CLERK CLERK o MAYOR'S REPORT Assembly/Council Challenger Flight -- Borough has suggested January 22 or 24 (the 21 is their Assembly meeting). Other possible dates would be the Monday before their assembly meetings (first and third Tuesdays of the month). They also suggested the flight take place from 4-8 p.m. instead of 6 to 10 p.m. (it was mentioned that could be a problem because of council's and others' work responsibilities). WHEREAS, the City received a $3,000 Volunteer Fire Assistance Grant from the State of Alaska, Department of Natural Resources for the purchase of radio equipment; and WHEREAS, it is in the best interest of the City to accept the grant; and WHEREAS, the $3,000 match for the grant is included in the Fire Department small tools account. WHEREAS, the Library received a reim__bursement of $6,106.70 under the Universal Service for Schools and Libraries (E Rate); and WHEREAS, the intent of this program is to promote use of the internet; and WHEREAS, the Library needs additional computer equipment and software to facilitate intemet access. Freas, City Clerk Approved by Finance' ( 11 / 20 / 2000) jl Introduced: Adopted: Effective: December 6, 2000 December 20, 2000 December 20, 2000 Suggested by: Administration CITY OF KENAI OItDIN~CE NO. 1892-2000 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING KMC 14.05.010 AND 14.05.105 TO ASSIGN THE DUTIES OF HISTORIC PRESERVATION TO THE KENAI PLANNING AND ZONING COMMISSION. Whereas, the Kenai Historic Commission was eliminated by Ordinance No. 1887-2000 effective December 15, 2000; and Whereas, in order to continue with its historic preservation Certified Local Government (CLG) status, the City of Kenai wishes to continue some of the historic preservation functions of the former Kenai Historic Commission; and Whereas, the appropriate commission to assume those duties, is the Kenai Planning & Zoning Commission. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that KMC 14.05.010 and 14.05.105 be amended as follows: SF,~TION I 14.05.010 Duties and powers. [a] The Commission shall be required to perform the following duties: (1) Review and act upon requests for variance permits, conditional use permits, planned unit residential development permits, and other matters requiring consideration under the Kenai Zoning Code. (2) Interpret the provisions of the Kenai Zoning code and make determinations when requested by the Administrative Official. (3) Review the City of Kenai Comprehensive Plan on an annual basis and conduct a minimum of one public hearing. Said recommendations shall be forwarded to the Council for consideration. (4) Promote public interest and understanding of comprehensive planning, platting, zoning, land management, and other issues relating to community planning and development. (5) Propose plans for the rehabilitation or redevelopment of any area or district within the City. (6) Shall perform historic preservation reviews and duties as set forth in KMC 14.20.105. (b) The Commission shall act in an advisory capacity to the Kenai City Council regarding the following matters' (1) Kenai Zoning Code and Official City of Kenai Zoning Map amendments. (2) City and airport land lease or sale petitions. (3) Capital Improvements Programming. The Commission shall submit annually to the Council a list of recommended capital improvements which, in the opinion of the Commission, are necessary and desirable to Ordinance No. 1892-2000 Page 2 of 3 be constructed during the forthcoming three-year period. Such list shall be arranged in order of preference, with recommendations as to which projects shall be constructed in which year. (c) The Commission shall act in an advisory capacity to the Kenai Peninsula Borough Planning Commission regarding the following matters: (1) Subdivision Plat proposals. (2) Right-of-way and easement vacation petitions. (3) City of Kenai Comprehensive Plan amendments. SECTION II 14.20.105 Townsite Historic (TSH) District (h) Review process. The Commission will review all building permit applications as well as all exterior architectural aJterations and demolition to properties included in the Historic Preservation Plan. Upon , submittal of such an application, the Planning Department shall schedule the application for review by the Planning and Zoning Commission at the following appropriate meeting. [THE BOARD'S RECOMMENDATION SHALL BE BASED UPON THE DEVELOPMENT CRITERIA IN THIS SECTION AND ALL OTHER PERTINENT PROVISIONS OF THE KENAI MUNICIPAL CODE.] Any other building permits within the Townsite Historic District shall be handled administratively by the Building Official. {i) Historic Preservation. The Commission shall: (1) Conduct or cause to be conducted .a survey of the historic, architectural, and archaeological resources within the community. The survey shall be compatible with the Alaska Heritage Resources Survey and able to be readily integrated into statewide comprehensive historic preservation planning and other planning processes. Survey and invento .ry documents shall be maintained to protect the site location(s) from possible vandalism. The survey shall be updated annually. (2} Review and comment to the State Historic Preservation Officer on all proposed National Register nominations within the bOundaries of the City. When the Commission considers a National Register nomination that is normally evaluated by professionals in a specific discipline, the Commission will seek expertise in this area before rendering a.decision. (3) Develop a local historical preservation plan that will be compatible with the Alaska State Historic Preservation Plan and produce information that is compatible with the Alaska Heritage Resource Survey. [(i)] ~ Signs. Signs shall be as allowed as set forth in KMC 14.20.220(f). [(j)] [k) Penalties. Penalties for non-compliance with this Chapter shall be as set forth by KMC 14.20.260. [(k)] 1~ Definitions. (1) Alteration-Any act or process that changes one or more of the exterior architectural features of a structure, including, but not limited to, the erection, construction, reconstruction, or removal of any structure which requires a building