City of Kenai ORDINANCE NO. 1522-92 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING PORTIONS OF THE ANIMAL CONTROL ORDINANCES OF TITLE 3 OF THE KENAI MUNICIPAL CODE. WHEREAS, modern and efficient animal control procedures are in the best interest of the City of Kenai; WHEREAS, the City of Kenai wishes to encourage pet owners to have their animals spayed or neutered; WHEREAS, the public safety sometimes requires that animals be taken into protective custody; NOW, THEREFORE, BE, IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that KMC 3.05.010 (7)-(15), 3.05.100(a), (b) and (d); 3.15.010, 3.15.020(a)(3), 3.15.020(a)(7)(h) and 3.15.050; 3.20.010, 3.20.050; and 3.25.090(a) be amended as follows: 3.05.010 Definitions: As used in Title 3: (1) "Animal" means all domestic or domesticated members of the Kingdom Animalia. (2) "At large" means not under restraint. (3) "Cat" means a domestic or domesticated member of the family Felidae. (4) "Current rabies vaccination" means a vaccination: (a) as specified in the "compendium of animal rabies vaccines" prepared by the Rabies Subcommittee of the National Academy of Sciences and by the National Association of State Public Health Veterinarians, Inc. (1978); (b) administered in accordance with state law; and (c) evidenced by a rabies vaccination certificate in a form approved by the State Division of Public Health. (5) "Dangerous Animal" means any animal which due to improper or inadequate supervision or control has done an act harmful in its character to human beings or animals, regardless of whether the act is done in a playful or hostile manner. (6) "Dog" means a domestic or domesticated member of the family Canidae. [(7) "DOG FANCIER'S FACILITY" MEANS A PREMISES WHERE A PERSON OWNS FIVE OR MORE DOGS OVER THE AGE OF FOUR MONTHS, AND WHICH IS NEITHER A KENNEL NOR A DOG MUSHER'S FACILITY.] 1 [(8)] Q "Kennel" means a premises where a person owns four or more dogs over the age of four months are kept. [IN THE OPERATION OF A BUSINESS SUBJECT TO TAXATION UNDER AS 43.70, WHICH BUSINESS INCLUDES THE BUYING, SELLING, TRAINING, BOARDING, OR BREEDING OF DOGS.] [(9)] L8� "Impoundment" means: (a) The seizure of animals by the methods set forth in KMC 3.25.010(d). (b) Seizure of a vicious animal. [(10)] L`-q "Officer means a person charged by law with the duty to enforce provisions of this title. [(11)] (10) "To own" an animal includes having title, keeping, harboring, and having custody or control of an animal. [(12)] LLI "Person" includes individual, joint venture, partnership, corporation, or unincorporated association. [(13)] L121 "Restrain" means: (a) physical confinement, as by leash, chain, fence, or building; or (b) under competent voice control when an animal is engaged in an activity or form of training requiring that it not be physically confined; or (c) under competent voice control when an animal is on the property of its owner. [(14)] LU3 "Sterile" means rendered incapable of reproduction by surgical operation. [(15)] .{ 141 "Vicious Animal" means an animal that has done an unreasonable act harmful to human beings or animals which act is done in a hostile manner. Any animal which has been twice adjudged a dangerous animal by a court of competent jurisdiction, whether by a plea of no contest or guilty or by trial, shall be considered vicious for purposes of penalties imposed by KM(., 3.05.060(d). (Ords. 935, 1185) 3.05.100 Fees: (a) The fee for a kennel facility [DOG FANCIER'S FACILITY, OR DOG MUSHER'S FACILITY] shall be. $5.00 per dog in the facility, up to a maximum of $25,00. (b) The fee for a dog license shall be [$3.00] $2.00 for a sterilized dog and [$5.00] 10.00 for all other dogs. The fee for replacing a lost clog license tag with a duplicate shall be $.25. (c) The fee for redeeming an impounded animal shall be the sum of the impoundment and boarding fees specified in this subsection, provided that if, within thirty (30) days of paying the impoundment and boarding fees, the owner of an impounded animal presents proof that the animal has been sterilized, the Animal Control Officer shall refund to the owner the impoundment fee for the animal. The refund for sterilization shall be allowed only once for any animal. (1) First Impoundment Fee: Dog - $35.00; Cat - $10.00, (2) Second Impoundment Fee within a twelve-month period from first impoundment: Dog - $50.00; Cat - $20.00, plus citation, shots, license, and boarding fees as required. (3) 'Third impoundment fee and thereafter within a twelve-month period from first impoundment: Dog - $75.00; Cat - $30.00, plus citation, shots, license, and boarding 2 fees as required. (4) Boarding fee: Dog and Cat, $3.00/day; Other animal weighing more than fifteen (15) pounds, $5.00/day. The boarding fee also shall include any other costs actually and reasonably incurred by the Animal Control Office in maintaining the animal, including, but not limited to, medical care. (5) Any impounded animal which by reason of its size, strength, dangerous propensities, or other characteristics cannot reasonably be kept in the Animal Control Shelter may be reclaimed upon payment of an impoundment fee of $25.00 plus the actual costs reasonably incurred by the Animal Control Office in impounding, transporting, and keeping the animal. (d) The fee for adopting an animal shall consist of a charge [OF $10.00[] to defray the cost of vaccinating [THE ANIMAL TO AND HELP DEFRAY THE COST OF], impounding, spaying; or neutering,, and caring for the animal, and shall be set by the City Manager. (Ord. 935) 3.10,010 Interference with Peace or Privacy [PREVENTING ANNOYANCE BY ANIMALS]: No person may permit an animal which he owns to [ANNOY] interfere with another [PERSON] uerson's [BY INTERFERING WITH THE LATTER' S SLEEP, WORK, OR] reasonable right to peace or privacy by making repeated or continued noise. Chapter 3.15 LICENSED FACILITIES Sections: 3.15.010 Licenses Required. 