor stated that she thought Council had given the leasing
responsibility over to Department of Natural Resources in regard
to these properties.
Councilman Walker stated that there were some of Council who did
not want to turn it over to DNR. Councilman Walker suggested
that an appraiser be contacted and find out the appraised value
of those sites. He feels the sites should be leased at their
appraised value. Councilman Walker does not think the properties
should be turned over to DNR. He believes this topic should be
addressed in a number of public meetings.
Kim Howard stated that she has contacted West Alaska Brokerage
who appraises sites in Bristol Bay. There is a concern that if
the City asks a lease price for a shore fishery lease which is
more than DNR is asking around the state, there is potential for
a lawsuit. Ms. Howard suggests that an appraisal be obtained for
one site.
Mayor Williams stated that he has discussed this matter with the
Borough appraiser. The Borough is looking at different ways to
set the value. They are moving slowly as they do not want to get
into an area where there are legal problems.
Councilwoman Monfor discussed the changes that were just made by
the Board of Fisheries with regard to subsistence/commercial
fisheries. There is a possibility that subsistence fishermen
could also have access to these sites. Councilwoman Monfor added
that if the City charges the leaseholders, they may have to
charge subsistence users. Mayor Williams stated that they may be
breaking new ground in developing a different type of lease for
those sites.
Councilman Smalley stated that DNR could charge the City a
management fee. Councilwoman Monfor stated that she does not
have a problem developing a leasing process. She does think that
there are many unknowns until a determination is made on
subsistence fishing. Until that determination is made, it is

foolish to go into this process. Mayor Williams suggested that
Council wait until after the summer's fishing season to see how
.the new Board rules work out.
City Manager Brighton stated that Administration was not asking
for a decision this night. There are a lot of loose ends. He
asked that Council allow Administration to go to a broker and
have one lot appraised. There is no rush. Ms. Howard reminded
Council that there are pending tidelands leases with Mr. Garnett.
City Manager Brighton suggested that a conditional lease,
allowing future * amendments, could be drafted with that
individual.
MOTION:
Councilman Walker MOVED to expend the necessary funds to actually
do an appraisal on one lot and investigate to determine if it is
necessary to continue and proceed with this. Councilman Smalley
SECONDED the motion. There were no objections from Council. SO
ORDERED.
H-10. Discussion - Sewer Treatment Plant Renovation Project
Public Works Director Kornelis referred to his memorandum
included in the packet. Director Kornelis also introduced CH2M
Hill representative, Jim Maciariello, who attended the Council
Meeting. CH2M Hill has requested an increase of $29,655 in the
cost for the Engineering Design on the 1991 Modifications of the
Sewer Treatment Plant.
A construction cost estimate has recently been completed on the
project by the engineer. The construction cost is estimated at
$1,450,0009 A great amount of time has been spent to reduce the
cost. CH2M Hill originally requested an increase of $78,295 to
$136,931. The negotiations to lower the cost are explained in a
letter from CH2M Hill which was also included in the packet. The
Public Works Department recommends that the amount be increased
to $29,655,
MOTION:
Councilman Smalley MOVED to amend the contract with CH2M Hill to
include an increase of $29,655. Councilwoman Monfor SECONDED the
motion.

Councilman Walker asked for supporting data showing the increase
in the scope of -the project. Director Kornelis referred to page
2 of CH2M Hill's December 14, 1990 letter. Listed there are
additional items which have increased the design and construction
costs.
Councilman Walker stated that the City is dealing with experts
who should be able to determine costs in the beginning and not
have to come back for a 40% increase. Director Kornelis stated
that the items listed (increasing the cost), are items which will
save the City money in the long run. Mr. Kornelis feels the
changes are necessary. Councilman Walker asked if these items
are required. Mr. Kornelis stated many are required.
Mayor Williams stated that there still may be unknown costs in
the building of the facility. Adjustments may be requested from
the mechanical contractor, as an example. After the $1,500,000
is used, then money would have to come from the General Fund,
Mr. Kornelis stated that he has budgeted $917,000 for
construction. The project should go to bid in February.
Councilman Walker and Mayor Williams asked Mr. Maciariello if he
can guarantee that his firm will not come back and ask for more
money later. Mr. Maciariello stated that they have a better idea
of what the project entails and would not be coming back for any
additional engineering design fund increases.
Mayor Williams informed Mr. Kornelis to investigate FHA grant
monies available for small communities for water and sewer
projects. The person to contact is in Palmer.

