fi-a. PZ07-25 - A Resolution of the Planning And Zoning Commission of the
City Of Kenai, Alaska, recommending to the Council to enact KMC
9.10.015 requiring durnpsters to be screened on at least three sides.

Kebschull reviewed the resolution included in the packet, listed the work session dates
and notes from those sessions, and gave the Commission the options they could
choose from regarding their actions an the resolution.
Twait opened the meeting to public hearing.
Phil Nash, 110 South Willow, Kenai -- Spoke in apposition. to the resolution and
submitted photographs to the Deputy City Clerk to share with the Commission.
John Mellish, 412 Frontage Road, Kenai -- Spoke in opposition to the resolution,
noting it would be difficult to maneuver trucks to empty the dumpsters and his
building, being older, had no extra space for a screened dumpster or snow removal.
Pat Porter, 310 Rogers Road, Kenai -- Spoke in support of the resolution, noting she
understood there may be older buildings needing variances.
There being no further comments, the meeting was closed to public hearing.

ANALYSIS
This plat is a resubdivision of two lots creating, Tract i A consisting of approximately
76.797 acres and Tract B containing approximately 4.645 acres. Klamath Avenue is an
undeveloped right-of way and does not provide access to any parcels. Eliminating the
right-of--way will not affect any other parcels. The new Tract 1A will be accessed via
Swires Road. Tract B is accessed via the Kenai Spur Highway. The parcels are zoned
Suburban Residential, Rural Residential and General Commercial. The new Tract 1 A
will require a rezone to eliminate a split zone. Tract B incorporates the area currently
zoned General Commercial. The resulting lots meet the minimum lot size for the zones.
City water and sewer are available off of Swires Road. Water is also available within the
Public Use Easement that is being retained. No installation agreement is required.
Plat needs to reflect the correct street name of Swires Road. Property owner will be
required to rezone Tract 1A.
City Engineer: The vacation of Klamath Avenue will eliminate an undeveloped right-of-
way.

Recommend approval with the following recommendations:
1. Correct spelling of street name of Swires Road.

ANALYSIS
General information:
On behalf of Lowes, HIW, Inc., Lounsbury & Associates has applied for a
variance far an off~premise sign. The sign will be located on Airport Way on
property owned by t_owe's to provide access to the proposed store located on
the adjoining lot. The property is located in the General Commercial zone.
This sign will require a variance from KMC 14.20.220 {c)(3)(N):
"No off-premises commercial advertising signs, including billboards,
except as allowed under subsection {c)(1)(G) of this section, ar at an
outdoor sporting event, sports facility or sports field."
The proposed Airport Way sign measures less than 120 square feet and meets
all other requirements of the sign code.
KMC 14.20.220 (a){9) states, "Relief from the provisions of this section may be
provided by a variance as prescribed under KMC 14.20.180."
KMC 14.20.180 details the intent and application process for Variance Permits.
The Code also outlines the review criteria that should be used by the Planning

and Zoning Commission to determine if a variance should be granted. The
Commission shall establish a finding that ail of the following conditions exist as a
prerequisite to issuance of a variance permit:
1. Special conditions or circumstances are present which are peculiar
to the land or structures involved which are not applicable to other
lands or structures in the same zoning district. The Airporf Way
property will provide a second access to the adjoining parcel where
the proposed store will be located. Lowes owns both lots.
2. The special conditions or circumstances have not been caused by
actions of the applicant and such conditions and circumstances do
not merely constitute a pecuniary hardship or inconvenience,
There is no special condition or hardship. Lowe's is seeking fo
provide signage fo identify access to the store. Removing the lot
line would eliminate the off-premise sign; however, a variance
would be required for a second freestanding sign.
3. The granting of the variance shall not authorize a use that is not a
permitted principal use in the zoning district in which the property is
located. Granting this variance would not provide for a use that is
not permifted in the zone.
4. The granting of a variance shall be the minimum variance that will
provide for the reasonable use of the land andlor structure. This
development fronts two main streets, Airport Way and Marathon
Road. The proposed signage appears reasonable.
5. The .granting of a variance shall not be based upon other non-
conforming land uses or structures within the same land use or
zoning district. The variance is not based on other non-conforming
Land uses or sfructures in the zoning district.
City Engineer: As Lowe's owns bath parcels, if the property was platted as one a
variance would not be needed for an off-premise sign. But, a variance would be
required for an additional freestanding sign.
Buildin Official: No building code issues.
RECOMMENDATIONS
Lowe's HIW, Inc. is planning to build their store on the lot adjoining this parcel,
Lot 1 B-4, Baran Park Subdivision Lowe's Access. Lowe's intends to provide
additional access to the store from this lot on Airport Way along with access off
Marathon Road. The store will be located on the adjacent parcel and the sign
code allows for one freestanding sign per premise. KMC 14.20.220 (c)(3)(N)
does not allow off-premise signs. The applicant is requesting a variance from
this requirement to identify access to the proposed store. This development
fronts twa major streets, Airport Way and Marathon Raad. The proposed
signage appears reasonable and will meet the needs of the store. Recommend
approval.

