Seven designs were presented to the Commission. Commissioners expressed support in the
Kenai Airport logo on the signs and focus on local aircrafts. There was discussion regarding the
pros and cons of all the colors; concern expressed regarding potential color fading.
Commissioners requested more accurate representation on the signs and have something
prepared for further discussion at the next Commission meeting.
6. NEW BUSINESS
a. Action/Approval – Special Use Permit to State of Alaska, Division of Forestry for
Aircraft Loading and Parking
It was clarified that this item was regarding the annual renewal of the Special Use Permit for
operation at the Kenai Airport.
MOTION:
Commissioner Bielefeld MOVED to approve the Special Use Permit to the State of Alaska,
Division of Forestry and Commissioner Pitts SECONDED. There were no objections, SO
ORDERED.
b. Action/Approval – Alaska Realty Group, LLC – Assignment of Lease to Mossy Oak
Properties
MOTION:
Commissioner Bielefeld MOVED to approve assignment of lease to Mossy Oak Properties, and
Commissioner Dodge SECONDED. There were no objections, SO ORDERED.
c. Action/Approval – Recommending Approval to Lease Amendment Extending the
Timeframe for Legacy Electric LLC, Lessee, to Complete Improvements as Set Forth
in the Original Lease of Airport Reserve Lands for Property Located at 115 FBO Road,
Kenai, Alaska 99611; Further Described as Lot 2, Block 1, General Aviation Apron
MOTION:
It was MOVED and SECONDED to approve first amendment to Legacy Electric for lease of airport
reserve lands. There were no objections, SO ORDERED.
7. REPORTS
a. Airport Manager – Bondurant reported the following:
• Continuing to advertise available City property in the Petroleum News;
• She attended the Alaska Public Employee Insurance Manager Training on April
2;
• On April 13 at the Airport there would be the launch party for the Read on the Fly
Program;
• The post winter snow and ice control meeting was scheduled for April 18;
• On April 23-25 the annual FAA Certification inspection would be conducted;

• Assistant E. Shinn scheduled to attend the Great Alaska Aviation Gathering on
May 4-6;
• The Runway Safety Action Team Meeting scheduled for May 22;
• She would be attending the Bi-Annual Alaska Region Division Workshop on June
6-7;
• The Annual Kenai Peninsula Air Fair scheduled for June 9-18;
• She met with the new City Planner, Elizabeth Appleby on April 12 and provided
her a tour; and
• She reminded members about the Volunteer Appreciation Dinner on April 19.
b. City Council Liaison – Council Member Navarre had nothing to report but offered to
take the sign design for immediate Council approval, if interested.

Commissioner Minelga requested Council Member Navarre to continue thinking about the need
of rehabilitation of Willow Street, past the Airport, to Marathon Road.

Empire Airlines, Inc. -Special Use Permit
The Empires Airlines, Inc., is requesting renewal of the special use permit for aircraft parking on
approximately 11 ,2 50 square feet on the commercial apron. The special use permit will be
effective for one year from Jul y 1, 2018 to June 30, 2019 .
The rate is based on the table below passed by City Council at the May 18 , 2016 Council
meeting.

SPECIAL USE PERMIT
The CITY OF KENAI (City) grants to EMPIRE AIRLINES , INC . (Permittee), whose
address is 11559 N . Atlas Road, Hayden, ID 83835, a Special Use Permit for the purpose
of aircraft parking at the Kenai Municipal Airport subject to the requirements and the
conditions set forth below.
1. Premises. Permittee shall have the non-exclusive right to use 11 ,250 square feet as
described in the attached Exhibit A for the uses identified in this Permit.
2. Term. The term of this Permit shall be for I year commencing on July 1, 2017 and
ending on June 30, 2018 . Regardless of the date of signature, this Permit shall be effective as
of July 1, 2017.
3. Permit Fees. Permittee shall pay the following fees for the privileges extended to
Permittee under this Permit:
A. Permit: Permittee shall pay a monthly fee of $655.31 plus applicable sales tax .
B. Proximity Card for Gate Access: In addition to the general permit fee ,
Permittee shall pay a deposit of one hundred dollars ($100 .00) for the use of each
proximity card issued to Permittee by City to allow for gate access to the Airport to
conduct the uses permitted hereunder. City shall refund this deposit to Permittee
when the card is returned to City. City may exercise a right of offset to apply the
deposit to any outstanding balance due to City from Permittee at the termination of
this Permit.
C. Other Fees: City may assess additional fees for aviation or aviation support
activities and uses not defined in this Permit. If a fee has not been established for
those activities or services, a fee will be established by the Airport Manager.
Payment shall be directed to City of Kenai, ATTN: Finance Department, 210 Fidalgo
A venue, Kenai , AK 99611 and a courtesy notice of payment provided to Airport
Administration at 305 North Willow Street, Suite 200, Kenai, AK 99611. All permit fees
are payable in advance of each month unless otherwise provided. In the event of
delinquency, interest at the rate often percent (10%) per annum, and penalty often percent
(10%) shall also be due (KMC 1.75.010). Interest shall accrue from the date due until the
date paid in full. Failure to timely make payments is grounds for termination of this Permit.

4. Use. City authorizes Permittee's non-exclusive use of the Premises for the
following purpose(s):
Aircraft Parking. NOTE: This permit does not guarantee the exclusive use of the area
identified in Exhibit A. City reserves the right to re -assign Permittee, upon reasonable
notice. to other areas as airport needs may require.
Permittee shall have the right of ingress and egress to the Airport using only designated
gate access locations (which may require a proximity card) for the use of the Premises.
This Permit, and any access rights allowed hereunder, are for Permittee's use only and may
not be transferred or assigned.
Use of the Premises by Permittee is subject to the reasonable administrative actions of the
City of Kenai for the protection and maintenance of the Premises and of adjacent and
contiguous lands or facilities and is further subject to the following conditions:
Permittee acknowledges that the use granted herein is subject to the Kenai Municipal Code
and municipal regulations governing the Kenai Municipal Airport and as those laws and
regulations may be amended from time to time.
Solicitation of donations or operation of a business or other commercial enterprise not
contemplated by this Permit is prohibited without the written consent of City.
No person may repair an aircraft, aircraft engine, propeller, or apparatus in an area of the
Airport other than that specifically designated for that purpose by the Airport Manager or
designated representative. The Airport Manager or designated representative reserves the
right to designate reasonable areas where aircraft owners may perform services on their
own aircraft.
5. Airport Operations. Permittee shall ensure that the Permittee, its employees, and
guests, and anyone else acting by, on behalf of, or under the authority of Permittee on the
Airport, that perform any repairs or activities authorized under this Permit act in a manner
that ensures the safety of people and the Airport, the protection of public health and the
environment, and the safety and integrity of the Airport and any premises on the Airport.
Permittee shall employ qualified personnel and maintain equipment sufficient for the
purposes of this provision . The Permittee shall immediately notify City of any condition,
problem, malfunction, or other occurrence that threatens the safety of the Airport , the safety
of persons using the Airport, the public health or the environment, or the safety or integrity
of any premises on the Airport.

6. Inspection. The Federal Aviation Administration (FAA) and/or City shall have the
right and authority to inspect, at any time for any purpose whatsoever, the Premises as well
as any and all equipment used by the Permittee under this Permit.
7. Coordination with Airport Management. Permittee shall coordinate all activities
on the Airport with Airport Management, or a designated representative, and shall abide
by all reasonable decisions and directives of the Airport Management regarding general
use of the Airport by Permittee.
8. Radio Transmitting Equipment. Permittee shall discontinue the use of any
machine or device which interferes with any government-operated transmitter, receiver, or
navigation aid until the cause of the interference is eliminated.
9. Insurance. Permittee shall secure and keep in force adequate insurance, as stated
below, to protect City and Permittee. Where specific limits are stated, the limits are the
minimum acceptable limits. If Permittee's insurance policy contains higher limits , City is
entitled to coverage to the extent of the higher limits.
A. Commercial General Liability insurance, including premises, all operations,
property damage , personal injury and death, broad-form contractual, with a per-
occurrence limit of not less than $1 ,000,000 combined single limit. The policy must
include an endorsement under which the insurer extends coverage to Permittee's fuel
handling activities. The policy must name the City as an additional insured.
B. Worker's compensation insurance with coverage for all employees engaged in
work under this Permit or at the Premises as required by AS 23.30.045. Permittee is
further responsible to provide worker's compensation insurance for any
subcontractor who directly or indirectly provides services to Permittee under this
Permit.
C . Commercial Automobile Coverage with not less than $1,000,000 combined
single limit per occurrence. This insurance must cover all owned, hired , and non-
owned motor vehicles the Permittee uses on the Airport. The policy must name the
City as an additional insured.
D. All insurance required must meet the following additional requirements:
I. All policies will be by a company/corporation currently rated "A-" or
better by A.M. Best.
11. Permittee shall submit to the City proof of continuous insurance
coverage in the form of insurance policies, certificates, endorsements ,

or a combination thereof, and signed by a person authorized by the
insurer to bind coverage on its behalf.
m. Permittee shall request a waiver of subrogation against City from
Permittee 's insurer and the waiver of subrogation, where possible ,
shall be provided at no cost to City.
iv. Provide the City with notification at least thirty (30) days before any
termination , cancellation, or material change in insurance coverage of
any policy required hereunder.
v. Evidence of insurance coverage must be submitted to City by July 1,
2017. The effective date of the insurance shall be no later than July
1, 2017.
City may increase the amount or revise the type of required insurance on written demand
without requiring amendments to this Permit. City will base any increase or revision on
reasonable and justifiable grounds. Within two weeks of the written demand , Permittee
shall submit to City evidence of insurance coverage that meets the requirements of the City.
10. Assumption of Risk. Permittee assumes full control and sole responsibility as
between Permittee and City for the activities of Permittee, its personnel , employees , and
persons acting on behalf of or under the authority of the Permittee anywhere on the Airport.
Permittee shall provide all proper safeguards and shall assume all risks incurred in its
activities on and access to the Kenai Municipal Airport and its exercise of the privileges
granted in this Permit.
11. Indemnity, Defend, and Hold Harmless Agreement. Permittee agrees to fully
indemnify, defend, and hold harmless , the City of Kenai, its officers, agents , employees ,
and volunteers from and against all actions , damages, costs , liability , claims , losses ,
judgments, penalties, and expenses of every type and description, including any fees and/or
costs reasonably incurred by the City 's staff attorneys and outside attorneys and any fees
and expenses incurred in enforcing this provision (hereafter collectively referred to as
"Liabilities"), to which any or all of them may be subjected, to the extent such Liabilities
are caused by or result from any negligent act or omission or willful misconduct of the
Permittee in connection with or arising from or out of Permittee's activities on or use of
the Premises, Permittee 's access to the Kenai Municipal Airport, an d/or Permittee's
exercise of the privileges granted in this Permit. This shall be a continuing obligation and
shall remain in effect after termination of this Permit.

