City Attorney's Salary
KENAI CITY COUNCIL
WORK SESSION
January 9, 1991
Work Session began at approximately 7:05 p.m.
Councilmembers present were: Smalley, Measles, Williams,
Swarner, and Monfor.
Administration present were: Cary Graves, Wm. J. Brighton, C.A.
Brown, and City Clerk Freas.
Information distributed: 1/3/91 CAB memorandum to WJB stating
the salary history of Tim Rogers. Also an AML breakdown of
attorney salaries for municipalities in Alaska.
Mayor Williams MOVED to pay Cary Graves a salary of $65,000 per
year as City Attorney. Councilman Measles SECONDED the motion.
Councilman Smalley stated he would support that offer.
Councilwoman Swarner stated as a condition that Cary must live
inside the City. Councilman Smalley stated that he did not think
it could be a condition of hire, but council should encourage him
to live inside the City. Cary stated he expected that request
and has no problem with the request.
Councilwoman Monfor asked if Cary would receive the same benefit
package as other City employees. The answer was yes.
Cary stated that at this time he did not believe it was necessary
to hire someone to fill the Legal Assistant position. He stated
further that Diane Craig, his secretary, has registered for
paralegal classes at the college. She is handling collections at
this time. He would like to try it this way for now. Councilman
Measles agreed. Cary stated further that if a time came that
extra help was needed, he could contract work out, etc.
Cary stated the major cases before him at this time are: Leigh v.
City, HEA appeal, Cunningham Park injury case, Burnett appeal.
Mayor Williams asked what other duties he performs. Answer:
Traffic court, collection work, lease work, zoning questions,
interpretations, etc. Mayor Williams asked if Cary is
comfortable with the work load as it is. Answer: Yes.
Councilwoman Swarner brought up another point. She stated that
she wanted it understood that Cary is working for the whole
Council, not personally for one member of the Council. That any

research he does should be requested by a majority of the
Council, not by just one member. Councilmembers Monfor and
Smalley agreed.
Mayor Williams stated that the annual salary discussed ($65,000)
will be brought back to the Council on Wednesday night. Finance
Director Brown asked from what date did Council want to start
this amount of pay. Cary stated that he accepted the job on
January 3, 1991. Councilman Smalley asked if this pay raise
start on January 1, 1991. Finance Director Brown stated that
there was plenty of money in the budget. Rogers' last day of
work was technically October 31, 1990. Cary has been working at
the job from before that. Council could go back to November 1,
1990 if they desired. The Council should make a motion at the
1/16/91 Council meeting which will include the amount of pay and
the date from which they wish to start this rate of pay.
Mayor Williams suggested starting January 1, 1991. Cary agreed.
Councilwoman Swarner discussed the travel budget. She stated
that much travel was paid for Tim Rogers than should have. She
does not want Cary to think that he can go that often.
Councilman Smalley did not think that there will be a problem.
Mayor Williams suggested that they not allow leave time to accrue
for a large amount. Councilwoman Monfor stated that Council
should be sensitive to Cary needing to take leave time. It was
repeated that Cary will have the same benefit package as other
employees.
Mayor Williams asked Cary if he wanted a contract or 30-day hire
as the Clerk and City Manager. Cary stated he would be satisfied
with the same good -faith hire as the City Manager and City Clerk.
ITEM COMPLETE.
Other discussion followed regarding the suggestion made by Mayor
Williams that the City purchase the bowling alley and make it
into a convention center. Mayor Williams stated that he felt
that when a piece of property can be acquired by the City for no
cost, it is something to look at. Councilman Smalley stated that
the citizenry has spoken against the concept of a convention
center. Councilman Measles stated he is very happy to field
calls regarding a convention center as he feels it has been
needed for twenty years.
Mayor Williams updated Council members regarding the Fire
Training School. He stated that he was in a meeting on 1/7/91.
Wheels have started to move. A re -zoning of the area to Light
Industrial needs to be completed. This question will be before
the Planning & Zoning Commission on January 23, 1991. This

ordinance will be before Council on 2/6/91 (effective 3/6/91). A
public hearing regarding air quality control by the DEC will be
held on 3/15/91. If everything is acceptable, the University
will want to lease that property from the City and if the City
approves the lease, the University can put out a bid for the
construction of the building. Construction could start 6/1/91.
Mayor Williams and Mayor Gilman will be meeting with Commander
Cignalini in Juneau and then will met with the University after
his return from Juneau. Mayor Williams will then bring the
question of hiring a lobbyist in Washington, D.C. before Council
again.
City Manager Brighton added that in order for the City to lease
the property to the University, the City must first purchase the
property from airport lands. Kim Howard is already getting an
survey and appraisal of the property. Finance Director Brown
added that prior to purchasing the property from airport lands,
it must first be released from FAA. Mr. Brown also stated that
an ordinance for the acquisition of the property will be
introduced at the 1/16/91 council meeting.
Also discussed was the Church property on Fidalgo. Councilwoman
Swarner asked what was happening with the property as she noticed
the snow was being cleared and a for sale sign has been placed on
the building.

Last night, you asked me the starting pay of the last City Attorney. Tim
Rogers was hired on September 15, 1982 at an annual salary of $52,500.

Between 9/15/82 and today, classified City employees have received cost of
living increases totaling 23.5%. A person could say, therefore, that the
starting pay of the last City Attorney was roughly equivalent to $65,000 in
today's dollars, based upon the pay increases other City employees have
received (52,500 x 1.235 = 64,838).