ANALYSIS
General Information:
This is an application to rezone Tract C, Central View Subdivision. The property is
currently zoned Suburban Residential, Rural Residential, and Conservation. The
request is to rezone the property to Rural Residential. This rezone will eliminate the
split zone,
KMC 14.20.270 describes amendment procedures. Section 2 states, "Amendments
to the Official Zoning Map shall be considered only if the area to be rezoned contains
a minimum of one (1) acre (excluding street or alley rights-of--way) unless the
amendment enlarges an adjacent district boundary." The rezone is larger than an
acre and enlarges an adjacent district boundary.
The parcel is approximately 5.98 acres and privately owned. This property does not
have access to City water and sewer. As noted above, the property has three zoning
designations.
The Suburban Residential zone is "intended to provide for medium density residential
development in areas which will be provided with common utility systems." Generally
these lots are smaller and are served by water and sewer.
The Conservation zone is "intended to apply to areas which should be preserved

primarily as open areas and as watersheds and wildlife reserves." "It is intended that
this zone shall apply mainly to publicly owned land."
The Rural Residential zone is "intended to provide for low density residential
development in outlying and rural areas in a form which creates.. a stable and
attractive residential environment." These lots are generally larger with on-site water
and sewer.
The parcel is designated as Conservation in the 2003 Comprehensive Plan. The
Plan defines the Conservation classification as, "The Conservation district applies to
public lands whose primary use is open space, recreation, fish and wildlife habitat,
drainage ways, floodplain, and wetlands. Same public improvements may be
appropriate within appropriate design guidelines." The Plan defines Rural Residential
as, "The Rural Residential district includes areas that, due to location or site
conditions, are best suited far large-lot single-family residential development. Homes
in this district typically rely on individual on-site water supply and wastewater disposal
systems."

RESTRICTING THE USE OR STORAGE OF CONEX-TYPE STRUCTURES IN THE
CENTRAL COMMERCIAL AND RESIDENTIAL ZONE5 AND 2) REQUIRING
ACCESSORY STRUCTURES BE BUILT TO MATCH THE PRIMARY BUILDING ON THE
LOT AND 3) PROVIDING FOR TEMPORARY USE OF CONEX-TYPE STRUCTURES
DURING CONSTRUCTION PROJECTS AND INCORPORATING THE EXISTING
REQUIREMENT THAT ACCESSORY STRUCTURES OVER 120-SQUARE FEET
REQUIRE A BUILDING PERMIT.
WHEREAS, KMC 14.20.200 (Accessory Structures) sets out the rules for accessory structures in
the Kenai Zoning Code; and,
WHEREAS, storage or use of conex-type structures for permanent storage in residential zones
can cause unsightly conditions leading to reduced property values; and,
WHEREAS, storage sheds not built to match the primary structure can cause also unsightly
conditions leading to reduced property values; and
WHEREAS, it is in the best interest of the City of Kenai to restrict the use of conex-type
structures for storage in the Central Commercial and residential zones, and
WHEREAS, a limited exemption should be allowed to provide for temporary storage during
construction.
NOW, THEREFORE, THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI RECOMMENDS THE COUNCIL OF THE CITY OF KENAI, ALASKA AMEND
KMC 14.20.200 by 1) adding subsection (a){7) incorporating the existing requirement that
accessory structures over 120-square feet require a building permit and 2) adding subsection {b)
as follows.

(7) Accessory structures over 120-square feet require a building permit as set forth in the
building code incorporated by reference in KMC 4.32.
2.
(b) Storage or use of conex-type structures or storage sheds requiring a building permit in the
Central Commercial and residential zones is restricted as follows:
(I) Under this section "residential zone" means one of the following zones: Rural Residential
Zones, Suburban Residential Zones, Urban Residential Zane, ar Townsite Historic Zone.
(2) Conex-type structures ar storage sheds must be built to the following standards:
(a) Shall have all wheeled assemblies removed, be placed on non-rot susceptible
blocking or foundation, be roofed and sided or painted to match the primary
building on the lot;
(b} Shall be roofed and sided or painted within two years of the issuance of a building
permit.
(3) Conex-type structures maybe used in the Central Commercial and residential zones For
temporary storage during construction projects. A permit is required for this temporary
use and is obtained as part of a building permit. A temporary conex permit is valid for 90
days with renewal necessary for an additional time period as allowed within the
discretion of the Building Official.