12 . Fuel Spill Prevention and Response Plan. Areas of the Apron have been seal coated
to protect asphalt from adverse effects of petroleum product spills. The City requires that
Permittee provide adequate absorbent materials and tools available on the Premises and at the
airport in order to maintain a fuel spill and response capability. Permittee shall be liable for
any damage caused by and costs associated with any spill, the cleanup of any spill, or the
discharge of petroleum products or hazardous materials due to Pennittee's use of the Apron
and/or use of the Airport.
Permittee shall provide to City an acceptable fuel spill prevention and response plan and
will maintain fuel spill and response capability. Permittee further agrees to have a copy of
the fuel spill prevention and response plan located in the Pennittee's fuel dispensing
equipment at all times. Permittee must comply with the Airport's Storm Water Pollution
Prevention Plan as appropriate to Pennittee's activities.
Permittee shall not store any personal property, solid waste, petroleum products, Hazardous
Material as defined by 14 CFR § 171.8, hazardous waste (ignitable, corrosive, reactive, or
toxic) or any hazardous substance on any portion of the Airport. Pennittee is aware that
there are significant penalties for improperly disposing of the Hazardous Materials and
other waste and for submitting false information regarding Hazardous Materials, including
the possibility of fine and imprisonment for knowing violations .
Permittee shall immediately remove the material in the event of spillage or dripping of
gasoline, oil, grease, or any other material which may be unsightly or detrimental to the
pavement or surface in or on any area of the Airport.
Permittee may not construct or install any above-ground or underground fuel storage tanks
or dispensing systems at the Airport.
No person shall smoke on an aircraft-parking ramp, inside an aircraft hangar, or within
fifty feet (50') of any aircraft fuel facility or fuel truck.
Permittee is subject to FAA Advisory Circular 150/5230-4 Aircraft Fuel Storage,
Handling, and Dispensing on Airports, the National Fire Protection Associations'
"Standard for Aircraft Fueling Servicing" in NFP A 407 ( 1996 version), and the current
version of the International Fire Codes. All inspections of fuel facilities, by City or other
regulating entities to which Perrnittee is subject, shall be conducted to assure compliance
with the fire safety practices listed in these referenced documents .
13. Hazardous Substances and Materials. Permittee shall confonn and be subject to
the requirements of 14 CFR § 139.321 regarding the handling and storage of hazardous
substances and materials.

14. No Discrimination. Permittee shall not discriminate against any person because of
the person's race, creed, color national origin, sex, age, or handicap. Pem1ittee recognizes
the right of City to take any action necessary to enforce this requirement of the Permit.
Permittee will furnish services provided under this Permit on a reasonable, and not unjustly
discriminatory, basis to all users of the Airport and shall charge reasonable, and not
unjustly discriminatory, prices for each product or service provided at the Airport.
15. Licenses and Permits. Permittee shall obtain and maintain all required federal,
state, and local licenses, certificates, and other documents required for its operations under
the Permit. Permittee shall provide proof of compliance to City upon request by the City.
16. Compliance with Law/Grant Assurances. This Permit, and Permittee 's activities
conducted under this Permit, is subject to all executive orders, policies and operational
guidelines and all applicable requirements of federal, state, and City statutes, ordinances,
and regulations in effect during the term of this Permit. Further, Permittee shall comply
with all applicable requirements imposed on the Airport by federal law to ensure that the
Airport's eligibility for federal money or for participation in federal aviation programs is
not jeopardized. This Permit is subordinate to the City 's grant assurances and federal
obligations.
17. No Exclusivity. The privileges granted under this Permit are not exclusive to
Permittee. City has the right to grant to others any right or privilege on the Airport.
18. Assignment. The privileges granted under this Permit are personal to Permittee and
may not be assigned by Permittee.
19. No Joint Venture. City shall not be construed or held to be a partner or joint
venturer of Permittee in the conduct of its business or activities on the Premises or
elsewhere at the Kenai Municipal Airport.
20. No Waiver. Failure to insist upon a strict compliance with the terms, conditions,
and requirements herein contained, or referred to , shall not constitute or be construed as a
waiver or relinquishment of the right to exercise such terms , conditions , or requirements.
21. Personalty. Permittee shall remove any and all personal property, including all
vehicles , from the Premises at the termination of this Permit (or any renewal thereof).
Personal property placed or used upon the Premises will be removed and/or impounded by
the City, if not removed upon termination of this Permit and when so removed and/or
impounded, such property may be redeemed by the owner thereof only upon the payment
to the City of the costs of removal plus storage charges of $25.00 per day. The City of
Kenai is not responsible for any damage to or theft of any personalty of Permittee or of its
customers.

22. Termination; Default. This Permit may be terminated by either party hereto by
giving thirty (30) days advance written notice to the other party. City may terminate the
Permit immediately, or upon notice shorter than thirty (30) days, to protect public health
and safety or due to a failure of Permittee to comply with condition or term of this Permit
which failure remains uncured after notice by City to Permittee providing Permittee with a
reasonable time period under the circumstances to correct the violation or breach.
23 . Landing Fees; Fee Schedule. Timely payment of landing fees and other required
Airport fees is a condition of this Permit and, as such, failure to timely pay landing and
other airport fees is grounds for termination. Without limiting the foregoing, Permittee
shall pay landing fees for aircraft landings as set out in the City's comprehensive schedule
of rates, charges and fees. Permittee shall make payment within thirty (30) days following
the end of each month and without demand or invoicing from City. Permittee shall also
provide Airport Administration with monthly certified gross take-off weight reports within
ten (10) days foJlowing the end of each month for landings for the preceding month.
Airport landing fees shall be paid at the Airport Administration Building, 305 North
Willow Street, Suite 200 , Kenai, AK 99611.
24. Impoundment. At the discretion of the Airport Manager, City may impound any
aircraft parked on the Premises after termination of this Permit. Impoundment may be
accomplished by affixing a seal to the door of the aircraft or the moving of the aircraft for
impoundment purposes. Inconvenience or damage that may result from such movement
wiJl be at the risk of Permittee. An impoundment fee plus a towage fee shall be charged
on each aircraft impounded . In addition, a daily storage fee shall be charged for each day
the aircraft remains impounded. Any impounded aircraft that is not redeemed within ninety
(90) days after impoundment shall be considered abandoned and shalJ be subject to sale at
public auction. Notice of any auction shall be published. Publication shall be in a
newspaper of general circulation in that area for at least once during each of three (3)
consecutive weeks not more than thirty (30) days nor less than seven (7) days before the
time of the auction.
25. Definitions. As used in this Permit, "Permittee" means Empire Airlines, Inc . and
where the context reasonably indicates, its officers, agents , and employees. "Airport"
means the Kenai Municipal Airport.

SPECIAL USE PERMIT -2018
The CITY OF KENAI (City) grants to CROWLEY FUELS LLC (Permittee), whose
address is 201 Arctic Slope Ave., Anchorage, AK 99518 , a Special Use Permit for the
fueling area on the apron at the Kenai Municipal Airport subject to the requirements and
the conditions set forth below.
1. Premises. Permittee shall have the non-exclusive right to use 35,000 square feet as
described in the attached Exhibit A for the uses identified in this Permit.
2. Term. The term of this Permit shall be for 1 year commencing on July 1, 2018 and
ending on June 30, 2019. Regardless of the date of signature , this Permit shall be effective as
of July 1, 2018 .
3. Permit Fees. Permittee shall pay the following fees for the privileges extended to
Permittee under this Permit:
A. Permit: Permittee shall pay a monthly fee of $2,537.50 plus applicable sales
tax.
B. Proximity Card for Gate Access: In addition to the general permit fee,
Permittee shall pay a deposit of One Hundred Dollars ($100.00) for the use of each
proximity card issued to Permittee by City to allow for gate access to the Airport to
conduct the uses permitted hereunder. City shall refund this deposit to Permittee
when the card is returned to City. City may exercise a right of offset to apply the
deposit to any outstanding balance due to City from Permittee at the termination of
this Permit.
C. Other Fees: City may assess additional fees for aviation or aviation support
activities and uses not defined in this Permit. If a fee has not been established for
those activities or services, a fee will be established by the Airport Manager.
Payment shall be directed to City of Kenai, ATTN : Finance Department, 210 Fidalgo
A venue , Kenai, AK 99611 and a courtesy notice of payment provided to Airport
Administration at 305 North Willow Street, Suite 200, Kenai , AK 99611. All permit fees
are payable in advance of each month unless otherwise provided. In the event of
delinquency, interest at the rate of I 0% per annum, and penalty of 10% shall also be due
(KMC 1.75.010). Interest shall accrue from the date due until the date paid in full. Failure
to timely make payments is grounds for termination of this Permit. (See ii 22 , Termination)
4. Use. City authorizes Permittee 's non-exclusive use of the Premises for the
following purpose(s):

