WHEREAS, the City of Kenai has a public trust to provide a variety of services to the community. An efficient and productive work force is vital to carry out that trust. The public has a reasonable right to expect persons employed by the City of Kenai to perform their duties free from the effects of drugs, including alcohol; and WHEREAS, the City has an obligation to seek public safety through the actions of its employees. Furthermore, employees of the City have a reasonable right to work in a safe environment free from the effects of drug use, including alcohol. The City has a reasonable right to expect employees to report for work fit for duty free from the effects of drugs, including alcohol; and WHEREAS, the City has an obligation to ensure employee and public safety through the actions of its employees. Furthermore, the City has the right to ensure that its employees will comply with City, State, and federal occupational safety and health regulations, law and policy. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that KMC 23.35.020 is amended as follows: 23.35.020 Causes for Warning, Suspension, or Dismissal: (a) When an employee's conduct falls below desirable standards, he may be subject to disciplinary action. (b) General reasons for which an employee may be disciplined include: (1) Drinking intoxicating beverages on the job or arriving on the job under the influence of intoxicating beverages or such drugs. (2) Illegal possession of any controlled substance on the job. (3) Ingestion, either on the job or within eight hours before reporting to work, of any controlled or other dangerous substance, unless prescribed by a licensed medical practitioner. Employees shall notify their immediate supervisor when required to use prescription medicine that they have been informed has the potential to impair job performance. The employee shall advise the supervisor of the known side effects of such medication, as well as the prescribed period of use. No employee shall ingest any prescribed or over-the-counter medication in amounts beyond the recommended dosage. (4) Violation of a lawful duty. (5) Insubordination. (6) Breach of discipline. (7) Being absent from work without first notifying and securing permission from the employee's supervisors. (8) Being habitually absent or tardy for any reason. (9) Misconduct. (10) Conviction of a felony or a misdemeanor involving moral turpitude. (11) using religious, political, or fraternal influence. (12) Accepting fees, gifts, or other valuable things in the return for performance of the employee's official duties for the City. (13) Inability to perform the assigned job. (14) Political activity as restricted by the Charter. 15 Failure to follow the City's alcohol and controlled substance abuse and testing policy as set forth in the City of Kenai Employee Handbook. 16 Knowingly or negligently failing to follow federal and state occupational safety and health regulations and City law and policy regarding the same. Manninen, City Manager-q/ Date: December 15, 1995 RE: Introduction of an Ordinance Dealing with the Regulation on the use of Alcohol and Drugs; City Employment Policy Development will be Included in the City of Kenai Employee Handbook and City of Kenai Supervisor's Handbook Attached for Council consideration at the December 20, 1995 Council meeting is an ordinance defining, limiting and restricting the use of alcohol and drugs and providing penalties and testing procedures for the same. Once adopted, the City Administration will promulgate rules and distribute them in the City's Employee Handbook and Supervisor's Handbook as well as incorporated in Chapter 23 of the Kenai Municipal Code dealing with general conduct, discipline, termination, and appeal. WHEREAS, the Kenai Spur Highway has the highest daily traffic counts on the Kenai Peninsula and is the principal connector between the communities of Kenai and Soldotna, serving the residents of the Kenai Peninsula on a daily basis for work, shopping and commuter airplane access; and, WHEREAS, the highway serves to benefit the economies of both communities as the residents engage in trade between the areas; and, WHEREAS, one portion of the highway was partially completed during the 1995 construction season; and, WHEREAS, the public expectations have been to finalize the project rather than leave the remaining portion of the highway incomplete; and, WHEREAS, the completion of the Kenai Spur Unity Trail Pedestrian/Bike Path is necessary to ensure safe travel of biking and walking/running public; and, WHEREAS, it is in the best interest of the Department of Transportation (public) to provide safe, expedient traffic flow and at a reasonable cost to the public. WHEREAS, the State of Alaska has recently opened a subsistence and personal salmon dip net fishery at the mouth of the Kenai River; and, WHEREAS, the fishery has attracted thousands of "dipnetters" from all over the state to use the Kenai Beach Road for access and parking; and, WHEREAS, the State did not plan on the tremendous impact this fishery is having on the Kenai Beach Road; and, WHEREAS, the State needs to upgrade the Kenai Beach Road by excavating the frost susceptible material, backfilling, improving the drainage, paving, signage, and adding parking areas; and, WHEREAS, the City of Kenai is presently considering improvements for access from the Kenai Beach Road through the dunes to the Kenai Beach by means of boardwalks, elevated stairs, walkways, decking, and interpretive signs; and, WHEREAS, the State of Alaska has an obligation to the public to plan and implement a proper means of access when opening up a dip net fishery such as this. Williams, Mayor Suggested by: Administration CITY OF KENAI RESOLUTION NO. 94-41 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, RECONFIRMING THE CITY'S COMMITMENT TO TAKE OVER THE OWNERSHIP, MAINTENANCE, AND OPERATION OF NORTH FOREST DRIVE AND REDOUBT AVENUE LOOP, AFTER THE STATE OF ALASKA PROPERLY UPGRADES THESE ROADS, THE DRAINAGE SYSTEM, AND THE BIKE/PEDESTRIAN PATHS TO ACCEPTABLE ENGINEERING STANDARDS MUTUALLY AGREED TO BY DOT/PF AND THE CITY OF KENAI. WHEREAS, North Forest Drive and Redoubt Avenue, previously called Homesite Loop, are poorly constructed rural strip paved roads, and WHEREAS, the existing North Forest Drive and Redoubt Avenue roads exhibit severe frost heaving, poor drainage systems, and heavily damaged and hazardous bike/pedestrian paths, and WHEREAS, the City of Kenai thinks that Forest Drive and Redoubt Avenue need the following improvements to be properly upgraded: 1. All the frost susceptible material from the road and bike/pedestrian path subbases need to be excavated. 2. The existing rural ditch and culvert drainage system need to be replaced with an underground storm drainage system. 3. The roads need to be repaved to two 12 foot wide driving lanes with paved shoulders for parking. 4. Curbs and gutters need to be constructed along the roads which tie into the storm drain system. 5. The existing bike/pedestrian path needs to be replaced with a bike/pedestrian concrete or paved sidewalk along one (or both) sides of North Forest Drive and Redoubt Avenue. 6. The street light at each intersection needs to be reinstalled, and WHEREAS, the City of Kenai agrees with the State that the roadways should be built to the current State of Alaska and Federal Highway engineering standards, and WHEREAS, North Forest Drive and Redoubt Avenue are presently state maintained roadways. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA' that the City of Kenai reconfirms its commitment to take over the ownership, maintenance, and operation of North Forest Drive and Redoubt Avenue loop, after the State of Alaska properly upgrades these roads, the drainage system, and the bike/pedestrian paths to acceptable engineering standards mutually agreed to by DOT/PF and the City of Kenai. PZ95-61—Variance Permit for Signage—Seventh Day Adventist Church CARL GLICK MOVED FOR APPROVAL OF PZ95-61. MOTION SECONDED BY KAREN MAHURIN. Chairman Walker asked for staff comment. Jack La Shot stated that the only additional comment is that this sign is similar in size to one that was existing prior to the Spur Highway project. That sign was non -conforming and since it was removed, the code says you cannot replace a nonconforming sign. That is why the church is requesting a variance permit. Chairman Walker opened public hearing. Mr. Grizzell stated the church would like to have the variance approved noting that the sign that was taken down was the same size as they one they are requesting to put up. Mr. Grizzell noted that this sign would be lighted but that the other sign had also had lighting. Chairman Walker brought item back to the Commission for discussion. Karen Mahurin asked if this was a different sign than the sign that was taken down or if this is the exact sign and they are just asking permission to put the sign back up. Mr. Grizzell stated it is a different sign but it is the same size. Grizzell noted the old sign was eight foot wide by ten foot high and the new sign will be eight foot high by ten feet long, it will be turned sideways. Mahurin asked why the church wanted a sign that large. The pastor of the church responded for visibility so that people driving by can see it. He noted that when he first became the pastor that he missed the church several times because he did not see the sign. He continued noting it is a nice sign and an improvement and that the church would like to be recognized. Chairman Walker asked how far a distance from the road the new sign would be placed. Mr. Grizzell estimated it would be 30 to 35 feet from the actual road bed and 8 to 12 feet behind the property line. Grizzell added that in no way would the sign obstruct any view for traffic traveling either way. Walker noted that would be his concern to make sure that the sign did not in any way obstruct traffic. Grizzell added that the bottom of the sign would be approximately four and a half or five feet off the ground. John Booth stated he seemed to recall reading in the code required that the sign be placed by the city building official. Booth noted he thought that was under section 180. Walker asked if La Shot had a copy of the code. Booth stated that section 180 is the variance code and section 220 the sign code. Booth read under paragraph 7, "The building official shall determine the area of all signs and classify all signs." Booth noted that this may not describe who will place the sign. Booth noted he was incorrect. Walker asked for further discussion or comments. Phil Bryson noted he had contact with the city office concerning interpretation of the area and was told that these signs are not specifically addressed in the code as most items are not. And, administration was interpreting this as being an 80 foot sign with two faces. That was the same area as the prior sign. Bryson stated he will be supporting this permit. Karen Mahurin stated she will be voting no because she believes there is a sign ordinance for a specific reason. Mahurin noted that if it were the same sign that was taken down she would view it differently but she has a problem with the fact that they Planning & Zoning Commission Page 2 December 27, 1995 Minutes are reconstructing a sign with new dimensions. The ordinance does not allow the sign to be put back up. The difference between 32 square feet and 80 square feet is