permit. ). Ordinance No. 1892-2000 Page 3 of 3 (2) Construction-The act of addin~ an addition to an existing structure or the erection of a new principal or accessory structure on a lot or property which requires a building permit. (3) Demolition-Any act or process that destroys in part or in whole a landmark or a structure within a historic district. (4) Certified Local Govemment-A local government "that has been certified to carry out the purposes of section 101(b) of the National Historic Preservation Act." (5) Historic District-An area designated as a "historic district" by ordinance of the City Council, which contains within definable geographic boundaries, one (1) or more landmark and which may have within its boundaries other properties or structures that, while not of such historic and/or architectural significance to be designated as landmarks, nevertheless contribute to the overall visual characteristics of the landmark or landmarks located within the historic district. (6) Historic Preservation-The act of adopting regulations and restrictions for the protection and preservation of places and areas of historical and cultural importance to the Kenai. (7) Landmark-A property or structure designated as a "landmark" by ordinance of the City Council, pursuant to procedures prescribed herein, that is worthy of rehabilitation, restoration, and preservation because of its historic and/or architectural significance to the City of Kenai. (8) New Development-Any development which requires a building permit. (9) Reconstruction-The action of returning a structure to original state. (10) Relocation-Any relocation of a structure on its site or to another site. (11) Renovation-To restore to a former better state (as by repairing or rebuilding). (12) Site plan-Schematic drawing complying with the development criteria of this chapter and drawn to scale showing proposed structure in relation to the site. WHEREAS, House Bill 335, which was effective August 20, 2000, made inclusion of elected officials in the PERS optional; and WHEREAS, in the past compensated elected officials were statutorily included in the PERS; and WHEREAS, the State of Alaska Division of Retirement and Benefits requests that the City amend its participation agreement; and WHEREAS, it is in the best interest of the City of Kenai to include the Mayor and City Council members in the classifications of employees entitled to participate in the PERS. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that the City Manager shall take all steps necessary to amend the participation agreement to include the Mayor and City Council members in the classifications of employees entitled to participate in the PERS effective August 20, 2000. The 28 parcels of real property owned by Henderson was transferred to a.trustee, attorney Steve Yoshida of Homer, for sale through normal realtor listings, and 'the remaining real property was subjected to a Lis Pendens that tied up fl~e property in such case that thc sales of the 28 parcels was i~sufficicnt to. Pay off the debts of Henderson's creditors including tl~e wrongful death m~d personal injury claims recited above..If the 28 par. ce'!s were.not sold within 4 Years any party could request an attction of file parcels. Hen. derson was allowed to remain in possession of 4 parcels subject to a Lis Pendens, and to operate her package liquor store, which was located on one of thc 4 parcels. Thc sales of the 28 parcels I~as been exceedingly slow and since Henderson died in February of 2000, it is highly likely tl~at the auction remedy will now be requested. Should the 28 parcels not bring a high enough price, the remaining 4 parcels, including tile one on which tl~e package store is located will be sold. Given the past sale record, it is undersigned'a opinion that all of the properties will end t~p being sold at auction but not pay off all debts. It is undersigned's recollection that the settlement in the State personal injury/wrongful dead~ suit included the caveat that if tl~e sales of all real estate did not satisfy all of claims, tlmt the package license would be sold by Henderson, subject to ABC approval, and the proceeds also applied to tire claims. Undersigned is presently attempting to locate suit papers to verify that recollection. Further undersigned is aware that various claims have been filed in the Henderson Estate and tha.t therefore, it .would be in appropriate to transfer an asset of the Estate to a benefi¢ia .fy of the decedent before all creditors are satisfied. ITEM 4: PERSONS SCHEDULED TO BE HEARD - None ITEM 5- , OLD BUSINESS Discussion -- Bluff Erosion / Coastal Trail Update Komelis gave a brief report on the Coastal Trail status and noted Peratrovich, Nottingham, and Drage, Inc. was awarded the contract for the environmental and permitting phase of the Kenai Coastal Trail for the sum of $62,000. He indicated the anticipated completion date was May but it was possible it could be done much earlier. Discussion took place on the permitting process and the potential problems. Komelis reported all agencies will be involved from the very beginning so no problems were anticipated with regards to the permitting process. ITEM 6: NEW BUSINESS Discussion -- Bridge Access Bike Path Kornelis reported the State began preliminary design work for the Bridge Access Bike Path. A meeting was held on December 5th where various options were discussed, including tying the path into the existing Birch Island Trail. Kornelis reported that the Unity Trail work continues as well and could be out for bid as early as February. ITEM 7: ,REPORTS 7-a. Director-- Komelis reported the following: · Dock Foreman Freden attended the Harbor Master meetings in Kodiak and returned with many good ideas. · The ceremonial start of the Tustemena 200 Sled Dog Race would not start at the dock as done in previous years. Instead it will start at' 'the softball fields by Kenai Chrysler and the route will go down Marathon Road, along the airport and back to the softball fields. 