Aviation Fueling on Apron Fueling Area. NOTE: This permit does not guarantee the
exclusive use of the area identified in Exhibit A. Citv reserves the right to re -assign
Permittee, upon reasonable notice. to other areas as airport needs may require.
Permittee shall have the right of ingress and egress to the Airport using only designated
gate access locations (which may require a proximity card) for the use of the Premises.
This Permit, and any access rights allowed hereunder, are for Permittee's use only and may
not be transferred or assigned.
Use of the Premises by Permittee is subject to the reasonable administrative actions of the
City of Kenai for the protection and maintenance of the Premises and of adjacent and
contiguous lands or facilities and is further subject to the following conditions:
Permittee acknowledges that the use granted herein is subject to the Kenai Municipal Code
and municipal regulations governing the Kenai Municipal Airport and as those laws and
regulations may be amended from time to time.
Solicitation of donations or operation of a business or other commercial enterprise not
contemplated by this Permit is prohibited without the written consent of City.
No person may repair an aircraft. aircraft engine, propeller, or apparatus in an area of the
Airport other than that specifically designated for that purpose by the Airport Manager or
designated representative. The Airport Manager or designated representative reserves the
right to designate reasonable areas where aircraft owners may perform services on their
own aircraft.
5. Airport Operations. Permittee shall ensure that the Permittee, its employees, and
guests , and anyone else acting by, on behalf of, or under the authority of Permittee on the
Airport, that perform any repairs or activities authorized under this Permit act in a manner
that ensures the safety of people and the Airport, the protection of public health and the
environment, and the safety and integrity of the Airport and any premises on the Airport.
Permittee shall employ qualified personnel and maintain equipment sufficient for the
purposes of this provision. The Permittee shall immediately notify City of any condition,
problem, malfunction, or other occurrence that threatens the safety of the Airport, the safety
of persons using the Airport, the public health or the environment, or the safety or integrity
of any premises on the Airport.
6. Inspection. The Federal Aviation Administration (FAA) and/or City shall have the
right and authority to inspect, at any time for any purpose whatsoever, the Premises as well
as any and all equipment used b y the Permittee under this Permit.

7. Coordination with Airport Management. Permittee shall coordinate all activities
on the Airport with Airport Management, or a designated representative, and shall abide
by all reasonab le decisions and directives of the Airport Management regarding general
use of the Airport by Permittee.
8. Radio Transmitting Equipment. Permittee shall discontinue the use of any
machine or device which interferes with any government-operated transmitter, receiver, or
navigation aid until the cause of the interference is eliminated.
9. Insurance. Permittee shall secure and keep in force adequate insurance, as stated
below, to protect City and Permittee. Where specific limits are stated, the limits are the
minimum acceptable limits. If Permittee's insurance policy contains higher limits, City is
entitled to coverage to the extent of the higher limits.
A. Commercial General Liability insurance , including premises, all operations ,
property damage , personal injury and death, broad-form contractual, with a per-
occurrence limit of not less than $1,000,000 combined single limit. The policy must
include an endorsement under which the insurer extends coverage to Permittee's fuel
handling activities. The policy must name the City as an additional insured.
B. Worker's compensation insurance with coverage for all employees engaged in
work under this Permit or at the Premises as required by AS 23.30.045. Permittee is
further responsible to provide worker 's compensation insurance for any
subcontractor who directly or indirectly provides services to Permittee under this
Permit.
C. Commercial Automobile Coverage with not less than $1,000,000 combined
single limit per occurrence. This insurance must cover all owned, hired, and non-
owned motor vehicles the Permittee uses on th e Airport. The policy must name the
City as an additional insured.
D. All insurance required must meet the following additional requirements:
i. All policies will be by a company/corporation currently rated "A-" or
better by A.M. Best.
1i. Permittee shall submit to the City proof of continuous insurance
coverage in the form of insurance policies, certificates, endorsements ,
or a combination thereof, and signed by a person authori zed by the
insurer to bind coverage on its behalf.

111. Permittee shall request a waiver of subrogation against City from
Permittee's insurer and the waiver of subrogation, where possible ,
shall be provided at no cost to City.
iv. Provide the City with notification at least thirty (30) days before any
termination, cancellation, or material change in insurance coverage of
any policy required hereunder.
v. Evidence of insurance coverage must be submitted to City by July 1,
2018 . The effective date of the insurance shall be no later than July
1,2018.
City may increase the amount or revise the type of required insurance on written demand
without requiring amendments to this Permit. City will base any increase or revision on
reasonable and justifiable grounds. Within two weeks of the written demand , Permittee
shall submit to City evidence of insurance coverage that meets the requirements of the City.
10. Assumption of Risk. Permittee assumes full control and sole responsibility as
between Permittee and City for the activities of Permittee, its personnel , employees, and
persons acting on behalf of or under the au thority of the Permittee anywhere on the Airport.
Permittee shall provide all proper safeguards and shall assume all risks incurred in its
activities on and access to the Kenai Municipal Airport and its exercise of the privileges
granted in this Permit.
11. Indemnity, Defend, and Hold Harmless Agreement. Permittee agrees to fully
indemnify, defend, and hold harmless , the City of Kenai, its officers, agents, employees,
and volunteers from and against all actions, damages , costs , liability, claims, losses,
judgments, penalties , and expenses of every type and description, including any fees and/or
costs reasonably incurred by the City's staff attorneys and outside attorneys and any fees
and expenses incurred in enforcing this provision (hereafter collectively referred to as
"Liabilities"), to which any or all of them may be subjected, to the extent such Liabilities
are caused by or result from any negligent act or omission or willful misconduct of the
Permittee in connection with or arising from or out of Permittee's activities on or use of
the Premises, Permittee 's access to the Kenai Municipal Airport, and/or Permittee 's
exercise of the privileges granted in this Permit. This shall be a continuing obligation and
shall remain in effect after termination of this Permit.
12 . Fuel Spill Prevention and Response Plan. Areas of the Apron have been seal coated
to protect asphalt from adverse effects of petroleum product spills. The City requires that
Permittee provide adequate absorbent materials and tools available on the Premises and at the
airport in order to maintain a fuel spill and response capability. Permittee shall be liable for

any damage caused by and costs associated with any spill , the cleanup of any spill , or the
discharge of petroleum products or hazardous materials due to Permittee's use of the Apron
and/or use of the Airport.
Permittee shall provide to City an acceptable fuel spill prevention and response plan and
will maintain fuel spill and response capability. Permittee further agrees to have a copy of
the fuel spill prevention and response plan located in the Permittee's fuel dispensing
equipment at all times. Permittee must comply with the Airport's Storm Water Pollution
Prevention Plan as appropriate to Permittee's activities.
Permittee shall not store any personal property, solid waste , petroleum products , Hazardous
Material as defined by 14 CFR § 171. 8, hazardous waste (ignitable, corrosive, reactive, or
toxic) or any hazardous substance on any portion of the Airport. Permittee is aware that
there are significant penalties for improperly disposing of the Hazardous Materials and
other waste and for submitting false information regarding Hazardous Materials, including
the possibility of fine and imprisonment for knowing violations .
Permittee shall immediately remove the material in the event of spillage or dripping of
gasoline, oil , grease, or any other material which may be unsightly or detrimental to the
pavement or surface in or on any area of the Airport.
Permittee may not construct or install any above-ground or underground fuel storage tanks
or d ispensing systems at the Airport.
No person shall smoke on an aircraft-parking ramp , inside an aircraft hangar, or within 50'
of any aircraft fuel facility or fuel truck.
Permittee is subject to FAA Advisory Circular 150/5230 -4 Aircraft Fuel Storage,
Handling, and Dispensing on Airports , the National Fire Protection Associations'
"Standard for Aircraft Fueling Servicing" in NFP A 407 (1996 version), and the current
version of the International Fire Codes . All inspections of fuel facilities, by City or other
regulating entities to which Permittee is subject, shall be conducted to assure compliance
with the fire safety practices listed in these referenced documents.
13. Hazardous Substances and Materials . Permittee shall conform and be subject to
the requirements of 14 CFR § 139.321 regarding the handling and storage of hazardous
substances and materials .
14. No Discrimination. Permittee shall not discriminate against any person because of
the person's race , creed, color national origin, sex , age, or handicap . Permittee recognizes
the right of City to take any action necessary to enforce this requirement of the Permit.
Permittee will furnish services provided under this Permit on a reasonable , and not unjustly

discriminatory, basis to all users of the Airport and shall charge reasonable, and not
unjustly discriminatory, prices for each product or service provided at the Airport.
15. Licenses and Permits. Permittee shall obtain and maintain all required federal,
state, and local licenses , certificates , and other documents required for its operations under
the Permit. Permittee shall provide proof of compliance to City upon request by the City.

