Proposed Historic District Projects EXHIBIT "A" DRAFT January 11, 1993 14.20.105 Townsite Historic (TSH) Zoning District (a) The TSH Zoning District is intended to provide for a mixed, controlled use in a designated area, which will protect and enhance the historic character of the zone. The goal of the TSH zone is to manage all new development, reconstruction and alterations within the zone. The intent of the Townsite Historic Review Board is to enhance and identify the city of Kenai's heritage, to present this heritage in a manner that promotes civic pride, and to foster an awareness of where we as a people have evolved. (b) Historic District Board A historic district Board will be established to regulate development within the TSH zone. The following provisions will govern the Board's activities through the State of Alaska Certified Local Government Program: (1) The Board will consist of a minimum of seven members with a demonstrated interest, competence, or knowledge in historic preservation, appointed for terms of not less than three years. (2) To the extent available in the community, three Board members shall be professionals, as defined by National Park Service regulations, from the disciplines of history, architecture or architectural history, and archeology. (3) The Board will meet at least twice each year and conduct business in accordance with the Open Meeting Laws of Alaska. This includes public notification of meeting place, time and agendas. (4) Written minutes of each Board meeting will be prepared and made available for public inspection. (c) Historic District Board Duties: (1) The Board shall make recommendations to the Kenai Planning and Zoning Commission as to the area of the city to be included within the zone and any adjustments to the boundaries in the future. (2) The Board shall review zoning requirements and review all proposed changes to the zoning law within the TSH Zoning District. TSH Zoning District - DRAFT January 11, 1993 Page 2 (3) The Board shall schedule a minimum of two meetings annually and special meetings as requested by the Planning Department to review proposed building permit applications within the zone or other business considered necessary by the Planning Department. (4 ) The Board shall conduct or cause to be conducted a survey of the historic, architectural, and archaeological resources within the community. The survey shall be compatible with the Alaska Heritage Resources Survey and able to be readily integrated into statewide comprehensive historic preservation planning and other planning processes. Survey and inventory documents shall be maintained to protect the site location(s) from possible vandalism. The survey shall be updated every ten years. (5) The Board shall review and comment to the State Historic Preservation Officer on all proposed National Register nominations for properties within the boundaries of the City. When the TSH Board considers a National Register nomination which is normally evaluated by professionals in a specific discipline and that discipline is not represented on the Board, the Board will seek expertise in this area before rendering a decision. (6) The Board shall act in an advisory role to other officials and departments of local government regarding the identification and protection of local historic and archaeological resources. (7) The Board shall work toward the continuing education of citizens regarding historic preservation and the community's history. (8) The Board will review all building permit applications as well as all exterior architectural alterations within the designated zone. The Board's responsibility will be to provide it's recommendation for approval, denial or modification to the Planning and Zoning Commission. The guidelines to be followed by the Board will be designed to preserve the character which typify development in the zone and provide the basis for preserving the historical character of the zone. Applications must be accompanied by a schematic drawing of proposed changes within the zone. TSH Zoning District - DRAFT January 11, 1993 Page 3 The criteria for determining acceptable use shall include, but not be limited to the following: (1) All alterations to existing structures should be performed so as to preserve the historical and architectural character of the TSH zoning district. (2) The distinguishing original qualities or character of a building, structure, or site in its environment shall not be destroyed. The removal or alteration of any historic material or destruction of architectural features cannot be done without approval. (3) Changes which may have taken place in the course of time are evidence of the history and development of a building, structure, or site, and its environment. These changes may have acquired significance of their own, which should be recognized and respected. (4) Landscaping requirements according to City of Kenai guidelines. (5) All exterior construction must be completed within a year of date of approval. (d) Development Criteria The development criteria is intended to provide for a district in which residential and business enterprises co -habitat as a desirable and compatible use. All proposed construction, renovation, demolition, or alteration shall: (1) Encourage, whenever possible and compatible with historic character of the TSH zone, foot traffic; restaurants, gift shops, parks, etc; indigenous Kenai Peninsula flora; wooden structures including log style with soft colored or natural sidings. (2) Discourage uses which will violate the historic and scenic quality of the TSH zone; buildings and building additions that are not compatible with adjacent buildings or which violate the existing scale of the district. (3) Specific structures and activities which will not be allowed, but are not limited too: (a) Metal buildings (b) Buildings with "modern design style of architecture" that have no historical correlation with the district TSH zoning District - DRAFT January 11, 1993 Page 4 (c) All multiple family residences including duplexes and larger structures (d) Trailers (e) Gas stations (f) Auto repair shops (g) Rental storage of any kind (h) Junk and junkyards (i) Kennels or similar uses (j) Livestock, Stables, Commercial horseback riding (k) Auto body and paint shops (1) Commercial buildings are limited to a total area of no more 5,000 per story, with any individual unit within the structure of no more than 2,500 square feet (4) Existing structures: All structures existing prior to the enactment of this ordinance will be allowed to continue in their present form and use. In the event of loss of the existing structure due to demolition, fire or natural causes, the structure may 7 be rebuilt with the following requirements: (a) The structure to be rebuilt must conform to the previously existing structure in terms of size, shape and location. (b) No additions to the pre-existing structure will be allowable. (c) The use of the new structure must be the same as the previous structure. (d) Application for reconstruction of the structure must be made to the Planning Department within one year of the date of loss due to demolition or damage. (e) Reconstruction of the structure must be complete within two years of the date of the loss due to demolition