WHEREAS, the monthly meeting schedule of boards, commission and~ committee meetings (except Planning and Zoning) has been reinstated by the Kenai City Council; and, WHEREAS, Ordinance No. 2017-2003, amending KMC 1.90.050(b) to coincide with the newly created bi-monthly meeting schedule and extending the period for determining absences from three to six months was passed by the Council on October 15, 2003 and became effective on November 15, 2003; and, WHEREAS, because the monthly meeting schedule has been reinstated, the prior allowable absences should also be reinstated. WHEREAS, studies have shown that youth wearing certified protective he!m__ets that are properly sized and properly worn, have prevented or limited serious head injuries and deaths while bicycling, skating, skateboarding, and riding similar vehicles; and, WHEREAS, studies have shown that helmet laws reduce bicycle-related head injuries by 45% and deaths by 15%; and, WHEREAS, despite the overwhelming evidence of the need to wear certified protective helmets, many children do not wear them while bicycling, skating, skateboarding, and riding similar vehicles; and, WHEREAS, requiring minors to wear and properly fasten a certified protective helmet of appropriate fit is needed to foster greater and continued use of certified protective helmets; and, WHEREAS, the citation for a first time violator imposed by this ordinance for non- compliance can be dismissed upon acquisition of a properly fitted certified protective helmet which will provide an incentive for youths and parents to comply with the helmet requirements set out in this ordinance; and, WHEREAS, it is the intent of this ordinance that the proceeds of the frees received under this ordinance be used by the City ..to support distribution of certified protective helmets to children or to support brain injury awareness/prevention groups. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that thc Kenai Municipal Code is hereby amended by enacting KMC 13.40.055 to read as follows: 13.40.055 Requirement that minors wear certified protective~ helmets. (a) It shall be unlawful for any person under eighteen (18) years,. of age to operate or ride upon in-line or roller skates, skateboards, scooters, coasters, toy motorized vehicles, gasoline or electric motor-driven cycles or scooters, bicycles, tricycles, unicycles, or any similar vehicles on any public property or private property that is open for public use Ordinance No. 2052~2004 Page 2 of 2 (b) (c) (d) (e) within the City, including highways, streets, roads, bike- ways or trails, or rights-of-way, unless that person wears a certified protective helmet that is properly fitted and that is properly fastened. This requirement also applies to any minor who rides in a restraining seat, trailer, backpack, or similar child-restraining device, used by someone who operates in-line or roller skates, skateboards, scooters, coasters, toy motor vehicles, gasoline or electric motor-driven cycles or scooters, bicycles, tricycles, unicycles, or any similar vehicles. A parent or guardian having control or custody of an unemancipated minor whose conduct violates this section shall be liable for the frae imposed by this section. No parent or guardian of any unemancipated minor shall allow the minor to violate this section. The frae for the first violation of this section shall be $25.00. The frae for a second violation of this section shall be $35.00. The fine for a third or subsequent violation shall be $5o.oo. The first time a person is charged with a violation of this section, the Court or City may dismiss the charge upon presentation of evidence that the person has purchased or obtained a certified, protective helmet. A certified protective helmet is a helmet containing a manufacturer certification that it meets the standards of the American National Standards Institute, American Society for Testing and Materials (ASTM) or the United States Consumer Product Safety Commission (CPSC). Graves, City Attorney DATE: July l, 2004 RE' Use of the term "custody" in proposed KMC 13.40.055 Ordinance 2052-2004 (KMC 13.40.055(a)) states in part: A parent or guardian in control or custody of an unemancipated minor whose conduct violates this section shall be liable for the fine imposed by this section. The purpose of that section is to make most parents liable for any fines levied against children for violation of this section. During the introduction of the ordinance, a member of the public suggested that the word custody shOuld be stricken fi'om the proposed ordinance because of situations where divorced parents have joint custody. In that situation, only one divorced parent would normally have control over a child who does not wear a helmet, but both would have "custody." The way it is written, a parent with joint custody could be liable for the fine of a child arising while in the control of the other parent. However, both parents could also be liable for a fine of a child when in the control of neither one, such as when staying at a friend's house. The idea is that both custodial parents are liable for the fine if the child violates the law whether or not the child is in the parent's actual control. California has a nearly identical section in its state code. states in part: California Vehicle Code {}21212(e) The parent or legal guardian having control or custody of an unemancipated minor whose conduct violates this section shall be jointly and severally liable with the minor for the amount of the fine imposes pursuant to this subdivision. Hawaii also has a nearly identical section. Hawaii Revised Statutes {}291-150 states in part: Mayor John J. Williams and Councilors July 2, 2004 Page 2 of 2 The parent or legal guardian having control or custody of .an unemancipated minor whose conduct violates this section shall be liable for the mount of the fine imposed pursuant to this section. Removing the term "custody" from the ordinance would make it more difficult to collect fines imposed for violation of this ordinance. Let me know if you have any questions. For date of last revision see last line at the bottom. There is no federal law in the U.S. requiring bicycle helmets. States and localities began adopting laws in 1987, but there is no formal central registry for them. Here are the ones we are aware of as of this date. There are other laws that cover them too, but we don't have the info on all of them yet. Private property (a driveway, for example) was excluded but all roads and trails are covered. Virginia's state enabling legislation permits localities to adopt laws covering only children under the age of 15. Although as shown by the blanks we do not have official confirmation in every case, all of the Virginia laws we have found specify 'fourteen and younger." (under 15) That's a total of 20 State laws (including the District of Columbia as a "state") and 134 local laws. Only 17 states have no state or local helmet laws at all. These are bicycle helmet laws. As noted, we do not have info on which of the laws cover skaters, scooter users, Segways or other conveyances. Here is the same list by date that the law became effective. The Health Policy Tracking Service, National Conference of State Legislatures, has a more detailed chart, listing the states that