significant. Mahurin reiterated that she would not be supporting this permit. Mr. Grizzell commented that the sign was the same size as the original sign; however, it would be laid on it's side. Chairman Walker stated he understands and shares Commissioner Mahurin's concerns. Walker stated his concern is with the code as it is written and as the code has not been adapted to provide for signage along the Spur Highway in this particular zone. Walker stated he still has a major concern with the amount of setback as it is approximately 30 feet from the highway. Walker stated if it were a greater distance from the highway he would probably support it. Jack La Shot stated that as far as visibility the sign is behind the property line and noted that he estimates a full car length between the property line and the sign. La Shot noted he doesn't think visibility will be a problem. Phil Bryson noted two items concerning the setback. Bryson stated he doesn't know what side of the center line of right of way the highway is being constructed to noting he suspects it is not the center of the right of way and it may be to the south. Bryson stated it is approximately 80 feet from the sign to the edge of the driven surface and he didn't feel a four by eight sign would be adequate to be seen from that distance nor could it be read. VOTE: GLICK YES BOOTH YES WALKER YES MOTION PASSED. BRYSON YES MAHURIN NO 7. NEW BUSINESS: a. Special Planning & Zoning Commission Meeting Chairman Walker stated the question before the Commission is, "Will the Planning & Zoning Commission approve the scheduling of a special Planning & Zoning Commission meeting for January 16, 1996?" Bryson stated that will be a busy week but scheduling the meeting would be okay with him. Mahurin asked if the meeting would be at 7 p.m. and Walker advised yes. Chairman Walker questioned if there would be a conflict with the use of the council chambers. Councilman Smalley stated he did not believe there was a conflict but Ms. Kebschull could verify that with the city clerk. Smalley commented that this item had came up at council and that council was Planning & Zoning Commission Page 3 December 27, 1995 Minutes going to first of all request that the Planning & Zoning Commission change their meeting to that night. Smalley stated he had commented that he didn't think that would be a good idea and after further discussion the special meeting was discussed. Smalley noted that when the discussion took place the rest of the council was present and they are members of other boards and commissions and no conflicts were noted. Walker noted that if a conflict arises that perhaps the meeting could be held in the library conference room. Meeting scheduled for January 16, 1996 at 7 p.m. S. OLD BUSINESS: a. Tidelands Lease Application Ms. Mahurin asked Chairman Walker if he wished to deal with each lease separately or as a group. Walker noted that would be up to the maker of the motion. Walker noted that the business was entitled "Tidelands Lease Application." Walker advised Ms. Mahurin before answering her question he would like to ask administration to explain the question on the back of the packet information. Jack La Shot noted that the report from Kim Howard explains the situation and that the only question before the commission tonight is if the use falls within that permitted under the zoning ordinance for a non -zone in Kenai. La Shot noted this has historically been fished for years and years. La Shot added his personal opinion is that the use does fall with that permitted in a non -zone and a similar use as allowed by other agencies. La Shot stated that the Commission did not have to discuss who may be leased the land, that would be up to council. Chairman Walker asked Ms. Mahurin if her question was to deal with these separately or together. Walker asked if she wished to deal with them together and Ms. Mahurin responded yes. KAREN MAHURIN MOVED FOR APPROVAL OF THE INTENDED USE OF THE PERMITS UNDER THE ZONING ORDINANCE. MOTION SECONDED BY PHIL BRYSON. Walker asked if there were any further staff comments. None noted. Walker asked if anyone in the public wished to speak to the item. None noted. Phil Bryson reiterated La Shot's statement that the code is essentially silent in the area requested for leasing and also the proposed use is one that has been traditional for many years in that area. Bryson stated he will be supporting the motion as he feels it is appropriate. Planning & Zoning Commission Page 4 December 27, 1995 Minutes Walker stated he had one comment noting he does not like the formula the city utilizes for the lease applications in these areas, he does fully support this particular use of this property. Walker added that he felt it was in the correct zone and he will be supporting the motion. VOTE: BRYSON YES MAHURIN YES WALKER YES MOTION PASSED. 9. CODE ENFORCEMENT ITEMS: 10. REPORTS: a. City Council BOOTH YES GLICK YES Councilman Smalley noted that the Commissioners had a copy of the agenda in their packets with notations on it. Smalley stated that he had a report from the library showing 12,811 actual, active card users. The library has over 14,000 cards out. October use of the library itself was 7,368 and November was 6,014. Walker asked if these are different users or repeats? Smalley stated that all were different and he had a copy of the report showing where the users reside, etc. (Report given to Walker.) Walker asked if Smalley happened to know how many square feet the library is? Smalley asked La Shot who stated he thought around 17,000 but noted he was guessing. Smalley reported that James McCubbins a student from Kenai Central High had spoke to the council. He is working on his Eagle Scout project. This was going to be done a couple years ago and then was postponed. The council is going to assist with an amount not to exceed $1,000 for a sign on the north end of town. Dick Hultberg spoke to council on whether the city had ordinances concerning the placement of advertisement flyers on windshields in parking lots, etc. A great deal of garbage results from these flyers. Smalley reported that the administration will be recommending an ordinance before too long dealing with this type of advertisement. Under resolutions, Items 3, 4, & 5 were tabled. Item 3 was tabled because it was felt that the city would have been making electrical outlets available for some of the employees at the airport at city expense when in fact there are some electrical outlets Planning & Zoning Commission Page 5 December 27, 1995 Minutes at other parts of the airport terminal for airport employees at lessee expense. The city did not want to create a situation of supplying a service to some employees at city expense. Smalley reported that there will be power in the shelter being built for the airport manager and other city employees. Resolution 95-80 dealt with the highway project and it was tabled for a rewrite. The project list sent by the state identified a lot of different highway projects that are ongoing as Kenai projects when in fact they are from other areas on the Kenai Peninsula. Smalley stated the Keith Kornelis will be contacting the state and properly identifying the locations of these areas. In addition, regarding the prioritization of the projects, resolutions will be developed requesting several projects be given priority number one. Smalley gave an example of the pedestrian/bike trail being a priority one and yet the widening of the road is listed as a priority three. The fish initiative was tabled and will be brought back on the 17th. Smalley stated there was a concern about the proper allocation of the fisheries and the document will be rewritten. Councilman Smalley noted that under New Business, Item 5, Alaska Municipal League membership dues had just about doubled and had risen from around $900 to almost $1900. Smalley added that this is a phase and when it reaches full development it may cost as much as $6600 and is not sure that the council will be willing to pay that amount. The Department of Health & Social Services Health Center lease was approved. Smalley noted that the city will be encouraging DHSS to develop other space for the Health Center. The center has 1147 square feet leased. Council held a discussion about policy change for use of Leif Hanson Memorial Park. Smalley stated that administration is to develop a new policy for types of events that should be held at the park. If food is served, those functions may be held at the park strip corridor at the ball park. Smalley noted the concern being that some past functions have had a large number of people with children who climb on the memorial plantings, trash, etc. Councilman Smalley advised that the council chose not to act on participation in the National Flood Insurance. Discussion by the council concerned Item 1.4 which talked about potential restrictions on development along the river corridor. Council also passed a resolution regarding Anglers Acres for the state to help stabilize the banks in that area. Smalley added that during discussion of the flood damage it was stated that damage was more a result of erosion than from the flood itself. Chairman Walker asked Smalley to explain this. Smalley stated that the reimbursement for damages that the city had applied for through FEMA were the result of erosion. The damage on private property in Anglers Acres was probably a combination of erosion and flood. Smalley explained that when the water was high it eroded the bank itself and the Planning & Zoning Commission Page 6 December 27, 1995 Minutes bank dropped off. Smalley added that the flooding of the river occurred more on the upper river. La Shot added that the flood had accelerated the natural erosion. b. Borough Planning Phil Bryson advised that the Borough Planning Commission had not met since his last report. c. Administration Jack La Shot commented that the newspaper article regarding the Spur Highway project had been misleading and that the current project will be completed. La Shot added that some other projects have had their prioritization changed. 