or damage. (f) If applicant wants to rebuild, other than a pre-existing structure, the existing structure provisions as stated above are not applicable. (e) Criteria for designation of landmarks to be included into the TSH: (a) Its age - approximately fifty years old. (b) Its character, interest or value as part of the development, heritage, or cultural characteristics of the city of Kenai. (c) Its location as the site of a significant historic event. (d) Its identification with a person or persons who significantly contributed to the culture and development of the city of Kenai. (e) Its distinguishing characteristics of an architectural type. TSH Zoning District - DRAFT January 11, 1993 Page 5 (f) Its relationship to other distinctive areas that are eligible for preservation according toga plan based on a historic, cultural, or architectural motive. Alteration -Any act or process that changes one or more of the exterior architectural features of a structure, including, but not limited to, the erection, construction, reconstruction, or removal of any structure which requires a building permit. 2. Construction -The act of adding an addition to an existing structure or the erection of a new principal or accessory structure on a lot or property which requires a building permit. 3. Demolition -Any act or process that destroys in part or in whole a landmark or a structure within a historic district. 4. Certified Local Government -A local government "that has been certified to carry out the purposes of the National Historic Preservation Act". 5. Historic District -An area designated as a "historic district" by ordinance of the City Council which may contain within definable geographic boundaries one or more landmarks and which may have within its boundaries other properties or structures that, while not of such historic and/or architectural significance to be designated as landmarks, nevertheless contribute to the overall visual characteristics TSH Zoning District - DRAFT January 11, 1993 Page 6 of the landmark or landmarks located within the historic district. 6. Historic Preservation -The act of adopting regulations and restrictions for the protection and preservation of places and areas of historical and cultural importance to the Kenai. 7. Landmark -A property or structure designated as a "landmark" by ordinance of the City Council, pursuant to procedures prescribed herein, that is worthy of rehabilitation, restoration, and preservation because of its historic and/or architectural significance to the city of Kenai. 8. New Development -Any development which requires a building permit. 9. Reconstruction -The action of reconstructing. 10. Removal -Any relocation of a structure on its site or to another site. 11. Renovation -To restore to a former better state (as by repairing or rebuilding. 12. C:\YP51\DOCS\TSHTASK\TSHDRAFT.GBK CITY OF KENAI TOWNSITE HISTORIC TASK FORCE MISSION STATEMENT The purpose of the City of Kenai Townsite Historic Task Force (TSHTF) is to develop specific recommendations to be presented to the Kenai City Council relating to: A. The proposed area to be included in a Townsite Historic District B. A revised townsite historic ordinance C. The restoration and enhancement of properties and structures considered to have historic significance The purpose of the TSHTF is not to promote any specific industry or enhance the marketing of any product. It is to provide a framework from which private and public interests can create their own goals. The intent of the TSHTF is to enhance and identify the city of Kenai's heritage, to present this heritage in a manner that promotes civic pride, and to foster an awareness of where we as a people have evolved. The TSHTF will focus on community improvement, including rules and procedures intended to clearly define and proposed development. The intent of these rules and procedures is to provide a basis for what is considered acceptable development or alteration to existing prop rties in a manner that can be clearly understood and will welc�me change. The framework is based on specific recommendations as well as a more generalized concept of how the historic portion of the city should be preserved and presented. We feel confident that the efforts of the TSHTF will have a positive effect toward promoting the historic district for the education, pleasure, and welfare of the people of Kenai and those visiting the city not only today, but for future generations. ®r CITY OF RENAI ORDINANCE AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING THE KENAI MUNICIPAL CODE TITLE 14 BY SUBSTITUTING A NEW ORDINANCE FOR 14.20. 105 TOWNSITE HISTORIC (TSH) ZONING DISTRICT. WHEREAS, the current area known as the Townsite Historic (TSH) Zoning District, has varied and conflicting land uses which are not compatible with the historic nature of the district: and, WHEREAS, the Kenai City Council has created a Townsite Historic Task Force to review and make recommendations pertaining to the Townsite Historic Zone; and, WHEREAS, the Townsite Historic Task Force has reviewed the existing ordinance and redrafted it to better meet the needs of the area; and, NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, as follows: The Kenai Municipal Code Title 14 amended by substituting Section 14.20.105 entitled Townsite Historic (TSH) Zoning District: as defined in the attached "Exhibit All. CITY OF KENAI TOWNSITE HISTORIC TASK FORCE PROPOSED HISTORIC DISTRICT PROJECTS As requested by the City Council of the City of Kenai, the Task Force has developed and hereby submit a list of projects the City may wiSh to consider for development and/or improvement within the Townsite Historic District. These, proposals have not been ranked by level of importance. In addition, no analysis as to feasibility or cost has been considered. The list is intended for discussion and review purposes. 1. PARK DE4ELOPMBNT The area in old town which is surrounded by the streets named Overland, Mission and Upland, has been considered for a Historic Park. The area is mostly vacant land, made up of 24 individual lots which have different owners. Structures currently located in this area include: two fourplexes (at the northern edge); two single family dwellings (at the southwest corner); a shop (on the southwest corner); and a single family trailer (on the east side). The existing structures are located on the edge of the boundaries leaving an area which would serve well as a park setting. Included in this park would be trails, benches, lawn and various structures which are currently uninhabited and located throughout the community and surrounding areas. These structures representing log homes, shops, outbuildings (maybe an outhouse or two) would be relocated to this area to be renovated and maintained on a permanent basis. Responsibility for the renovation and maintenance would be with the Townsite Historic District Board. The Board would also be responsible for surveying the area to locate such facilities, decide which would be selected to be moved to the park and what their permanent placement within the park would be. The City Council's involvement in this project would be to acquire the property, develop the park and provide the funding for necessary maintenance. 