7-bo Dock Foreman -- No report. Eldridge asked if there were any new leases planned for the dock for the upcoming year. Komelis replied not at this time, and added the existing lessee contacted him regarding lowering the rates. The lessee was asked to submit a proposal to the Harbor Commission but nothing had been received to date. It was noted the current rate was very low. Thompson asked about dock maintenance and Komelis reported maintenance was done annually for the cables, fire protection equipment and fuel lines. 7-C. City Council Liaison -- Councilman Bookey reported the following: The City Manager rendered his resignation to be effective when a suitable replacement is hired. Bookey noted, Ross would be missed. · Much discussion took place on a proposal to build a privately-owned prison in Kenai and the issue was tabled. · The budget process will begin within the next 60 days. · An City of Kenai economic forum will be held in February. 7-d. ITEM 5' REPORTS 5-a. Director--Jankowska reported the following: · A new part-time employee was hired who has a degree in arts and anthropology and who is also trying to pursue her art career. The new employee is working out well. · A computer was installed and dedicated to the genealogy area. The computer is also connected to the Internet and situated in the conference room. · A new projector was purchased and is being used when showing videos. A new VCR machine and DVD will be requested in the next budget. Some of the library furniture was rearranged in anticipation of a new shelf that will be installed in front of the library. The new shelf will hold juvenile books. Efforts are being made to connect the library to the DSL internet service and until the initial cost of connection is known, some budgeted purchases are being delayed (network printer, etc.). With the DSL connection, service will be faster and phone bills should be reduced. · A new phone system was installed with four phone lines. Three are connected to an answering machine that picks up when the library is closed to the public. A fourth unadvertised number is available outside of the answering machine to allow contact to be made to employees prior to the library's open hours. · URL's for on-line documents (Alaska Hunting Regulations, Constitution, Alaska Economic Trends, etc.) are being added to the Library's website as links. It is anticipated that URLs will be added for documents that are not available in paper format. · Consideration is being given to including a "Family New Year's Online Resolution" to the next library newsletter as an item of interest. The resolution is an agreement to be made between children and parents about intemet use. · Because URLs are often outdated, incorrect, etc., purchase of a URL checker is being considered. This computer program would keep URL links updated. 5-b. Friends of the Library-- Commissioner Brown reported the following: · The Friends' profit from the recent raffle was over $13,000. · The Library's Holiday Open House is scheduled for December 14 from 4:00-7:00 p.m. · The "Home Tea" membership drive will begin in January. · "Writers' Night" will be held on March 15 at the Visitors Center. · An "Library Employee of the Year" will be announced at the Holiday Open House. 5-¢. City Council Liaison -- Councilman Moore reported the following: · The next council meeting is scheduled for December 6 at which time public hearings will be held on the ordinances regarding fire inspections for bed and breakfasts and day cares. · City Manager Ross announced his resignation effective in June. Council will set a work session at their December 20 meeting to begin a search for a new hire. ITEM 6: OLD BUSINESS 6-a. Discussion -- Goals & Objectives -- The Commission reviewed the list and confirmed its accuracy. Clerk Freas reported the goals and objectives, as well as the list of accomplishments were attached to the Commission's November meeting minutes and included in the council's packet. LIBRARY COMMISSION MEETING DECEMBER 5, 2000 PAGE 2 6-b. Discussion -- Library Expansion -- Peters explained Commissioner Heus requested the topic be included on the agenda and she was absent from the meeting. He noted information included in the packet entitled, Library Improvement Planning Processes. Discussion followed regarding forming working subcommittees to investigate, plan, etc. an expansion and the following was noted: A subcommittee of the Commission would require public notice of meetings and a record kept. · If members of the Commission were invited to join committees of the Friends of the Library, public notice would not be required as it is a non-profit organization. The Friends would be responsible for any minutes that might be taken. Commission members could work individually on different topics of interest and report back to the Commission. · A work session could be scheduled, advertised, etc. (must be approved by council). Peters was requested to include the topic on the january agenda. ITEM 7: NEW BUSINESS Discussion -- Culturally Sensitive Library Practices A broad discussion took place in regard to what was planned for the library in regard to this item which was included on the goals and objectives list. Jankowska explained, because the library had a large Alaskana grouping, she hoped to better identify the area and acquire funding for a reading program like the Prime Time Reading recently held and at which Alaska Native themes and storytelling would be presented. Jankowska was given suggestions of who to contact at Cook Inlet Region, Inc., the Kenai Natives Association, Inc. and the Kenaitze Indian Tribe. Brenckle noted she had some documents she would be willing to donate to the library for this use. ITEM 8: COMMISSIONER COMMENTS/OUESTIONS Brown -- Noted the books formerly stored in the conference room for the Friends annual book sale were now being stored at the Economic Development District building. Brenckle -- Noted she was excited about the development of cultural focus at the library. Rodes -- Was very interested in progressing with an addition to the library. Amen -- Suggested the Library's webpage be promoted more in the schools and that the KCHS webpage include a link to the Library's webpage. Amen will discuss the matter further with the webpage master at the high school. 