Permittee shall pay a deposit of One Hundred Dollars ($100 .00) for the use of each
proximity card issued to Permittee by City to allow for gate access to the Airport to
conduct the uses permitted hereunder. City shall refund this deposit to Permittee
when the card is returned to City. City may exercise a right of offset to apply the
deposit to any outstanding balance due to City from Permittee at the termination of
this Permit.
C. Other Fees: City may assess additional fees for aviation or aviation support
activities and uses not defined in this Permit. If a fee has not been established for
those activities or services, a fee will be established by the Airport Manager.
Payment shall be directed to City of Kenai, ATTN: Finance Department, 210 Fidalgo
A venue, Kenai , AK 99611 and a courtesy notice of payment provided to Airport
Administration at 305 North Willow Street, Suite 200, Kenai, AK 99611. All permit fees
are payable in advance of each month unless otherwise provided. In the event of
delinquency, interest at the rate of I 0% per annum, and penalty of 10% shall also be due
(KMC 1.75.010). Interest shall accrue from the date due until the date paid in full. Failure
to timely make payments is grounds for termination ofthis Permit. (See~ 22 , Termination)
4. Use. City authorizes Pennittee's non-exclusive use of the Premises for the
following purpose(s):

Aircraft Loading and Parking. NOTE: This permit does not guarantee the exclusive use
of the area identified in Exhibit A. City reserves the right to re-assign Permittee. upon
reasonable notice, to other areas as airport needs may require.
Permittee shall have the right of ingress and egress to the Airport using only designated
gate access locations (which may require a proximity card) for the use of the Premises.
This Permit, and any access rights allowed hereunder, are for Permittee 's use only and may
not be transferred or assigned.
Use of the Premises by Permittee is subject to the reasonable administrative actions of the
City of Kenai for the protection and maintenance of the Premises and of adjacent and
contiguous lands or facilities and is further subject to the following conditions:
Permittee acknowledges that the use granted herein is subject to the Kenai Municipal Code
and municipal regulations governing the Kenai Municipal Airport and as those laws and
regulations may be amended from time to time.
Solicitation of donations or operation of a business or other commercial enterprise not
contemplated by this Permit is prohibited without the written consent of City.
No person may repair an aircraft, aircraft engine, propeller, or apparatus in an area of the
Airport other than that specifically designated for that purpose by the Airport Manager or
designated representative. The Airport Manager or designated representative reserves the
right to designate reasonable areas where aircraft owners may perform services on their
own aircraft.
5. Airport Operations. Permittee shall ensure that the Permittee, its employees, and
guests , and anyone else acting by, on behalf of, or under the authority of Permittee on the
Airport, that perform any repairs or activities authorized under this Permit act in a manner
that ensures the safety of people and the Airport, the protection of public health and the
environment, and the safety and integrity of the Airport and any premises on the Airport.
Permittee shall employ qualified personnel and maintain equipment sufficient for the
purposes of this provision. The Permittee shall immediately notify City of any condition,
problem , malfunction, or other occurrence that threatens the safety of the Airport , the safety
of persons using the Airport, the public health or the environment, or the safety or integrity
of any premises on the Airport.
6. Inspection . The Federal Aviation Administration (FAA) and/or City shall have the
right and authority to inspect, at any time for any purpose whatsoever, the Premises as well
as any and all equipment used by the Permittee under this Permit.

7. Coordin ati on wi th Airport Management. Permittee shall coordinate all activities
on the Airport with Airport Management, or a designated representative, and shall abide
by all reasonable decisions and directives of the Airport Management regarding general
use of the A irport by Permittee .
8. Radio Transmitting Equipment. Permittee shall discontinue the use of any
machine or device which interferes with any government-operated transmitter, receiver, or
navigation aid until the cause of the interference is eliminated.
9. Insurance. Permittee shall secure and keep in force adequate insurance , as stated
below, to protect City and Permittee. Where specific limits are stated, the limits are the
minimum acceptable limits . If Permittee 's insurance policy contains higher limits , City is
entitled to coverage to the extent of the higher limits.
A. Commercial General Liability insurance, including premises, all operations ,
property damage , personal injury and death , broad-form contractual, with a per-
occurrence limit of not less than $1 ,000 ,000 combined single limit. The policy must
include an endorsement under which the insurer extends coverage to Permittee 's fuel
handling activities. The policy must name the City as an additional insured.
B. Worker's compensation insurance with coverage for all employees engaged in
work under this Permit or at the Premises as required by AS 23.30.045. Permittee is
further responsible to provide worker's compensation insurance for any
subcontractor who directly or indirectly provides services to Permittee under this
Permit.
C. Commercial Automobile Coverage with not less than $1,000,000 combined
single limit per occurrence . This insurance must cover all owned, hired, and non-
owned motor vehicles the Permittee uses on the Airport. The policy must name the
City as an additional insured.
D. All insurance required must meet the following additional requirements:
i. All policies will be by a company/corporation currently rated "A-" or
better by A.M. Best.
1i. Permittee shall submit to the City proof of continuous insurance
coverage in the form of insurance policies, certificates, endorsements,
or a combination thereof, and signed by a person authorized by the
insurer to bind coverage on its behalf.
m. Permittee shall request a waiver of subrogation against City from

Permittee's insurer and the waiver of subrogation, where possible,
shall be provided at no cost to City.
1v . Provide the City with notification at least 30 days before any
termination, cancellation, or material change in insurance coverage of
any policy required hereunder.
v . Evidence of insurance coverage must be submitted to City by July 1,
2018. The effective date of the insurance shall be no later than July
1, 2018.
City may increase the amount or revise the type of required insw·ance on written demand
without requiring amendments to this Permit. City will base any increase or revision on
reasonable and justifiable grounds. Within two weeks of the written demand, Permittee
shall submit to City evidence of insurance coverage that meets the requirements of the City .
10. Assumption of Risk . Permittee assumes full control and sole responsibility as
between Permittee and City for the activities of Permittee, its personnel, employees , and
persons acting on behalf of or under the authority of the Permittee anywhere on the Airport.
Permittee shall provide all proper safeguards and shall assume all risks incurred in its
activities on and access to the Kenai Municipal Airport and its exercise of the privileges
granted in this Permit.
11. I ndemnity, Defend, and Hold Harmless Agreement. Permittee agrees to fully
indemnify, defend, and hold harmless, the City of Kenai, its officers , agents , employees ,
and volunteers from and against all actions, damages, costs, liability, claims, losses,
judgments, penalties, and expenses of every type and description, including any fees and/or
costs reasonably incurred by the City's staff attorneys and outside attorneys and any fees
and expenses incurred in enforcing this provision (hereafter collectively referred to as
"Liabilities"), to which any or all of them may be subjected, to the extent such Liabilities
are caused by or result from any negligent act or omission or willful misconduct of the
Permittee in connection with or arising from or out of Permittee's activities on or use of
the Premises, Permittee's access to the Kenai Municipal Airport, and/or Permittee 's
exercise of the privileges granted in this Permit. This shall be a continuing obligation and
shall remain in effect after termination of this Permit.
12. Fuel Spill Prevention and Response Plan . Areas of the Apron have been seal coated
to protect asphalt from adverse effects of petroleum product spills. The City requires that
Perrnittee prov ide adequate absorbent materials and tools available on the Premises and at the
airport in order to maintain a fuel spill and respons e capability. Permittee shall be liable for
an y damage cau sed by and costs as sociated with any spill, the cleanup of any spill, or the

discharge of petroleum products or hazardous materials due to Pennittee's use of the Apron
and/or use of the Airport.
Permittee shall provide to City an acceptable fuel spill prevention and response plan and
will maintain fuel spill and response capability. Permittee further agrees to have a copy of
the fuel spill prevention and response plan located in the Permittee's fuel dispensing
equipment at all times. Permittee must comply with the Airport's Storm Water Pollution
Prevention Plan as appropriate to Permittee's activities.
Permittee shall not store any personal property, solid waste, petroleum products, Hazardous
Material as defined by 14 CFR § 171.8 , hazardous waste (ignitable, corrosive, reactive, or
toxic) or any hazardous substance on any portion of the Airport. Permittee is aware that
there are significant penalties for improperly disposing of the Hazardous Materials and
other waste and for submitting false information regarding Hazardous Materials, including
the possibility of fine and imprisonment for knowing violations.
Permittee shall immediately remove the material in the event of spillage or dripping of
gasoline, oil , grease, or any other material which may be unsightly or detrimental to the
pavement or surface in or on any area of the Airport.
Permittee may not construct or install any above-ground or underground fuel storage tanks
or dispensing systems at the Airport.
No person shall smoke on an aircraft-parking ramp, inside an aircraft hangar, or within 50'
of any aircraft fuel facility or fuel truck.
Permittee is subject to FAA Advisory Circular 150/5230-4 Aircraft Fuel Storage,
Handling, and Dispensing on Airports, the National Fire Protection Associations'
"Standard for Aircraft Fueling Servicing" in NFP A 407 (1996 version), and the current
version of the International Fire Codes. All inspections of fuel facilities, by City or other
regulating entities to which Permittee is subject, shall be conducted to assure compliance
with the fire safety practices listed in these referenced documents.
13. Hazardous Substances and Materials. Permittee shall conform and be subject to
the requirements of 14 CFR § 139 .321 regarding the handling and storage of hazardous
substances and materials.
14. No Discrimination. Permittee shall not discriminate against any person because of
the person 's race, creed, color national origin, sex, age, or handicap. Permittee recognizes
the right of City to take any action necessary to enforce this requirement of the Permit.
Permittee will furnish services provided under this Permit on a reasonable, and not unjustly

discriminatory, basis to all users of the Airport and shall charge reasonable, and not
unjustly discriminatory, prices for each product or service provided at the Airport.
15. Licenses and Permits. Permittee shall obtain and maintain all required federal,
state, and local licenses, certificates, and other documents required for its operations under
the Permit. Permittee shall provide proof of compliance to City upon request by the City.
16. Compliance with Law/Grant Assurances . This Permit, and Permittee 's activities
conducted under this Permit, is subject to all executive orders, policies and operational
guidelines and all applicable requirements of federal, state, and City statutes , ordinances,
and regulations in effect during the term of this Permit. Further, Permittee shall comply
with all applicable requirements imposed on the Airport by federal law to ensure that the
Airport 's eligibility for federal money or for participation in federal aviation programs is
not jeopardized. This Permit is subordinate to the City's grant assurances and federal
obligations .
17. No Exclusivity. The privileges granted under this Permit are not exclusive to
Permittee. City has the right to grant to others any right or privilege on the Airport.
18. Assignment. The privileges granted under this Permit are personal to Permittee and
may not be assigned by Permittee.
19. No Joint Venture. City shall not be construed or held to be a partner or joint
venturer of Permittee in the conduct of its business or activities on the Premises or
elsewhere at the Kenai Municipal Airport.
20. No Waiver. Failure to insist upon a strict compliance with the terms, conditions ,
and requirements herein contained, or referred to , shall not constitute or be construed as a
waiver or relinquishment of the right to exercise such terms, conditions, or requirements.
21. Personalty. Permittee shall remove any and all personal property, including all
vehicles , from the Premises at the tennination of this Permit (or any renewal thereof).
Personal property placed or used upon the Premises will be removed and/or impounded by
the City, if not removed upon termination of this Permit and when so removed and/or
impounded , such property may be redeemed by the owner thereof only upon the payment
to the City of the costs of removal plus storage charges of $25 per day. The City of Kenai
is not responsible for any damage to or theft of any personalty of Permittee or of its
customers .
22 . Termination; Default. This Permit may be terminated by either party hereto by
giving 30 days advance written notice to the other party. City may terminate the Permit
immediately, or upon notice sh01ier than 30 days , to protect public health and safety or due