11. PERSONS PRESENT NOT SCHEDULED: 12. INFORMATION ITEMS: a. KPB Planning Commission Action from December 11, 1995 Phil Bryson explained that this was a situation wherein the plat had not been filed and the surveyor requested additional time to file. Jack La Shot noted that the city routinely receives these reports from the borough and in the future they will be included in the packets to advise the Commission of borough action. Bryson added that the borough approves all plats for one year and for that for approval to stay valid an extension must be requested. Bryson noted that unless there has been some major change in the right of way in the area or a need for a change, they are commonly approved for an extension. a. National Flood Insurance Memo to Council b. Term Letters Chairman Walker encouraged Commissioners to contact the City Clerk with their response to the clerk's letter. a. COMMISSION COMMENTS & QUESTIONS: Ms. Mahurin stated she would urge that the council be prudent in supporting resolutions for commercial or sport fisheries. Mahurin stated she felt the city should remain impartial. Regarding the Leif Hanson Park, Mahurin stated that the Kenai River Festival, which was a large group, was a wonderful use of the area. There was food and the next day the park was clean. Mahurin stated she would urge the city to look very carefully before amending policy as to who would be allowed to use the park. Smalley noted there is a statement in the policy that the administration may approve activities at the park. Chairman Walker asked that prior to the next meeting that the P.A. system be repaired. KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 2 A-6. CONSENT AGENDA There were no changes made to the consent agenda. Mayor Williams noted the consent agenda would stand as presented. ITEM B : SCHEDULED PUBLIC COXWMM B-1. James McCubbins - Eagle Scout Project/Welcome to Kenai sign for north end of town. McCubbins explained that he is working toward an Eagle Scout award and wants to place a "welcome to Kenai" sign at the north end of town. McCubbins reminded council that he had requested permission to place the sign and financial assistance from the city a few years ago, but that the money had lapsed. McCubbins requested re -approval of the funding. McCubbins explained that he would be requesting aid from carpenters and friends to help him complete the project, and requested permission to use the city shop during the day. He will also be using the KCHS shop. He plans on placing the sign in the spring. Smalley referred to minutes of the 1991 meeting in which McCubbins originally requested financial help from the city. Smalley asked if an encroachment permit has been received. Public Works Director Kornelis explained that he referred McCubbins to George Church at DOT in regard to placing the sign in the state right-of-way. Kornelis added, he checked with the city's Building Official and found that he will not be needing a city encroachment permit as the sign is an informational sign. McCubbins explained he planned to use redwood slants with wooden letters on the face of the sign. It would be a one-sided sign with the lettering to be seen coming into the city from the north. Councilwoman Swarner suggested the sign include a "thank you for visiting Kenai" on the back side to be read leaving Kenai going toward Nikiski. Mayor Williams requested a more detailed picture of the sign with actual dimensions, etc. for the city file. KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 3 MOTION: Councilman Smalley MOVED that the City assist Mr. McCubbins in sponsoring his Eagle Scout project for this sign on the north entrance of town for a cost not -to -exceed amount of $1,000. Councilwoman Swarner SECONDED the motion. There were no objections. 80 ORDERED. Dick Hultberq - Request amendment to code regarding placing of advertisement fliers on vehicles. Mr. Hultberg stated his address to be 1618 Fathom Drive in Kenai. Hultberg explained that he recently attended the bazaar at the Kenai Central High School during the Thanksgiving holiday. While there, he found there were various groups in the area who placed advertisement fliers on the windshields of vehicles using the parking lot at the school. Hultberg stated he found the fliers to be a nuisance as they come loose from the vehicles and they become trash to be picked up during the spring clean-up. Hultberg requested an ordinance to make people who place the fliers, be responsible for cleaning up the loose fliers. Councilman Bookey asked if the Code covered this problem. Attorney Graves stated he would do a report on handbills and what other communities have done to circumvent the problem. Council requested Graves to investigate the matter and report back for the next council meeting. ITEM C: PUBLIC HEARINGS C-1. Resolution No. 95-77 - Establishing the Authorized Signatures for Withdrawal From Depositories of Municipal Funds. Resolution No. 95-78 - Transferring $2,000 in the Airport M&O Special Revenue Fund for Installation of Interior and Exterior Electrical Plug -Ins in the New Carport Building. MOTION: Councilman Measles MOVED for adoption of Resolution No. 95-78 and Councilman Smalley SECONDED the motion. There were no public comments. Councilman Bookey asked if work on the project had begun. Airport Manager Ernst explained that the work had begun and apologized for that. However, Ernst further explained that Finance Director Sweeney brought it to his attention the project was not a repair and maintenance project, but a capital improvement project, and because the cost was over $1,000, it had to come to council to move funding from the Repair and Maintenance Account to the Special Revenue Fund. Otherwise, it would have been within the limits of his authority to write a purchase order for $2,500. Councilman Bookey stated his concern that the cost of this particular project had gone over budget and stated he was not comfortable in spending any more money on the project. Bookey asked if any more doors or heaters were to be added to the project. Ernst replied, doors would be added at some time, but they do not plan to put heat in the structure. Bookey stated his distress with the project and that it had gone out of control. He would have liked to have the costs included in the regular budget and carry it through or have the council set a priority at budget time. Williams noted the resolution included a statement from the Finance Director explaining it is an authorization to spend money for a capital asset which will be depreciated in the future. Councilman Moore asked Finance Director Sweeney what the city's capitalization policy is for capital assets. Sweeney answered, assets that are in excess of $1,000 and have a useful life in excess of one year. For an improvement to a building, the aggregate is investigated. If the aggregate meets those two requirements, and either provides a new function to the building or will extend the useful life of the building or asset, then it is capitalized as an improvement to the building. Resolution No. 95-79 - Transferring Airport Terminal Enterprise Fund for Electrical Outlets. MOTION: Smalley: Yes Swarner: No $1,200 in the Installation of Councilman Measles MOVED for adoption of Resolution No. 95-79 and Councilman Smalley SECONDED the motion. There were no public comments. Councilwoman Swarner asked if this work had begun. Ernst answered yes and added, the work was started because the ditching was done prior to the frost. Again, it was a $1,200 authorization, which at the time, believing it was a repair and maintenance item, he thought he had the authority to go forward with the project. Ernst explained outlets which had been available for use, had been removed so the structure could be placed. They added plug -ins inside the building and added two sets of plug -ins for the outside of the building so that when city employees fly out, they can plug in their vehicles. The rest of the funding would be to extend outlets for the general employees of the terminal. Measles asked how many outlets were to be placed. Ernst explained, two banks of four inside the building and two banks of two on the backside of the building. There would be one for every two parking spaces beyond that. Those would be on pedestals of banks of four -- approximately four pedestals in the employee parking area. The pedestals are those left over from the original construction of the new portion of the terminal. Measles asked if the availability of plug -ins for general employees of the terminal at that end of the building, would be a problem if they are not available for other employees, use. Ernst answered, there are outlets on the other side of the terminal (restaurant and car rentals). Measles asked if a terminal employee could complain that -plug -ins are available for some and not for all. Ernst answered, there could be complaints from someone not working on the north side of the building. KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 6 Ernst added, there may be a problem if another airline would rent in the terminal. There are more pedestals available for use. Councilman Bannock asked if the availability of plug -ins was something new. Ernst answered it is new, as far as making free plug -ins available to terminal employees. The car rental agencies pay for their plug -ins. They are metered separately. Councilman Measles stated his concern that the cost for use of the plug -ins on one side of the building would be absorbed by the city, but on the other end, are not. Ernst explained the plug -ins have not been placed for the terminal employees. If council does not want them placed, they do not have to be. The wiring is now up to that area, but has not been placed for those plug -ins. The only plug -ins available would be those for the city employees use (which are situated on the building). Those were included in Resolution No. 95-78. Ernst added, as soon as he found he was in err, he had the work stopped. Williams asked who would be using the plug -ins. Measles and Ernst answered, the airline employees. Ernst added, the airline employees requested them and he did not think it would be a problem. Measles stated he would not have a problem with making the plug -ins available, if the plug -ins at the other end of the terminal would be available under the same conditions. Ernst stated that could be a problem as the restaurant parking area is the only place where the city would have the choice of paying the costs for the plug -ins. It is not included in the car rental agencies' contracts for the city to supply electricity to the plug -ins. Measles suggested that if the airlines want plug - ins, they should install a meter and pay for the electricity like the restaurant or car rental agencies would do if they elected to turn the power on to their plug -ins. Measles added, all the lessees should be treated the same. Ernst stated he would prefer council to say no to placing the plug -ins for the terminal employee use if they do not feel comfortable in making them available. The work is at a point where it does not have to be done, except those for the city employees. KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 7 Councilman Bannock stated he would like to see the plug -ins there if there is a need for them. However, he would like them to be on a meter by whatever business is responsible for using them, like at the other end of the building. Councilman Smalley stated he did not have a problem having the plug -ins metered. He agreed with Measles' concerns in regard to having free use of plug -ins for one and not the other. Swarner asked what the cost would be for a meter. Ernst suggested $100 to $200 for a 100 amp meter. Resolution No. 95-80 - Supporting the Completion of the Kenai Spur Unity Trail Pedestrian/Bike Path and the Kenai Spur Highway Expansion Project, in the Phases as Originally Scheduled, as a Number -One Priority on the National Highway System. MOTION: Councilman Smalley MOVED for approval of Resolution No. 95-80 and Councilman Bookey SECONDED the motion. There were no public comments. Councilman Smalley stated his concern of the statement in the resolution "a number -one priority." However, he felt the trail was needed and would support the resolution. Councilman Bannock stated he did not support the placing of the bike trail as a "number -one priority." Public Works Director Kornelis explained the resolution was brought forward after the council's luncheon with area legislators. The pedestrian bike path is part of the highway project. The DOT has re -prioritized projects and that information was available as Item H-9. The new listing names a lot of projects as number -one priorities. The concern is that DOT