H-11. Discussion - Congregate Housing Update
Public Works Director Kornelis referred Council to a memorandum
which was passed out to them prior to the meeting. The
memorandum included an estimated budget and schedule developed by
the architect and engineers. At this time, they are in the
schematic design phase. The design is going along smoothly.

H-12. Approval - Proof of 1991-92 Capital Improvement Project
List Brochure
The CIP list brochure proof was included in the packet for
Council to review. Mr. Kornelis stated that the outside of the
brochure will be the same as other years, only with the year
changed. The inside of the brochure will have space for another
picture. He has chosen a picture of the airport. Mayor Williams
asked if Mr. Kornelis had proof read the form. Mr. Kornelis
stated that he found no problems. It is ready to go to press.
There were no objections from Council in regard to the brochure.
ITEM I: ADMINISTRATION REPORTS
Mayor
Mayor Williams stated that he planned to call an executive
session, but thought it would be better to wait until there is a
full Council. He distributed a memorandum from Finance Director
Brown to Council for their review prior to calling an executive
session.
Mayor Williams reported that he will be meeting with Mayor Gilman
and Mr. Steffy with regard to planning a strategy to obtain the
funding necessary to build the Helicopter Cold Water Recovery
School. There will also be a meeting with Mr. Gilman, Mr. Steffy
and representatives from UAA on January 7, 1991 with regard to
the Fire Training School. Mayor Williams distributed a copy of a
faxed proposal letter from Brad Gilman, a Washington, D.C.
attorney. Mr. Gilman is a son of Mayor Gilman. Brad Gilman has
proposed to lobby for the City in Washington, D.C., to obtain
monies to build the facility. Mayor Williams requested that the
Council review the proposal and that a decision of whether to
hire Mr. Gilman as a lobbyist will be made at a later date.
Mayor Williams distributed to Council a copy of a booklet of
information regarding the Helicopter Cold Water Recovery School
which was put together as an informational handout. Mayor
Williams stated that a considerable amount of effort is being put
into this project and that if it is placed in the City, it will
be a very important economic development for the City.
Councilwoman Swarner asked what the fee arrangement would be for
the lobbying. The letter states $24,000, plus incidentals.

Mayor Williams stated that it is a rough draft proposal at this
time. Councilwoman Swarner stated that she would like to see how
much the "incidentals" are projected to be. Also, if the other
lobbyist could be involved. Mayor Williams stated that many
times you need a lobbyist on the spot. This is difficult with
the time difference, plus the distance and travel time involved
to get to Washington, D.C. when it is necessary.
City Manager Brighton stated that these items are negotiable to
be discussed at some future time. He asked Council to review the
proposal at this time and discussion will follow later.
Mayor Williams stated that the Helicopter Cold Water Recovery
Project will be his primary project this year. He will be
putting a lot of time and effort into this project. He wants
Council to be aware of what is transpiring.
Mayor Williams stated that he has spoken with the printer in
regard to the reprinting of the City brochure. He would like to
talk with the printer again in January. He believes there is a
need for the brochures. The price will probably be about $6,000-
$7,000. He will bring this back to Council perhaps at the next
meeting.
Mayor Williams stated that the NLC Conference was very
informative. Things look very bad for small cities.

Reed prior to the January 2, 1991 meeting. Administration should
contact Mr. Reed and make reservations for dinner. Clerk Freas
is to contact the press and inform them where the meeting will be

fisheries business tax. They are working on HB 400 and HB 456.
She would like to know that the City will support her both
financially and the time involved.

Mayor Williams stated that prior to the meeting with the
legislators a weeks ago, he met with two of the local
legislators. It was suggested that the congregate housing
project be requested to be placed in the Governor's budget.
Director Kornelis stated that he has sent a cover letter and
portfolio. Council requested that the City Manager and Mayor
write a letter to the Governor regarding Congregate Housing,
Mayor Williams added that he will be attending the inaugural ball
in Anchorage. He has information if anyone would like to
purchase tickets.
Councilwoman Monfor - Happy Holidays! Councilwoman Monfor would
like the Council to consider going back to meeting with just the
City's legislators to discuss projects for the City. Mayor
Williams asked that she remember how helpful Zawacki was in
obtaining the Congregate Housing funding. Councilman Walker
added that Mr. Zawacki is very responsive.
Councilman Smalley - Appreciated the Public Works Department's
punctual snow removal. He is pleased to see that the sidewalks
are being cleared also. He also thanked Attorney Graves for the
prompt drafting and inclusion of Ordinance No. 1409-90 with
regard to liability insurance for vehicles -for -hire.
-- Will the City undergo additional costs for fuel which are not
included in the budget and how is it being handled? Mr. Kornelis
stated that diesel fuel is quite a bit higher. He does not know
at this time if there will be a budget problem. It depends a lot
on the amount of snow removal required.
Mr. Kornelis was informed of street lights needing repair at
Willow and Marine, and Tinker and Lawton.