3.15.020 Licensing Procedure. 3.15.030 License Revocation. 3.15.040 Hearings -- Appeals. 3.15.050 Standards for Operating Facility. 3.15.010 Licenses Required: No person may operate a kennel [DOG FANCIER'S FACILITY, DOG MUSHER'S] facility without having a license therefor issued pursuant to this chapter. 3.15.020 Licensing Procedure: (a) Application for a license under this chapter shall be to the Chief Animal Control Officer. The application shall include: (t ) The name and address of the applicant; (2) The number and breeds of dogs to be, kept in the facility; (3 ) The type of facility the applicant proposes to operate under the license, and a description of the proposed facility. [SUFFICIENT FOR THE CHIEF ANIMAL CONTROL OFFICER. TO DETERMINE WHETHER THE FACILITY SHOULD BE LICENSED AS A KENNEL, DOG FANCIER'S FACILITY, OR DOG MUSHER'S FACILITY.] An application for a kennel license to be used for commercial purposes shall include a copy of a current Alaska Business License for the operation of the kennel and a Borough Sales Tax application or registration number; (4) The address of the premises where the applicant proposes to operate under the license, and the name and address of the owner of the premises; (5) A diagram of the premises on which the applicant proposes to operate under the license. The diagram shall show the lot lines and the location and dimensions of yards and structures on the premises where the applicant proposes to operate under the license, designate the parts of the premises on which dogs will be kept, and show the location and use of structures of adjacent lots. The diagram need not be based upon a formal survey of the premises. (6) The license fee required by KMC 3.05.100; (7) Proof of a current rabies vaccination for each dog kept in the facility that is over the age of three months. (b) The Animal Control Office shall not issue a license under this chapter to any person who has been convicted of neglecting an animal or cruelty to an animal. (c) The Animal Control Office shall not issue a license under this chapter until it has inspected the premises where the applicant proposes to operate the facility, and determines that the applicant will operate the facility in accordance with standards set forth in KMC 3.15.050. (d) The Animal Control Office shall prepare a written repect of the inspection's findings; including any reason why the proposed facility does not meet the standards set forth in KMC 3.15.050 and any steps which the applicant may take to make the facility qualify for a license. The Animal Control Office shall give the applicant a copy of the report. (e) A license issued under this chapter shall expire on December 31st of the year in which it is issued. (f) An application to renew a license issued under this chapter shall be made at least thirty (30) days after the license expires, and shall be made in the same manner as an application for a new license, provided that the applicant may rely upon materials submitted with his original application to the extent they accurately portray the current condition of the facility. (g) 'The applicant shall be informed in writing that the application or receipt of the license provided for in this chapter does not relieve the applicant of meeting all zoning ordinance requirements or any other applicable City, Borough, or State laws or regulations. (h) The applicant shall agree in writing that the kennel [DOG FANCIER'S, OR DOG MUSHER'S] facility may be inspected by the Chief Animal Control Officer or his designee at any time during business hours of the permittee. 3.15.030 license Revocation: (a) If an inspection of a facility licensed under this chapter reveals: (1 ) The facility constitutes a health hazard; (2 The facility violates a City or Borough ordinance or regulation; 4 (3) The facility violates a provision of this title, a term, condition, or limitation of a license issued under this chapter or a City regulation promulgated under this title. The inspecting agency may so notify the operator of the facility, stating in writing the steps the operator may take to remedy the violation. (b) The inspecting agency shall allow a facility operator who has been notified of a violation under subsection (a) of this section a reasonable time not exceeding fifteen (15) days to remedy the violation. At the end of that period, the inspecting agency shall reinspect the facility to determine whether the violation has been cured. (c) If after reinspection, the inspecting agency determines the violation has not been cured or that new violations have occurred, the Chief Animal Control Officer may commence a proceeding to revoke the license for the facility under KMC 3.15.040. 