do not have _ laws. Worth a look, particularly if you need citations of the laws, but when we have checked them their chart has been outdated and lacking some of the laws listed above. We update our page periodically by searching those local municipal and County codes that are available on the Web. You can do that for your community at Municode.com if your own code is posted. Washington State codes are found at Municipal Research Services Center of Washington. We also have another page with more info on mandatory helmet laws, including copies of some of them. And we have a page suggesting language on standards for anyone writing a new law. To search the Web for details on state and local laws, the definitive central resource page is Doug Mink's MassBike Page with pointers to the texts of the laws, resources, search engines and more. Here is a map of the US highlighting which states have helmet laws. State and local helmet laws now apply in states that include more than http ://www.bhsi.org/mandator. htm 7/1/2004 half of the total population of the US, but actually a much smaller portion of the population is covered, less than 15 per cent, due to age limitations of the laws. Laws have been proposed and may be either defeated or in some stage of the legislative process in a number of other states. If you need detail on the provisions of these proposed laws, including penalties, enforcement, associated educational campaigns, helmet banks or giveaway programs, treatment of contributory negligence (liability) provisions, or dates of enactment, the National Safe Kids Campaign has a stares sheet on bicycle helmet laws available from Meg Farrage at 202-662-0616. We are indebted to Safe Kids for their help in keeping our list up to date, and to Ralph Wessels for information on the Washington State communities. Evaluations You can access here a compendium of bicycle helmet safety program evaluations taken from the Centers for Disease Control's MMWR issue titled "Injury Control Recommendations' Bicycle Helmets" Please send us any other evaluations you may see in the furore so we can add them to this page. Here is a formal study on the effect of bicycle helmet legislation on bicycling fatalities. Consumer Product Safety Commission staffer Greg Rodgers has published a study concluding that the presence of a State law increases helmet use by 18.4 per cent. New York State repons that since it introduced its first helmet law in 1989 for passengers under 5, and its second in 1994 for riders under 14, the annual rate of cyclists hospitalized from bicycle-related traumatic brain injuries has fallen for the under 14 group from 464 in 1990 to 209 in 1995. The rate for cyclists 14 and over for the same years declined less rapidly, from 454 to 382. There is no way to determine exactly what proportion of the improvement was due to helmet laws, since there is no data on improvements to bicycle facility safety, rider education or total miles ridden in those years, and helmet promotion campaigns by Safe Kids and others were active in the state. But it is likely that increased helmet use, prompted by passage of the first law in 1989 and http://www, bhsi. org/mandator, htm 7/1/2004 Bicycle Helmet Laws Page 9 of 14 the promotion campaigns in New York communities, played a role in the reduction of injuries. New Jersey reported in July of 1997 that since it introduced a helmet law for kids under 14 the number of bicycle-related fatalities for that group fell by 60 per cent, from 41 in 1987-1991 to 16 in 1992-1997. For riders age 14 and over the figures were 75 and 71. The School Board of Sommers Point, NJ added a helmet role and boosted helmet use by those who ride to school from 6 per cent up to more than 70 per cent. Their attorney thought that failure to require helmets could leave the School District liable in the event of an injury. Duval County, Florida, reported an increase in helmet use by all ages from 19 per cent in 1996 to 47 per cent in 1997 after the Florida law was passed. Bicycle deaths fell from five to one, and injuries from 325 to 105. Results were even better in the age group covered by the law. Hillsborough County, Florida, also reports an increase in helmet use and a decline in injuries after passage of the same law. An email to us from a protesting parent in Florida said her twelve year old daughter was ticketed, did not respond, and was issued a drivers license that was immediately suspended. (If so, it is the only place in the country where you can get a drivers license at age 12!) That seems to us a lame way to enforce a pre-teen helmet law, although it may increase compliance more than a fine would. A study published in Pediatrics in 2002 found that in Canada the bicycle-related head injury rate declined significantly (45% reduction) in provinces where legislation had been adopted compared with provinces and temtories that did not adopt legislation (27% reduction). NHTSA has a page up on motorcycle head injuries and costs to society that supports motorcycle helmet laws. A contractor working for them has been working on a report on bicycle helmet laws that should be ready soon. In the meantime, they have put up a page with some summary comments on how bike laws get passed. Notes The Shaker Heights, Ohio, law covers adults but not kids under the age of 5 years. It does cover passengers on bicycles, however. The Austin, http://www, bhsi. org/mandator, htm 7/1/2004 Texas, law was originally for all ages, but a grass-roots protest movement resulted in limiting it in October, 1997, to riders under 18. A similar change was made in Barrington, Illinois. Seymour, Connecticut, repealed its law. (The referendum also included an unpopular no- smoking law.) An attempt in 1999 to force a referendum on the Farmington Hills, Michigan, law for riders under 16 failed for lack of signatures. The Canadian province of British Columbia has made exceptions to their all-ages law for medical exemptions, those with heads larger than size 8 (Bell had not yet begun producing their Kinghead for sizes up to 8 1/4) and those whose religion requires headgear making helmets impossible (primarily Sikhs). The City of Oakwood, Ohio, has taken an different route by adopting a ~resolution encouraging the use of helmets. It directs the Safety Department (Police) to develop educational programs for helmet safety. It also provideS the authority for officers to "wave over" minor cyclists who are not using protective head gear. No fines or other deterrents are permissible as this is not an ordinance. Many bicycle clubs, the US racer's organizing body, USA Cycling and the Triathlon Federation require helmets in their events, although they may or may not support helmet laws. The International Inline Skating Association supports helmet laws for those under 18 while inline skating. U.S. military regulations require helmets on military facilities. The National Bicycle Dealers Association opposes mandatory helmet laws. Bicycle Retailer and Industry News has editorialized against them. At least one helmet manufacturer has helped out on occasion when a community passed a new helmet law by providing free helmets to organizations working in conjunction with the local police department to introduce the law. They can't respond every time, but Sportscope