ORDINANCE NO. 1411-91
AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA AMENDING KMC
22.05.045(a)(2).
WHEREAS, KMC 22.05.045(a)(2) provides that the City is to secure a
grantee index from a title company prior to acceptance of a note and
deed of trust in a sale of City land, and
WHEREAS, the language of this code section is flawed in that a grantee
index is not a product that can be purchased, and
WHEREAS, the City administration is scheduling a sale of foreclosed
property and believes that it is unnecessary to obtain title reports
and reviews of the grantee index on most sales of foreclosed
properties.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA that KMC 22.05.045(a)(2) is hereby amended as follows:
22.05.045 Terms for Financing Sale of City Lands: (a) In order
to expedite and facilitate the sale of City lands, the City Manager is
hereby authorized to accept terms for said sales and may accept a note
secured by a deed of trust for a portion of the purchase price
thereof, subject to the following restrictions:
(1) If the sale is to a lessee who has placed a lien for
financing upon the land or improvements, then the City Manager is
not authorized to sell the land except for total cash payment,
provided, however, that the City Manager may accept a note
secured by a deed of trust subordinate to the existing security
interest if the amount of the note thereby secured is within the
difference between the fair market value of the land with
improvements, and the sum of all prior security interests. The
sale documents shall be subject to the same restrictions
contained in the lease as the lease provides at the time of sale.
(2) Except for property sold by the City subsequent to
foreclosure for delinquent taxes or assessments, [P]prior to
making a determination to accept a note and deed of trust from a
prospective purchaser, the City Manager shall secure a
preliminary commitment for title insurance and a review of the
grantee index covering the party desiring to purchase the land
from the title company [IN THE RECORDING DISTRICT IN WHICH SAID
PARTY RESIDES AND ALSO] in the local recording district, and no
credit will be advanced on such sale if there are any delinquent
liens or unpaid judgments found in the title company report until
any such judgments or liens are paid and releases therefor have
been filed.

SUBJECT: KMC 22.05.045 (Grantee Index)
The City administration has been reviewing the Kenai Code and Alaska
Statutes in preparation for a sale of foreclosed property. We will be
bringing an ordinance and other information to Council soon for a sale
that should take place in late spring or early summer.
One provision of the City Code that must be dealt with is KMC
22.05.045(a)(2), which says the City must "secure a grantee index
covering the party desiring to purchase the land" when a note is taken
on the sale. The attached ordinance does three things:
(1) It says that the City will secure a preliminary commitment for
title insurance and a review of the grantee index. The old
language makes no sense; one cannot secure or purchase a
grantee index, which is a reference book not a product.
(2) It eliminates the requirement of this review in the recording
district in which the proposed buyer resides, while retaining
the requirement in the local recording district. The review
in the buyer's recording district would probably not be very
effective and, in fact, is not being done now.
(3) It makes an exception for sales of foreclosed property. The
administration feels that this is an unnecessary cost and
burden when selling most foreclosed property. In many cases,
such as for inexpensive parcels, we should ask for cash sales.
Thus, there would-be no note and no need to investigate the
buyer. In other cases, such as for expensive parcels, we
should set the down payment high enough to help ensure that as
much of the back taxes and assessments will be paid as
reasonably possible.

After arriving in Palisade, Colorado on my vacation with
Patrician my sinuses started acting up. I decided to see a
specialist (please refer to the letter from Dr t Huffaker for
credentials). I was told I was in need of an operation as soon
as possible. After being assured it was not, or should not be a
difficult operations and I would he an outpatient at the
hospital with a two week recovery period, I said go ahead.
The inflammation turned out to be so bad, and my condition so
run down, the doctor left me in the hospital for the next day
feeding me antibiotics. on my check-up? eight days later, he had
to do some touch-up surgery. I have to go hack on the seventh of
January for mother check-up to make sure everything was as he
expected and doing okay.
This note is to explain why I have not returned and why I
would like to be excused from the next City Council meeting* I
am hoping things will be alright with my sinuses and I can return
for the meeting on January 16, 1990.
Hope all had a merry Christmas and will be enjoying a Happy
New Year .