3.15.040 Hearings -- Appeals: (a) A person aggrieved by the granting, limiting, conditioning, or denying of a license under this chapter may, within fifteen (15) days of the action complained of, apply for a hearing before the Chief` Animal Control Officer or his designee. Upon timely application under this subsection, the Chief Animal Control Officer or his designee shall hold a hearing to determine whether the license should be granted, conditioned, limited, or denied. The person aggrieved may appeal the decision of the Chief Animal Control Officer to the City Council within thirty (30) days whose decision shall be final. (b) Before revoking a license under this chapter, the Chief Animal Control Officer or his designee shall hold a hearing to determine whether the license should be revoked. The party aggrieved may appeal to the City Council within thirty (30) days of the decision whose decision shall be final. 3.15.050 Standards for Operating Facility: In operating a kennel [DOG FANCIER'S FACILITY, OR DOG MUSHER'S] facility, the operator shall: (a) Comply with the provisions of this title, the terms, conditions, and limitations of any license issued hereunder and any City regulations promulgated under this title. (b) Provide shelter adequate to preserve the health of the animals kept in the facility. (c) Maintain the facility in a sanitary condition. (d) Provide for the adequate care and feeding of animals kept in the facility. (e) Design and equip the facility so as to keep all animals on the premises. (f) Keep on that number of animals in the facility which is safe and healthy for the facility's sake. (g) Maintain the facility in such a manner that it does not constitute a nuisance to owners or occupiers of land in its vicinity. 5 Chapter 3.20 LICENSES Sections: 3.20.010 Requirement for Licenses. 3.20.020 Licensing Procedure. 3.20.030 Dog License Tags and Receipts. 3.20.040 Issuance of Licenses. 3.20.050 Exemptions. 3.20.010 Requirement for Licenses: A person who owns a dog over the age of three (3) months, other than in the operation of a kennel, [DOG FANCIER'S FACILITY, OR DOG MUSHER'S FACILITY,] shall obtain a dog license for that dog pursuant to this chapter. (Ord. 935) 3.20.020 Licensing Procedure: (a) Application for a dog license shall be to the Chief Animal Control Officer. The application shall include: (1) The name and address of the owner of the dog; (2 ) The name, breed, color, age, and sex of the dog; (3) Proof that the dog has a current rabies vaccination; (4) The license fee required by KMC 3.05.100; (5) Written proof that the dog is sterile, if the owner seeks to qualify for the reduced license fee under KMC 3.05.100(b). (b) A dog license shall expire on December 31 st each year. (c) An application to renew a license issued under this chapter shall be made at least thirty (30) days before the license expires, and shall be made in the same manner as an application for a new license. 3.20.030 Dog License Tags and Receipts: (a) For each dog licensed under this chapter, the Animal Control Office shall issue the owner a numbered receipt and a tag stamped with an identification number. (b) To be licensed under this chapter, a dog must bear a license tag securely fastened to its choke chain, collar, or harness, provided that the dog need not bear the tag while confined, in harness, in competition, in training, or while hunting:,. (c) No person may use a dog license tag or receipt for a dog other than the one for which it was issued. 3.20.040 Issuance of Licenses: The Chief Animal Control Officer may permit the submission of applications for licenses, and the issuance of licenses, under this chapter by mail. M 3.20.050 Exemptions: KMC 3.20.010 does not apply: (a) To a person who does not maintain a permanent residence in the City of Kenai when that person owns a dog for no more than thirty (30) days. (b) To a person who presently has resided in the City for no more than thirty (30) consecutive days. (c) To a person who does not maintain a permanent residence in the City when that person owns dogs for dog mushing purposes for more than thirty (30) days, but no more than ninety (90) days during the dog mushing season, provided he obtains a temporary [DOG MUSHER'S] kenn 1 license. The Animal Control Office shall issue a temporary [DOG MUSHER'S] kennel license for no charge upon proof that all dogs for which the license is to be issued have a current rabies vaccination. (d) To a blind person, for the ownership of a seeing eye dog, or to a deaf person, for the ownership of a hearing dog. 3.25.090 Protective Custody: (a) When an officer finds it is necessary that an animal not subject to impoundment be taken into custody of the Animal Control Shelter to preserve the animal's or the public's health or safety, the officer may take the animal into protective custody. (b) The Animal Control Shelter shall maintain an animal in protective custody until the animal is redeemed by its owner, or for a minimum of ten days, after which time the animal may be disposed of as an impounded animal. (c) The owner of an animal in protective custody may redeem the animal upon demand, without paying an impoundment fee, upon payment of a, boarding fee as provided in KMC 3.05. 