2. BEACH TRAIL Inlet Street is the only dedicated access to the beach from Old Town. This street begins at Alaska Street and follows down the bluff diagonally to Meeks Crossing. It has been closed for many years and has suffered from severe erosion. Our request is that Inlet Street be repaired to the level of a foot path to allow for foot traffic to and from Meeks Crossing. PROPOSED TOWNSITE HISTORIC PROJECTS Page 2 3. STREET IMPROVEMENTS Negotiations seem to be complete with the Russian Orthodox Church relating to the dedication of the land necessary within the Church grounds to construct a street in that area. We urqe that this process including the necessary public hearings and other necessary land easement be obtained during the winter of 1993. With these procedural concerns complete, we urge that the street construction occur during the summer of 1993. 4. FISH AND WILDLIFE FACILITY Several years ago, the City was considering a trade of wetland properties with the Fish and Wildlife for their facility located on Overland Avenue. As the buildings currently existing on the Fish and Wildlife facility represent early Kenai construction, an effort should be made to retain them. We feel to resume discussions with the Fish and Wildlife to arrange a trade of their land holdings on Overland for wetland properties should be considered. 5. BLUFF EROSION As we are all aware, the bluff overlooking the mouth of the Kenai river has continued to erode for many years. This problem has now resulted in the need to abandon residences and threatens others. In addition, an unpaved street is in jeopardy of being lost to erosion. We recommend that the City consider a permanent solution to the problem. Such a solution should involve a method of permanently eliminating the erosion problem in order to terminate the progressive loss of town site land to the river. 6. BEACH FRONT It appears that vehicle traffic on Kenai Avenue has increased in recent years to the detriment of the sand dunes.on the south side of the avenue. The sand dunes are being destroyed as vehicles leave Kenai Avenue to drive over the dunes to the beach. In addition, significant amounts of trash (including empty liquor bottles) can regularly be seen along the avenue. As Kenai Avenue dead -ends at the mouth of the slough draining from the upland areas behind the City and serves no apparent purpose, we recommend the avenue be closed or upgraded and barricades be erected on both sides of the avenue to protect the natural habitat surrounding the avenue from damage caused by vehicles and foot traffic. In addition, if a decision to close the avenue is made, the land on which the avenue is constructed should be returned to its original appearance. PROPOSED TOWNSITE HISTORIC PROJECTS Page 3 This closure or upgrade would result in a reduction in the damage being done to the sand dunes and significantly reduce the litter and debris currently being deposited in the area. 7. ( 4 ) The Board shall conduct or cause to be conducted a survey of the historic, architectural, and archaeological resources within the community. The survey shall be compatible with the Alaska Heritage Resources Survey and able to be readily integrated into statewide comprehensive historic preservation planning and other planning processes. Survey and inventory documents shall be maintained to protect the site location(s) from possible vandalism. The survey shall be updated every ten years. (5) The Board shall review and comment to the State Historic Preservation Officer on all proposed National Register nominations for properties within the boundaries of the City. When the TSH Board considers a National Register nomination which is normally evaluated by professionals in a specific discipline and that discipline is not represented on the Board, the Board will seek expertise in this area before rendering a decision. (6) The Board shall act in an advisory role to other officials and departments of local government regarding the identification and protection of local historic and archaeological resources. (7) The Board shall work toward the continuing education of citizens regarding historic preservation and the community's history. (8) The Board will review all building permit applications as well as all exterior architectural alterations within the designated zone. The Board's responsibility will be to provide it's recommendation for approval, denial or modification to the Planning and Zoning Commission. The guidelines to be followed by the Board will be designed to preserve the character which typify development in the zone and provide the basis for preserving the historical character of the zone. Applications must be accompanied by a schematic drawing of proposed changes within the zone. All proposed construction, renovation, demolition, or alteration shall: (1) Encourage, whenever possible and compatible with historic character of the TSH zone, foot traffic; restaurants, gift shops, parks, etc; indigenous Kenai Peninsula f lora; wooden structures including log style with soft colored or natural sidings. (2) Discourage uses which will violate the historic and scenic quality of the TSH zone; buildings and building additions that are not compatible with adjacent buildings or which violate the existing scale of the district. In the event of loss of the existing structure due to demolition, fire or natural causes, the structure may be rebuilt with the following requirements: (a) The structure to be rebuilt must conform to the previously existing structure in terms of size, shape and location. (b) No additions to the pre-existing structure will be allowable. (c) The use of the new structure must be the same as the previous structure. (d) Application for reconstruction of the structure must be made to the Planning Department within one year of the date of loss due to demolition or damage. (e) Reconstruction of the structure must be complete within two years of the date of the loss due to demolition or damage. (f) If applicant wants to rebuild, other than a pre-existing structure, the existing structure provisions as stated above are not applicable. (e) Criteria for designation of landmarks to be included into the TSH: (a) Its age - approximately fifty years old. (b) Its character, interest or value as part of the development, heritage, or cultural characteristics of the city of Kenai. (c) Its location as the site of a significant historic event. (d) Its identification with a person or persons who significantly contributed to the culture and development of the city of Kenai. (e) Its distinguishing characteristics of an architectural type. (5) Uses (a) Principal Permitted Uses as allowed in Land Use Table. (b) Conditional Uses: As allowed in the Land Use Table and subject to the provision of this chapter. 1. Such uses must be similar to principal uses permitted in the zone. 2. Such uses must be in harmony with the intent of the zone. (f) Review process Upon submittal of an application, the Planning Department shall schedule the application for review by the TSH Zoning District Review Board at the following appropriate meeting. The Board shall make a recommendation tegarding the permit application the Planning and Zoning Commission. The Board's recommendation shall be based upon the development criteria in subsections (C) and (D) above and all other pertinent provisions of the Kenai Municipal Code. (g) Penalties: Penalties for non-compliance with this Chapter shall be as set forth by KMC 14.20.260 (Ord. 1132, 1240) (h) Definitions: 1. Alteration -Any act or process that changes one or more of the exterior architectural features of a structure, including, but not limited to, the erection, construction, reconstruction, or removal of any structure which requires a building permit. 