has helped some communities in this way. Contact information is available on the Sportscope Web site or by email to info~sportscope.com International Sweden has conducted an international literature search, summarized in this study published in 2003. (See page four for the English abstract.) They found that helmet laws can achieve level of usage not achieved by education alone, that helmet laws reduce head injuries, and that helmet laws can result in a reduction of cycling by young people. In Australia, bicycle helmets are mandatory in all states and temtories. Compliance is high but varies by area, with some cities over 90% and rural areas much lower. In the State of Victoria cyclists' head injuries declined 41%. There were 36% fewer child riders on the road, immediately after the legislation passed, but perhaps more adult riders. Changes in ridership may or may not have been related to the passage of the laws, and the road culture in Australia is unique to that country. (No similar effects have ever been documented in the US.) Injury reduction was below expectations, but still spectacular. Hospital data from Western Australia show that the number of intracranial injuries was cut in half with increased helmet use, while head injuries were less serious, and hospital stays shorter. New Zealand's national helmet law took effect in January, 1994. Sweden is reportedly considering a national law. Iceland's mandatory helmet law, covering children under 15, came into effect in October of 1998. The Spanish legislature passed a comprehensive bicycle law in mid-1999 that reportedly included a mandatory helmet provision, although we do not have any further information on it. Canada has some provincial and local helmet laws. Ontario's helmet law for cyclists under 18 took effect in 1995. (It was originally to have covered all ages). In March, 2003, the Canadian Institute for Health Information announced that hospitalizations due to cycling-related injuries were down 12.5 per cent between 1997-98 and 2001-02. Head injuries fell even more precipitously, by 26 per cent during the same period. British Columbia's 1996 all-ages law apparently has been successful. Nova Scotia's law came into effect in 1997 and covers all ages. New Brunswick also has an all-ages law. In Quebec, the Montreal suburbs of Cote Saint-Luc and Westmount have passed by-laws requiting the use of bicycle helmets within their boundaries. In October, 1997, the Cote Saint-Luc law was extended to cover bicyclists and skaters of all ages. Alberta added a law on May 1, 2002, requiting helmets for riders under 18, including passengers and toddlers on tricycles. Prince Edward Island's law was effective on July 5, 2003, and covers all ages. A research project in Toronto before and after their law came into effect showed that "although the number of child cyclists per hour was significantly different in different years, these differences could not be attributed to legislation. In 1996, the year after legislation http://www, b hsi. org/mandator, htm 7/1/2004 came into effect, average cycling levels were higher (6.84 cyclists per hour) than in 1995, the year before legislation (4.33 cyclists per hour)." Conclusion--Contrary to the findings in Australia, the introduction of helmet legislation did not have a significant negative impact on child cycling in this community Finland passed a mandatory helmet law with an effective date of January, 2003. It covers all ages, but there is no fine associated with breaking the law. In April of 2003 the Union Cycliste Intemationale (UCI) announced that it intended to make helmet use compulsory_ in the professional races it sanctions. If the ruling sticks (in 1991 an compulsory helmet role was rejected by the riders) it would follow several well-publicized deaths, including that of Kazakh rider Andrei Kivilev. Kivilev died of a head injury without a helmet. The impetus for the ruling had also grown since a helmeted rider fell on a mm at an intersection in a rainy Dutch stage of the Tour de France and hit his head on a concrete bollard in the center of the road, but to the astonishment of the crowd got up and raced away. Our View The Bicycle Helmet Safety Institute supports carefully drawn mandatory helmet laws coveting all age groups because we believe they are needed to raise awareness that helmets save lives, in the same way that seatbelt laws and smoke detector requirements were used to inform the public that those safety devices were necessary. Many riders and parents do not know that they need a helmet, and the laws educate as much as they force compliance. We also believe that most riders regard helmets as a fashion item rather than as a safety appliance, and like any other fashion this one may wane. We support efforts to improve the safety of the cycling environment to reduce the need for helmets, which should always be regarded as the primary injury prevention measure for reducing all injuries to cyclists. We do not believe that wearing a helmet causes riders to take additional risks. We believe that in this country promoting helmets will not detract from the effort to improve road safety, and in fact has stimulated those efforts, giving us the most widespread and best-supported campaigns for better road safety for cyclists that we have ever had in our history. We consider bicycles on a http://www, bhsi. org/mandator, htm 7/1/2004 Bicycle Helmet Laws Page 13 of 14 public road to be vehicles, and believe that the operator has the fights and obligations of vehicle users in our ever-more-populated and outrageously unsafe road environment, so requiring a bicycle helmet is as reasonable as requiring a helmet on a motorcycle rider or requiring seatbelt usage in cars. We would support provisions for medical exemptions based on a doctor's certification or religious requirements for headgear. We do not participate in the endless Interact "Helmet Wars," and seldom respond to emails on the subject, but we have a Web page up..discussing some of the recurring points. Despite that statement, we have always been a lot more enthusiastic about promoting voluntary use of helmets than promoting laws, and it would appear from the list above that most U.S. states and localities are too. Even seatbelt laws, which have been around for a long time, are mostly secondary offense laws limiting a police officer to occasions when a driver has been stopped for something else. Graves, City Attorney DATE: June 30, 2004 RE: Code Enforcement Officer When the FY 2004-2005 budget was presented, it was envisioned that the code enforcement position would be contracted out. It does not appear practical at this time to do that. The value of the contract is relatively small. Because of the nature of the position, the person doing it needs insurance coverage; but, because of the size of the contract, it is not economical to purchase that type of liability insurance just for this contract. Making the code enforcement person a temporary part-time position would mean the person would not receive benefits such as holiday pay, medical, or annual leave. We would have to pay for such things as workers compensation and Medicare. Ordinarily, a temporary position is hired only for a period of six months. KMC 23.05.070(0. The temporary status would expire toward