1 00(c) (2) or (c)(3). (d) A person who owns an animal taken into protective custody and disposed of as an impounded animal may obtain a review of that disposition as provided in KMC 3.25.080. Presently the code covers three levels of kenneling activities permitted in the City of Kenai. We would like to see these three levels consolidated into one level. Under current. definitions a "dog f icier" can have up to four dogs before a permit is required. A kennel under the definition can have up to three dogs before a permit is required. A dog musher's facility, while mentioned through out the code, hacks a definition at all. Putting these three facilities under one heading would alleviate confusion for the facilities owner, adjacent property owners and the animal control office. Our proposed ordinance could read as follows: A kennel facility means a premises where four or more dogs over tiie age of four_TIonths are kept for the purposes known to the owner of the facility TI)is new definition would streamline the present definition; making it easier to identify facilities and enforce the code. Licensing procedures, standards for operating a kennel facility, ,and revocation hearings and appeals would reinalin the same as presently dictated by the animal _ontrol code. '['he next area of the code that needs revision is Protective Custody, 3.25.090. Presently, an ..nimal cl,)ntrof officer may seize a restrained animal which he determines to be in some sort of jcopardN . We wou[ua like to see this area, animal jeopard�', extended to the public's safety, Page 2 Code Revisions/A.C. 10/9/92 For example we receive many calls where a dangerous animal is restrained in a place that hoses a threat to individuals. We respond by removing the animal, however, there is a gray area as to the legality of the seizure. Clarification of this area would certainly assist animal control in performance of our duties. The proposed ordinance should read as follows: When an officer finds it necessary that an animal, not subject to impoundment, be taken into custody of the Animal Control Shelter to preserve the public's or the animal's health and safety, the officer may take the animal into protective custody. The final revision to the code we would like to see is license fees, see KNIC 3.05.100 (b). We request that the fee for non -sterilized dogs be increased to ten dollars ($10.00) and sterilized dogs be decreased to two dollars ($2.00). This way animal control is rewarding individuals for having their animal spayed or neutered, and also giving incenti,e to those that have not. Because of the surplus of dogs and cats, there is no reason for these pets to leave City custody in breeding condition. The current system of refunding a deposit upon proof ot* spay/neuter is resulting in extra work for the Finance Department as well as less than desired compliance with spay/neuter goals. Urder the proposed system fees for adoption would include the cost of spay/neuter surgery. Ai.er payment the animals would be taken to Kenai. Veterinary Hospital by the Kenai Animal Control to be spayed or neutered and get their vaccinations. The veterinarian would bill the City twice a month for the services (which have already been paid to the City by the new owner). Dogs and cats that are too young for surgery would be adopted and given a voucher that can be used when the animal is old enough. This system would reduce non-compliance with spay/neuter goals to almost none, as well as reducing work for the Finance Department. Fees ror adoption would, at first glance, be increased but total costs for adopting a spay/neutered animal would be less due to special rates from Dr. McCartan. Fee 13 OTHER ANIMALS $ 82.00 Total The Animal Control Ordinance would have to be amended to reflect these changes. The decision to use Kenai Veterinary Hospital would have to be addressed. My position is that the Kenai Animal Control has an excellent relationship with Dr. McCartan and has relied on his services for many years, often at little or no cost. Dr. McCartan is the only veterinarian operating in the city limits and unless another clinic is opened here he should be given preference. BR/iry cc: Charles A. Brown, Finance Cary Graves, City Attorney Suggested by: Public Work_ City of Kenai RESOLUTION NO. 92-77 A RESOLUTION OF' THE: COUNCIL OF THE CITY OF KENAI, ALASKA TRANSFERRING $1,280 IN THE BOATING FACILITY FUND FOR INSTALLATION OF WATER FILTERS IN THE DRINKING WATER SUPPLY. WHEREAS, the City has installed new filter.:, to improve the quality of the drinking water at the City Dock; and WHEREAS, due tc a misunderstanding regarding billing for the improvements, an appropriation and purchase order were not approved in idvance, and a $1,280 shortfall exists in the budget. Bob said that he would come by and take a look at it. When he did he said that the water had changed and he told me he was going to try a new filter and separator to see if it helps. Bob installed these units but never said anything about a price. When I returned from vacation in September, DeBest had sent the attached bill for $3150.00. Bob and I couldn't get together until October, at which time he told me that it was his mistake for not mentioning the cost of the system and also my mistake for not asking. I was under the assumption that the filter system installed would be part of the existing system, to bring the dock's water up to drinkable standards. Before the filters were installed the water was not drinkable. The filters were definitely needed. In the notice Mr. and Mrs. Bennett were told that if they did not remove the debris as directed