to a failure of Permittee to comply with condition or term of this Permit which failure
remains uncured after notice by City to Permittee providing Permittee with a reasonable
time period under the circumstances to correct the violation or breach.
23. Landing Fees; Fee Schedule. Timely payment of landing fees and other required
Airport fees is a condition of this Permit and, as such , failure to timely pay landing and
other airport fees is grounds for termination. Without limiting the foregoing, Permittee
shall pay landing fees for aircraft landings as set out in the City's comprehensive schedule
of rates, charges and fees. Permittee shall make payment within 30 days following the end
of each month and without demand or invoicing from City. Permittee shall also provide
Airport Administration with monthly certified gross take-off weight reports within ten days
following the end of each month for landings for the preceding month. Airport landing
fees shall be paid at the Airport Administration Building, 305 North Willow Street, Suite
200, Kenai, AK 99611.
24. Impoundment. At the discretion of the Airport Manager, City may impound any
aircraft parked on the Premises after termination of this Permit. Impoundment may be
accomplished by affixing a seal to the door of the aircraft or the moving of the aircraft for
impoundment purposes. Inconvenience or damage that may result from such movement
will be at the risk of Permittee . An impoundment fee plus a towage fee shall be charged
on each aircraft impounded. In addition, a daily storage fee shall be charged for each day
the aircraft remains impounded. Any impounded aircraft that is not redeemed within 90
days after impoundment shall be considered abandoned and shall be subject to sale at
public auction. Notice of any auction shall be published. Publication shall be in a
newspaper of general circulation in that area for at least once during each of three
consecutive weeks not more than 30 days nor less than seven days before the time of the
auction.
25. Definitions. As used in this Permit, "Permittee" means Everts Air Fuel , Inc. and
where the context reasonably indicates, its officers, agents, and employees. "Airport"
means the Kenai Municipal Airport.

SPECIAL USE PERMIT 2018
The CITY OF KENAI (City) grants to UPSCO United Parcel Service Co., Inc. (Permittee),
whose address is 6200 Lock.heed Ave., Anchorage, AK 99502, a Special Use Permit to
conduct aeronautical and/or aviation-related activities at the Kenai Municipal Airport
subject to the requirements and the conditions set forth below.
1. Premises. Permittee shall have the non-exclusive right to use 4,000 square feet as
described in the attached Exhibit A for the uses identified in this Permit.
2. Term. The term of this Permit shall be for 1 year commencing on July 1, 2018 and
ending on June 30, 2019. Regardless of the date of signature, this Permit shall be effective as
of July 1, 2018 .
3. Permit Fees. Permittee shall pay the following fees for the privileges extended to
Permittee under this Permit:
A. Permit: Permittee shall pay a monthly fee of$233 .00 plus applicable sales tax.
B. Proximity Card for Gate Access: In addition to the general permit fee,

to protect asphalt from adverse effects of petroleum product spills. The City requires that
Permittee provide adequate absorbent materials and tools available on the Premises and at the
airport in order to maintain a fuel spill and response capability. Permittee shall be liable for
any damage caused by and costs associated with any spill , the cleanup of any spill , or the

discharge of petroleum products or hazardous materials due to Permittee 's use of the Apron
and/or use of the Airport.
Permittee shall provide to City an acceptable fuel spill prevention and response plan and
will maintain fuel spill and response capability. Permittee further agrees to have a copy of
the fuel spill prevention and response plan located in the Permittee's fuel dispensing
equipment at all times. Permittee must comply with the Airport's Storm Water Pollution
Prevention Plan as appropriate to Permittee's activities.
Permittee shall not store any personal property, solid waste, petroleum products, Hazardous
Material as defined by 14 CFR § 171.8, hazardous waste (ignitable, corrosive, reactive, or
toxic) or any hazardous substance on any portion of the Airport. Permittee is aware that
there are significant penalties for improperly disposing of the Hazardous Materials and
other waste and for submitting false information regarding Hazardous Materials, including
the possibility of fine and imprisonment for knowing violations.
Permittee shall immediately remove the material in the event of spillage or dripping of
gasoline, oil , grease, or any other material which may be unsightly or detrimental to the
pavement or surface in or on any area of the Airport.
Permittee may not construct or install any above-ground or underground fuel storage tanks
or dispensing systems at the Airport.
No person shall smoke on an aircraft-parking ramp, inside an aircraft hangar, or within
fifty feet (50') of any aircraft fuel facility or fuel truck.
Permittee is subject to FAA Advisory Circular 150/5230-4 Aircraft Fuel Storage,
Handling, and Dispensing on Airports, the National Fire Protection Associations'
"Standard for Aircraft Fueling Servicing" in NFP A 407 ( 1996 version), and the current
version of the International Fire Codes. All inspections of fuel facilities , by City or other
regulating entities to which Permittee is subject, shall be conducted to assure compliance
with the fire safety practices listed in these referenced documents.
13 . Hazardous Substances and Materials. Permittee shall conform and be subject to
the requirements of 14 CFR § 139.321 regarding the handling and storage of hazardous
substances and materials .
14. No Discrimination. Pennittee shall not discriminate against any person because of
the person's race, creed, color national origin, sex, age, or handicap. Permittee recognizes
the right of City to take any action necessary to enforce this requirement of the Permit.
Permittee will furnish services provided under this Permit on a rea s onable, and not unjustly

discriminatory, basis to all users of the Airport and shall charge reasonable, and not
unjustly discriminatory, prices for each product or service provided at the Airport.
15. Licenses and Permits. Permittee shall obtain and maintain all required federal,
state, and local licenses , certificates, and other documents required for its operations under
the Permit. Permittee shall provide proof of compliance to City upon request by the City.
16. Compliance with Law/Grant Assurances. This Permit, and Permittee's activities
conducted under this Permit, is subject to all executive orders, policies and operational
guidelines and all applicable requirements of federal, state, and City statutes, ordinances,
and regulations in effect during the term of this Permit. Further, Permittee shall comply
with all applicable requirements imposed on the Airport by federal law to ensure that the
Airport 's eligibility for federal money or for participation in federal aviation programs is
not jeopardized. This Permit is subordinate to the City's grant assurances and federal
obligations.
17 . No Exclusivity. The privileges granted under this Permit are not exclusive to
Permittee. City has the right to grant to others any right or privilege on the Airport.
18. Assignment. The privileges granted under this Permit are personal to Permittee and
may not be assigned by Permittee.
19. No Joint Venture. City shall not be construed or held to be a partner or joint
venturer of Permittee in the conduct of its business or activities on the Premises or
elsewhere at the Kenai Municipal Airport.
20. No Waiver. Failure to insist upon a strict compliance with the terms, conditions,
and requirements herein contained, or referred to , shall not constitute or be construed as a
waiver or relinquishment of the right to exercise such terms, conditions, or requirements.
21. Personalty. Permittee shall remove any and all personal property, including all
vehicles , from the Premises at the termination of this Permit (or any renewal thereof).
Personal property placed or used upon the Premises will be removed and/or impounded by
the City, if not removed upon termination of this Permit and when so removed and/or
impounded, such property may be redeemed by the owner thereof only upon the payment
to the City of the costs of removal plus storage charges of $25.00 per day. The C ity of
Kenai is not responsible for any damage to or theft of any personalty of Permittee or of its
customers.
22. Termination; Default. This Permit may be terminated b y either party hereto by
giving thirty (30) days advance written notice to the other party. City may terminate the
Permit immediately, or upon notice sh01ter than thirty (30) days , to protect public health

and safety or due to a failure of Permittee to comply with condition or term of this Permit
which failure remains uncured after notice by City to Permittee providing Permittee with a
reasonable time period under the circumstances to correct the violation or breach.
23. Landing Fees; Fee Schedule. Timely payment of landing fees and other required
Airport fees is a condition of this Permit and, as such, failure to timely pay landing and
other airport fees is grounds for termination. Without limiting the foregoing, Permittee
shall pay landing fees for aircraft landings as set out in the City's comprehensive schedule
of rates, charges and fees. Perrnittee shall make payment within thirty (30) days following
the end of each month and without demand or invoicing from City. Permittee shall also
provide Airport Administration with monthly certified gross take-off weight reports within
ten (I 0) days following the end of each month for landings for the preceding month.
Airport landing fees shall be paid at the Airport Administration Building, 305 North
Willow Street, Suite 200, Kenai , AK 99611.
24. Impoundment. At the discretion of the Airport Manager, City may impound any
aircraft parked on the Premises after termination of this Permit. Impoundment may be
accomplished by affixing a seal to the door of the aircraft or the moving of the aircraft for
impoundment purposes. Inconvenience or damage that may resu lt from such movement
will be at the risk of Permittee. An impoundment fee plus a towage fee shall be charged
on each aircraft impounded. In addition, a daily storage fee shall be charged for each day
the aircraft remains impounded. Any impounded aircraft that is not redeemed within ninety
(90) days after impoundment shall be considered abandoned and shall be subject to sale at
public auction. Notice of any auction shall be published. Publication shall be in a
newspaper of general circulation in that area for at least once during each of three (3)
consecutive weeks not more than thirty (30) days nor less than seven (7) days before the
time of the auction.
25. Definitions. As used in this Permit, "Permittee" means UPSCO , United Parcel
Service Co., Inc. and where the context reasonably indicates , its officers , agents , and
employees. "Airport" means the Kenai Municipal Airport.

