HomeMy WebLinkAboutORDINANCE 1885-2000SUBSTITUTE Suggested by: Administration CITY OF KENAI ORDINANCE N0. 1885-2000 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, REQUIRING: (1) HOME OCCUPATION DAY CARE FACILITIES TO BE INSPECTED FOR COMPLIANCE WITH THE FIRE CODE PRIOR TO ISSUANCE OF A PERMIT AND EVERY OTHER YEAR THEREAFTER; AND (2) OTHER HOME OCCUPATIONS TO BE INSPECTED FOR FIRE CODE COMPLIANCE PRIOR TO ISSUANCE OF A PERMIT IF DEEMED NECESSARY BY THE FIRE MARSHAL. Whereas, residences which are the subject of home occupation permits currently are not required to have a fire code inspection prior to the issuance of a permit; and Whereas, because such residences (other than day care facilities) are used in part as commercial premises, they may need to have a fire code inspection prior to issuance of a permit; and Whereas, because of the vulnerability and age of the clientele, day-care facilities should be inspected prior to issuance of such a permit and every other year thereafter to ensure compliance with the fire code. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that KMC 14.20.320 is amended by adding the following section: (h) Fire Code Inspections: 1. Day care facilities shall be inspected by the Fire Marshal for compliance with the fire code (KMC 8.05) prior to approval of the permit. Thereafter, they shall be inspected every other year by the Fire Marshal. Failure to comply with the fire code (KMC 8.05) shall be grounds for the suspension or revocation of the facilities' home occupation permit. 2. Residences which are the subi ect of a home occupation permit application (other than day care facilities) ma~~be. required to be inspected by the Fire Marshal for compliance with the fire code (KMC 8.05 rior to a royal of the ermit if the Fire Marshal determines it is necessar,~public safety.