the City of Kenai would contract the work and put a lien on the property in order to recover any costs. Mr. and Mrs. Bennett did not reply to this notice and order within the time allowed so the City of Kenai hired J.C. Bookey Excavation to go in and clear the lot of all dangerous debris. A search warrant was obtained from the Alaska Court System and the lot cleared. After the work was finished a notice was sent to Mr. and Mrs. Bennett stating that the lot had been cleared and thy_,, City of Kenai is going to pursue with a lien on the property to recover costs. Coghill stated that one finding related to an administrative requirement that equipment purchased with federal funds cannot be used outside of the federal project for which they were purchased. A letter had been forwarded to the City. The City responded to the letter stating that: the City will not use federal FAA equipment outside of the airport. Coghill added that the City management and Finance Department have a "super -clean" accounting system. Coghill added that it is probably the cleanest governmental 4ob they do in the State. Airport Commission Airport Manager Ernst reported that the Commission met last Thursday. There was no quorum. They then had an open discussion and decided to forego meetings until February 11, 1993. D-3. Harbor Commission Public Works Director Kornelis stated that the minutes of the last meeting were included in the packet. I-4. Library Commission Councilwoman Monfor stated that the minutes of the last meeting were included in the packet, as well as the month -end report. Monfor stated that the Annual Library Christmas Open House will be held on Tuesday, December 22, 1992. Monfor requested an donation of $100 from Council in order to help pay for the preparations. MOTION: Councilman Measles MOVED to donate $100 to the Library to help pay for costs of the Open House. Councilwoman Swarner SECONDED the motion. There were no objections. SO ORDERED. D-5. Parks & Recreation Commission Councilman McComsey stated there was no quorum at the last meeting. D-6. Planning & Zoning Commission Councilman Smalley reported that he was not present at the meeting. However, the minutes were included in the packet. Smalley reported that concerns have been expressed by the Commission regarding the Quandt property and the trailer parked at the cornea of Beaver. Loop. Also, concern was expressed regarding a -trailer park facility on Beaver Loop. Smalley reported that he City is dealing with the all of these concerns. Miscellaneous Commissions and Committees Cannery Worker Camping Facility Task Force - Williams referred to the letter included in the packet from the Task Force. Williams stated that the Task Force is putting pressure back on the City even though it is not the City's responsibility to have such a facility available. Williams asked Clerk Freas for comments. Freas stated that of the approximate fifteen persons requested to be involved in the Task Force, only three persons attended the meetings beside herself. Freas stated that Bob Scott could not attend the first meeting due to an Airport Commission meeting at the same time. Scott had come to the Task Force meeting for a moment, however. Freas added that the second meeting was held at the Bicentennial Building. Freas was contacted the day after the meeting from Will. Jahrig, who was included on the list of members for the Task Force. Jahrig did not attend the meeting as he failed to read the :information mailed to him as to where the meeting was to be held. Williams asked for direction from the Council. Councilman Measles stated the direction should be that they sunset the Task Force and enforce the City codes. There were no objections. Williams sunsetted the Task Force. All -America City - Councilwoman Monfor reported on her trip to Los Angeles to attend the National Civic League's "Diversity in Government" workshop for All -America City "wannabees." Monfor stated that she attended the workshops and gave information about Kenai's experience. Monfor added that she attended panel discussions where she was the only person from Alaska attending. Monfor stated that those present could not comprehend our Bush area and the size of our school districts. Townsite Historic Task Force - Councilman Smalley stated concerns he and the Planning & Zoning Commission have with the Townsite Historic statement that the intent of the Task Force is to manage the TSH Zone. Smalley stated that would be a duplication of service as the Planning & Zoning Commission now deals with it. Smalley added that the Commission does not favor the Task Force becoming a commission. Coun,::ilman Bookey stated that the Task Force does not intend to become a commission. They intend to put in place a guideline for Planning & Zoning to follow. Brown stated that there has always been insurance on the building, but insurance on the pieces was delayed until an inventory was completed and a price quote could be received from an insurance company. The inventory is being completed, and a price for the insurance has been received. Brown stated the cost was less than he expected and there is money in the budget to purchase the .insurance. There were no objections. SO ORDERED. H-5. Discussion - Kenai Courthouse/Meeting with Architect, City, G&S Construction, and Court System. This item was added during Agenda Approval. Council