SPECIAL USE PERMIT 2018
THE CITY OF KENAI (City) for the considerations and pursuant to the conditions and
requirements set forth below, hereby grants to HDL ENGINEERING CONSULTANTS,
LLC (Permittee), whose address is 10735 Kenai Spur Highway, Suite IB , Kenai, AK 99611,
the non-exclusive right to use that area described below:
Tract A FBO Subdivision consisting of approximately 8,040 square
feet in the northwest comer (the Premises), including the
approximately 930 square feet building located thereon.
and as further shown in the attached Exhibit A.
1. TERM. This special use permit shall commence on April 1, 2018 and terminate June
30, 2018.
2. PERMIT FEES. The Permittee shall pay a permit fee of $543.00 plus applicable
sales tax per month ($418.00 for building and land rent and $125.00 for electricity for the
term of this Permit).
In addition, the Permittee shall be charged $76 .10 per month for water and sewer until June
30, 2018 ..
Permittee shall pay the City the monthly fee on or before the first day of each month
beginning April 2018 .
Checks, bank drafts, or postal money orders shall be made payable to the City of Kenai
and delivered to the City Administration Building, 210 Fidalgo Avenue, Kenai, Alaska
99611 on or before the first of each month.
In addition to the permit fee specified above , Pennittee agrees to pay to the appropriate
parties all levies, assessments, and charges as hereinafter provided:
A. Sales tax now enforced, or levied in the future , computed upon the permit fee
payable in monthly installments whether said fee is paid on a monthly or
yearly basis ;
B. All necessary licenses and permits , pay all lawful taxes and assessments
which, during the term hereof may become a lien upon or which may be
levied by the State, Borough, City, or by any other tax levying body, upon
any taxable possessory right which Permittee may have in or to the Premises
by reason of its use or occupancy or by reason of the terms of this Permit,

provided however, that nothing herein contained shall prevent Permittee
from contesting any increase in such tax or assessment through procedures
provided for by law.
C. Interest at the rate of 8% per annum and penalties of I 0% of any amount of
money owed under this Special Use Permit, which money or fee not paid on
or before the date it becomes due.
D. Costs and expenses incident to this Special Use Permit including, but not
limited to, recording costs .
3. USE. The use of the Premises by Permittee is limited to the purposes specified
herein: Permittee shall use the Premises only for a Soils test lab and equipment storage.
Any and all needed building or site modifications must be separately approved in
writing by the Airport Manager and the site and existing improvements must be
restored to as good or better condition than the si te and improvements were in prior
to modification by Permittee.
This use is subject to the reasonable administrative actions of the City of Kenai for the
protection and maintenance of the Premises and of adjacent and contiguous lands or
facilities.
4. INSURANCE. Permittee shall secure and keep in force adequate insurance, as
stated below , to protect City and Permittee . Where specific limits are stated, the limits are
the minimum acceptable limits. If Permittee's insurance policy contains higher limits, City
is entitled to coverage to the extent of the higher limits .
A. Commercial General Liability insurance, including Premises, all operations,
property damage, personal injury and death, broad-form contractual, with a per-
occurrence limit of not less than $1 ,000,000 combined single limit. The policy must
include an endorsement under which the insurer extends coverage to Permittee ' s fuel
handling activities. The policy must name the City as an additional insured.
B. Worker's compensation insurance with coverage for all employees engaged
in work under this Permit or at the Premises as required by AS 23.30.045. Permittee
is further responsible to provide worker's compensation insurance for any
subcontractor who directly or indirectly provides services to Permittee under this
Permit.
C. Commercial Automobile Coverage with not less than $1,000,000 combined
single limit per occurrence. This insurance must cover all owned, hired, and non-
owned motor vehicles the Permittee uses on the Airport. The policy must name the
Special Use Permit-HDL Engineering Consultants, LLC Page 2of6

City as an additional insured.
D. All insurance required must meet the following additional requirements:
I. All policies will be by a company/corporation currently rated "A-" or
better by A.M. Best.
11. Permittee shall submit to the City proof of continuous insurance
coverage in the form of insurance policies, certificates , endorsements,
or a combination thereof, and signed by a person authorized by the
insurer to bind coverage on its behalf.
111. Permittee shall request a waiver of subrogation against City from
Permittee's insurer and the waiver of subrogation, where possible,
shall be provided at no cost to City.
1v. Provide the City with notification at least thirty (30) days before any
termination, cancellation, or material change in insurance coverage of
any policy required hereunder.
v. Evidence of insurance coverage must be submitted to Ci ty by April,
2018. The effective date of the insurance shall be no later than April,
2018.
City may increase the amount or revise the type of required insurance on written demand
without requiring amendments to this Permit. City will base any increase or revision on
reasonable and justifiable grounds. Within two weeks of the written demand, Permittee
shall submjt to City evidence of insurance coverage that meets the requirements of the City.
5. INDEMNITY, DEFEND, AND HOLD HARMLESS AGREEMENT. Permittee
agrees to fully indemnify, defend, and hold harmless, the City of Kenai, its officers, agents,
employees, and volunteers from and against all actions , damages, costs, liability, claims,
losses, judgments, penalties, and expenses of every type and description , including any
fees and/or costs reasonably incurred by the City's staff attorneys and outside attorneys
and any fees and expenses incurred in enforcing this provision (hereafter collectively
referred to as "Liabilities"), to which any or all of them may be subjected, to the extent
such Liabilities are caused by or result from any negligent act or omission or willful
misconduct of the Permittee in connection with its use of the Premises. The Permittee shall
not be required to indemnify, defend, and hold harmless , the City of Kenai, its officers,
agents , employees, and volunteers for the independent negligence of the City of Kenai. If
there are Liabilities for the joint negligent act, or omission, or willful misconduct of the

Permittee and the City of Kenai, the indemnification and hold harmless obligation shall be
apportioned on a comparative fault basis.
6. PERMITTEE'S OBLIGATION TO PREVENT AND REMOVE LIENS.
Perrnittee will not permit any liens including, but not limited to , mechanics', laborers',
material men's, or mining liens or any other liens obtainable or available under existing
law, to stand against the Premises or improvements on the Premises for any labor or
material furnished to Permittee or to any related entity or claimed to have been furnished
to Permittee or to the Permittee 's agents, contractors, or related entities, in connection with
materials supplied to Permittee for its activities on the Premises and/or in connection with
work of any character performed or claimed to have been performed on the Premises or
improvements by or at the direction or sufferance of Permittee. Provided, however, the
Perrnittee shall have the right to provide a bond as contemplated by Alaska law and contest
the validity or amount of any such lien or claimed lien. Upon a final determination of the
lien or claim for lien, the Permittee will immediately pay any judgment rendered with all
proper costs and charges and shall have such lien released or judgment satisfied at
Permittee's own expense.
7. PERSONALITY. Permittee shall remove any and all personal prope1ty, including
all vehicles , from the Premises at the termination of this Permit (or any renewal thereof).

10. NO DISCRIMINATION. Pennittee will not discriminate on the grounds of race,
color, religion , national origin, ancestry, age, or sex against any patron, employee,
applicant for employment, or other person or group of persons in any manner prohibited
by federal or State law. Permittee recognizes the right of the City to take any action
necessary to enforce this requirement.
11. ASSIGNMENT. Pennittee may not assign, by grant or implication, the whole or
any part of this Permit, the Premises, or any improvement on the Premises without the
written consent of the City. Unless the City specifically releases the Permittee in writing,
the City may hold the Pennittee responsible for performing any obligation under this
Permit which an assignee fails to perform.
12. ASSUMPTION OF RISK. Permittee shall provide all proper safeguards and shall
assume all risks incurred in its use of the Premises.
13. NO JOINT VENTURE. The City shall not be construed or held to be a partner or
joint venturer of Pennittee in the conduct of its business or activities on the Premises.
14. SURVIVAL. The obligations and duties of Permittee under paragraphs 5 and 6 of
this permit shall survive th.e cancellation, termination or expiration of this permit.
15. AUTHORITY. By signing this Permit, Permittee represents that it has read this
agreement and it agrees to be bound by the terms and conditions herein and that the person
signing thi s Permit is duly authorized by the company to bind the company hereunder.

i. All policies will be by a company/corporation currently rated "A-" or
better by A.M. Best.
IL Pennittee shall submit to the City proof of continuous insurance
coverage in the form of insurance policies, certificates, endorsements,
or a combination thereof, and signed by a person authorized by the
insurer to bind coverage on its behalf.
111. Pennittee shall request a waiver of subrogation against City from
Permittee's insurer and the waiver of subrogation, where possible,
shall be provided at no cost to City.
iv. Provide the City with notification at least 30 days before any
termination, cancellation, or material change in insurance coverage of
any policy required hereunder.
v. Evidence of insurance coverage must be submitted to City by June 1,
2018. The effective date of the insurance shall be no later than June
1,2018.
VJ. This insurance shall be primary and exclusive of any other insurance
carried by the City of Kenai. This insurance shall be without
limitation on the time within which the resulting loss , damage, or
injury is actually sustained.
5. INDEMNITY, DEFEND, AND HOLD HARMLESS AGREEMENT. Permittee
agrees to fully indemnify, defend , and hold harmless , the City of Kenai , its officers, agents,
employees, and volunteers from and against all actions, damages, costs, liability, claims,
losses , judgments, penalties, and expenses of every type and description, including any
fees and/or costs reasonably incmTed by the City's staff attorneys and outside attorneys
and any fees and expenses incurred in enforcing this provision (hereafter collectively
referred to as "Liabilities"), to which any or all of them may be subjected, to the extent
such Liabilities are caused by or result from any negligent act or omission or willful
misconduct of the Permittee in connection with its use of the Premises. This shall be a
continuing release and shall remain in effect after termination of this Special Use Permit.
6. PERMITTEE'S OBLIGATION TO PREVENT AND REMOVE LIENS.
Pennittee will not permit any liens including, but not limited to , mechanics', laborers',
material men's, or mining liens or any other liens obtainable or available under existing