'Peters -- Wished the Commission happy holidays and reminded them of the holiday open house on December 14. She explained, comments she received from the school district office were that it is harder for the schools to come to the Library for tours with the library being closed in the early morning. Bryson requested some clarification on conservation zone signage and Bannock stated his concern in regard to Section 14.20.220(a)(3) that allows the city to erect signs as they deem necessary. He noted, he didn't feel the city should have more rights than an ordinary citizen. It was suggested Bannock discuss his concerns with the city attorney. Kebschull reported she would schedule a public hearing on the issue for the Commission's first meeting in January. Tarr reported to the Board of Directors that this was the first written negative letter that she ever received during her four years as the Executive Director. Tarr sent a letter of apology to the couple. New staff training for summer 2001 will be implemented. Tarr and the KCVB staff will work with the Soldotna Visitor Center staff, sharing information on fishing, attractions, etc., to ensure that all visitors are provided the most accurate and up-to-date information. Director Nelson suggested that KCVB also send the same information to Homer and Seward. Director Braun added that he had only heard good comments about the Kenai Visitors & Cultural Center. The Grand Opening reception for the event will be May 4, 2001. Tarr presented the Board with a sample artist packet. Approximately 115 packets were mailed to Alaskan and national artists. Alaskan artist and UAA art professor, Bill Sabo, is designing artwork that will be reproduced onto posters which will be sold at the Center during the exhibit. Tart met with the Editor of Alaska Magazine to inform him about the Fish Odyssey exhibit. Ray Troll, well known artist from Ketchikan, AK, will be the cover feature of the April 2001 issue and will also participate in the "2001' A Fish Odyssey" at KVCC. Tarr said the magazine will also cover KCVB's fish odyssey exhibit, which will be excellent advertising for the show. K&H Graphics, is designing an advertisement on "2001' A Fish Odyssey" to be placed in the Soldoma Visitors Guide and other publications. Tarr and Director Braun will presem the "2001' A Fish Odyssey" to the Soldotna Chamber of Commerce Board of Directors on November 17, 2000. Tarr and Braun will present ideas to include the Soldotna and Kenai Chambers of Commerce, as well as local businesses to make this exhibit a community wide effort. Tarr submitted proposals for purchasing a new LCD projector to City of Kenai Manager, Rick Ross. Tarr said KCVB would purchase a laptop for Power Point presentations if the City would agree to replace the original projector with a LCD type. Tart discussed many items that KCVB has purchased for the building since 1997. A complete list will be presented to the City of Kenai in the near future. KCVB Board Meeting November 6, 2000 Page 4 I® EXECUTIVE DIRECTOR'S REPORT (continued) The Board of Directors discussed the purchase of a new projector. Director Bookey, Kenai City Council member, said the City of Kenai was responsible for replacing permanent fixtures in the Cultural Center, based on the original agreement made between the City of Kenai and the Center's professional manager, KCVB. Tart will attend the next City Council meeting, as the purchase of a new projector may be an agenda item. Tarr suggested a KCVB Strategic Planning Board Retreat should be held. The last board retreat was held in1996, before Tarr became KCVB's Executive Director in April 1997. All Board members agreed to attend a board retreat, tentatively.scheduled for mid- February. Tarr addressed the issue of employee benefits for KCVB's regular full lime staff Tarr said that KCVB staff DOES NOT receive any benefits such as lil~or me~hcal ~nsurance, nor do they participate in any kind of 401K retirement plans. Tarr asked the Board to consider approving Resolution 2000-2, the transfer of funds from the equipment replacement fund to establish a benefits package for KCVB's employees. An employee benefits program is not yet put together, but Tart said she is working to develop one, which the board would eventually need to approve. Tart stated that KCVB had replaced major equipmem for the Cemer in 1999 and 2000 and she did not anticipate the need to replace any major office equipment in the near future. Board members discussed the employee benefits issue. Tarr said that KCVB was a minority among other CVB's since most others in and om-of-state offer employee benefits. Other comparable non-profits in the area such as KP~C and Soldoma Chamber of Commerce also have employee health and retiremem benefits. Tarr said the benefits package would have to be paid for out of the equipment savings fund. Director Malston said that employee benefits were a good idea but did not believe that KCVB could afford it. President Braun asked Tarr to see if the City of Kenai has an "umbrella policy" that could include KCVB staff. Director Bookey agreed that KCVB staff should have benefits but was concerned about funding for the benefits in the future. Bookey said KCVB only had Gaming revenues as an income and the future of Gaming is uncertain. Director Fulton would like to see. several types of employee benefit plans before approving Resolution 2000-2 to transfer funds from the equipmem fund. The Board members asked Tarr to collect several examples of employee benefit plans to be presented to the Board at a future meeting. Resolution 2000-2 was not approved at this board meeting. KCVB Board Meeting November 6, 2000 Page 5 J® EXECUTIVE DIRECTOR'S REPORT (continued) Tart reported that the KCVB Executive Director's evaluation should be completed by November l~t. Presidem Braun asked Directors Vozar, Lofstedt and Nelson to assist with Taft's evaluation. The evaluation committee will make a report at the December board meeting. Tart reported that the Kenai Peninsula Borough will have an economic summit on December 8, 2000. Tarr will be a facilitator