moved the completion of the Spur Highway project, at the Soldotna end, lower on the list, from a number -one priority to a number -three priority. Bannock stated he believes the completion of the highway is a major priority, but did not believe the bike path is either a KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 8 number -one priority or a priority. Measles agreed that the completion of the highway should be a much higher priority than the bike path. Kornelis further explained the new ratings of the state's highway, etc. projects. Kornelis noted the DOT changed the priority of the Soldotna end of the Spur Highway from a number - one to a number -three priority as a National Highway Project. They also left the bike trail as a number -one priority under the TRACK program. Measles suggested the resolution be re -written and remove all references to the bike trail, emphasizing the completion of the highway project and not the bike trail (heading, the therefore paragraph and, remove the fifth whereas). Councilman Smalley suggested a second resolution be produced for support of the Unity Trail. Williams suggested Resolution No. 95-80 state that the completion of the Spur Highway Project was moved to a number -three priority and should be upgraded to a number -one priority. MOTION: Councilman Smalley MOVED to table Resolution No. 95-80 and present it at the next meeting with a complete re -write of this document, speaking specifically to the Spur Highway Expansion Project and a separate resolution speaking to the pedestrian bike bath. Resolution No. 95-81 - Recognizing the Social and Economic Importance of the Alaska Commercial Salmon Fishing Industry and Opposing the F.I.S.H. Initiative. MOTION: Councilman Moore MOVED for approval of Resolution No. 95-81 and Councilwoman Swarner SECONDED the motion. There were no public comments. Williams noted that he included copies of Resolution 91-2 to point out that the council has had a policy of being very careful between its support of either the sport or commercial fishing industries. However, the council has always stated that proper biological information and proper KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 9 biological allocation should be uppermost in the State's desire to control the fishery and the fisheries should not come under a political situation in regard to allocation. Councilman Moore explained the Initiative, on the surface, may appear harmless, but if looking at it more closely, it could impact Cook Inlet more than in any other part of the state. The problem with the Initiative in that it is not region -specific, but based on statewide salmon harvest. Some of the definitions of the Initiative are that harvest need is harvest capability or what you need equals what you are capable of harvesting. Also, the Initiative is based on projections and not actual runs. Moore also added that of the top ten taxpayers in the city, three of them are fish processors. Councilman Bannock stated he knows little about salmon harvesting and would prefer not making a decision until the other side of the topic is heard. Bannock added, he would not be comfortable in voting on the resolution at the meeting. Ron Rainey - Rainey reported that a representative of F.I.S.H. Fairness in Salmon Harvest is scheduled to speak at the Kenai Chamber of Commerce in the next few weeks. He also would like to hear both sides of the issue. Councilman Bookey agreed with waiting on a vote until after hearing both sides of the topic. Williams suggested a change be made in the "now, therefore" paragraph. The paragraph should read: Now, therefore,..., Alaska, recognizes the social and economic importance of the Alaska commercial salmon fishing industry to our community and to the State of Alaska and that we oppose the passage of the F.I.S.H. Initiative. An addition to the last whereas should also be made, i.e., ...Board of Fisheries through sound biological information rather than political consideration. MOTION: Councilman Bannock MOVED to table Resolution No. 95-81 and Councilman Bookey SECONDED the motion. Measles requested the resolution be brought back for consideration of council at the January 17, 1996 meeting. Moore noted that date would be after the deadline for submitting KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 10 signatures for the legislature. Measles stated they could proceed with the signatures, and the Legislature would not have acted on anything at that time. There would still be time to address the matter with the Legislature. Moore added that if the Legislature does not act, the Board of Fisheries will have to vote on it. It is more than the Legislature involved. C-6. Resolution No. 95-62 - That the City of Kenai Goes on Record Supporting the Permit Applications of the Beaver Creek Bank Restoration and Protection Group Submitted to Various Agencies and Directs That This Resolution be Sent to the Alaska Department of Fish and Game and to the Applicants. MOTION: Councilman Measles MOVED for adoption of Resolution No. 95-82 and Councilman Smalley SECONDED the motion. Ron Rainey - Rainey (the applicant requesting the resolution) explained there are two hurdles to cross: one, the permit to get the project underway and, two, requesting matching funds from the Exxon Valdez Trustee Council for the project. Rainey added there is no one else in the city of Kenai applying for the funds. However, there are 66 other applicatants in other areas requesting funds. Williams asked Kornelis if the city applied for Exxon Valdez Restoration funding for projects inside the city. Kornelis answered yes. Rainey corrected his statement as no other individuals in the city have applied for matching funds. VOTE: There were no objections to the motion. 80 ORDERED. Council on Aging Councilwoman Swarner reported the minutes of the recent meeting were included in the packet. Swarner added there was a lengthy discussion about smoking at the Congregate Housing complex. Swarner added, the topic would come to council in a future meeting. Williams noted the discussion in the minutes regarding placing automatic front doors at the Center. Williams suggested Administration prepare a cost estimate to place automatic front doors and include the information in the next budget. Adding the doors will make the building more in line with the ADA requirements. Administration was directed to include cost estimates, etc. in the budget for discussion. D-2. Airport Commission Councilman Measles reported the minutes of the recent meeting were included in the packet. He did not attend the meeting. Williams requested Administration investigate the costs, etc. of having the access ramp and canopy remodeled at the airport terminal and place the information in the budget for discussion. Again, the improvement would make the building more in line with the ADA requirements. Airport Manager Ernst noted that the building has already met the ADA requirements. Williams stated, it may appear that the present design meets the requirements, but he does not think it a safe situation. Williams added, he would like a redesign of the entryway with a more graduated ramp for better protection from freezing. He added, he did think the grade was correct. Ernst noted the engineer reviewed the area and said it met the criteria. D-3. Harbor Commission Councilman Bookey reported the minutes of the recent meeting were included in the packet. There were no comments. KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 12 D-4. Library Commission Councilman Moore reported there was no meeting since the last council meeting. Moore did report the open house at the library was a huge success and that over 300 people attended. Councilman Smalley asked if the number of card users at the library include summer residents. Library Director De Forest answered, the summer residents are automatically renewed by computer. Smalley asked if 12,500 would be closer to the actual number for use of information in the Comprehensive Plan. De Forest answered yes. D-5. Parks a Recreation Commission Councilman Bannock reported a meeting was held two weeks ago. The minutes were included in the packet. Tim Wisniewski was added as a new member. Bannock added, in referring to the report of the vandalism to the restroom at the beach, the Commission sent along a respectful, "told you so." Bannock suggested the building be strapped up for six months to protect it from further damage. Smalley and Bookey agreed. Smalley asked if the restroom at Cunningham Park was as vulnerable as the one at the beach? If it is, he would like both to be banded and plywood placed around them. After a short discussion, Williams suggested Administration protect the assets of the city. Council agreed. D-6. Planning h Zoning Commission Councilman Smalley reported the minutes of the last meeting were included in the packet. Smalley reported the Commission discussed the National Flood Insurance Program. The Commission was concerned that the Program could severely limit development in the flood area. The Commission has requested a sample ordinance be drafted and brought back to them. They want to insure that, when reviewing a draft ordinance, the city's protections are included and wouldn't create difficulties for the residents. Smalley suggested the Harbor Commission also be invited to the work session scheduled on January 23. The updating of the Comprehensive Plan is progressing. The Commission also discussed the goals and objectives of other KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 13 commissions and committees. Smalley reported he suggested to the commission that those goals and objectives be included in the Comprehensive Plan as the group submitted. They agreed. Smalley also reported Commissioner Booth was sworn in. The Commission has a full body at this time. Clerk Freas referred to a letter included in the packet from Mr. Verdugo requesting the Planning & Zoning Commission meeting be changed to January 16 so that they can more easily schedule their visit to Kenai. They plan to make a presentation at the January 17 council meeting and would also like to make a presentation to the Planning & Zoning Commission. Moving the meeting would help. Freas suggested a special Commission meeting be held and that way there would not be added pressure in regard to public hearings, etc. which may have to be advertised, etc. Council directed that the Planning & Zoning Commission be requested to hold a special meeting on January 16, 1996. D-7. Miscellaneous Commissions and Committees Historic District Board - Council referred to the memorandum included in the packet in regard to the December 26, 1995 scheduled meeting of the Board. Because there is a shortage of members and it was expected that there would not be a quorum of the active members for the upcoming meeting, Council directed the meeting to be cancelled. Challenger Learning Center - Councilman Bannock gave a brief report on the Steering Committee's most recent meeting. The Committee developed a list of questions to review at each meeting. Also, a local radio personality, who had been very negative in regard to the Committee's efforts, attended the meeting and left it with a very positive attitude. Williams noted that he found six possible funding sources for the Center and has passed the information on to Kathy Scott. ITEM E: MINUTES E-1. Regular Meeting of December 6, 1995. Approved by