law, to stand against the Premises or improvements on the Premises for any labor or
material furnished to Permittee or to any related entity or claimed to have been furnished
to Permittee or to the Permittee's agents, contractors, or related entities , in connection with
materials supplied to Permittee for its activities on the Premises and/or in connection with
work of any character performed or claimed to have been performed on the Premises or
improvements by or at the direction or sufferance of Permittee. Provided, however, the
Permittee shall have the right to provide a bond as contemplated by Alaska law and contest
the validity or amount of any such lien or claimed lien. Upon a final determination of the
lien or claim for lien, the Permittee will immediately pay any judgment rendered with all
proper costs and charges and shall have such lien released or judgment satisfied at
Permittee's own expense.
7. PERSONALITY. Permittee shall remove any and all personal property, including
all vehicles, from the Premises at the termination of this Permit (or any renewal thereof).
Personal property placed or u sed upon the Premises will be removed and/or impounded by
the City, if not removed upon termination of this Permit and when so removed and/or
impounded, such property may be redeemed by the owner thereof only upon the payment
to the City of the costs of removal plus storage charges of $25 per day. The City of Kenai
is not responsible for any damage to or theft of any personalty of Permittee or of its
customers.
8. FORBEARANCE. Failure to insist upon a strict compliance with the terms,
conditions, and/or any requirement herein contained, or referred to, shall not constitute or be
construed as a waiver or relinquishment of the right to exercise such terms, conditions or
requirements.
9. TERMINATION; DEFAULT. This Permit may be terminated by either party
hereto by giving 60 days advance written notice to the other party. City may terminate the
Permit immediately, or upon notice shorter than 60 days, to protect public health and safety
or due to a failure of Permittee to comply with condition or term of this Permit which
failure remains uncured after notice by City to Permittee providing Permittee with a
reasonable time period under the circumstances to correct the violation or breach.
10. NO DISCRIMINATION. Pem1ittee will not discriminate on the grounds of race,
color, religion, national origin, ancestry, age, or sex against any patron, employee,
applicant for employment, or other person or group of persons in any manner prohibited
by federal or State law . Permittee recognizes the right of the City to take any action
necessary to enforce this requirement.
11. ASSIGNMENT. Permittee may not assign, by grant or implication, the whole or

any part of this Permit, the Premises, or any improvement on the Premises without the
written consent of the City. Unless the City specifically releases the Permittee in writing,
the City may hold the Permittee responsible for performing any obligation under this
Permit which an assignee fails to perform.
12. ASSUMPTION OF RISK. Permittee shall provide all proper safeguards and shall
assume all risks incurred in its use of the Premises.
13. NO JOINT VENTURE. The City shall not be construed or held to be a partner or
joint venturer of Permittee in the conduct of its business or activities on the Premises.
14. SURVIVAL. The obligations and duties of Permittee under paragraphs 5 and 6 of
this permit shall survive the cancellati on, termination or expiration of this permit.
15. AUTHORITY. By signing this Permit, Permittee represents that it has read this
agreement and it agrees to be bound by the terms and conditions herein and that the person
signing this Permit is duly authorized by the company to bind the company hereunder.

Building Restriction Line (BRL) adjacent to the commercial apron
appears to reflect no conflict. The BRL line is 100 feet back to the
east of the commercial apron .
o Lessee must comply with sector-specific requirements of the Kenai
Airport 's Multi Sector General Permit #AKR06AD35 if conducting
an industrial activity with a SIC code in the range 451 2 -458 1 (Air
Transportation Fa c ility).
Removing the lot line will provide the square footage required to accommodate
Hilcorp 's proposed construction project. This project will create new land lease
revenue , employment opportunities, and be an asset to the Kenai Airport and the
City of Kenai.

I have reviewed t he attached lease application submitted by Hilcorp Alaska , LLC (Hilcorp) for
compliance with Kenai Municipal Code (KMC) for zoning , the Imagine Kenai 2030
Comprehens ive Plan, and the Airport Layout Plan . Hi lcorp plans for lot improvements to be
completed at the end of 2019 to support o il and gas operations in Cook Inlet. The lease term
would be 35 years, with a start date in fall 2018 . Improvements include a ramp , fuel farm , office
spaces, hangar, gravel parking for 50 vehicles, and an eight (8) -foot high security fence around
the vehicle parking lot. Hilcorp has submitted the application filing fee and is in compliance with
obligations due to the City and Kenai Peninsula Borough.
The site plan shows the proposed hangar will cross the property line between the two lots. The.
property line would be vacated prior to construction of the proposed hangar, requiring
recommendation from the Planning and Zoning Commission to the Kenai Peninsula Borough for
approval of the p lat.
Pursuant to KMC 14.20 .065 , the parcel is within the Airport Light Industri al (ALI) Zone . The
purpose of the ALI Zone is to protect the viability of the Kenai Mun icipa l Airport as a significant
reso urce to the commun ity by encouraging compatible land uses and reducing hazards that
may endanger the li ves and property of the public and aviation users. The proposed
aeronautical use by Hilcorp for passenger and cargo transportation would be a permitted use in
the ALI Zone.
The Imagine Kenai 2030 Comprehens ive Plan outlines goals, objectives , and action items for
the C ity, including some pertaining to the Kenai Municipal Airport:

• Objective T-1 : Support future development near or adjacent to the airport when such
development is in alignment with the Kenai Municipal Airport's primary mission, "To be
the commercial air transportation gateway to the Kenai Peninsula Borough and Cook
Inlet."
• Action Item: Support the Airport's marketing strategy to actively recruit development on
Airport Industrial Park leases.
The proposed use by Hilcorp complies with the Imagine Kenai 2030 Comprehensive Plan in that
it supports development on lease lots and the development is in alignment with the Kenai
Municipal Airport mission .
The Airport Land Use Plan was developed to identify the highest and best uses of Kenai
Municipal Airport land . The Airport Land Use Plan discusses the need for more hangar facilities ,
promoting use of the Kenai Municipal Airport by service providers and the traveling public,
leasing land , and enhancing the opportunities for local economic development. The proposed
use by Hilcorp complies with the Airport Land Use Plan . It would enhance local economic
development and provide more hangar space.
Mary Bondurant, Airport Manager, recommended approval of the lease application by the
Airport Commission after review for compliance with the Airport Land Use Plan, Airport Layout
Plan, Federal Aviation Administration regulations, Airport Master Plan, Airport Improvement
Program grant assurances, and Airport operations .
I recommend approval of the lease application at the May gth meeting of the Planning and
Zoning Commission , contingent upon Hilcorp submitting a plat to the Planning and Zoning
Commission showing a vacation of the property line the proposed hangar would cross .

April Mid-month Report
2016 Fencing Rehabilitation -Wince-Corthell-Bryson submitted the plans and specs
along with the Construction Safety and Phasing Plan through the FAA OEAAA website
for final review and comment.
2017 Terminal Rehabilitation Project-Design Grant-City and Airport Administration
met with the FAA on March 29, 2018 to discuss the funding, bidding process and
timeline for this project.
2017 Snow Removal Equipment -The new multipurpose unit was received the week of
March 5th. Oshkosh training is complete. The closeout process with begin on this
grant.
In-house Activities -
Marketing of City Lands -The full-page color ad for the Petroleum News' annual
Explorers magazine is complete . This magazine has a shelf life of 12 months. In addition
to a distribution list of 8,000 subscribers, the magazine will also be displayed at oil and
gas conferences in Alaska and the Lower 48. We will also have the ad in a PDF file for
our use.
April 2-3, 2018 -The Airport Manager attended the APEi Manager training at Soldotna
City Hall. The training included supervisor's training on performance evaluations,
coaching and mentoring, employee discrimination and harassment awareness, along with
documentation guidelines.

April 13, 2018 -The Kenai Airport is excited to be the 8th airport to participate in the Read
on the Fly literacy program. Partnering with AKonthe GO and the Kenai Library, children
will be able to pick up a book and read while traveling within and through Alaska. Special
thank you to Mary Jo Joiner, Kenai City Librarian for providing the books, and Mr. Gordon
and the Soldotna High School Shop Classes for building the bookshelf to the
specifications.
April 18, 2018 -There will be a post-winter snow and ice control meeting at 9am in the
Kenai City Council Chambers. Airport staff, tenants and contractors will meet to discuss
how snow and ice control, sanding, and de-icing operations went this season.
April 23-25, 2018 -The annual FAA Certification Inspection will be conducted this week.
The Airport's project engineer will also be in attendance. The inspector will be reviewing
ARFF training curriculum, inspection records of all fueling agent facilities, Airport
Emergency Plan, 49 CFR 139 Certification Manual, self-inspections, NOTAM log, runway
safety areas, ground vehicle driving records, airport master record, Wildlife Hazard
Management Plan, etc.
May 4-6, 2018 Great Alaska Gathering -The Airport Manager and Administrative
Assistant will be attending this trade show in Anchorage at the Fed Ex Hangar. This is a
great opportunity to network with aviation enthusiasts to promote the airport, its lands,
future developments, and the Kenai Peninsula Air Fair. Stop by and visit us at booth 191 !
May 22, 2018 Runway Safety Action Team -This meeting will be held in Kenai City
Council Chambers at 2:30pm. Invitations will be mailed to Air Traffic Control Tower and
Flight Service Station personnel along with local pilots and other airport users . The team
consists of FAA officials who inspect the airfield and review operating procedures to
enhance safety at a towered airport.
June 6-7, 2018 -The bi-annual Alaskan Region Airports Division Workshop will be held
in Anchorage. Anticipated topics include the AIP program, guidance, compliance,
environmental, planning , lessons learned, regional and national perspectives, and more!
June 9, 2018 -it's coming!! The 18th Annual Kenai Peninsula Air Fair! Airport staff is busy
working on the poster, activities, and vendors.

been accomplished. The letter was provided and the FBO was instructed accordingly prior to the
inspection out brief.

3. 139. 7-COMPLIANCE WITH ADVISORY CIRCLULARS
There were several locations along the airport fence line that had significant gaps that could
allow wildlife or intruders to gain access to the airport. Some of the locations could use barbed
wire or extra fence skirting along the bottom and other locations could use some soil/dirt and
grading to eliminate the gaps. The gate on the north side of the field needs to be lowered to
lessen the gap.