2. Demolition -Any act or process that destroys in part or in whole a landmark or a structure within a historic district. 4. Certified Local Government -A local government "that has been certified to carry out the purposes of the National Historic Preservation Act". 5. New Development -Any development which requires a building permit. 9. Reconstruction -The action of reconstructing. 10. Removal -Any relocation of a structure on its site or to another site. 11. Renovation -To restore to a former better state (as by repairing or rebuilding). 12. STREET IXPROVEMENTS Negotiations seem to be complete with the Russian Orthodox Church relating to the dedication of the land necessary within the Church grounds to construct a street in that area. We urge that this process including the necessary public hearings and other necessary land easement be obtained during the winter of 1993. With these procedural concerns complete, we urge that the street construction occur during the summer of 1993. 4. FISB AND WILDLIFE FACILITY Several -years -ago, the City was considering a trade of wetland properties with the Fish and Wildlife for their facility located on Overland Avenue. As the buildings currently existing on the Fish and Wildlife facility represent early Kenai construction, an effort should be made to retain them. We feel to resume discussions with the Fish and Wildlife to arrange a trade of their land holdings on Overland for wetland properties should be considered. S. BLUFF EROSION As we are all aware, the bluff overlooking the mouth of the Kenai river has continued to erode for many years. This problem has now resulted in the need to abandon residences and threatens others. In addition, an unpaved street is in jeopardy of being lost to erosion. We recommend that the City consider a permanent solution to the problem. Such a solution should involve a method of permanently eliminating the erosion problem in order to terminate the progressive loss of town site land to the river. 6. BEACH FRONT It appears that vehicle traffic on Kenai Avenue has increased in recent years to the detriment of the sand dunes on the south side of the avenue. The sand dunes are being destroyed as vehicles leave Kenai Avenue to drive over the dunes to the beach. In addition, significant amounts of trash (including empty liquor bottles) can regularly be seen along the avenue. As Kenai Avenue dead -ends at the mouth of the slough draining from the upland areas behind the City and serves no apparent purpose, we recommend the avenue be closed or upgraded and barricades be erected on both sides of the avenue to protect the natural habitat surrounding the avenue from damage caused by vehicles and foot traffic. In addition, if a decision to close the avenue is made, the land on which the avenue is constructed should be returned to its original appearance. PROPOSED TOWNSITE HISTORIC PROJECTS Page 3 This closure or upgrade would result in a reduction in the damage being done to the sand dunes and significantly reduce the litter and debris currently being deposited in the area. 7. SIGNAGE We recommend that the existing sign ordinance of the City of Kenai be modified to establish specific provision relation to the historic district. It has been closed for many years and has suffered from severe erosion. our request is that Inlet Street be repaired to the level of a foot path to allow for foot traffic to and from Meeks Crossing. STRRLT 3 Negotiations seem to be complete with the Russian Orthodox'Church relating to the dedication of the land necessary within the.Church grounds to construct a street in that area. We urge that this process including the necessary public hearings and other necessary land easement be obtained during the winter of 1993. With these procedural concerns complete, we urge that the street construction occur during the summer of 1993. 4. FISH AND WILDLIFE FACILITY Several years ago, the City was considering a trade of wetland properties with the Fish and Wildlife for their facility located on Overland Avenue. As the buildings currently existing on the Fish and Wildlife facility represent early Kenai construction, an effort should be made to retain them. We feel to resume discussions with the Fish and Wildlife.to arrange a trade of their land holdings on Overland for wetland properties should be considered. . 5. BLUFF EROSION As we are all aware, the bluff overlooking the mouth of the Kenai river has continued to erode for many years. This problem has now resulted in the need to abandon residences and threatens others. In addition, an unpaved street is in jeopardy of being lost to erosion. We recommend that the City consider a permanent solution to the problem. Such a solution should involve a method of permanently eliminating the erosion problem in order to terminate the progressive loss of town site land to the river. s. RZACK FRONT It appears that vehicle traffic on Kenai Avenue has increased in recent years to the detriment of the sand dunes on the south side of the avenue. The sand dunes are being destroyed as vehicles leave Kenai Avenue to drive over the dunes to the beach. In addition, significant amounts of trash (including empty liquor bottles) can regularly be seen along the avenue. As Kenai Avenue dead -ends at the mouth of the slough draining from the upland areas behind the City and serves no apparent purpose, we recommend the avenue be closed or upgraded and barricades be erected on both sides of the avenue to protect the natural habitat surrounding the avenue from damage caused by vehicles and foot traffic. In addition, if a decision to close the avenue is made, the land on which the avenue is constructed should be returned to its original appearance. Rehabilitation means returning a building to a state of usefulness while protecting architecturally significant features and materials. The philosophy of rehabilitation is embodied in the Secretary of the Interior's Standards for Rehabilitation (sae Fact Sheet )V-3), which are used across the country in rehabilitating buildings listed on the National Register (see Fact Sheet IV-1). The rehabilitatio► of a house often involves creating a modern kitchen within the existing building or adding a new garage. In many cases,. the homeowner is engaged in both restoration and rehabilitation. Renovation means modernizing a building without necessarily attempting to retain its significant features. Often the tern is used when discussing the house's mechanical systemsrenovating the heating system may mean replacing the old boiler with a modem heat pump system. Remodeling means modernizing a building without attempting to retain orpreserve its significant features. It often involves removal of important architectural features ormatedal and the installation of new ones. Today remodeling a historic or