Interest rates have generally
fallen throughout this quarter.
As
noted on Exhibit II, the one-year treasury
bill discount
was 7.07 on
October 5th
and was 6.55 on December
21st.
On December
19th, the
Federal Reserve Board cut its
discount by one-half percent
to 6.5, the
first change
in the rate since
February, 1989.
Everything looks like we are headed for even lower rates, given the
economy, unless we have a war. And even if there is a war, I'm not
sure what it means for interest rate. A short war would probably not
have a significant effect. A long war might (1) push interest rates
down even further because it would deepen and lengthen the recession,
or (2) push interest rates higher because it would widen the budget
and trade deficits. I'm using the coin -flip method of prediction.

As you can see from the purchases this quarter, I'm still extending
maturities (betting on lower rates). But, I'm also keeping about $1.5
million uncommitted in the money market fund. I'm straddling the
fence. At September 30, 1990, the average days maturity was 267 days.
At December 27, 1990, the average days maturity has been extended to
326 days.
Exhibit I shows the current status of the City's portfolio. The
average annual yield of the current portfolio is 8.677% on $26,519,019
invested. At the end of last quarter, the City's average annual yield
was 8.699% on $26,670,825 invested.
As I do each quarter, I will compare the City's return on investment
with specific benchmarks:

I've said it before, but I feel it must be repeated. This yield
advantage is almost a fluke. It is a result of the purchase of
$11,000,000 (over 40% of the portfolio) of treasury notes at 9.473%
that mature on April 30, 1991. Since I purchased these notes on May
11, 1989, interest rates have dropped like a rock. The notes will
mature before next fiscal year begins. I've ran various scenarios
regarding the reinvestment rate, and it goes something like this: if
all securities that mature between now and August 1, 1991 are
reinvested at 7.25%, our average interest rate on the entire portfolio
will drop to 7.4% for FY91-92. At that rate, it would reduce our
estimated interest revenue in next year's budget in the General Fund
by about $175,000.
If the recession is short, and interest rates pick up before the
maturity date of the $11,000,000 notes (April 30, 1991), then things
won't be that bad. In any case, it is doubtful that this finance
director will be willing to go out on a limb again and put 40% of the
portfolio in one security. It worked once; I was luckier than smart.
The result will probably be several securities with staggered
maturities resulting in an average yield much closer to market rates.

Water and Sewer Improvements
FOR: Council meeting of January 2, 1991
I talked to Mr. Sam Hardin of the Farmers Home Administration who
explained their two programs for financial aid for water and sewer
improvements.
1. Sewer and Water Loan Program. This is a lending program where
the loan is paid back 100%. It is available for cities that
can not et a loan any other way. If a city has a poor credit

rating own loan the or is unable to get their Y may be
eligible.
2. Sewer and Water Grant Pro ram. This program is for small
cities that have a medium household income level that is less
than the state average. It is based on the latest 10 year
census which is for 1980. Mr. Hardin thinks that it will be
12 - 18 months before the 1990 census can be used. According
to the 1980 census Kenai had a medium household income level
of $31,129 while the state non -metro areas had a level of
$23,423,
It appears that Kenai does not qualify for either the loan or grant
program offered by Farmers Home Administration.

After reading your proposal concerning the " Alaska Life Safety Institute " to be
located within the City of Kenai, I found the proposal interesting for several reason's.

valuable a Cold Water Training program would be to any over water activity. The
program that you outline in your booklet will benefit many concerns throughout Alaska
and beyond. At this time I know of only one training program available to the private
sector which is being conducted in the Southern part of The United States at a cost of
at about $1000.00 a day per person. As I understand the Southern can not
program
offer the training that the Alaska program would and the Alaskan fee's would avail the
programs to more trainee's.
Secondly Diversified Services is a facility that services life raft's and ro osin

to open our doors for business in the fall of 1991. Our facility will be built just a mile
and a half from the Institute. We are working with the United States Coast Guard
towards Coast Guard Certification, making this facility Y the only one of it's kind on the
Kenai Peninsula.