KENAI MUIICIPAL AIRPORT

The Kenai Mun1c1pa1 Airport is 60 air miles from Anchor-
age. tn a central location. has an elevation of 93 feet wtth
an average te•perature of 61 degrees. It consists of one
terminal. one control tower. a 7.211 feet fn length and 150
feet tn width runway. and an tndustrtal park. It has an 111-
weat~er rawway that offers flatter approaches. better flying
weather, less congestion, lower af rport fees, rental r1~e1,
local taxes, more parking and develop•ent space. and a greater
abt11ty to. accomodate tbe operator than any comparabie factl-
tty t~ Alaska. The airport ts also used as an alternate for
Anchorage. It ltes equt-dtstant fro• any .•tneral exploration
tn the state.
Before there was an a1rf1eld. planes hid to land on t••
beach. In the wtnter b•rause of snow and tee on the beach1
the area south of the present runway would be cleared for
planes to land on stts.
So••tfme fn 1941 an airport was constructed by the U.S.
Afr Force on 'ublfc domain under Afr Navtgatton Site With-
drawal No. 156. Th• new 5,000 feet long runway was co•pleted
by the Cfv11 Aeron1utfcs Adm1nfstratfon fn 1942 •• ~t times
someone wf th a vebf cle had to chase moose, caribou, and bears
off the runway. In the winter, snow on the runway was P•cked .
down by a huge roller.
The first airlines to use the airport were Alaska Atr-
lfnes and Pac1f1c Nort~ern Airways. both arr1vfng fn 1946.

Both airlines brought in people, supplies, and mail, with
Pacific Northern Atrlin~s beint the chfef supplier.
Because of the private plane boom, the Kenai airstrip
was lengthened by 1,000 feet wtth steal pferced plank land-
fng mats, 150 feet wfde, at both ends. The center of the
runwa1 was surfaced wfth gravel. Thts project was funded by
the A1r Force. The runway was then lighted with medium
fntensity lights and a 24-tnch duplex rotating beacon with
clear and green lenses. mounted on a 51-foot tower adjacent
to the then flfght service statton on the east sfde of the
runway. There were three different apron areas adjacent to
the runway, one of which was constructed for the Afr Force • .
Other F.A.A. facf11tfes·were a low frequ1nctes radfo
range (SBRA), a very high frequencies omni-directional radio
range (UDRTAC). a communications trans•ttter sfte, and a
ltvtng quarters area for F.A.A. personnel whfch fs now owned
by the Cfty of Kenai.
· Th1 first airport terminal buf ldtng was built tn the
su11111er of 1952 and was located north of the spur highway
near the cemetery.
Du~ing the Korean War, the Afr Force based single engfae
Jet fighters at the Kenat airport. The airport facilities
were mafntafned by the F.A.A. by an agreement. Thfs mainten-
ance agreement was cancelled by the Afr Force on June 30. 1962.
However, the Air Force st111 retained four tracts of various
stzes 1dJ1cent to the atrport under F.A.A. permft.
In 1959 the F.A.A. was directed to transfer certain air·
ports that were betng operated as tntermedf ate fields to the

Atrpor.t. The airport was ortgtnally bu11t to provtde a
landing fteld for small aircraft, such as the DC-3 and smaller.
The planes were used to haul in material for the construction,
operation and aetntenance of the airways communfcatfons sta-
tton and navtgattonal aids butlt at Kenai as part of the Alaska
Airways System. Since there was no high-way, heavy equipment
and supplies were transported during the open navtgatton sea-
son by barge. When the highway system between Anchorage,
Seward, and the Peninsula was completed, the Kenai afrport was
no longer a F.A.A. requirement fn operating the airways station
and navtgat1onal atds.
Transftfonal grant funds tn the amount of $21,000.00 per
year for the fiscal years of 1960 through 1962 were allocated
to take care of maintenance of the airport. Some of these
funds were used tn the Avtatton Services Buildtng, whtch was
completed tn November, 1960, becoming the largest co111111ercial
structure f n Kenai at that time.
In May, 1963, the Kena1 Ctty Council established the Kenai
Airport Co11111tssfon, whfch was formed to establfsh polfcies,
•ules and regulations for the airport. The Airport Commfsston
was a vital factor in the development of the af rport and fts .
operations until September 1, 1965, when the Commtsston was
abolished.
In 1965 an airport improvement project got under wa1. wtth
a cost of approximately $1,146,667.00. Plans were also developed
for use and leasfng of land tn the small aircraft apron; (1)
Small Aircraft Apron Use Plan, and (2) Small Aircraft Apron
Leasing Program.

There were numerous improvements tn 1967. such as 2,500
feet of addf t1ona1 runway which was paved tn the spring of
1968. the completfon of storage parting for 80 more vehicles,
an addttfonal 1,870 feet of Daved taxiways, and conversion of ..
medtun intensity runway lighting to htgh intensity.
On danuary 26, 1967, Pacific Northern Airlines moved to
the newly completed Kenat Afr Terminal. At 12:35 p.m. that
day a constellation flight landed and the ffrst passengers
passed through the new facflfty. In February the contractor
of the terminal, J. a. Narrack Co •• turned over the •teys 0
to the cfty •. On Saturday nfghtl March 11. an official open
house celebration was held. Prior to thfs celebration tt
was believed that the passenger space was inadequate for the
amount of traffic already usfng the bufldfng. Because of thts,
the front porch area was glassed tn to gtve more room.
In dune of 1967 Pac1ftc Northern Atrlfnes and Western
Afrlfnes negotiated a merger. On duly 1, 1967, Pacfftc
·Northern Afrlfnes, known also as •Alaska Flag Lfne• wtth
asters of Golda aade way for the •Red. Nhfte, and Black Chtef ,•
Western Afrlfnes.
Kenat owns 1.600 acres of airport lands, of whfch 10.2
acres was offered for rampstde oper1ttons :bordertng on the
matn taxtway. Eighteen and eight-tenths acres were available
tn an undeveloped state for operation adjacent to the ramps1te.
In the 1ndustrf1l park, 6.8 acres of lots were avatl1ble for
constructton end 16.6 acres for an fndustrt1l commercfal
subdf vf ston.

financed by an Economic Development Administration matching
fund. EDA declared that the project had been one of the most

Because of the buttdfng of the industrial air park, the
City of Kenai co•p1eted tnstallattons of water. sewers. paved
streets. and underground electric lfnes. Other com1ercfal
ut11ftfes installed natural gas lfnes and underground tele-
phone ltnes to the area.

Other improvements fn 1973 were addft1ona1 paved taxi·
ways, loading ramp, and a paved access road to the control
tower, all totaling $507,627.00. Security regulations re-
quired a complete surrounding security fence whfch was com-
pleted fn 1974 with a cost of $463,429.00.
Plans for the airport now include studies of airport
lands and development of a comprehensive land use plan, tn·
stallation of a radto-controlled lighting system, and an

In all the years the Kenai afrport has been tn use there
have been only a total of stx accidents resultf n9 tn two
fatalftfes. The two fatalities occurred in 1971 when two
private planes collided in mid-atr over the afrffeld, k1111ng
one pilot and one student pf lot trainee.
The intensive use of the airport 1n prior years by the
m111tary resulted in only two separate accfdents, one a C-119
Flying Boxcar and one a C-47 cargo plane. There were no
serious injuries to either crew.
Use of the kenaf airport as an alternate to Anchorave
Internattonal Atrport has been nomtnal in the past, due prt-
mar11y to the extensive instrument landing system at the
Anchorage field, and due also to the lack of a U.S. Customs
Office and personnel at the Kenai airport.

of its.four engines. The passengers and the crew had to re-. .
•afn aboard the disabled craft until another plane. accompanied
by U.S. custom officials, was brought tn from Anchorage. The
lack of a customs offfce at Kenaf prevented the passengers
from df sembartfng the disabled plane.
The largest plane to land at the airport was a C-141
Starltfter. The total number of planes (landings and take-
offs) using the Kenaf afrport tn 1974 was 48,814 wfth the
number of 1975 estimated to be around 52,000. matfng Kenaf
the thfrd &~sfest afrport f n Alaska.
The atrport ts currently betng operated wfthout a full-
ttme a~rport manager. The current City Manager f s designated
as the Acting Af rport Manager. The ff rst airport manager
was 6eorge L. 0 Red• daynes, who served from 1963 to 1969.
&tlbert Stafford was appotnted tn 1969 for •·short perfod.
Many persons credft the late 6eorge·L. daynes as the drivtng
force behfnd many of the airport tmprov .. ents and past
operations. A•ong other achievements, he fs credited with
single-handedly df ggtng the water well to serve the newly
constructed airport terminal building. which was built prfor
to the extenston of the city water lines that presently serve
the ter11tn1l butldfng and surrounding area.

THE HISTORY

• All agreements but one expired in 1998 and are

runway. New MOA administration nixed that

to FAA personnel on interpreting and administering the
various continuing commitments airport sponsors make
to the U.S. Government [Grant Assurances] when they
accept grants of federal funds or federal property for
airport purposes.

17.5 Self-sustaining Principle
Airports must maintain a fee and rental structure that
makes the airport as financially self-sustaining as
possible under the particular circumstances at that
airport. The requirement recognizes that individual
airports will differ in their ability to be fully self-
sustaining, given differences in conditions at each
airport. The purpose of the self-sustaining rule is to
maintain the utility of the federal investment in the
airport.

17.11 Nonaeronautical Rates
Rates charged for nonaeronautical use (e.g.,
concessions) of the airport must be based on fair market
value (e.g., lease of land at fair market rent subject to the
specific exceptions listed in this chapter).

17. 15 Exception for Community Use:
a. Acceptance. The local community must use the land
in a way that enhances the community's acceptance of
the airport; the use may not adversely affect the airport's
capacity, security, safety, or operations. Acceptable
uses include public parks and recreation facilities,
including bike or jogging paths.

purposes and (b) not-for-profit aviation organizations, (c)
transit projects and systems, and (d) military

revenue that the airport could otherwise earn.