older home is often considered inappropriate -- replacing wood clapboard with vinyl siding, for example. However, older remodelings that have become a part of the history and evolution of the house should usually be retained. For example, many Colonial houses were remodeled in the 19th century in one of the Victorian styles. Since the latter has often obtained importance in its own right, it should be retained in a restoration or rehabilitation. Adaptive use (or reuse) means rehabilitating a building for a use different from that for which it was originally designed An old house, forexample, can beadapted to serve as professional offices. Conservation means arresting the physical deterioration of building materials by some type of intervention or corrective measure. Maintenance can be as simple as sweeping the floors or as extensive as repainting the exterior. Reconstruction means rebuilding a destroyed building exactly as it was. After a fire or natural disaster, many homeowners reconstruct their homes.. Relocation means moving a building from its original site. Many professionals involved in preservation do not advocate the relocation of historic buildings, as relocation destroys the historic setting. Sometimes, however, relocation is the only way to save the building from destruction. If a building must be relocated, the new site should resemble the original as closely as possible. Retrofitting is a British term for adaotiv_ a use. The terms are used interchangeably in America Salvage means saving parts of a historic building from destruction by removing them prior to demolition. As with relocation, most professionals involved with preservation do not advocate salvage except as a last resort. Stabilization means halting further deterioration of a building. While conservation means to stop deterioration and correct the problem, stabiiiza is typically used to mean only stopping the decay The term is frequently used in conjunction with arresting structural problems or seating the house from vandalism or the weather. TSH Ordinance Arness reported that he had spoken to Cary Graves, City Attorney, regarding the ordinance. Graves had offered to draft an ordinance once the task force established a basic outline. Arness and Meeks had talked to Russ Sacket from the off ice of History and Archealogy. He said that the City just needed wording in their present ordinance which would cover criteria needed for grants, etc. The Committee could be called anything as long as it met, or attempted to meet the criteria which is: live in Kenai, seven members to include 1 architect or historical architect, 1 archaeologist, 1 historian. Members would serve not less then two year terms, and would meet a minimum of twice a year. The group TSH TASK FORCE September 5, 1992 Page 2 decided the name should be the Historic Review Board. The group discussed sections of the code, as follows, (changes underlined): (a) Intent: second paragraph: The goal of the TSH zone is to manage all new construction, demolition and alterations by requiring a building permit. (b) Guidelines: The following guidelines are intended to provide the applicant with an idea of the general criteria the Historic Review Board (Review Board) will employ when reviewing proposals for construction in the TSH zoning district. Under (c) (1) One copy of the application signed by the applicant (3) One cony of a landscaping and site plan complying with the development criteria ofthis chapter and drawn to scale showing the existing structure and all proposed alterations and additions in relation to the site. Provided that no landscaping/site plan shall be required unless the proposed construction exceeds 525.000 in value. The group also wished to limit any new buildings to 25,000 SF, and no more than two stories. The Task Force will continue to make suggestions as to code changes then submit them to Graves so he can prepare a new draft ordinance for review. b. Heritage Village 5. Bluff erosion A. Jim Arness handed out an outline (copy attached) which he developed to aid in writing the new ordinance. B. As discussion began, Paul Hanson suggested that this outline be presented to Council and P&Z for their input at this early stage of writing the new ordinance. For example, he stated that P&Z may not want the Historic Commission created. After a brief discussion, it was determined that what is needed now is clarification from TOWNSITE HISTORIC TASK FORCE Minutes -- October 15, 1992 Page 2 Council regarding the direction of the Task Force and the end result desired. Jim Arness will talk to Mayor Williams. C. Most of the meeting time was used to discuss in detail specifics to be included in, or excluded from, the new ordinance. TSH Ordinance Jim Arness felt the group should begin discussing concepts they would like to have included in the Ordinance. He felt that perhaps Cary Graves could draft a new ordinance and the Committee could review and refine that ordinance. At the previous meeting the Task Force had pinpointed the purpose of the ordinance, that permits would be required for all new construction, demolition, and alterations. The Task Force discussed keeping the Historic Commission separate from Planning and Zoning. It -would be a seven member body, which would include an architect, real estate specialist and attorney, if feasible. There would be a Townsite Historic Zone and designated landmarks outside the zone if needed. The criteria for historic status would be 50 years or historic value. Actions to be reviewed would include any activity requiring a building permit or any public projects even if no building permit is required. They thought there should be a minimum amount of value on construction needing a permit (such as $1,000) or demolition of any building. Bookey said he felt there should be a clause addressing the financial feasibility of restoring an old building or demolishing it. Some buildings may pose an economical problem for property owners due to high insurance premiums, etc. Arness said the "economic hardship" clause could be included. Property owners could appeal a negative decision on the basis of economic hardship. A clause should also be included that any present building destroyed by fire, etc. may be rebuilt to same status as before it was destroyed. TOWNSITE HISTORIC TASK FORCE October 1, 1992 Page 2 Bookey thought that should include the same types of business activities also. They should have grandfather rights even though they might not be allowed under the new ordinance. Bookey felt that the size of the zone should be established before a lot of detail went into the ordinance. b. Zoning Boundaries After a brief discussion the Task Force decided on proposed boundaries as shown on the attached map, and including from the top of the bluff to mean high tide mark. Arness said that the Task Force should decide how restrictive they want to be within the new zone. He felt that multiple housing should be discouraged, any industrial or manufacturing activity. Service businesses could be allowed, such as attorneys, dentists, etc., but a size limit on office space might be defined, such as no business office bigger then 2,000 to 3,000 SF. Arness said he would talk to the City Attorney about drafting an ordinance the Task Force could work