at the event. REVIEW OF MONTHLY REPORTS The following reports were distributed: Cultural Center, Financials, Gaming, Visitors Statistics, Membership Tarr reported that October was the best momh for gaming all year with a net transfer of $14,000. Tarr and Peggy Baxter, KCVB's Gaming Manager revised the check cashing policy at the Pemnsula Oilers Bingo Hall to decrease the amount of returned checks (NSF). Tarr reported that KCVB has a Certificate of Deposit that will mature in December 2000. (KCVB's long-term cash reserves are kept in the CD). Director Vozar asked if KCVB could use the earned interest for operating capital. Tarr stated that KCVB's Accounts Payable were current. BOARD COMMENTS Director Fulton wants to see examples of employee benefits programs. Director Bookey said the proposed Coastal Trail in Kenai had lost its potemial source of federal funding and the project was temporarily stalled. Director Legg congratulated Tarr and KCVB staff on a successful art exhibit, "Alaska 2000: A Celebration of Wildlife Art" and said she was looking forward to the upcoming exhibit "2001' A Fish Odyssey." Directors Vozar and Lofstedt thanked Tarr and KCVB staff members for their hard work and dedication. Pat Dwinnell -- Noted she obtained a copy of the Soldoma inspection list and asked what the Kenai list involved. She reported she was representing some of the public who could not attend the meeting and who had not received information from the city in regard to the ordinance. She requested action be held until all had time to review the information. It was confirmed letters with the original ordinance and inspection list were mailed to all the bed and breakfasts with current conditional use permits. Of those mailed, four were returned. Acting Fire Chief Walden explained the Fire Marshal created the list which was available to the public and Building Official. Walden reviewed the Soldotna list and noted they were identical except Kenai did not require escape ladders. Williams noted KENAI CITY COUNCIL MEETING MINUTES DECEMBER 6, 2000 PAGE 3 the ordinances had been before the Planning & Zoning Commission twice and action had been postponed by council in order to be sure the mailings were sent and the public was aware of the ordinances. He added, there had been newspaper articles in regard to the proposed ordinances as well. Williams stated he did not want to postpone action again. Ms. Reilly-- P.O. Box 324, Kenai. Stated she opposed the ordinances and explained she believed the bed and breakfast and day care owners were business people with objectives to earn money. She added, though she had not read the ordinances, she felt the business owners knew enough to have had the items on the list in place. It was explained traditional commercial businesses have these types of inspections, but private residences do not; commercial business inspections are more stringent; the reason for inspections of bed and breakfasts and/or day cares is because they are businesses in private residences; and, doing the inspections is a basic life and health safety issue. There were no public comments. Administrative Assistant Kebschull explained this would hopefully be the last part of the GIS project for water/sewer as-builts. The as- builts were digitized which created a layer of information on the program. The information does not show service lines as that is the property owners' information. She referred to her memorandum included in the packet which outlined the cost savings that would occur using in-house temporary help. She also explained, during this phase, updating of the information would occur and hotlinks would be added to maps to either bring Up an as-built or a list telling where to find the as-built. Resolution No. 2000-69 -- Awarding the Bid to Seekins Ford for an Emergency Squad Fire Apparatus for the Total Amount of $148,142 and Authorizing Use of the Equipment Replacement Fund for the Purchase. Acting Fire Chief Walden explained the vehicle would allow the ability for additional lighting, better access for beach and bluff rescues and the city's insurance rating would be better because the vehicle would be used as a back-up vehicle to a fire engine. Richard $itbon -- 118 Ha_ida, Kenai. While distributing information handouts, Sitbon reported he is employed as a guard at the Wildwood Prison and is a local business owner. Stated he had no concerns with privately-owned prison, but was concerned with public safety, council's quick decision to support the building of a prison, additional families of prisoners moving into the area in regard to quality housing, etc. He suggested building a casino as an alternative. Richard Dominick-- P.O. Box 1634, Kenai. Explained he also is employed as a correctional officer at Wildwood and is a local business owner." Stated he opposed the city's resolution as well as the Borough's ordinance. He believed it was time for an additional prison, but not a privately-owned prison. He noted guards that would be hired at a privately-owned prison would be transient workers and that the corporation who would run the prison would be out to make a profit. Steve Richard -- Correctional officer at Wildwood. Referred to information which had been reported by the Kenai Natives Association and stated some of it was not accurate and misleading, noting the types of prisoners that would be housed; prisoners could be released into this community; prisoners would be allowed to go out into the community to visit family; and inadequate training. He also distributed information. George Avila -- Public Safety Employee Association representative. While distributing information, Avila explained his opposition to the proposed development as safety concerns for the community; guards who will be transient workers and whose certification will not be recognized by the State; impact on the area school populations; costs per prisoner; profits earned by the privately-owned prison will go out of state; and a private prison will fill the beds by bringing in out-of-state prisoners (other than Alaska prisoners}. BREAK TAKEN: 8:06 P.M. BACK TO ORDER: 8:17 P.M. Blaine Gilman -- 