CALL TO ORDER Commission Chair Twait called the meeting to order at 7:00 p.m. a.Pledge of Allegiance Commission Chair Twait led those assembled in the Pledge of the Allegiance. b.Roll Call Commissioners present: Chair J. Resolution PZ2018-25 Original Preliminary Plat of Shadura Subdivision Nilchil Addition, submitted by McLane Consulting, Inc., P.O. Box 468, Soldotna, Alaska 99669, on behalf of Nilchil Solutions LLC, 508 S.Willow, Suite A, Kenai, Alaska The City Planner reviewed the staff report as provided in the meeting packet and noted staff recommended approval of this plat, subject to the following conditions: x Further development of the property shall conform to all federal, State of Alaska, and local regulations; x The Kenai City Council shall declare the twenty-five (25) foot alley not needed for a public use and approve the vacation of the alley as shown on the preliminary plat; x A signature line and notary block shall be added to the plat for the beneficiaries of the Deed of Trust encumbering the property to approve the plat; and x The twenty (20) foot building front setback shall be delineated on the plat. MOTION: Commissioner Askin MOVED to adopt Resolution No. PZ2018-25 with staff recommendations and Commissioner Halstead SECONDED the motion. Chair Twait opened the floor for public testimony. McLane Consulting, Jason Nielman clarified they intended to upgrade the structure and currently are finalizing the engineering plans. He noted the plan was to lease to four businesses, move their office on-site, and potentially build other buildings on the lot. There being no one else wishing to be heard, public comment was closed. PENDING ITEMS:None. 10. REPORTS: a. City Council – Council Member Knackstedt reviewed the action agenda from the October 3 City Council Meeting. He specifically noted there was an executive session to discuss financial renegotiation of the bowling alley with more information to come February 3, 2019; and the certification of the elections would occur at the October 17 City Council meeting. b. Borough Planning – Fikes reported the Commission met on October 8; nine plats were reviewed and eight of them were approved, and one was postponed; specifically approved in Kenai was the vacation of a portion of a section-line easement off Cannery Road, near Dunes Road Access. She further reported that the Material Site Plan Committee was starting back up and planned to meet in November. c. Administration – City Planner Appleby reported on the following: x The Planning and Zoning Department approved a Landscape Site Plan to Kenai Mini-Storage for an addition to the building; x The last TRASHercize event was spent at Millennium Square Park in preparation for the Pumpkin Festival on October 13; x A Kenai Area Start-Up Week Event was developed to support and celebrate local businesses as well as encourage new businesses, and scheduled for the week of November 11. The City of Kenai planned to sponsor an event, discussing City- owned lands and City land policies, themed Policy with a Pint; and x She attended a meeting this week for a potential Kenai Area Coordinated Transportation Plan and she would provide more information as it comes available. The City Planner also provided an update on the Kenai Code enforcement cases from this summer through September. 11. ADDITIONAL PUBLIC COMMENT – None. 12. Box 468 Soldotna, Alaska 99669 Requested Action:Preliminary Subdivision Plat – Anglers Acres Subdivision Shuey Addition Existing Legal Description: Tract 3, Anglers Acres Subdivision Lowe Addition Proposed Legal Description: Tracts 3A and 3B, Anglers Acres Subdivision Shuey Addition Street Address:1600 Angler Drive KPB Parcel No:04939052 Existing Zoning:Rural Residential Current Land Use:Vacant Land Use Plan:Rural Residential ANALYSIS The subject property is within the Rural Residential zone. Pursuant to Kenai Municipal Code 14.24.010, the minimum lot size is 20,000 square feet. The proposed Tract 3A would be approximately 4.599 acres (200,332 square feet) and Tract 3B would be approximately 12.522 acres (545,458 square feet), both of which meet the minimum lot size as required by City Code. The tracts also meet the minimum lot width of sixty (60) feet as specified by Kenai Municipal Code 14.24.020. The surveyor has indicated that the reason for the subdividing of Tract 3, Anglers Acres Subdivision Lowe Subdivision is to allow the property owners to sell Tract 3B, Anglers Acres Subdivision to the State of Alaska for habitat protection. Funds used to purchase the property will be those received by the State of Alaska in a civil settlement from the Exxon Valdez Oil Spill (EVOS). Great Land Trust has been facilitating the purchase on behalf of the EVOS Trustee Council. The Kenai