from. Arness asked if there were additional projects besides the Heritage Village proposed by the Mayor? Paul Hanson said he would like to see a walking tour established with signage on the historic sites. Becky Tromblee said she would like to see the road to the cemetery reconstructed to run between church property (alongside the rectory) and the Fish and Game property. Presently the road cuts through her property and her neighbor's. Jim Bookey felt this could best be addressed along with the Mission Street improvements project. Roger Meeks wanted to look at establishing a trail to the beach, which would be built to protect against bluff erosion. G. ApPROVAL OF MINUTES September 3, 1992 - Minutes approved as presented. Chairman Arness reminded the Task Force of the three items identified at the previous meeting which the group would address, which were: revise ordinance, review zone boundaries and identify projects such as development of a historic village, streets, lighting, signage, etc. Meeks said that he had talked to Alan Boraas, Kenai Peninsula College. Boraas had expressed interest in doing some archeological digs in the area between Upland, Overland and Mission Streets, if the City purchases this property for a historic village site. Meeks also felt that if the Ordinance provided for historic landmarks to be satellite areas of the zone the property owners should have that option. McCune agreed and felt that property owners such as Cherrier, who border the TSH zone should be able to opt out of the historic zone if desired. Arness said he felt it was important to keep a buffer around the historic zone. He said the Ordinance could address a certificate of appropriateness for all developments in the zone. The Task Force discussed the purpose of the Ordinance and felt that the present section of KMC 14.20.105 Intent was good. It was felt that under purpose "all new. construction, demolition and alterations should be reviewed", should be added to the present ordinance. Arness felt that the Ordinance should include specific wording to provide for Kenai to become a Certified Local Government (CLG). Upon becoming a CLG, an Historic Preservation Committee would be established which would review all development in the TSH zone. Tromblee requested that the Land Use Table for TSH and the original ordinance which established the TSH zone be provided for the Task Force. Arness asked the Task Force what criteria should be used to establish the historical value of property? Harvey reported that usually the minimum age of a site must be 50 years to qualify as a historic landmark, but since Kenai is a relatively new city, incorporated in the 60's that criteria might be waived. Meeks suggested that not just age or location be considered, but the historic bearing the site had on the development of Kenai. Mayor John Williams asked to give a brief report since he had to leave early to attend another function. The Mayor said he would like to see some of the old buildings from behind Ft. Kenay relocated. He would like to create a setting to display these cabins and some other artifacts and possibly name the area "Heritage Village". The Mayor said that lands could be purchased from existing owners and there were some capital improvement monies available which could be used for matching grants to facilitate this project. 4. NEW BUSINESS a. Report - Townsite Historic Tour Chairman Arness asked if Task Force members had any questions regarding the tour which had been taken on August 29th. He felt that a trail system could be developed in that area for beach access. b. Task Force Review Schedule The Task Force decided to meet on the first and third Thursdays of the month, with additional meetings as needed. Chairman Arness said he would like to identify general projects for the TSH area. Then the Task Force could recommend areas of improvements to Council. The three areas Arness identified were: 1. Establish physical boundary of TSH zone 2. Redraft or develop new ordinance to apply to the TSH zone. 3. Specific recommendations for projects or alterations to zone. Arness had prepared a Mission Statement for the group (attached). He felt that this would help to set the scope of work the TSHTF wished to accomplish. Arness suggested that the zone might be similar to the zone suggested by P&Z, which was basically the area around the Russian Orthodox Church. Other historically significant sites, such as the Lil Hakkinen home might be designated as landmarks, and come under the same zoning criteria. Harvey said she felt it was important to look at the Ordinance as soon as possible, there were three applications for development in the TSH zone scheduled for the next Planning and Zoning meeting. Consiel were adding a living room on their home; Foss wished to relocate the old Juluissen home to his property; and Poppin wished to sell four lots for a possible cabinet shop. It was hard for the Planning staff to direct these people because the zone is "up in the air" so to speak. Mccard asked if the Planning and Zoning Commission would support a moratorium in TSH? Scott said that any recommendation should go directly to Council. Respectfully submitted, Loretta Harvey Transcribing Secretary CITY OF KENAI TOWNSITE HISTORIC TASK FORCE MISSION STATEMENT The purpose of the City of Kenai Townsite Historic Task Force (THTF) is to develop specific recommendations to be presented to the City Council of the City of Kenai relating to the proposed area to be included in a Townsite Historic District, a revised Townsite Historic Ordinance, and suggestions for the restoration and enhancement of properties and structures considered to have historic significance. The intent of the THTF is to enhance and identify the City of Kenai's heritage. To present this heritage in a manner that promotes civic pride and an awareness of from where we as a people have evolved. The THTF will focus on community improvements including rules and procedures intended to clearly define any proposed development. The intent of these rules and procedures is to provide a basis for what is considered acceptable development or alterations to existing properties in a manner that can be clearly understood and also positive in attitude to welcome change. The purpose of the THTF is not to promote any specific industry or enhance the marketing of any product. Our intent is to provide a framework from which private and public interests can create their own goals. The framework is based on specific recommendations as well as a more generalized concept of how the historic portion of the City should be preserved and presented. We feel confident that the efforts of the THTF will have a positive effect toward accomplishing this goal. CITY OF KENAI TOWNSITE HISTORIC TASK FORCE August 4, 1992 - 7:00 P.M. Election of Officers Jim Arness was elected Chairman of the Task force. b. Meeting Schedule Mayor Willians, noted the memo regarding the Mission Street improvement plan, the Planning and Zoning recommended a public hearing before their meeting of August 26th. The Commission had asked the Task Force to set the date so they could attend. The Mayor felt there were some other areas, he wished to have the Task Force look at. He mentioned three areas, look at Mission Street improvements; look