the end of the calendar year. That is traditionally a slow time for code enforcement. The administration would then decide whether to request the position be made a regular part- time position. That position also would not receive benefits because it would still be less than 15 hours per week. KMC 23.40.010. If it were decided to keep the position as a temporary one, the temporary employee would be laid off after six months (probably in December). In the spring (when code enforcement picks up again), a temporary code enforcement person would be added. The resolution in the packet transfers money from Professional Services to Salary and Benefits to reflect the change from a contract to a temporary, part-time employee. Referring to her letter included in the packet, Wheeler reported the Senior Connection had been investigating the possibility of building an assisted living facility in the community and in doing so, hired James McConnell as the project coordinator. James McConnell -- McConnell reviewed efforts to build an assisted living facility in $oldotna several years ago. Because that project did not go forward, the AHFC grant funds were returned and made available for other projects. The results of an updated feasibility study indicated the need for ten units in the community of Kenai in 2003- 04, however the growth rate of need (based on senior population growth) indicated a 19% increase each year, i.e. in 2004-05, 16 units. McConnell reported, the Senior Connection applied for development grant funds and have developed a list of properties in the city limits which are of interest for a facility site. He indicated, the site w/ll need to be large enough to allow future expansions. He requested council set a work session for reviewing the list of properties, discuss their conceptual design and timeframe, etc. Mayor Williams noted the council's interest in working with the Senior Connection in their efforts and noted the city requested the Borough Mayor dedicate a 20-acre property along Swires Road for this purpose. At the time, the Mayor indicated the property needed to be used for a higher and better use. Williams suggested the city request the property again since the city's improvements on Lawton Drive added value to the property. Borough Assembly Member Glick-- Indicated the Borough has assisted the Cooper Landing Senior Center in acquiring Borough property for development of a senior center, as well as Sterling KENAI CITY COUNCIL MEETING JUNE 16, 2004 PAGE 3 It was decided Council Members Porter and Swarner would meet with the Senior Connection after the next Council on Aging meeting, scheduled for July 1. Also, a resolution in support of the project is to be placed on the agenda for the July 7 council meeting. Mr. McConnell is to provide background information to the City Clerk for the preparation of the resolution. Williams requested the resolution include signature lines for all the council members. ITEM C: .I/N. SCHEDULED PUBLIC COMMENTS (3 minutes) Raymond Rowley -- Discussed the placement of permanent toilets on city beaches to assist as a public convenience, especially during the dip net fishery. He reported, he has constructed toilets for other park areas on the Peninsula with the cost at approximately $23,500. He noted, the toilets are pre-cast concrete and take a day to install. It was noted, the cost for the city to provide temporary toilets during the dip net fishery is approximately $17,000 for both sides of the fiver. Crary Kernan -- Reported he is a guide and has several clients who require handicap- accessible facilities. He noted, the temporary toilets are difficult for his clients to use and encouraged the council to purchase Rowley's product as he felt the handicap consideration is crucial. Williams noted the budget had been set and, though lessened, the city still faced funding difficulties and purchase of permanent toilets at this time was not anticipated. However, he requested the purchase be discussed during the next budget cycle. ITEM D: REPORTS OF KPB ASSEMBLY, LEGISLATORS AND COUNCII~ Borough Assembly Member Betty Gllck -- Glick reviewed actions taken by the Assembly at their June 14, 2004 meeting which was continued from June 1 as well as their regular meeting of June 15. She noted, after lengthy discussion and deliberation, the Borough budget was passed and it included $50,000 for the Economic Development District; the mil levy was maintained at 6.5; the sales tax cap was mainta~ed at $500; and, two questions relating to police powers in Niskiski will be placed on the October ballot. Williams opened the floor for public comments. Mary Warrington -- Stated she very much supports the helmet law. She noted, the helmets are not always the key to the issue, but being aware is. She hoped the ordinance will help people realize the dangers of not wearing helmets. Vicky Thompson -- Stated she was impressed by the way the ordinance is written, i.e. "helmets "properly fitted and fastened." Stated her strong support of the ordinance. Nolan Compton -- Stated he feels an ordinance of this nature is absolutely necessary; feels the ordinance will not be enough because parents and adults need to also wear helmets; and, is very glad to see the city considering the ordinance. Kristine Sehmidt-- Noted the following: · Stated she felt the ordinance was a good idea but was concemed there may not be resources to enforce the ordinance and requested council to be sure resources were devoted for the enforcement. · Recommended the age be changed from 18 to 14 due to "control of children" issues. · Noted "custody" is sometimes shared by parents and a frae should be levied on the parent with whom the child is with at the time of the offense. Williams read the portion of the ordinance relating to frees and noted, money is not always the deterrent. He added, the substitute ordinance levies the frees for first, second and third offenses. Williams also noted, the whereas which states the intent of use for the fines collected would be for supporting distribution of helmets or brain injury awareness efforts, etc. Ross stated he would give the ordinance a lot of consideration, but had concerns with putting the government between the parent and child and the city doing the parents' work. Although he appreciates the work done by the Warrington's and administration, he probably would not support the ordinance. Moore stated he discussed the impending ordinance with his son and the ordinance was causing his son to wear his helmet, which he had been unable to do. Bookey stated he had similar concerns as Ross and enforcement concerns as well. Police Chief Kopp explained the issue of enforcement was in prioritizing and resources available. He noted, both the Police and Fire Departments' participation in safety issues and training for the community. Realistically, though, it would not be the highest priority. Fire Chief Walden noted, support and endorsement of the KENAI CITY COUNCIL MEETING JUNE 16, 2004 PAGE 10 departments' safety training by council is a great value instead of only suppression and enforcement. He added, he believed the ordinance a good thing, along with funding for enhancement of the safety programs. Williams noted, council has become involved in the health and safety of the citizens