City Council approved the City Manager to sign a letter of support for this purchase at their regular meeting on September 19, 2018. Tract 3A is to be retained in private ownership by the Shuey family. If Tract 3A would be developed, the property owners would be required to obtain additional permits from the City. The preliminary plat notes the lots are at least 200,000 square feet in size and would follow State of Alaska requirements for well and septic system installations. Access to the property is via Angler Drive, a paved and City-maintained road. The right- of-way for Angler Drive stops at the northeasterly boundary of Tract 3A. The surveyor has shown a twenty-foot wide pedestrian access easement that crosses Tract 3A to reach Page 5 of 14 Oct. 24, 2018 Planning and Zoning Commission PZ2018-26 Staff Report Page 2 Tract 3B, which will become public land once it is sold to the State of Alaska. In addition, the plat shows a 20-foot wide recreational easement for the nonexclusive benefit of Tracts 1 and 2, Anglers Acres Subdivision Lowe Addition that was granted in the Warranty Deed for Lower Property recorded on July 24, 1997, in Book 510 at Page 712. Kenai Municipal Code 14.10.070(d)(3) provides that a dead end street shall terminate in an open space (preferably circle) having a minimum radius of fifty (50) feet. The surveyor had initially requested the City of Kenai not to require the fifty (50) foot radius cul-de-sac. After on-site inspection with the property owners, the City Planner, the City Public Works Director, the City Streets Foreman, and a representative from the City Fire Department, the plat was modified to dedicate a radial right-of-way at the end of Angler Drive on Tract 3A. This designation on the plat was deemed to meet City Code and concerns for snow storage, drainage, and emergency vehicle access. The plat displays the flood zones as determined by Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) panel number 020012-2035A. The zone denoted as FIRM Zone A3 on the plat is within the one-percent annual chance (100- year) floodplain. The plat notes the administrator for the floodplain in the City of Kenai is the Kenai Peninsula Borough. The area shown as FIRM Zone C is an area of minimal flood hazard and is higher than the elevation of the 0.2-percent annual chance (500-year) floodplain and the one-percent annual chance (100-year) floodplain. The plat notes that portions of the subdivision are within the Kenai River Habitat Protection Area pertaining to development within 50 feet of the Kenai River. In addition, the plat shows a 10-foot by 30-foot utility easement on the proposed Tract 3A. The plat notes that no permanent structure shall be placed within the utility easement that could interfere with a utility to use the easement. RECOMMENDATIONS City staff recommends approval of the preliminary plat of Anglers Acres Subdivision Shuey Addition, subject to the following conditions: 1. Further development of the property shall conform to all federal, State of Alaska, and local regulations. 2. Map Page 6 of 14 Oct. 24, 2018 Planning and Zoning Commission _____________________________________________________________________________________ CITY OF KENAI PLANNING AND ZONING COMMISSION RESOLUTION NO. 2018 - 26 A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI RECOMMENDING THAT THE SUBDIVISION PLAT ANGLERS ACRES SUBDIVISION SHUEY ADDITION ATTACHED HERETO AS EXHIBIT “A” BE APPROVED SUBJECT TO THE CONDITIONS OUTLINED BELOW. WHEREAS, the City of Kenai received the plat attached as Exhibit A from McLane Consulting; and, WHEREAS, the plat meets City requirements of the Rural Residential Zone; and WHEREAS, the plat accurately represents street names and surrounding properties; and, WHEREAS, the parcels are accessed via Angler Drive, a paved and City-maintained road; and, WHEREAS, the plat shows a radial right-of-way to form a cul-de-sac at the end of Angler Drive and this was deemed suitable for emergency vehicle access and City maintenance access; and, WHEREAS, City water and sewer services are not available and an installation agreement is not required; and, WHEREAS, well and wastewater disposal systems placed on-site will follow State of Alaska requirements; and, WHEREAS, the plat accurately references flood hazard areas and the Kenai River Habitat Protection Area which may require additional permits for development; and, WHEREAS, Tract 3B will be conveyed to the State of Alaska by the landowners for the purposes of habitat protection and this conveyance was supported by the Kenai City Council. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI, ALASKA TO RECOMMEND APPROVAL OF THE SUBDIVISION PLAT ATTACHED AS EXHIBIT “A”, SUBJECT TO THE FOLLOWING CONDITIONS: 1.