consent agenda. KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 14 ITEM F: CORRESPONDENCE ITEM G: OLD BUSINESS G-1. Discussion - Timber Sales on City Land; Resource Conservation and Development. Mark Hodgins - Introduced the purpose of the Kenai Peninsula Resource Conservation and Development District (RC&DD) as a resource to connect timber owners with small timber operators. The RC&DD will be working closely with the Economic Development District. Hodgins reviewed selective harvesting and the local timber operators' use of timber. Hodgins encouraged the city to consider selectively logging the beetle -killed trees on the Section 36 lands and other city -owned lands. Hodgins offered his help in connecting the city with local harvesters. Hodgins also reported he has a youth enterprise group at Nikiski High School who would, for a small fee, survey the properties for a count of the beetle -killed trees and estimate the value. City Manager Manninen stated that in his discussion with Mr. Hodgins a couple of weeks ago, he indicated he had different people willing to service different tracts. For instance, there may be some people that might want to go into Municipal Park, if we were to mark some of the dead and dying trees in there and harvest for firewood burning, half -a -dozen trees. But the area in Section 36, you probably want to get a bigger operator in and get crews and get the trees identified and decide what to do there and probably that land could be cleared for little or no net cost to the city by the time money is received from the timber operator. The roads would end up being put in and the dead trees out of there. That is his hope. There are other areas, perhaps the Parks people could identify Cunningham Park, Municipal Park, other parks that there may be a few trees and that could be marked and let people go in and take out if they meet the requirements that the city has. We wouldn't want any liability, insurance -wise and we wouldn't have them hiring half -a -dozen people and having people get hurt in there. But, if a single people working for themselves and may not require the Worker's Compensation and having hired people working for them. It may be a workable situation then for small parcels. KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 15 Councilman Smalley stated he reviewed the documents included in the packet. Smalley asked if the road right-of-ways are marked in Section 36. If they are not, they would not be able to be done. If they are, what happens to the liability of the city if someone would take trees outside of the road right-of-way? Another concern was the question included in Kornelis' memorandum (included in the packet) which asked if the city would want to take all dead and infested trees of over 911. Smalley stated he would want any healthy tree, even over 9" to remain. Smalley thought it a poor choice of words to say the city would want the land "cleared." Councilman Bookey stated he did not have a problem with logging the city land. However, the logging industry is an extremely dangerous industry, and the city would need to be very, very careful to draw up whatever is needed to ensure the liability for the city is non-existent. Williams referred to Dr. Hansen's letter, distributed at the beginning of the meeting. Williams stated that at some time in the future, the city may want to have the right-of-ways in Section 36 surveyed, etc. and encourage development of the area, i.e. approaching Princess Lodge that land is available in the city conducive to a rural lodge setting. Williams suggested the city should investigate the cost for having the area surveyed. Measles agreed that the city should find out what it would cost to have the right-of-ways surveyed in Section 36. At this time the city owns land adjacent to each of the rights -of -way. If there is no development in that area soon, the city may own more. Administration was asked to investigate the cost of surveying all the road right-of-ways within Section 36 (the centerline of the road). ITEM H: NEW BUSINESS H-1. Clerk Freas answered no, the amount was about double that of last year. Bookey reminded council that the cost was more because the Borough said they would prorate the cost and then didn't. A discussion followed about the phase -in of higher dues. Measles noted that the shortfall will only be in the Kenai Peninsula Borough. However, the shortfall is not as big as was initially thought. Williams stated no and added, he believed the city should continue to urge and support a move of the Health Department to a more appropriate facility. VOTE: There were no objections to the motion. SO ORDERED. H-7. Discussion - Possible Amendments to the Polices and Procedures - Leif Hansen Memorial Park. Clerk Freas reviewed her memorandum which was included in the packet. The memorandum reminded council that a letter from Dennis and Susan Townsend was reviewed by them at their September 20, 1995 meeting. The Townsends had stated their concerns that the Leif Hansen Memorial Park had been used for large gatherings with bands, etc. and that type of use may be detracting from the peaceful memorial park for which it was developed. During that KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 18 meeting, council directed the Townsend letter and a copy of the Policies and Procedures for the park be forwarded to the Beautification Committee for comments and then those comments be forwarded to the Parks & Recreation Commission for their review and comment. The comments from both the Committee and Commission were included in the memorandum. Those comments were as follows: Beautification Committee Comments: Recommend that the city continue to allow groups to use Leif Hansen Memorial Park but recommend that larger groups use other park facilities which are better able to accommodate them. In addition, tents and other items should be set up away from the memorial plaques, shrubs, etc. Parks & Recreation Commission Comments: Given the memorial intent of the park, the Commission recommends to council that events of less than 50 people be allowed to use the park, but that larger groups use the green strip area, with administration having the final say. Council reviewed the comments. Councilwoman Swarner questioned whether the park could continue to be used for weddings. Parks & Recreation Director McGillivray added that the Commission's comments were made with the understanding that weddings could still take place at the park, knowing that there could be more than 50 people in attendance. Councilman Measles suggested guidelines be written for park use with groups of over 50 people. The guidelines should state what type of event could take place there with over 50 people. Williams questioned whether events with small children in attendance is necessarily offensive. Measles stated he agreed that their presence may not be offensive, however he finds it very offensive when children are swinging on the trees, etc. and parents do nothing to stop it. Measles added, events that bring larger crowds should use the green strip area. Councilman Smalley stated he agreed with Measles and that larger events with entertainment, etc. should use the green strip area. There are restrooms available as well. Swarner suggested limiting the time of use of the park to one hour for large groups. Swarner added, during Veterans Day and KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 19 Memorial Day services, the park is not used for more than one- half hour and many times, there are more than 50 people in attendance. Swarner added she did not disagree with Measles in regard to using the park for weddings, memorial services, memorial services, etc. If there is going to be entertainment or food, the event should be at the green strip. Councilman Bannock stated he would like to see a definition of activities that would be allowed, i.e. weddings, funeral, memorial services, etc. would be.acceptable. Birthday parties, Kenai River festivals, etc. should not be there. Williams suggested no functions be held at the park at which food is a major part of the event. Events with food, etc., should use the green strip where electricity, barbecues, water and restrooms are available. Council requested Administration to develop guidelines be developed for use of the park. The guidelines should be brought back to council for final review. H-8. Discussion - National Flood Insurance. Councilman Smalley reported the concerns of the Planning & Zoning Commission's review of the flood insurance ordinance. Item 1.4 of the prevention ordinance includes much of the same concerns council had with the overlay ordinance. The ordinance could limit or restrict development. Another concern was what kind of cost factor would it have to the city. An estimate of cost to the city would be the time in drafting the ordinance, cost of advertisement of public hearings, and the policing of the ordinance. Smalley added that Item 1.4 was the major concern of the Commission. However, passage of the ordinance would allow for flood insurance to be purchased by property owners. Councilman Measles stated the same concerns were why the city did not go into the program in the 19801s. In the recent flood, it was found the Borough did not police their ordinances, building codes, and other requirements which they agreed to do when they began their participation in the flood insurance program. Williams stated his question was whether the city should join the flood insurance program based on the number of people that would be affected -in the city in a historical perspective. Williams KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 20 added, most of the damage along the River was due to erosion and not flooding. By joining the program, would the community be done a service? Councilman Measles asked if the acquiring flood insurance improve the property owners' situation in order to get insurance for flood erosion? If they went to a standard company for insurance? Measles stated he did not believe that there was anyone inside the city who was affected directly by the flood. The damage in the city was bluff erosion, not flood damage. Measles added, if the city decides to join the flood insurance program, all the requirements of the flood insurance program would have to be included in the city's building codes, permitting processes, etc. Measles added, if the city was participating in the flood insurance program, homeowners may not have been able to build their homes where they are built. If all of what is stated in the program is followed, insurance costs would be cheaper because the homes wouldn't be built where they are and there would be no risk. Smalley stated those were the discussions which Planning & Zoning had on the subject. Williams added, participating in the program could prevent a contractor from developing property along the bluff. Bookey agreed. Council referred to the question included in City Engineer La Shot's memorandum regarding the flood insurance program which asked, "Should administration proceed with preparation of a resolution and ordinance using the samples as a guideline and begin the process of adoption? Council's answer was no. H-9. Discussion - State Transportation Needs and Priorities. Public Works Director Kornelis reviewed the Needs and Priorities with council, noting that comments needed to be forwarded to the State by January 8, 