took time to read the memorandum distributed to them at the beginning of the meeting in regard to this topic. Kornelis reported that a meeting was held to discuss the Kenai Courthouse Project. At the meeting, the City of Kenai was represented by Brown, Graves and himself. The Court System were represented, as well as the Architect and Dan Green from G&S Construction. At the meeting, they discussed ways to keep the project going while staying within the budget. G&S Construction had not prepared the amount of funds needed to complete the project. G&S will forward for each line item, a not -to -exceed amount to complete the project. They had asked for allowance to complete the project and leave the budget open-ended. Kornelis stated that the City requested the not -to -exceed amounts and not allow an open-ended budget. Kornelis stated that the funds are basically gone. Approximately $100,000 is left in the contingency fund after change orders. Williams stated that he has set up a breakfast meeting with Senator Salo and Representative Navarre at 7:00 a.m. on November 23, 1992 to discuss various City projects with them. Williams stated that Kornelis has been requested to attend and bring additional information regarding monies needed. Kornelis stated that he is experiencing some problems getting the total amount needed as the representative from Rozak Excavating is out of town for another ten days. They include getting grant funds from the Court System; a second borrowing might be made to finish the project; and limiting the scope of the project by not landscaping and paving, etc. Williams added that he would like to complete everything. H-6. Approval - Change Order No. 2 - Kenai Courthouse/Concrete Labor Increase - $128,096. This item was added to the agenda at the beginning of the meeting. Kornelis stated that at the meeting with the Court System, contractor, architect and City, Dan Green of G&S Construction stated he would be requesting $159,000 as a not -to -exceed amount to complete the slab and concrete. The Court System asked for the amount needed to pay for the amount of work completed. The slab work will cost $30,000. This work will be billed for upon completion of the slab. (Due to the cold weather, the slab will not be completed until after the building is framed.) The Court System would like to have the costs before making a final change order in order to straighten out the budget. Mayor Legislators - Williams reminded Council of the breakfast with the Legislators scheduled for Monday, November 23, 1992, at 7:00 a.m. at the Merit Inn. DOT/FS - Williams reported that he attended a meeting at the Visitors Center regarding the ISTEA/Step Program. The Step program will recognize scenic routes with historic background. Williams stated he suggested they review the renovation and reconstruction of the Russian Orthodox Parsonage as well. KENAI CITY COUNCIL MEETING MINUTES NOVEMBER 18, 1992 PAGE 10 Williams stated he also discussed with the DOT representatives, a trail system around Birch Island and extension of the Boardwalk. Peninsula Caucus - Reminded Council of the Kenai Peninsula Caucus meeting to be held on Saturday, November 21, 1992 at the Kenai King's Inn beginning at 9:00 a.m. "Legislative Sendoff" - To be held on December 20, 1992 at 7:00 p.m. at the Eagles Halal. The "Sendoff" is sponsored by the Kenai Peninsula Central Labor council. EDD Representative - Another representative to the EDD Board of Directors needs to be appointed. Williams stated he will attend the next meeting. Governor's Economic Summit - Williams requested that the City pay for hotel and mileage for Vince O'Reilly to attend the Governor's Economic Summit in Anchorage, November 29-December 1, 1992. O'Reilly has volunteered to attend for the City. O'Reilly will then give mini -seminars to persons in the Kenai area who are interested. Lo-Mart Furniture - Williams stated he has heard that Lo-Mart Furniture is interested in moving in the Old Kenai Mall. Williams added that he has written a letter to Value Village to suggest they move a store into the area as well. Resource Development Council - The conference begins November 19. Barry Thomson will be attending as a representative of the Kenai Chamber of Commerce. EDA and EPA will be giving a program on Friday afternoon. Williams suggested Kornelis attend on Friday. CIRCAC - Reported that CIRCAC voted to send a letter objecting to oil leases in the Cook Inlet. Williams stated that it was not a unanimous vote. The city's representative voted against it. Williams stated he believes that Brown and Graves should be included in the discussion. The work session was scheduled for December 14, 1992 in the Kenai Council Chambers at 7:00 p.m. Public is invited. Clerk Freas was requested to remind the Council. Freas was also requested to advertise the breakfast scheduled for November 23, 1992. I-2. City Manager Acting City Manager Brown stated that a settlement offer has been forwarded for Council to review. Brown suggested a short executive session be held in order to discuss the matter. I-3. Attorney Graves reported that he has received permission to submit an amicus brief regarding the Open Meetings Act. I-4. City Clerk Freas referred to her memorandum included in the packet which stated the "packet days" for the December 2, 1992 meeting and the January 6, 1993 meeting. Williams