RESOLUTION NO. 2018-15
A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, CONSENTING TO
VACATION OF CERTAIN UTILITY EASEMENTS WITHIN THE PROPOSED RADAR
SUBDIVISION 2017 REPLAT.
WHEREAS, on December 13, 2017, by Resolution No . PZ2017-36 , the Planning and Zoning
Commission of the City of Kenai recommended that the Kenai Peninsula Borough Planning
Commission approve RADAR SUBDIVISION 2017 REPLAT with vacation of certain Utility
Easements; and,
WHEREAS, on January 8, 2018, the Kenai Peninsula Borough Planning Commission met and
approved the Preliminary Plat and Utility Easement Vacation consistent with the recommendation
of the Planning and Zoning Commission for the City of Kenai; and ,
WHEREAS , pursuant to Kenai Municipal Code Section 22.05.110(b)-Determination as to Need
for Public Use. Vacation of rights-of-way or easements which may be determined by resolution,
which shall contain the new public use for which the property is to be dedicated or the reason the
land is no longer needed for public use; and,
WHEREAS , ACS, GCI , ENSTAR Natural Gas and Homer Electric Association have submitted
statements to the Kenai Peninsula Borough which offer no objection to the removal of these Utility
Easements; and,
WHEREAS, the Utility Easements listed below are no longer needed for a public use as there is
an existing ten foot (10') Utility Easement located along the perimeter of the proposed Lot One-
A, Block Four, RADAR SUBDIVISION 2017 REPLAT.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA:
Section 1. That following Utility Easements, within the RADAR SUBDIVISION 2017 RE PLAT,
within the City of Kenai are no longer needed for a public use and that the Council of the City of
Kenai consents to these vacations :
a) Vacate a ten foot (1 O') wide Utility Easement along the Westerly boundary of Lots
One through (1-4), Block Four (4); Radar Subdivision , Plat No. K-706 , and
b) Vacate a ten foot (10') wide Utility Easement along the Easterly boundary of Lot
Five (5), Block Four (4), Radar Subdivision , Plat No . K-706
Section 2. That this resolution takes effect immediately upon adoption .

Resolution 2018-15-Consenting to the Vacation of Certain Utility
Easements within the proposed Radar Subdivision 2017 Replat
This memorandum introduces Resolutions 2018-15: Vacation of Certain Utility Easements within
the proposed Radar Subdivision 2017 Replat. On December 13, 2017, the City of Kenai Planning
& Zoning Commission passed Resolution PZ2017-36, recommending approval of the preliminary
plat of Radar Subdivision 2017 Replat.
This plat reconfigures Lots One through Five (1 -5), Block Four (4), Radar Subdivision,
according to Plat No. K-706, into a larger parcel to be described as Lot One A (1A), Block Four
( 4 ), Radar Subdivision 2017 Replat. The resulting parcel would be approximately 1.432 acres
and would meet the minimum lot size for the Heavy Industrial zone. Access to the reconfigured
Lot One A ( 1 A), Block Four ( 4 ), Radar Subdivision 2017 Replat is provided by the Kenai Spur
Highway which is a paved State maintained road .
The proposed plat shows a right-of-way for Ninilchik Drive; however, this is an unimproved right-
of-way and cannot be used for access to the lot until it is developed to City of Kenai road
standards .
Connections to the City Water and Sewer services are not available to this parcel. The applicant's
construction drawings indicate that the applicant intends to drill a well and install a private DEC
approved septic system . An installation agreement is not required .
The applicant has requested to vacate a ten foot (10') utility easement along the Westerly
boundary of Lots One through Four (1 -4), Block Four (4), and along the Easterly boundary of
Lot Five (5), Block Four (4), Radar Subdivision . A ten foot (10 ') utility will be dedicated along the
perimeter of Lot One A ( 1 A), Block Four ( 4 ), Radar Subdivision 2017 Re plat. The utility
companies: namely, ACS, GCI, Enstar Natural Gas and Homer Electric Associat ion have
submitted statements to the Kenai Pen insula Borough, which offer no objection to the removal
of the Utility Easements.