1996. Kornelis stated he would include the topic in the next packet also in order for council to have more time to review the information and make comments. Kornelis noted that many of the projects listed are stated to be in Kenai when they are not. Kornelis suggested a letter be sent to the State suggesting they correct the locations of the projects KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 21 Kornelis was directed to write a letter requesting the location of the projects be corrected and ask whether the Forest Drive improvements are in the engineering phase. Administration was also requested to bring meeting, resolutions in support of the Spur Project completion in Soldotna; completion Bike Path project; the Forest Drive/Redoub EXECUTIVE SESSION None. ITEM I: ADMINISTRATION REPORTS I-1. Mayor No report. I-2. City Manager t FAA Antenna Farm - City Manager Manninen referred to his letter to Mike Tarr, Manager of the FAA Flight Service Station, which was distributed at the beginning of the meeting. Manninen stated the letter was sent to Mike Tarr, after the mayor was in about a week ago and they found out the antenna farm was being considered obsolete. After a phone call today, Mike said to send him a letter and he would send it upstairs to the FAA people to give some consideration to making that facility obsolete and get back to him to specify what we want. Basically, what we want is to get the antenna moved out and to get possession of the property for the city and let the city operate that property and own it, operate it, lease it, whatever the city council decides to do with it as we do with other airport -owned lands for the benefit of the airport and airport operations. Tarr said it sounded like it was eligible and to send him a letter. Position Classification Plan - Manninen also reported that the Position Classification Plan update should be forwarded on January 17. The work group is finishing their interviews of personnel this week and they plan to have something written to KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 22 him by next week and he plans to turn that around to the department heads by the first week in January and get a final recommendation to the council by the second meeting in January. Both the work groups and the personnel rules update. I-3. Attorney Attorney Graves reported the bankruptcy hearing in the McLane case, which had been scheduled for 12/20/95, was continued to January. He will keep council updated. I-4. City clerk City Clerk Freas reported she received a telephone call from Liana Bigham, the Government teacher at KCHS. Ms. Bigham stated that due to various reasons, she would request that the city's Student Government Day be moved to January 17, 1996. This would give her more time to prepare the students, etc. It was noted that the semester would have ended by then and the students would no longer be studying Government. Freas explained that the students would be studying Sociology and the same students would be involved with that class as were involved with the Government class. Councilman Smalley requested permission from council to speak with the teacher and suggest that, if the concern of the school has been to have Student Government Day when they are studying the government portion of the senior civic's class, that it be done in the fall in the future instead of postponing, etc. Council changed Government Day to January 17, 1996. Councilman Smalley stated he would advise Ms. Bigham. 1-5. Finance Director Finance Director Sweeney reported he prepared and distributed the budget packet to department heads; has prepared a milestone schedule in regard to the Thompson Park Water and Sewer Assessment District and will include a copy of it as an information item for the next meeting; and, will have an agenda item for the next council meeting to set a public hearing date on the Thompson Park Sewer and Water Special Assessment District. Williams stated he wanted to discuss the assessments with Sweeney and Manninen with regard to costs to the large lots in the District. Williams added, those large lots, which cannot be KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 23 subdivided, should not be penalized by having assessments that are four or five times as much as the other lot assessments. Williams suggested the information be brought to council as prepared by administration and council will then discuss it and make any necessary changes. I-6. Public Works Director Habitat Restoration Project - Public Works Director Kornelis referred council to Information Item No. 2, which was his letter to Fish & Game in regard to the Habitat Restoration Project requests. Kornelis added, he received a call from Fish & Game and was requested to present the information at a meeting at the Borough. The fund will have $700,000 for distribution this year and $500,000 the next year. Fish & Game has also informed him they will be sending out changes in the scope of work to applicants. Snowblower - Kornelis also referred council to Information No. 10 and reported the new snowblower should arrive on Friday. He is waiting until after the city has receives the machinery before considering the dropping of liquidated damages. I-7. Airport Manager No report. ITEM Jet DISCUSSION J-1. Citizens None. J-2. Council Bookey - Referred to Information Item No. 8 in regard to the contracting out the city's fueling system. Bookey stated his concern that the item did not go to bid and whether the city would maintain its own system or abolish it. Kornelis answered they were looking for a facility where gas and diesel would be available around the clock and this facility was the only one that he found would be open. KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 24 Kornelis added, the city will keep its system for awhile. They will turn the mechanical valve off at the tanks and locking it and keeping it for a time for emergency use. They may consider pulling up the underground pipe between the tanks and dispensers. They have had many problems with the dispensers now there. There is also one other facility that has diesel available, but only during daytime hours. Bookey stated there may be someone in the private sector that would be willing to put a program together if the item had gone to bid. Bookey stated he was also concerned that the city would split its buying power because the city purchases fuel for a number of different facilities within the city, i.e. dock, sewer treatment plant, airport generators, water supply tank, etc. The city, in doing this, is diluting its ability to save money. Bookey asked Graves if the city would exclude itself from any liability if it would go to bid. Graves answered that if the tank leaked and there would be a spill, the city should be generally excluded from liability. However, if the city was filling the vehicle tank and spilled fuel on the street, the city would still have liability. Graves added, he believes the city is reducing its liability, however the issue is whether the increased price the city will pay is worth a reduced liability. That is a policy call. As far as bidding or an RFP, the administration's feeling is if council wants to proceed that way, that is also a policy call. Bookey stated that if the city is going to one dealer and that is all that is available that is acceptable. If the city then disassembles its fueling system, it will cease to have any control. He hates to see the city lose its control. Efficiently, he does not think this system will prove out for the city and believes in the end, the city will go back to its own system. Bookey added again, he was not comfortable with this system. Kornelis added, the city has had major problems with its existing system and have used this facility because the city's dispensers were out of service. As far as the city's liability, if they stay with the city dispensers, there will be major work needing to be done to that facility. Bookey stated he had discussed that matter with the city manager and he believes that the city hasn't justified the cost of the tank upgrade done a few years ago. KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 25 Manninen stated that expense was probably $7,500 five years ago. In talking with people in engineering recently, after our discussion the other day, they are estimating that if we were to keep the system, we would need to invest at least $10,000 in concreting around the tanks and possibly put some kind of either new tanks up and/or hood over the tanks and some piping and some electrical so there would be a substantial investment to keep the system going that we have in addition to what we put in five years ago. The question is whether it is time to cut our liabilities and run now or continue to make the investment and not know what's going to happen with the entire facility with the entire program, whether even the facility is going to be there in a year or five years and we're continuing to make a big, major investment. That's our concern now and in addition, as the attorney said, we could probably dump some of the liability by going outside to the private sector now and still would retain the flexibility later on by going back. It is a policy decision. Bookey again stated his concern that the city did not go to an RFP and the city will be buying $80,000 to $100,000 worth of fuel and believes it should go to bid. Also self-sufficiency for the city would far outweigh savings or costs. There will always be fuel spills somewhere. The city cannot outlive that liability. Kornelis stated he had a $2,500 purchase order out now. They have not allowed the work to be done because he wanted to see if they would contract it out. There is a lot of work to be done. He believes the dispensers will need replacing at an approximate cost of $10,000. In the summer, a concrete slab would need to be placed. He believes it is urgent enough to try this system or the city will have do something rather quickly as there is only one pump for gas and diesel that are working. Williams asked if the planned program could continue for now with the understanding that when the fiscal year changes, an RFP will be requested to allow everyone to bid. Manninen stated that if they would do an RFP, now would be the time to do it and take a month to have that come back and make a decision at that time if that's what council wants to do. Attorney Graves stated the city could buy gas for now and do an RFP in the interim and enter into a 30-day contract until RFP proposals are received. Administration has no objections to putting the item out for an RFP and that is why the matter was included in the packet for council review. Kornelis added he had KENAI CITY COUNCIL MEETING MINUTES December 20, 1995 Page 26 checked with stations, asking whether they are open 24 hours a day, etc. He could ask whether they would consider staying open to provide a service such as this or go to an RFP. Kornelis said he was originally concerned about how the security portion of this system would work. This facility's owners will be placing a video camera and each employee will have their own identification code. When the city is billed, the date, time and who got the fuel, what equipment got the fuel, etc. If there is a question, they can review the video to verify it. The city's tanks will be maintained in order to have it available for emergency use. However, they