stated he would not be attending the December 2, 1992 meeting and the Vice Mayor Measles will be presiding. at that meeting. I-5. Finance Director No report. There will be some construction change orders at the next meeting. Kornelis also reported that the letters regard lead and copper in the city water will be mailed to 80 City residents. I-7. Airport Manager Ernst reported that the FAA entitlement funds have been distributed. $7171000 will be distributed to the City of Kenai with which they will purchase new equipment for the airport. Ernst also reported that he has been asked to talk with three Russian Aviation Administrators visiting the Flight Service Station on Friday. Councilman Measles asked if the findings in the audit report regarding non-use of airport equipment on city streets prohibits the use if the airport is reimbursed. Ernst stated it is his understanding that it is not possible. Ernst stated that he has already asked and FAA said no. Ernst added that there is a possibility that after the equipment is replaced, depending on the value, the City may be able to purchase the equipment and then use it as its own. Ernst added that a least three pieces of equipment are still functional, although FAA considers their maintenance life over. Ernst stated he will investigate this possibility. MOTION: Councilman Smalley MOVED that the City Council convene in an executive session to discuss matters that the immediate knowledge of which would clearly have an adverse effect upon the finances of the City of Kenai. KMC, Titles 14 & 1 - Landscape Board MOTION: Councilwoman Swarner moved, seconded by Councilman McComsey, to adopt the ordinance. PUBLIC COMMENT% a. Randy Caler, Landscape Board Member. He has served on the Board for for 2-1/2 years. They have made in -roads and accomplished much for the City. They have had excellent cooperation with the builders. Due to a time conflict, he cannot serve on the Planning & Zoning Comm. b. Susan Smalley, Kenai. It is time to put the Board with P&Z. The Board deserves tremendous credit. People are putting trees in when they are building. Councilwoman Monfor noted Council did a lot of work to get this done. Just because it is slow now does not mean it will always be that way. She suggested the Board be dormant now. C. Verlin Darrow, Landscape Board Member. He is against abolishing this. P&Z is busy enough. They could use their expertise to work on their own commission. The Landscape Bd. meets on call. He does not know of any construction that was held up. He did not think eliminating the Board would streamline (the process). He turned down a P&Z appointment because he was protesting the abolishment. Sharon Mook is a good example - she was against the plan but she had many complements regarding the trees on her lot. He is proud of what they have accomplished. Councilwoman Monfor said one of the big reasons for establishing the Board was because of the quonset hut. (Bowling Alley) Councilwoman Swarner asked if the members were willing to serve on the Board i it continued. Mr. Caler replied, if it is continued as originally established. Mr. Darrow replied, of the members he has talked to, they would. A couple of members are not residents of the City and cannot serve on P&Z. Mayor Williams explained, the change was suggested by him after consultation with the attorney. He was trying to streamline the Comm/Comm. Nothing would change except the Board that will serve. we have to look out for costs regarding staff, etc. He does not look for major growth for at least three years. we can transfer responsibilities back in the future. Councilman McComsey asked, they only met when there was a building being built? Answer - yes. Councilman McComsey noted, so they are dormant till they are needed. Mayor Williams explained, one of the problems was it is hard to get all of them together. Also, he had a concern with a quorum of three, since that is not an overview of the public. It still goes to Council, however. Councilman McComsey asked if there had been any complaints. Answer - no. Councilman McComsey noted the fact they can meet and decide quickly is a benefit to the builders. It shall be unlawful for any person to construct, erect or maintain ary structure, bu:ild:ing, fence, or improvement, including landscaping, parkIng , and other facilities 14-73 (City of Kenai Supp. #46 - 11/13/87) 14.25.020-14.25.040 on property designated as a commercial tract unless such improvements are constructed or reconstructed in a manner consistent with the approved plan. (Ords. 1132, 1189) 14.25.030 Landscaping/Site Plan.