through the passing of a smoking ordinance, smoke detector requirements, etc. He noted, he believed society passes laws that are beneficial to society and believed this law would be worthwhile ff it saves one life during its existence. City Clerk Freas explained the policy had been developed when the commission meeting scheduled had been changed to bi-monthly. The changes to the policy indicate council's decision to return the meeting schedule to monthly, and also included several corrections. It was also noted, the policy would now include a method for meetings to be canceled by the City Clerk ff there are no agenda items and ff it is known ahead there will be no quorum available for the meeting, as well as an updated work session procedure. Porter noted her desire to postpone action on the policy update in order to include a procedure for reappointment of commission members and referred to a process used by the Hospital Board. Discussion also noted the difficulty in finding community members to volunteer for appointment. Porter suggested a sign-up booth at the Industry Days Picnic in August and stated she would do that. City Manager Snow referred to the memorandum included in the packet from Public Works Manager Komelis which updated the efforts in researching a possible land trade with The Conservation Fund. Snow reported, at their last meeting, council requested the issue be taken before the Harbor Commission for their recommendation. She confirmed the issue was taken to the Commission who recommended the city proceed with the land exchange. Bookey confmmed the issue was discussed with the Harbor Commission. He noted his personal concerns as the city receiving fair market value in the appraisals. Beautification Committee -- Swamer reported the meeting summary of the June 8 meeting was included in the packet. J-7b. Alaska Municipal League Report -- Swarner referred to information included in the packet relating to the summer AML meeting to be held in Kenai on August 19 and 20. J-7c. Arctic Winter Games -- Moore reported on the meeting held on June 3 and noted, the committee was moving forward with signage and working with city administration for necessary variance permits. He also noted, the contracts with the cities who will be involved in putting on the games was approved by the borough and will be forwarded to the cities for review. J-7d. Stranded Gas Committee -- Ross reported on the June 11 meeting and noted a presentation was made by ANGA. Discussions included a niche for point of entry; tax issues on the sales; and, a draft report on the work coming out (may come to council for review in the future}. He noted, the next meeting will be held in Fairbanks, but because of other commitments, he will be unable to travel there and will attend via teleconference. Ross also reported, there's a possibility the group may meet in Kenai in July or August. He has discussed this possibility with representatives from Agrium and suggested they give an industry overview at that time. He is hoping this meeting will include two days in which to fit in all the activities. ITEM K: REPORT OF THE MAYOR -- Mayor Williams noted he received a request from AML to send a letter of support to the Legislature relating to the proposed POMV and asked council for direction. Discussion followed and it was noted, there were varying opinions of council and no definitive answer was received. Attorney Graves reported a 30-day notice relating to the installation agreement was served on Mr. Andersen. If the work is not completed within the 30 days, the bond company will be informed they need to step in and fi~sh the project. · Commented on thc gun shots from the airport at very early hours of the morning. Airport Manager Cronkhite reported the shots have been made to remove sea gulls from the runways in order for safe landings and take-offs. She noted, she believed it would be short term problem as the birds will be attracted back to the beach during the dip net fishery. Swarner -- Reported she would be out of town for the week. Moore -- * He was glad to hear the flea market proposal was moving along. · Noted the amount of dandelions throughout the city properties and Parks Director Frates reported he had sprayed earlier in the spring and would be doing so again. · Noted only three members of council attended the council/staff meeting scheduled to be held prior to the council meeting. Everts is proposing a 55-year lease. The purpose is to construct an air cargo hangar with an estimated construction cost of $575,000. They may expand and build a fuel farm at a future date. KMC 21.10.080 states the term shall depend upon the durability of the proposed use, the amount of investment in improvement proposed and made, and the nature of the improvement proposed with respect to durability and time required to amortize the proposed investment. The FAA has agreed that the City may apply the criteria used by the State in 17 AAC 45 for their airport leases. This application meets the criteria that allows for a 55-year lease for a $575,000 investment. Prior to leasing, an appraisal must be approved by the Federal Aviation Administration. The Airport Commission reviewed the application at their June 3rd meeting and determined the intended use complies with the Airport Masterplan. The Planning and Zoning Commission determined the intended use complies with the Comprehensive Plan. It was noted the proposed amendment to the Land Use Table would allow development of the lot as planned. If the amendment is not adopted, a rezone would be required. The Commission unanimously recommended approval of the lease application. The property is in the process of being surveyed and a final plat is expected mid-September. Cronkhite noted, the property of interest to Even is un-subdivided property north of the Forestry lot.. She added, she felt it was an appropriate area for development of the type described; the size of the lot will allow planes to be pulled onto the lot; there's space for a hangar or a fuel farm; administration would work to coincide the process with approval of the Ieee application, acquisition of a property appraisal., etc.; the subject property is forested, and, there is approximately two to three feet of overburden on the property and the water table is high. Evert noted, their initial estimate for clearing the overburden and excavation was approximately $375,000 and that they would do some of the work in-house as they have experience in this area, however the city would want to participate in issues with the utilities, storm drains, underground equipment, etc. They are interested in moving ahead with the project and perhaps the city would partner with the project. There were no objections. SO ORDERED. 