would be made secure so there would not be a chance of leaks, etc. Kornelis stated he could put out an RFP and have it back to council for the January 17, 1996 meeting. Bookey stated he really believed the city should maintain its own system as well. Williams suggested administration bring a full report at budget time as to what the cost would be to upgrade the facility to a properly functioning operation. Kornelis added there are many considerations to be included in whether to upgrade, i.e. the future for the shop area, etc. Williams directed that an RFP be put out as soon as possible and do whatever is necessary for emergency fuel purchase between now and then. Council agreed. Swarner - Stated her concern that the intersection at Airport Way and the Spur Highway is a very sharp corner (because of the median) with no light. Kornelis stated there will be a signal there. Swarner also reported she and Manninen will be involved in a teleconference with AML regarding session topics. If council has any requests, please forward them to her. Williams noted the Mayors will be meeting in Juneau in January and will be speaking to representatives of the Corrections Department regarding the budget and corrections for the state. Moore - Stated his concern that there is a ditch at the end of the Spur Highway project, going toward Soldotna, that is glaciating out nearly onto the road. Kornelis stated it has been pointed out to DOT. Measles - No report. Daubenspeck Property Subdivision As you are aware, a developer has expressed an interest in leasing and eventually purchasing a portion of the above referenced property. The Daubenspecks have no objections to a developer building a senior citizen condominium complex on the site. The Kenai Historic District Board wishes to use the portion of Tract C near the bluff for a parking area and for an interpretative sign. The city also has several quonset huts that are being used for storage within Tract C. These areas are not included in the property needed for the condominium complex. Last June, the city discovered an underground storage tank on Tract C. At this time, the size and past use are unknown. An investigation as to past owners may help identify potential responsible parties. The city intends to have the tank removed prior to leasing or selling the property. A site investigation of material on the property may need to be performed in the Spring. The boundaries depicted on the attached map are approximate depending upon the developer's needs, location of the quonset huts, underground storage tank, etc. A lease application can be submitted if Ordinance 1671-96 is passed, making the property available for lease or sale. At that time a survey can be ordered. Kenai Municipal Code states that disposal or sale of lands shall be made only when, in the judgment of the City Council, such lands are not required for a public purpose. The Planning and Zoning Commission discussed this matter at their September 27, October 12, and October 25 meetings. Some of the Commissioners felt the corridor or a portion of the corridor along Bridge Access Road should be zoned Commercial for future commercial development. The area is currently zoned Suburban Residential. The Commission voted to recommend the property be made available for lease or sale. The issue was discussed by the Parks and Recreation Commission on October 5 and December 7. One of the issues the Parks and Recreation Department addressed was the as -built survey of what is known as the FAA football field, located adjacent to the Daubenspeck Property. It appears the goal posts, which the city obtained a State Parks grant for in 1973, were actually placed on the Daubenspeck Property rather than on the FAA football field. If the City Council determines this portion of the Daubenspeck property may be leased or sold, these goal posts should be moved to the FAA football field. The Commission moved to recommend the property be made available for lease or sale providing that access not be denied to the historical area. According to the requirements of Title 16 of the Kenai Municipal Code "Public Improvements and Special Assessments," specifically Chapter 16.10.010 City Manager Action, the basic issues defining an eligible LID/SAD are four -fold, as follows: 1. Public Improvement: The Kenai City Charter, Article 7, provides that a special assessment district shall be formed only for "public improvements." It is questionable whether these private docks/ramps qualify as a "public improvement." 2. Eligible Public Improvements: KMC Title 16 provides the authority and requirements for public improvements and special assessments. Specifically, KMC 16.05.060, defines public improvements for special assessment district treatment. These are listed in nine different categories. The closest -eligible category for this proposal is "for changes in channels of streams or watercourses." However, according to their request for Alaska Department of Fish and Game approval, the Beaver Creek Bank Restoration and Protection Group's application is not intended to "change the channel of streams or watercourses." Therefore, it is not eligible as an authorized capital improvement by KMC 16.05.060. It doesn't meet the required test of eligibility to qualify for a special assessment district treatment per the Kenai Charter and Kenai code. 3. Cost Estimates: William J. Nelson's November 1995 cost estimate at $199,692 for Lots 28, 29, 30 and 31 for Angler Acres Subdivision Part II improvements could be under estimated. 4. In summary, under Article 7 of the Kenai City Charter, special assessment districts may be formed only for "public improvements." This private project provides for constructing a private dock and ramp for each of the four (4) private property owners. Clearly, the general public either would not have access to the private property or access/use of the private docks/ramps if this proposed project were to be constructed. Thus, unlike a road, water or sewer line in a public right-of-way, the general public would not receive benefit of, access to or use of the property or "public improvements." Even if this were an eligible "public improvement," it is debatable whether its cost would be in line with William J. Nelson and Associates' November 1995 report/cost estimate. A prospective grant that might be secured to assist in payment for these private improvements may be from Exxon -Valdez Oil Spill funds; a grant application could be made by the petitioners or the City directly to the Exxon -Valdez Trustee Council. An application may be made to other sub -agencies that have already received funding for Kenai River habitat protection such as the Alaska Department of Fish and Game (ADF&G) or the Alaska Department of Emergency Services (ADES) or the Federal Emergency Management Agency (PENA). Kenai's Resolution 95-82, passed on December 20, 1995, demonstrates the City Council's empathy for the plight of the "Beaver Creek Bank Restoration and Protection" property owners. The Kenai River's fall 1995 flooding and disaster declaration indicates that there is a need for something to be done to protect the properties petitioning for improvements, but it appears that it is ineligible to be done as an SAD at public expense. Clearly, the proposed project does not qualify for special assessment district designation by the City Council of the City of Kenai according to the Kenai City Charter Article 7 and the Kenai Municipal Code, Title 16, KMC 16.05.060. You requested an opinion regarding whether such a project was authorized under Title 16 (Public Improvements and Special Assessments) of the Kenai Municipal Code. KMC 16.05.060 sets out the capital improvements for which a special assessment district may be formed. Special assessment districts may not be formed for capital improvements not contained in the list. The question is whether the bank restoration project could be categorized as causing "changes in channels of streams or watercourses." Page 5 of the Coastal Project Questionnaire and Certificate Statement submitted by the petitioners to the Borough asks the applicant to check a box if the proposed project will "change the water flow or the water channel."! The petitioners did not check that box. (The questionnaire and certificate statement is attached as Exhibit A.) Thus, according to the petitioners, the project does not involve changes in the channel of a stream or waterbed. Therefore, it does not come within the list of authorized capital improvements under KMC 16.05.060. Under Article 7 of the Kenai City Charter, special assessment districts may only be formed for "public" improvements. In addition to bank restoration on private property, this project would construct a private 61x10' dock and a 31x30' ramp for each of the private property owners. (See attached cost estimate of William J. Nelson, Exhibit B.) Unlike a road on a public right-of-way which the general public could use, the general public would not have access to the property or the docks/ramps. In Olds v. Alvord, 183 So. 117 (Fla 1938), the Florida Supreme Court held construction of waterfront improvements on private property was not an allowed "public" improvement. Therefore, there is also considerable doubt as to whether the proposal could be considered a "public" improvement given the nature of the project. For the above reasons, in my opinion the proposed project is not an authorized capital improvement for which a special assessment district may be formed under the Kenai Municipal Code. Section 16.10.010 of the Kenai Municipal Code specifies that the City Manager's Report must: "Discuss the need for, the desirable scope of, and estimated cost of the improvements; prospective grants that might be secured to assist in payment, for the improvements; a recommendation as to grant application; the recommended percentage of the improvement plan cost to be assessed against the property benefited.- a description defining the proposed district and properties to be assessed; and, a description of the desirable scope of the proposed improvement". I think all are included to some degree already in the report; however, I recommend that we include the following additional information: a. Recommended Scope of the Improvements: The requested improvements include the placement of gabions below grade at low water line, the placement of gabion mattresses on grade up to the mean high tide line, and the placement of vegetated geogrids/brush layers above the mean high tide line. The recommended scope of improvements are none as the improvements do not fall under the scope of Section 16.05.060 of the Kenai General Code. b. Description Defining the District: The description of the proposed District is Lots 28, 29, 30, and 31, Angler Acres Subdivision Part Two per Plat K77-116, Section 11, Township 5 N, Range 11 W Seward Meridian. 3. I drafted the following for council's consideration. 