150 North Willow Street, Attorney representing Kenai Natives Association, Inc. (KNA) explained that because the state's initial proposal to build a prison at Greely would probably not go forward, KNA developed a concept to build a privately-owned prison next to the Wildwood Correctional Facility. As the project progressed, it was now envisioned that if the Borough issues revenue bonds, a private prison facility could be built somewhere on the Kenai Peninsula Borough. The Borough would then develop a Request for Proposals and KNA and their team could participate in that effort. KENAI CITY COUNCIL MEETING MINUTES DECEMBER 6, 2000 PAGE 7 Gilman added, a small window of opportunity was available for the Borough to take the project from the Greely area and move it to the Peninsula. The Legislature appropriated funding and passage of the Borough's ordinance would be the first step. If the borough ordinance passes, the borough agrees to issue revenue bonds and the RFP is awarded to KNA, it would mean 250-300 permanent jobs in the area and a capital construction project of $80-90 million. He noted, because it would be a significant project for the area, he thought council should support it. Gilman noted representatives from KNA were in the audience, as well as a Comell Corrections representative. He added, it was hoped that with passage of the Borough ordinance the state funds could be appropriated to the Borough during the first part of the upcoming legislative session. Gilman added, the state was not funding publicly-owned prison facilities at this time. He also stated that if council did not support building a private facility in the a_rea, they would be ignoring a large economic opportunity. Williams noted he did not believe the Borough held police powers or correctional facility/jail powers, and asked if they would have the authority to go forward with an RFP, etc. Gilman answered he did not know and felt the borough attorney would have researched that question. He noted, a special statute allowing a government- to- government relationship in regard to prisons for municipalities was in place. He added, he was aware the state was only interested in developing a prison with a government-to-government agreement. Williams stated he agreed placement of the facility would be an economic benefit, but was concerned about other economic costs that would impact the city. Ross asked if after the RFP is developed, would it be a public document which the council and administration would have the opportunity to review and comment as well as the RFP award when it could be seen what will be proposed by KNA. Gilman answered, it was his understanding that any RFP and response would be public information. Ross asked if Gilman was aware of any discussions between the state and borough, etc. that would make the facility anything more than medium security, i.e. would there be minimum in the facility. If there would be minimum, what would be the community infrastructure needed to support a minimum facility, i.e. half-way houses, work release, furlough, etc. Gilman answered it was his understanding it was a medium. However, he believed that would be up to the state. Ross noted, the RFP would indicate the custody grade that would be held there. Gilman answered, he believed that would be specified between the state and the borough in the intergovernmental agreement. The RFP would be general in nature. l~~k P~,uitt -- 8500 Upper Huffman Road, Anchorage. Explained he was under contract with Cornell Corrections to team with KNA to develop a proposal for a privately-owned prison at Wildwood. Pruitt offered information in regard to the state's decision to support private prisons instead of building more public facilities and noted declining revenue challenged the Department of Corrections to develop other ways of doing business, i.e. introduction of halfway houses, substance abuse programs, electronic monitoring, etc. He also noted, the people in key positions with the K~NAI CITY COUNCIL MEETING MINUTES DECEMBER 6, 2000 PAGE 8 Legislature will not support building or operating state-run facility and would probably rather send prisoners out of state instead. Councilman Bannock explained he requested the resolution be brought forward and noted he believed Kenai was in a better position since the development of the Wildwood Correctional Facility and believed this a great opportunity for the community. He noted, comments from previous speakers regarding private versus public facilities was not a good argument as the state had already made that decision. He noted he opposed halfway houses and believed more bricks and mortar were needed. Bannock also noted the resolution supported the borough efforts to get the funding transferred in order to build a facility in the borough. He urged passage of the resolution. .. Williams stated he believed there shoUld be a very full and complete public hearing in regard to the prison industry in or near the city should be held in order for the community to have an opportunity to speak to the issue. Several people he spoke to regarding.the issue prior to the meeting, were all opposed. Some questions he felt needed to be asked were: Who would pay for the additional services that will be required of the city if a prison be built near the community (Wildwood), i.e. utilities, water/sewer, etc.? A 800-1,000 bed facility is a lot of people and minimum/medium security would mean they would be there only for awhile and because of that type of security, family members will move into the area. Who will handle the services supporting those who do not purchase homes, etc.? Who will pay for the additional school rooms and teachers needed? Who will pay for additional police and fire services? He added, he did not know the answers to the questions he asked and is not sure the citizens of Kenai were interested in taking on the commitment. Williams added, consideration should be given to what type of economy is wanted for Kenai and is there another way to create an economy within the community; is a prison economy the one wanted for the community; or, would a hotel/convention center