at complete review study which was done by Kasprisin in 1985, see how this would fit into overall picture for Old Towne; and look at the zone size and Ordinance. The group needs to look at what should be done with some historic artifacts such as the cannon, which has been around since the turn of the century. Also, since Fort Kenay was recently turned over to the Kenaitze Indian Tribe the buildings behind the fort may need to be relocated. These items should all be incorporated into the Task Force's job, because these are things that are historic in nature. TOWNSITE HISTORIC TASK FORCE MEETING August 4, 1992 Page 2 The Mayor asked the group to broaden their focus, should the City own some land in TSH? If the City should purchase those lands,what would be the purpose. This needs to be looked at along with the preservation ordinance. The area seems to keep dwindling down to the area around the church. The question is, is that all that needs to be preserved, or is there more? Some areas, such as the old library and the site of the fine arts center. Townsite historic preservation is a complex issue. The group needs to take a full look at the area and looking at the Certified Local Government Program. Look at the Matching Grant Program, once all this information is filed, the group would have to lobby Council for matching funds. There is money available for capital improvements, and matching grants. There is a cap of $500,000 set by ordinance. Judith Bittner, State Preservation Officer, said that the role of her office was mostly one of assistance. They have technical information and can put the City in touch with other programs and resources that might help Kenai. The first step the Task Force should probably undertake is to find what is important to preserve, historical and archeological sites. Bittner recommended that the program be set up to become a Certified Local Government (CLG). That way the city would have a system to assess what is important and how to reach the goal of protecting these important aspects of the zone. Elizabeth Henning, Advisor to the National Trust for Historic Preservation (NTPH). She explained that this organization was chartered by Congress as a non-profit to preserve non-commercial historic sites. Her office gives assistant to nine regional states. She has worked through problems which many communities face in common, which may be one way she could help the City of Kenai. She also has resources to help in developing historic ordinances and taking site surveys, etc. Steps that should be taken would include an historical/ archeological survey; whether the plan is needed, what incentives would there be for property owners; investigation of NTPH grant programs; and education programs for the community. Jim Arness asked Bittner and Henning what their recommendations would be to start the TSH review process. Elizabeth Henning said a site survey was the most important thing. Jim Arness felt he would like to set a timeline for accomplishing the goals the group may come up with such as drafting the ordinance, establishing a new zone, and other areas of concern. TOWNSITE HISTORIC TASK FORCE MEETING August 4, 1992 Page 3 Judith Bittner said that an inventory would get basic information down, such as local history, architectural statistics, history of Kenai, itself including settlement patterns, etc. Kathy Scott said that there was a frustration with the present system. She felt that when the new road systems were constructed the area area of Old Towne may be expanded and clear criteria needs to be established for further development. Scott suggested the group have a "walk through" of the zoning district. The group decided that a walk through should be scheduled for August 29th, Saturday at 2:00 p.m. The group would meet at the Russian Church (later changed to Senior Center). The next meeting will be held September 3rd. Jim Arness asked Task Force members to think about a timeline for work to be accomplished; schedule for meetings; agenda items and priority of items. C. Setting Public Hearing - Mission Street Improvements No date was set, as it was felt there was plenty of time to address this issue and it should be looked at along with the total ordinance and possible rezone. 4. There is also no requirement for City residency. It would not be appropriate for non-residents to set City policies for such a sensitive area. Goecke explained that this would be a Board. City guidelines do not require that a Board member be a City resident. As I remember if there is someone wanting to develop in the TSH zone they have to submit a document to this body, P&Z than would turn this to the TSH Board for their recommendations, than it would come back to the P&Z. This would create an additional step in approval of all development in TSH. Bannock said he felt that section B. and C. were not appropriate since it had never been clearly decided whether or not a Board was vital for sites to be considered as historic. Smalley said he felt that Ms. Bittner had stated that there be a Board or Panel/Commission that works in that capacity. The language did not state you had to have a specific body to deal with the historic area. Scott asked the Commission if they had reached a consensus as to whether or not the Board should be made up of residents. Bryson said he had trouble with non-residents making policies for the City of Kenai. He also noted that one of the main commercial activities in the TSH zone were apartments and under the new ordinance multi -family was not allowed. Hanson felt that the intent of the Task Force was that this body would have no power but be advisory only. Bannock said he would probably like the Board better if members were City residents. All meetings are open to the public so anyone can come and testify regarding historic sites. If b and c need to be in the ordinance than they should include resident criteria. KENAI PLANNING AND ZONING COMMISSION Minutes - January 27, 1993 Page 4 Glick said he realized this would be a specialized group. This area is a special area that merits this kind of consideration. Normally he would be against more regulartory hoops, but this area requires special treatment. Scott asked if there would be an objection to sending forth a recommendation on this section? Limiting the Board to advisory only, limiting members to residents only. Bryson said he felt there may be a need to obtain specialized help outside of the City limits. Scott asked if Bryson would like to recommend a minimum number of members who would be city residents. Bryson said he felt five would be appropriate, or an equal ratio. At least the majority of members should be residents. Bannock asked if the section could be rewritten to include "to the extent available within the city." Hanson said he felt that in the extent that this is intended to be a "advisory board" he would like to see the best qualified people be on it. Whether they reside in the city is not important. Scott thought that perhaps the Commission should recommend a majority, plus one. Scott asked for other comments regarding this proposed board. She noted that the ordinance suggested the board meet a minimum of twice a year or as needed. Hanson reported that the Task Force had designed it so the board would