6-bo Discussion-- Airport Conservation Properties/Amending Title 14, Land Use Table. The Commission reviewed the M. Kebschull memorandum added to the agenda at the beginning of the meeting which explained the majority of unsubdivided airport property is zoned conservation. The newly adopted Comprehensive Plan has recommended an airport overlay zone to eliminate the zoning restrictions on this property due to the conservation status. The original plan was to begin this process as soon as the Comprehensive Plan was adopted, however the airport is in the process of conducting an airport supplemental plan to include an inventory of airport properties and recommendations for future. Because it would seem premature to rezone properties without the advantage of the supplemental plan and the consultant's recommendation, Administration's recommendation is to amend KMC 14.20.070(a) to allow uses as permitted by the FAA. Council Member Moore noted he was looking forward to the preparation of the supplemental plan and the final resolution to many airport land issues. MOTION: Commissioner Watkins MOVED for the Airport Commission to recommend approval of the footnote as recommended by Planning Administration and Commissioner Versaw SECONDED the motion. She also noted, the applicants were present as well as an adjacent property owner. Glick asked if the date of the hearing could be changed as requested by the Wrights and Kebschull explained it could not due to the public hearing being advertised. She added, during a telephone conversation with Sharalyn Wright, she advised her the public hearing had been advertised and because of that, the public hearing had to be held at this meeting. However, the Commission could continue the hearing if they chose. Kebschull also reported, the hearing notice had been mailed to the Wright address and Ms. Wright indicated she had not received it. Ms. Wright also noted, she was calling from Seattle and her mail had been forwarded to a Juneau address. Kebschull stated the city code was followed in regard to advertising and notifying adjacent property owners of the permit. Chair Glick opened the public hearing. Glen CHfford, P.O. Box 245, Kenai, AK -- Clifford stated the applicants had contacted he and his wife during thc winter and said they wanted to come closer to the PLANNING & ZONING COMMISSION MEETING JUNE 9, 2004 PAGE 2 property, but according to the agreement in the subdivision covenant, a 20 foot setback was required on the side. At that time, he told her they would stay with the 20 feet. When the contractor made the error on the property (he couldn't fred the stakes in the snow), he told the applicants they would not argue the point if the Commission approved the status as is. Clifford added, they did discuss the driveway being in the middle of the property line and they would like it moved on to the middle of their property. Barrett advised subdivision covenants are not enforced by the city and the city has different setback requirements. Bryson noted, the encroachment cannot address trespass issues and the driveway situation was a trespass issue. Clifford stated he was not objecting to the structure as it is now. Barrett asked the applicant if a continuation of the public hearing would cause them a hardship. Nicolette Schemanski -- Stated a continuation would be hardship as they had been put on hold for 30 days. She added, the walls are prefabricated and the lumber had been delivered; all the crews were scheduled and they would prefer not to rearrange those schedules. Schemanski also reported they had already discussed the moving of the driveway with the excavator and the work had been arranged. Schemanski also noted, the garage would be facing the street. When asked how the Wright property related to hers, she indicated Lot 9 was owned by the Wrights. Discussion followed and comments included: · Commissioner Amen asked if the value of the adjacent property being affected was not a condition to this issue. Kebschull stated, that issue would be considered under conditional use permits and variances but is not a requirement of this section of the code and, in this case, she didn't believe it would affect the neighboring property owner. · Bryson stated he felt a structure could be a perception of diminished value, but Clifford was not objecting to the use and Lot 9 was not being damaged by the activity that occurred. Bryson stated he would support the motion to approve the permit. · Commissioner Eldridge noted staffs recommendation to grant a two foot encroachment for placing siding on the structure. · Bryson noted, in the letter from the Wrights, their objection was referenced to Lots 7 and 8; the petition is for Lot 8 alone. · The Commission does not necessarily need to discuss the request to continue a public hearing because all the requirements for the public hearing had been met, i.e. mailings, advertisement, etc.; under different circumstances, a request to continue may need to be discussed. ITEM 6: OLD BUSINESS Discussion -- Draft PZ04-22 -- Recommending to the Council of the City of Kenai, Alaska, the Council Elect to Administer the Kenai Peninsula Borough's Anadromous Streams Habitat Protection Ordinance by Adopting It and Incorporating It by Reference into KMC 14.20.165. Kebschull reviewed the draft Planning & Zoning resolution which was added to the agenda at the beginning of the meeting and noted, the Harbor Commission had reviewed the information at their June 7 meeting. A public hearing on PZ04-22 will be scheduled for the June 23 Commission meeting and no action was required for this meeting. It was also noted the Harbor Commission recommended approval by the City Council, though they did not have a copy of the draft for review, however they will see it before the ordinance goes before council for public hearing. .ITEM 7: NEW BUSINESS Discussion -- Amendment to KMC 14.22.010- Land Use Table Kebschull reviewed her memorandum included in the packet and noted the draft resolution added to the agenda at the beginning of the meeting. ITEM 9: CODE ENFORCEMENT Discussion -- One Stop Grocery Store- Building Permit & Landscape Site Plan Kebschu11 reviewed the information included in the packet and noted: · The property had a new owner who cleared the land last fall and the city informed them in writing they would need to submit a landscape site plan. · The owners now placed a coffee kiosk on the property and would need to start the process over again, i.e. building permit, landscaping site plan, etc. · The most owners were unaware of city landscaping requirements for that property, but would have been notified of them if they had filed the required landscape site plan. · When the initial landscape site plan was approved there were included strict buffering requirements. · Because the owners breached the original requirements and didn't submit a landscape site plan, they will be informed they need to buffer the land by extending the fence or planting new trees, etc. · The owners will be given an amount of time to make the appropriate submissions, etc. ITEM 10: REPORTS 10-a. City Council -- Bookey reported the Council had passed the budget, with a $176,000 deficit, however he felt the revenue would be higher than projected. He added, amendments were made to hire an additional police officer, add Sunday hours at the library, and purchase a town clock for probable installation at the Memorial Park. Bookey also reported the mil rate was reduced by one-half mil. 10-b. Borough Planning -- No report. 