Kebschull reviewed the staff report included in, the packet, noting connex structures
and sheds would be covered by the same codes, and the resolution allowed for
temporary storage using connexes.

Ross -Noted agenda from our last meeting
Ordinance 2287-2008 which was #3 under our public hearings was one that you forwarded to us.
There was no public testimony on it. The Council's determination was to continue it for a
second public hearing. We did have a discussion that the press did report its means of trying to
generate some interests in getting folks out to this, Because if we pass this ordinance in this
current form, that's going to be quite a change in how people have done sheds. The ability to go
to Fred Meyer or Home Depot and buy a shed or buy one from the high schoolers built becomes
very limited for folks if they have to design sheds that conform to the roof design of the design
of the home. And so we wanted to generate some interests on that to see if we could get some
public testimony.
The other ordinance that came forward was a result of your action on the landscaping site plan.
The Council did delete the requirement as it applies to residential lots. Left the rest of the
ordinance and passed it as your forwarded it.
You'll note on the agenda there were 4 public hearings on confirming of assessment rolls for
paving districts. I approached that meeting with some thought that it was going to be a long
meeting. They all passed unanimously there was no public that testified either for or against
these paving districts and the assessment rolls that affect their properties. So the folks must have
been satisfied with the numbers and wanted the projects.

ordinance because I attended that meeting because I know that you I was hexe that during the
many meetings where you had so many different proposals on the table and the comments that I
heard were I guess were disappointing because some of the things that you had talked about

weren't really an the table as far as I was concerned, and I thought had hoped that they would do
a work session with you or something because the ones about putting the a conexes. I felt like
they ready to vote it down as is, and the other issue of course was about the accessory structures
as Councilmember Ross said, but as far as the conexes go I was disappointed because I think that
there's some good there where some good things that came out of those hearings you had
especially about keeping them limited to say the back yard or and making sure the setbacks were
were greater or that um the same as regular buildings and they couldn't just a get those
exceptions to the side yard setbacks and I'm not sure that's gonna come out in a Council meeting
so I guess those were things that I think even if you don't care about whether the conexes are the
same exterior of the house are issues that need to be addressed with these conexes because
despite the fact that people same people seem to like them and want to put them in their yard
they are ugly and especially since they don't have windows and people don't try to make them
attractive like sheds and I don't think they have any place in a front yard or side yard I think they
should be limited to a back yard. But I'm not sure that's gonna come up in a City Council
meeting so I guess my point is that no matter how much work you do at these work sessions
anything can happen at the City Council level and it's a little disappointing when you have gone
through the pxocess and tried to make suggestions and then it's all opened to be changed at will.
I just wish there was someway the City Council could address their concerns with yous, so they
aren't reinventing the wheel and you can talk to them about some of the things that you had in
mind other than the thing that finally came out in the final package that you put together. So, I
just wish there was more of a dialog between the Commission and the Council on that one.

Twait -Councilman Ross can you enlighten use?
Ross - I would encourage any of you who wish to attend the next Council meeting there will be
another public hearing on it. Uh, I don hear a whole lot of concern and we didn't go into it on
conexes everybody agrees the canex issue needs to be addressed. I think there was some
sentiment there in generating the publicity to let people know this applies to the sheds. And the
sheds that you go down and buy at the high school the barn shaped shed is probably going to be
prohibited under this ordinance. Uh, and that's something folks should know. Is that under this
ordinance if it passes in it's current form as it applies to sheds must be constructed to the same
xoof line as the house, and looks like the house. It's going to preclude a lot of the manufactured
sheds that people buy in the area. But I think the main interests at the meeting was trying to
generate the information and I think the press covered it to get some public in sa that when we

suggestions included preparing Public Service Announcements to be played prior to
the dip net fishing season; placing a link on the city webpage to the video; providing a
brochure to the local hotels, Visitors Center, Library and cable TV; and placement of a
sign at Kenai beach entrances. Council stated no objections to the link on the city's
webpage to the video. It was also suggested Wensley bring brochure costs back to
council to consider for providing financial assistance.

• The Plannixg & Zoning Commission requested the ordinance be returned
for further review as there were questions of items included in the ordinance which
were not discussed during their review and deliberations.
• Federal agencies should comply with rnaunicipal code requirements as
well.
• Shed size/style should be regulated by subdivision covenants.
+ Suggestion the ordinance be pointed at use of cortex-type storage and not
sheds because the two get confused.
• If the intention is to phase out use of conex--type storage, aphase-
in/phase-out period should be considered.
• Suggestion no permits for conex-type storage be issued until after final
consideration of the ordinance. (It was noted, an ordinance would be required to
impose a moratorium.)

are ~iilled as material is delivered, sometimes taking 6 months to a year to equip before shipping
out to remote sites, rat other times taking; two,to.thrce weeks. It would be impossible to lteep these
connexes roofed..