not have to meet during the long, cold, winter months, when building activity is down. Scott noted that the ordinance numbering was confusing. Harvey said she would check the numbering and try to clarify it. Development Criteria: Bryson was concerned over the second sentence on page three regarding reconstruction. He felt it was reaching way beyond land use issues. Scott expressed concern over the legality of some parts of the ordinance. Have any of these been legally tested? Hanson said it has been tested and it was decided that if the historical interest in a community is great enough, if it's not arbitrary, than the ordinance can deny some uses in that area. Bryson referred to page 4 item (c) wondered why all multi -family structures including duplexes are prohibited from being constructed. Yet, if there is an existing building it would be allowed to rebuild. This seems. to be counter to the existing KMC. KENAI PLANNING AND ZONING COMMISSION Minutes - January 27, 1993 Page 5 Bannock had a problem with (a) Metal Buildings. He recalled Mr. Tormdle's attempt to put up such a building but he was denied. He also expressed concerns regarding (d) trailers, (already not allowed under KMC 24.22.40); (j) commercial horseback riding, (this is going overboard on what an ordinance should address.) Bryson comment on (1) just for sake of scale, Bailey building is 5,000 feet, so anything larger than that would be prohibited. The only viable business in Old Town are apartment rentals. The prohibition of apartments would create quite an impact on that area. Glick said he felt apartment buildings should be allowed as long as they conformed to the historic nature of the district. Scott summarized for the Commission: Problem with sections (c), (j) and (1). These sections need clarification and work. The primary concern is the rebuilding of prohibited non -conforming use structures under 4. Proposed Boundaries La Shot said that the Commission should decide what the area outside the proposed TSH zone should be zoned? Bannock mentioned that Bookey had requested that his RV park be included in one zoning designation. Glick said this item should probably be addressed separate from this zone change. Bryson noted that the Russian Cemetery was included in the proposed zone but cemeteries were not included in the Land Use Table. Goecke said the Task Force felt the cemetery had "grandfather rights" but no new cemeteries will be allowed. Bryson felt cemeteries should be allowed as a Conditional Use, rather then non -conforming. Bryson also thought that parking should be allowed on private lots, this is listed as a prohibited use under the new ordinance. b. Kenaitze Indian Tribe Twelve Month Planning Project La Shot reported that he had spoken to Robert Blankenship regarding this project. Blankenship was seeking support from the City for this project. La Shot had told Blankenship that no staff support could be offered, but the Planning and Zoning Commission might be willing to review the project as it progressed. Blankenship also asked if the City would draft a letter of support for this project. Scott said she could see the value of such a project from an economic development/tourism aspect. She hoped the Commission would be willing to provide assistance by reviewing the plan. She thought the letter was needed to support a grant proposal bid. KENAI PLANNING AND ZONING COMMISSION Minutes - January 27, 1993 Page 6 After further discussion the Commission took no action on this item. a. Plans and Goals for 1993 The Commission decided to adopt one goal for 1993, which is: Review of zoning and possible rezoning which would be consistent and enhance the city of Kenai along the Spur Highway. Also, the City of Kenai should encourage DOT to develop trail systems concurrent with the Spur improvement program, and encourage access at collector points. b. The Commission is discussing their goals and objectives for the year. The Spur Highway corridor will be a high priority. They will also be reviewing the Code for potential changes and the Comprehensive Plan for updating. Smalley added that Code enforcement problems have been forwarded to LaShot for review. Some include signs and businesses operating in the City without licenses, etc. MOTION: Councilman Smalley MOVED that the City purchase name labels for the Planning & Zoning Commission and Councilman McComsey BEWNDED the motion and requested UNANIMOUS CONSENT. Smalley added that he explained to the Commission the override of their decision in regard to the Carr's sign. Smalley also reported that a work session was held following the P&Z meeting. The work session was with the Townsite Historic Task Force. Together they reviewed the changes to the ordinance and boundary suggested by the Task Force. There was some discussion in regard to stricter enforcement of access to the beach in order to better protect the dunes. Chief Morris stated that their seasonal enforcement officer patrols that area. Smalley stated that the consensus of the Townsite Historic Task Force felt their proposal was what they want to present. The proposal will now be reviewed by P&Z and then on to Council. Williams referred to the resignation of Paul Hanson from the Planning & Zoning Commission which was included in the packet. Brown would like to call the these bonds because if they are called on August 1, 1993, $220,000 will be left and the city will be paying 8% interest. Brown recommended they be paid off. Brown added the bond bank will be calling other issuers and telling them it would be best to pay their bonds off as well. Consensus of council was to go ahead and pay the 1980 bonds off. H-11. Williams asked if the old ordinance for Townsite Historic had been canceled in regard to the recreational vehicle park being built on the bluff. Smalley stated old pavement, etc. has been thrown over the bank and is killing vegetation. Williams read a portion of Arness' letter in regard to Council's "non -action." KENAI CITY COUNCIL MEETING MINUTES JUNE 2, 1993 PAGE 62 Graves stated there are no "not allowed" uses in the old Townsite Historic zone. That was one of the problems. If a building permit is required, there is a process, however Graves did not know if a building permit was required. Bookey stated he was required to obtain a conditional use permit for the portion of his RV park which was inside the Townsite Historic Zone. Smalley stated he wondered what kind of permits would be needed to make adjustments to the bluff. Williams stated he did not want the Task Force to think the Council has failed to act on the Townsite Historic zoning changes. This was not the intent of Council. Council had decided to review the new ordinance at a later time due to a heavy schedule earlier last month. Smalley suggested a cease and desist be placed on the construction if it is not allowable by code. Kornelis stated he believed La Shot's interpretation different and he has the same question of whether the work is allowable or not. Smalley stated he believed any development in Townsite Historic is to go through Planning & Zoning first. Williams suggested this item be reviewed very carefully. Williams added he will do a letter to Arness and the Task Force members with information reported by La Shot. ITEM G: OLD BUSINESS G-1.