13.10.070 Placing advertising matter in or on motor vehicles: It shall be unlawful for any person, firm, or corporation to distribute handbills, circulars, pamphlets, cards, pictures or any advertising matter of any kind whatsoever, by placing the same in or upon any motor vehicle standing or parked without the permission of the owner or operator of the motor vehicle. The primary concern over such anti -litter ordinances is that they unduly restrict freedom of speech and the press by restricting the manner in which information is disseminated. McQuillin Mun Corp 6 24.392 (3rd Ed) states: An ordinance prohibiting the depositing of advertising matter in or on automobiles parked on city streets had been ruled a valid exercise of a city's police power and not an abridgement of freedom of the press and speech. (citations omitted) However, the legal authority McQuillin's uses to support such a position is from 27 to 46 years Mayor John Williams and the Kenai City Council December 28, 1995 Page 2 old.' A Westlaw computer search turned up some more recent cases.2 In Savage v. Trammell Crow Company, Inc., 223 Cal. App. 3rd 1562, 273 Cal Rptr. 302 (1990), the court held a shopping center owner's ban on placement of handbills on automobiles was a reasonable restriction on the time, place or manner of distribution of information as long as alternate channels of communication of the information were available.' In this case one could personally hand the handbill to persons rather than place them on automobiles. While it generally appears such a restriction is valid, I cannot be certain it would not be struck down by an Alaskan court given our courts' very protective approach to freedom of speech and the press. (Copy attached.) First of all, I was sorry to er that Commissioner Burden is resigning as ADEC Commissioner. He will be missed. The Kenai City Administration, Council, and its citizens are very disappointed that our water quality/quantity project was not ranked high enough to be included on this years ADEC funding proposal. This project was to be our final phase in our water system improvements. It would provide our citizens with an adequate clean and clear water supply. It is great that ADEC is going to allow the city to use left over funds from a couple of past grants to help us achieve our goal. Unfortunately, we are still $960,000 short. The City of Kenai has spent over $605,000 of city operating funds in the earlier phases of this project. We have drilled exploratory wells at various locations in an effort to find clean and clear water. We had a water system study performed to help us plan our improvements. We drilled a new production well, tested the water, developed the well, and performed a water well yield study. We are obtaining ownership of the well site. The City of Kenai is also using the last three years (94, 95, & 96) of the State Municipal Matching Grants Program to help fund this very important Kenai Water Quality/Quantity project. The program is educational with the emphasis on learning practical business skills. Handy Works will supply needed services in the Kenai/Nikiski area that are generally not available on the local level. These services will be conducting timber surveys in the Kenai/Nikiski area for landowners. The surveys will consist of identifying and marking beetle infested trees, damaged trees, estimating timber values, and mapping out locations of trees for potential harvest. This service will be conducted for $15.00 per acre for plots of land up to and including five acres. Larger plots of land will be done at a $10.00 per acre. Members of Handy Works are currently receiving training from Ron Cordle, a timber operator, and Wade Wahrenbrock, a forester from the State of Alaska. In addition, some legislators have expressed the opinion that allowing gaming/gambling is not in the best interests of the people of Alaska. The Soldotna Chamber of Commerce would like to encourage you, as a member of the Legislature, to consider the distinction between charitable gaming vs. gambling. Our organization agrees that full scale, casino -type gambling is not in the best interests of the state; however, charitable gaming (games of chance and contests of skill) should be viewed and accepted as forms of social activities, which allow non-profit organizations, such as ours, to generate operational funds. Activities encompassed under charitable raffles, classics (i.e. Nenana Ice Classic, contests of skill (i.e. fishing derbies, 10K activities are sponsored and conducted stimulate community participation and cz attraction to promote their area. Gail Phillips Page 2 To eliminate some of the problems associated with conducting these games, and provide for a more level playing field for those involved, the Soldotna Chamber would like suggest the following: a) Non -profits should be encouraged to conduct games on their own behalf; b) When an operator or vendor is utilized for the sale of pull tabs, the non-profit should receive a minimum of 70% of the ideal net proceeds for each deal of pull tabs to be sold. (The cost of the pull tabs, tax, etc. should not be factored into this equation.) Furthermore, the operator or vendor should be required to remit payment to the non-profit upon receipt of the pull tabs for sale; c) A cap should be placed on wages paid for working bingo or pull tab sales for employees of non -profits which conduct games on their own behalf and employees of operators. (Suggested rate $10.00 - $12.00 per hour.) Eliminate payment on a per session basis or monthly salary. These suggestions are made to help ensure that the majority of the funds generated from gaming are going to the non -profits. The legislature should consider the definition of a non-profit when determining who is eligible to receive a gaming permit. Those organizations which have received a non-profit status through the IRS (such as 501 (c) organizations) should be given priority over non-profit organizations that are organized to raise funds for non -charitable purposes. Stated reasons for the use of net proceeds should be for providing services within a community, rather than generating monies for such purposes as political contributions, profit -making ventures or other non - service oriented purposes. Additionally, a permittee should be required to prove that a majority of the funds generated through gaming activities are actually used for civic and/or service programs. December 19, 1995 Rep. Gail Phillips Page 3 We would also like to encourage the Division of Charitable Gaming to provide adequate notification to all permit holders with regards to proposed changes to rules and regulations, meetings and/or teleconferences concerning gaming, and any other matters that pertain to and could affect the conduct of gaming activities. Permittees need to be aware of what actions are being considered, the status of task force or committee meetings and other pertinent information, to keep informed and be able to provide comments and/or suggestions to those involved. On another subject; the legislature has considered several options for generating revenue for the state operating budget. The idea of a state lottery has been discussed at various times, and should be given serious consideration. Other states have lotteries in place that generate millions of dollars for their coffers. These programs should be reviewed, the pros and cons discussed, and a program developed for the State of Alaska to help offset the cost of government. Even though you haven't been asked, that is essentially what all local property taxpayers are doing. Property taxpayers have been doing it since 1986, and will continue donating to the state in the proposed Governor's budget for next year. In fact, the cumulative impact to some communities may be the same as donating to two thirds of their property taxes to the state. Why don't local property taxpayers know about this, and why does it happen? It happens because local taxpayers blame their local city council or borough assembly for any increase in local taxes or cuts in local basic services. It has also happened gradually over a number of years. Therefore, cutting local government's share of Alaska's oil revenue, and unilaterally transferring state responsibilities to local goveinments, is an extremely politically easy way for the state to balance its budget without having to face the local consequences of tax increases and service cuts. For the past ten years, including proposed cuts in this year's Governor's budget, the state has cut the share of Alaska's oil wealth that goes to local communities as Municipal Assistance and Revenue Sharing by over $90 million. This is twice the amount of revenue from any one of the "new taxes" recommended by the Long Range Financial Planning Commission during this century. The cumulative impact of cuts in Municipal Assistance and Revenue Sharing, other state programs such as education, and unilateral transfers of state responsibilities to municipalities likely total over $180 million, or approximately the revenue from a state income tax, or equal to the value of one Permanent Fund Dividend from every family that pays property taxes. Unfortunately, most taxpayers do not realize the role of the state in "sharing" revenues that belong equally to all Alaskans. To many taxpayers, "Municipal Assistance and Revenue Sharing" sound like some kind of giveaway program that should be cut to reduce state spending and avoid the re -imposition of the state income tax or a cut in the Permanent Fund Dividend Program. Should the state help support local government at all? Yes, each one of the fifty states provides some form of revenue sharing with local communities. The reason is simple, cities and boroughs were created by the state to provide local services (such as police, fire protection, road maintenance, etc.) more effectively, responsively, and efficiently than the state. To ensure that all residents receive a basic level of services, state revenue is "shared" with local governments. According to federal statistics, an average of one third of local governments budgets in the US are provided by the state. Alaska's funding to municipalities is falling below the average in the US, and far below the average in the western states, even though Alaska is still blessed with huge amounts of oil revenues and the cost of government in Alaska is high due to our climate, dispersed population, and geographic size. Over the past ten years cutbacks in state support to cities and boroughs has fueled much of the discontent with local government including "tax revolts" and local property tax caps. Aside from increases in local taxes, state cutbacks are seriously jeopardizing the stability of local government in rural areas with very weak tax bases. In the short run, these communities could lose the improved sanitary services and public safety services gained over the past twenty. In the long run, many communities may make the decision to unincorporate and give the responsibility for providing basic local services back to the state at a much higher cost. Already, Municipal Assistance and Revenue Sharing is at a level, as a percentage of the total state operating budget, lower than 1972, when living conditions and services in many Alaskan communities were at a much less acceptable level than we enjoy now. Neither the Governor's budget, nor the Long Range Financial Planning Commission, have discussed the impact of state budget cuts on local communities. In attempting to balance the state budget, the Governor and legislature have quietly cut the share of Alaska's oil revenues that go to municipal governments while cutting other municipal revenues and transferring state service responsibilities to municipalities. This trend will continue until all citizens of Alaska tell there state elected officials, "Balance the state budget, but don't do it by raising our property taxes".