The Attorney General has advised the Departmentof Commerce and Economic

Development, Division of Occupational Licensing, n an opinion dated October
249 1990, that pull -tab sales by other than permittees and licensees are not
authorized. The opinion holds that the department does not have authority to
authorize vendor partici ation in pull -tab sales. Accordingly, this week the
Department of Law noti ed the Division of Occu ational Licensing's Ganung
Section that permits or licenses are not to be issue by the department to, or for
the use of, anyone except a qualified permittee or licensee.
Effective January 1, 1991, pull -tab sales at vendor locations may no longer
occur. Therefore, on or before December 31, 1990, all unopened pull -tab
games held by a vendor(s), and all pull -tab games in play at a vendor location,
must be collected by the permittee or operator on whose behalf the pull -tab
games are being conducted.
As of January 1, 1991, no pull -tab sales may occur at any location other than the
licensed gaming premises of a permittee or operator. Gaming activity that
occurs at any unlicensed premises or locations will be considered a violation of
gaming statutes.

T received a call yesterday - from Tom .,.Swearingen, an asbestos
contractor, notifying me of his concern that municipalities and
school, districts may be unaware of new asbestos regulations (Alaska
Construction Code 059045) filed on December 3, 1990 and effective
on January 2, 1991. Because of the potential financial impacts of
the regulations as he sees it and the nearness of the effective
date, z are bringing this to your attention. If you are concerned
you may want to contact the Governor's Office or DOL Commissioner
Usera and perhaps request some relief by delay or revision.
Unfortunately, there is insufficient time for the League to
investigate the issue and, if appropriate or necessary, to develop
a formal position by January 2, 19919
According to Mr. Swearingen, he has been in contact with Bruce
'endall, the Governor's Legislative Liaison, Mr. Swearingen said
the amended regulations puts a greater burden on municipalities and
school districts by requiring them to perform inspections for
asbestos prior to any work; requires the municipalities to train
theiremployees for working with asbestos; requires medical
surveillance** requires the use of a new type of respirator; and
medical surveillance records to be maintained for 30 years. He
said he has been working with several school. districts (Anchorage,
Nome and Valdez),, and that the Anchorage School' District (Mike
Maguf f 3 4 8-5113) intends to file an objection with the Governor's -
of f ice .
I did contact Richard Arab, Deputy Director, Occupational Safety
and Health (455-r4855) . He said the regulations for the most part
are not new, According to him, the most significant changes are
clarifications requiring employers to check the work site
renovations and a table that distinguishes "maintenance" and
"abatement". He said he would be willing to send copies of the new
regulations to anyone who requests them. AML will provide him with
a nailing list but you won't get a copy before their effective

Kenai River Recreational Site
The proposed location is in the center of the prime
recreational use area of the entire Kenai River system. The
environmental pressure in the lower Kenai River due to lack
of public facilities of any kind has reached an alarming
state during the last 10 years.
Difficult as it may be to believe, there is not one
SANITARY FACILITY open to the general public on this World
Famous River from the river mouth for the next 162 miles
upstream. With boats spending six or more hours afloat you
can imagine how much pollution has taken place in the last
ten years. The need for a full recreational site has become
acute this past year (1990) as each year is progressively
worse than the previous year. The complete disregard by
many commercial and individual river users for the property
owners potential liability and safety of their property has
convinced our neighbor, wife and I to sell appro-Kimately 50
acres, about 600 feet of prime Kenai River frontage, and a 60
foot road access to the Kenai Spur highway to the State of
Alaska.
The decision to sell the property by the owners was not
an easy decision as most homesteaders find it very difficult
to sell their best property. Once the decision was made I
have been in contact with State. Parks, Fish and Game
Dingle Johns Funds) and "The Nature Conservancy"
(Environmental -Conservation -Ecological Group). All three
groups sent a representative to inspect the property last
Fall and all agreed the property was an exceptional location
on the Kenai River for an ideal show place Public
Recreation Site with adequate land for a multiple public use
project.
"The Pillars" an important salmon fishing landmark, is
located just down stream from the proposed site. "The
Pillars" also a part of the Oberts Homestead has been used
over a period of time by the Fish and Game & Fish and
Wildlife fisheries biologists for some of the most recent
major Kenai River biological discoveries. F & W found "The
Pillars" an invaluable base of operation for their landmark
discoveries made during their 19179-1981 King Salmon radio
tagging program. The main stream Kenai River channel site
extended seasonal access year round. This valued access
would be invaluable for public emergency, game warden, and
public services or a base for new biological salmon research
programs. Considering the amount of land, various
governmental agencies who need river access or equipment
storage could use the site to monetary advantage.