10-c. Administration -- Kebschull reported the Borough Assembly had adopted the City of Kenai Comprehensive Plan (copiea were later distributed to the Commissionl and noted areas of the code the Commission should probably review in the future as the landscaping site plan and subdivision ordinances. She said the airport is studying the issue at this time and is waiting for suggested uses. The FAA defines the area adjacent to the runway and inside the fence as the "airport perimeter," Kebschull said. Amen asked if there would be access, and Kebschull answered there would be access through the gates. She also said this would be only a short-term solution. Glick asked if this item had been approved by the Airport Commission and Kebschull answered yes. Amen asked what criteria they should use to make a decision. Since there is no information in the code, Kebschull said, they should use the information provided them. Amen asked if they should consider the cost to the City and Kebschull said Councilman Bookey had advised the Commission the Council would decide how to fund it. Barrett stated he completely disagreed with the ordinance for two reasons. First, he said, "there are no boogey men" on the Borough Assembly. Second, it would be a "degradation of City services" because staff would be spending too much time on it rather than other things. Amen asked why the Commission became involved in the issue and Kebschull said any issue affecting Title 14 always goes before the Planning & Zoning Commission. Barrett said it was his understanding that during the last two years the City would have been involved in making 64 decisions if the City had been administering the ordinance. Further, he said, if the City can't make the rules more lenient (because of the Borough ordinance), then why bother. Hammelman said the City was better off to have the Borough handle it. He said there was nothing wrong with the way it was being handled currently, and the ordinance was being proposed for the wrong reasons. Ham_~e~~ said he thought people might have forgotten why the Borough implemented the ordinance originally and that was to promote responsible development along the Kenai River, not to stop development. Also, he stated, it wasn't fair for Kenai citizens to have to pay for a service that's already being provided. Discussion and Set Public Hearing -- Amendment to KMC 14.20.245 -- Recreational Vehicles. Kebschull explained some people were taking advantage of a "loop hole" in the code allowing RV's to be parked and used in the City for 30 consecutive days. She said the City's intent for long-term use was to allow for company/relatives staying with an RV for up to 30 days, but some people are now parking them on empty residential lots. Kebschull said she spoke with the City Attorney and they drafted language for the code that would prevent this. The new wording would include that a property must have a principal permitted structure on it. The Commission agreed to put the recommended change on the agenda for public hearing on July 14th. Opening would probably be two or three weeks later; · She would provide a report on building permits for the next packet. Eldridge commented he had driven by Kenai Landing recently and there was no launch ramp. Kebschull stated that it is believed construction had been delayed and the area will be screened to protect the public. ITEM 11: PERSONS PRF~ENT NOT SCHEDULE-- Phil North, 3810 Wtldrose Avenue, Kenai -- North stated he agreed with the Commission's decision not to pass the river protection resolution, but he wanted to comment on it anyway. He said one reason for the Kenai River Center being built was to put all the permitting functions in one building to make it easier for the public, and it also turned out to be good for the departments involved. The Corps of Engineers also had plans to move into that building, pending funds, he stated. North said he thought moving those functions from the River Center would degrade the way the system worked. Also, North said, his wife used to work for the City at the Library, so he was somewhat familiar with issues of staffing shortages. He said the City shouldn't be adding services while cutting staff. When asked, North said he works for the EPA, but he was speaking as a resident of Kenai. ITEM 12: INFORMATION ITEMS-- None. Limnology Study- Temperature and salinity profiles were conducted to characterize the physical dynamics of the Kenai River estuary in conjunction with the baseline fish assessment completed March 2004. Bird Survey- Monthly bird surveys were completed in May 2004. Fish Study- Spring and winter fish studies have been completed by ADF&G. The ADF&G report, which presents the findings of the studies, was completed March 2004. Topographical/hydrographical surveys- Survey cross-sections have been completed. This data was used in the development of the hydraulic model of the lower Kenai River. Hydraulic Study- Modeling of river conditions with and without-bank stabilization has been completed. Results of the modeling indicate that minimal changes to the river's flow patterns wouldoccur under a stabilized bank condition. Riverbed sediment samples- Sediment samples were collected in May 2003 along the main fiver channel and bank areas. Results of the hydraulic model study will be used in conjunction with the riverbed samples to determine what, if any, changes to the fiver channel would occur under a stabilized bank condition. Sedimentation Study- A draft sedimentation study report by the Corps' Engineering Research and Development Center (formerly the Waterways Experiment Station) was presented to the Alaska District May 2004 for review. Review comments were submitted to ERDC June 21, 2004 with a requested turn-around date of July 7, 2004. This completion needs to be confirmed with ERDC. Geotechnical Study- Geotechnical fieldwork to determine groundwater flow rates has been completed. The piping of groundwater out of the face of the bluff is considered to be a major factor in bluff erosion process. Slope stability analysis of the bluff has been completed. Additional geotechnical work has been completed to verify previous data findings. The geotechnical report is to be completed by mid-July. Technical Report- An outline of the technical report has been prepared. The report will consist of a main report section and appendices. The main report will summarize the study and. appendices and will serve to tie the technical elements (environmental, geotechnical, hydraulics, and sedimentation) together. The main report will present study conclusions (does bluff stabilization adversely affect the dunes and environment?) and recommendations, such as remaining work to fully analyze and design a bank stabilization project. Study Schedule- All fieldwork has been completed. A draft of the sedimentation analysis report has been completed. Delay in receipt of this report has caused additional delays in preparing the environmental and hydraulic reports. The main report and appendices are scheduled for completion August 2004. The study team, including the city of Kenai, will review the draft prior to it being finalized. It is uncertain if, or to what extent the report will undergo an agency (ADF&G, USFWS, EPA, etc) review. The concern is that an agency review may result in inordinate delays or recommendations for additional studies beyond the scope of this study. The report is scheduled for completion September 2004. By TATABOLINE BRANT Anchorage Daily News (Published: June 28, 2004) Drivers who get caught breaking traffic laws outside city limits come Thursday can