economy be better as it would bring in similar paying jobs, etc. Williams stated, it wasn't that he didn't support a prison economy, but rather he questioned if there was a better way and who would take care of the other issues he discussed. In regard to halfway houses, he noted the issue had not been explored and with a 800-1,000 bed facility, there would be halfway houses and the question would be where will they be placed. He added, he wasn't sure the community wanted to address halfway houses again as they were opposed in the past. The question of whether the borough had authorization to develop a prison remained unanswered. Williams stated he was reluctant to support the resolution and preferred setting the issue aside for the council and let the borough take up. the issue at their level and bring it back to the city later in a broad public forum. ~NAI CITY COUNCIL MEETING MINUTES DECEMBER 6, 2000 PAGE 9 Councilman Bookey stated he had the same concerns Williams stated. He added, he didn't oppose the Wildwood Facility and believed it a good economic base for the area. Referring to the issues of additional police, fire, schools, etc., Bookey agreed they would have a major impact to the city. He stated he was not ready to support the resolution. Councilman Moore asked administration their feelings of what leverage the city would have if the borough ordinance would pass in regard to development of a prison outside the city limits, but in close proximity. Ross answered, without having the RFP to review and the ability to look at the proposal that might be submitted by KNA, his question could not be answered. He added, at this time, the specifications were not known; it was not know what the RFP would require of the contractor; and what the contractor proposes is not known. Ross stated, he would hope the RFP and RFP .. response could be reviewed by council and administration, but without them, the impact to utilities, schools, infrastructure requirements, etc. could not be calculated. Moore stated he understood that and wanted to know if the city would have the opportunity to review and comment. Ross answered, he believed Gilman indicated the city would have the opportunity to comment at each level. Councilman Frazer stated he agreed the public vs. private issue should be debated in a different forum, but knew there would be a lot of debate at different levels. He added, any major project within close proximity of Kenai would have an impact on city facilities, infrastructure, etc. whether it would be a major hotel, prison facility, gas pipeline terminus in Nikiski, etc. However, he believed a general amount of sales tax would be generated by having a facility developed in close proximity to the city which would offset some of the costs that may impact the city. In refemng to the resolution, he believed it would be better to set it aside rather than send a negative message. If the borough ordinance passes, and negotiations take place between the borough and state, the city could then give input. He added, he didn't believe he was qualified to criticize or support a private facility based on the information given, however his inclination would be to support the resolution with the idea that the city would have the opportunity to give input later. ITEM G: OLD BUSINESS Discussion -- City Economic Forum Williams reported he was working with the finance director and fire marshal to develop a short report which he would be giving at the Peninsula-wide forum on December 8. He urged council members to attend. He noted there had not yet been a lot planned for the city's forum scheduled for February. He expected more to be done after the borough-wide forum. Bookey stated his desire that the city forum focus exclusively on the City of Kenai; his concern that time was passing quickly and plans were not being formulated; and that he wanted council to be involved in planning the agenda and who would be invited to make presentations. Discussion followed and it was decided to hold a work session on December 20 beginning at 6:00 p.m. The director of the EDD would be invited to attend to discuss the forum with council. Discussion -- Proposed Kenai Peninsula Borough Negotiated Land Exchange/Herman & Irene Fandel, Applicants. Ross referred to information included in the packet which included minutes of the Borough Planning Commission's meeting. He noted Borough representatives were in the audience to speak to the issue. Ross explained there were two issues of which council should be aware and perhaps address: (1) the non-public offered sale to cure a trespass situation; and (2) a piece of borough land used in a noncompliant zoning situation (if the land is replatted and transferred to Fandel, it would not be able to be used in conjunction with Fandel's current home-use occupation permit). Ross noted, the first concern is something the Borough's Planning Commission would have to address and the second, the city's Planning & Zoning Commission would need to address prior to it coming to council for consideration. Roy Dudley -- Kenai Peninsula Borough representative. Dudley distributed vicinity maps and aerie photos of the properties. Dudley explained Fandel had been occupying the borough property since 1985 and the matter was brought to the borough's attention about a year ago. He noted, their process when finding a trespass is to {1) determine who is trespassing; {2) is the trespass on borough land; and {3) will the trespass be authorized or ejected. Dudley stated the current borough administration chose to eject the trespass. He added, they were proceeding under the KENAI CITY COUNCIL MEETING MINUTES DECEMBER 6, 2000 PAGE 12 KPB Code 17.10.100(i) and 17.10.220(c) by noticing other property owners within the area of their decision to negotiate a sale. Dudley reviewed the properties to be exchanged and their values, explaining the Fandel property to be exchanged was valued at $7,000 for a ten-acre parcel and the borough parcel on which Fandel's are trespassing was valued at $35,200. He noted Fanders would have to make up the difference in value. Ross noted the borough code allowed