- Submittal Requirements: Three (3) copies of the landscaping/site plan shall be submitted for approval to the Planning Specialist prior to the issuance of a building permit. One copy of the approved plans shall be returned to the applicant; one copy filed; and the third copy showing action taken, filed with the Building Official. The landscaping/site plan shall be prepared at a minimum scale of 1" 20' and shall include the following information: (a) Common and scientific name of the planting materials to be used in the project; (b) Typical planting details; (c) Location of all planting areas and relationship to buildings, parking areas, and driveways; (d) Identification and location of existing vegetation to be retained; (e) Identification and location of non -living landscaping materials to be used; (f) :Identification of on -site snow storage areas; (g) Drainage patterns; (h) Description of buildings, including building height, ground floor dimensions, kinds of budding ma-terials, type of architecture anticipated; (i) Physical features of the property including location of all buildings, ingress and egress, any unusual features of the property wh�_ch may restrict development or drainage. (c) Interior Landscaping: Interior landscaping involves those areas of the property exclusive of the perimeter and parking lot areas. Interior landscaping is desirable to separate uses or activities within the overall development. Screening or visual enhancement landscaping is recommended to accent or complement buildings, to identify and highlight entrances to the site, and to provide for attractive driveways and streets within the site. (d) Parking Lot Landscaping: Parking lot landscaping involves the land areas adjacent to or within all parking lots and associated access drives. Parking lot landscaping serves to provide visual relief between vehicle parking areas and the reminder of the development. It also is desirable for the purpose of improving vehicular and pedestrian circulation patterns. (e) Maximum Required Landscaping: The Landscaping/Site Plan Review Board shall not require more than five percent (5%) of any project area to be landscaped. (f) Review: The Landscaping/Site Plan Review Board may reconsider plans after they have been approved if problems arise in carrying out the landscaping/site plan as originally approved. (Ord. 1132) 14.25.045 Site Plan - Performance Criteria: (a) Objectives: An effective site plan should utilize a variety of techniques for achieving the intent of this ordinance. The appropriate placement or retention and improvements of buildings, parking lots, etc. should be considered on the site plan. (b) Buildings: A commercial or industrial use housed in the building is to be compatible with the surrounding properties, land use plan, and not be hazardous to the health, safety, and welfare of citizens. (c) Special Permits: The site plan shall list any special permits or approvals which may be required for completion of the project. (d) Parking Lots: Parking lots referenced on the site plan shall comply with KMC 14.25.250. (e) Snow Storage/Removal and Drainage: Snow storage/removal and drainage as referenced on the site plan shall be compatible with the surrounding area. (Ord. 1191) 1.4.25.050 Landscaping/Si_te Plan -Re -view Board: Meetings and Proceedings: The Board shall meet to :review and take action on a landscaping and site ;Plan within fourteen (14) days of satisfactory submit:tal to the Planning Department. The Building Official shall issue -t building permit upon approval of the 14-75 (City of Kenai Supp. #47 - 2/10/88) 14.25.050-14.25.100 associated landscaping/site plan by the Board or the expiration of fourteen (14) days without official Board action, providing all of the other requirements for the issuance of a building permit have been met. Any appeal of the action of the Board shall be submitted in writing to the Kenai City Council. (Ord. 1161, 1132) 14.25.060 Completion - Landscapirlg Plan: All required landscaping as presented in the approved landscaping plan shall be installed prior to the issuance of the Certificate of Occupancy by the Building Official. The Planning Specialist or any member of the Board may make the final inspection to verify the completion of the required landscaping. In the event that the landscaping has not been completed upon request for the Certificate of Occupancy, the Building Official may grant a temporary certificate not to exceed nine (9) months. (Ords. 1132, 1149) 14.25.065 Comlj�etion - Site Plan: All requirements as outlined in Section 14.25.045 shall be installed according to the site plan as approved by both developer and Landscaping/Site Plan Review Board and shall be approved by the Building Official or Planning Specialist. (Ord. 1132) 14.25.070 Modifications: Whenever there are practical difficulties in carrying out the provisions of this chapter, the Planning specialist may grant minor modifications for individual cases, provided the Planning Specialist finds that a special individual reason makes the strict letter of this ordinance impractical and that the modification is in conformity with the intent and purposes of this ordinance. There are some budgeted items not yet paid out of this budget that will need to be paid when billings are received. Attached is a printout of the expenditures made from the Miscellaneous budget to date. Budgeted items have been checked on the right. Other expenditures have been noted on the left. The bulk of the unbudgeted expenditures are attributed to the refurbishing of the T-33 airplane and the All -America City Award. The total costs spent for the refurbishing of the T-33 from this account in this year are $1,836. Other expenditures have been made from other accounts in this year for this project. The All - America City Award expenditures total approximately $12,000 in this account for this year only. Those expenditures include signs, banner:_, design work, sweatshirts,, decals and pins. Cost for items that have been budgeted for and will need to be paid from this account total approximately $3,500. This amount does not include any extras.