expect to pay double, and in some cases quadruple, what they do now for the violations. The Alaska Department of Public Safety announced last week it is increasing the fines for 230 traffic and vehicle offenses. The increases are the first major overhaul to the state's traffic fines in almost 20 years. The revision will bring the Alaska State Troopers more in line with other jurisdictions, such as Anchorage. Drivers caught with an open container of alcohol in their vehicle today, for example, would get a $300 ticket from Anchorage police but only a $50 ticket from troopers. Under the new fine schedule, the trooper ticket would cost $200. "We've tried to stiffen the fines for the infractions that create the greatest risk to the motoring public," Public Safety Commissioner Bill Tandeske wrote Friday. "These increases are not motivated by desire for revenue; rather, by our sincere desire to make the roads of Alaska a safer place for everyone." Sgt. Joe IVlasten, of the Anchorage Police Department Traffic Unit, estimated trooper fines were on average 75 percent lower than APD's. He was glad to hear they are going up. When it comes to modifying driver behavior, he said, "money is the big factor in many people's eyes." Troopers Capt. Al Storey said the department has considered increasing the fines for several years. The last large-scale revision was in 1985, he said. A string of wrecks last summer on the Seward Highway hastened the effort, Storey said. During one bloody week in August, six people were killed and seven others were sent to hospitals in a pair of accidents in the Turnagain Pass area. A number of nonfatal wrecks followed those in the same stretch of the highway. Speeding or improper passing often contributed to the accidents, according to trooper reports from the time. For violations of up to 19 mph over the speed limit, the fine has been raised from $4 per mph to $8. So someone cited for driving 50 mph in a 35 mph zone would face a fine of $120 instead of $60, according to troopers. Drivers caught going 20 mph or more over the speed limit would face a $12 fee for each mph in violation. Penalties would continue to be more expensive in school and construction zones. Fines for passing violations also will increase. Passing in a no-passing zone, failure to yield to an overtaking vehicle and failure to yield to oncoming traffic while passing will each be bumped from $50 to $~50. The fine for following too closely jumps from $50 to $100. And improper use of the center lane on a three-lane highway climbs to $75 from $30. Troopers do not know how much additional revenue the increased fines will generate annually. Storey said the goal is not to make more money but to make the roads safer. The purpose of this letter is to explain the impacts these earmarks have on the FY'04 Statewide Transportation Improvement Program (STIP), and to let you know the projects in Central Region that have been placed on hold as a result of them. Congress created a new and unique category of earmarks known as "Section 115" as part of the appropriation process in FY'04. Section 115 includes $61.1 million for projects throughout Alaska. Unlike preVious earmarks, this specific category does not add to but in fact is deductive from the State's normal share of federal-aid funding. Consequently, we must identify $61.1 million in projects currently programmed in the FY'04 STIP that can be put on hold and possibly delayed to offset these Section 115 earmarks. While it appears that this consequence was unintended by the earmark appropriators in Congress and the recipients making such earmark requests, the impact to the FY'04 STIP is unavoidable. The Department has determined that the only fair mechanism for offsetting these earmarks is to identify FY'04 STIP projects to place on hold within the same community or region that gets an earmark. The enclosed table shows the project funding that has been placed on hold for Central Region projects. The State has been working with the Congressional delegation to correct this earmark problem. How soon, and whether the fix can be achieved remains very uncertain, so we must take this action now. If the problem is resolved and funding restored, we will continue to move forward with projects in FY'04 as currently programmed in the STIP. If the funding is not restored, the projects we've placed on hold will have to be moved to FY'05 or later. "Providing lbr the movement of people and goods and the delivery of state services." In his remarks he prmsed the community health care system saying, "We recognize in our society, that 3eople can't afford health care, and they need access to health care. And it's a practical way to do so." Cottonwood Health Center, a local community health center, opened in January, 2002, in response to a need to help the Central ?eninsula's low income and vulnerable populations gain access to medical care. Governing the affairs of the center is Central Peninsula Health Centers, Inc., a local, non-prof~t board of directors. The Center's fees are based on family size and income. From one medical p ovmer working in less than 2,000 sq. ft. at the time of opening, Cottonwood has added 2,000 sq. ft. and 3 more providers (now 2 family practice physicians, a physician assistant, and a family nurse practitioner) to meet the growing demand. Yet space is still cramped and planning is in progress for the future construction of a new facility in Soldotna. Cottonwood recently began opening on Saturdays and has .initiated new behavioral health~ consultation services. W~e targeting low income people, the services of the clinic are open to anyone who has primary medical needs. Cottonwood fries private insurance, Medicaid, and Medicare claims for its patients. In a recent telephone survey completed by the Hospital Service Area Board, findings showed that over 25% of the area's population did not have a primary care provider and that there is a high incidence of chromc medical conditions. Executive Director Stan Steadman said, "We regularly see people who have not been to a primary care provider for a long time. Often, these folks have acute, multiple medical needs. It's a good feeling that the we have a quality medical team under the leadership of Dr. Mar~erite McIntosh who are ready to serve these people at a price geared to their re sources. In addition to Cottonwood, Central Pemnsula Health Centers operates Aspen Dental Center in Kenai. Services at the dental center are limited to youth, pregnant women, and adults in pain because of the great demand. This time, the focus will be related to adults, or as we say in the booklet, 'the later years'. The format will be the same- simple and easy to use and will be useful for parents, employers, teachers, support workers and other community members who are living/ working with people affected by fetal alcohol spectrum disorders. We are asking for your help. Please send us strategies that you have found to work with teens or adults (in any area) to be included. Don't feel overwhelmed by the idea of this, even one or two ideas that you could share would be very helpful in this project. We are also looking for any comments/suggestions/helpful hints about the booklet itself-if you've seen or worked with the booklet, let us know what you think.