for "the smallest practicable parcel" to alleviate the trespass and suggested that would indicate an encroachment of a fence, footing, etc. and is alleviated. Ross asked how it was decided to offer the size of the parcel under the section of their code used, noting it was an undeveloped piece of property. Dudley answered, the application offers the property to be exchanged, however borough administration had not ruled whether the application' met the code and the decision to go forward with the process was Mayor Bagley's. Williams noted the assessed value on the three city lots was $29,600 each and the appraised value on the piece being trespassed upon was valued at $35,000 even though it was the size of the other three lots combined. He asked why there was such a disparity. Dudley answered the main detriment to the property on which the trespass was occurring is a storm drain easement and was calculated into the determination. Williams noted the Nikiski property to be exchanged had flaws that would render the property somewhat useless and would decrease the value of the land. He added, his opinion of a procedure to clear a long-standing trespass and get the property on the tax rolls would be to have the Fandels purchase the property at market value instead of the borough acquiring additional lands in Nikiski. Dudley noted the Nikiski property did not have developed access and it would be difficult to develop access to the property, although the property was contiguous to other borough land. Bannock noted the city's Planning & Zoning Commission dealt with the issue and it was their position it was not a city issue, but was the borough's. He agreed with Williams' thoughts that the Fandels should be asked to purchase the property in order to cure the trespass as he didn't think the land exchange was in the borough's best benefit. However, that would be a borough prerogative. Williams noted, if the transaction takes Place, the city will have to deal with the home occupation permit for the questioned property. Frazer asked if a home occupation permit could be issued if there's no house on the property. Ross answered, that would be for the Planning & Zoning Commission to consider and suggested there could be alternatives, i.e. replat. Bookey asked if it was a gray area if there's a permit for the house, but the other property is used for a picnic and storage area. Ross answered, the only issue administration wanted to bring forward was that the home occupation permit would not extend to the adjacent property. The Assembly will then fly a mission at the Center for their members and members of the Fairbanks Assembly. Williams added, he was very interested in the Fairbanks Assembly coming to Kenai to see Nikiski in regard to the gas pipeline and GTL plant. Kenai is 70 air miles and 150 road miles from Anchorage. The Kenai Peninsula Borough is considered a prime recreational area for South Central Alaska, providing fishing, hunting, and winter sports opportunities. The City is approximately forty-five square miles in size, and is situated at the mouth of the Kenai River on the east side of Cook Inlet. The City of Kenai is the primary commercial and shopping center for the Kenai Peninsula. It is linked to Anchorage by road and by commercial air service. Kenai's economy is based primarily on fishing and fish processing, oil and gas, and, increasingly, tourism. The City adopted a home role charter in 1963 and has operated under a City Manager form of government since that date. Since 1980, the City has had three City Managers, appointed by a City Council consisting of a Mayor and six Councilmembers. In 1992 the City of Kenai was the recipient of the All America City award. Management of the City of Kenai The City Manager is the chief administrative officer of the City and repons directly to the City Council, as do the other Council appointed officers, the City Attomey and the City Clerk. The City Manager is responsible for directing the policy of Council. The City employs approximately 120 employees, including nine department heads that report to the City Manager. The City provides a wide range of municipal services, including police and fire, water and sewage treatment, street maintenance, municipal airport, senior citizen services, library, and parks and recreation. The Kenai Peninsula Borough provides solid waste disposal, tax collection, assessing, and public education. Finances of the City The City of Kenai enjoys a reputation of being a well-managed and well-financed city. The property tax base is assessed at approximately $356 million; the City's property tax rate is 3.5 mills, one of the lowest in the state of Alaska. The City levies a 3% general sales tax. The general fund budget of $8,039,000 is financed primarily by property taxes (16%), sales tax (45%), state revenue (6%), and interest revenue (9%). The General Fund is projected to have a small surplus from FY2001 operations. The total of all annual operating fired budgets is approximately $12.2 million. Capital project expenditures for the year ended June 30, 2000, totaled $3.1 million. The fund balance of the general fund is approximately $9 million, and the fund balances/retained earnings of all funds total approximately $34.2 million. Qualifications of the City Manager The next City Manager should be experienced with the rewards and difficulties of managing a full-service city. The ideal candidate will have at least seven years of responsible management experience in a small or medium sized community, with extensive personnel, budgetary, leadership, and communication skills. A minimum of a bachelor's degree in business, public administration, or a related field is required. The starting salary will be dependent upon qualifications. Employment benefits include optional enrollment in the State of Alaska Public Employee's Retirement System, paid health and life insurance, City-paid 401 contribution plan, and an optional employee-paid 457 deferred compensation plan. The manager position is not eligible for social security coverage if the candidate participates in the Alaska Public Employees Retirement System.
