HomeMy WebLinkAboutResolution No. 2018-60Sponsored by : Administration CITY OF KENAI RESOLUTION NO. 2018-60 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, DECLARING A THIRTY-THREE FOOT (33 ') WIDE SECTION LINE EASEMENT ALONG THE SOUTHERN BOUNDARY OF LOT 2, WATERFRONT ESTATES, NOT NEEDED FOR A PUBLIC PURPOSE AND CONSENTING TO THE VACATION OF THE SECTION LINE EASEMENT AS SET FORTH IN THE ATIACHED EXHIBIT "A". WHEREAS, the section line easement listed below is no longer needed for a public purpose because Royal Street and Dunes Road have been developed to provide superior and safer access to the public beach ; and , WHEREAS, Dragseth Subdivision 2016 Addition , Plat No. 2016-22, dedicated a 60 foot right-of way, expanding that portion of Royal Street to an 85 foot right-of-way to provide access from Old Cannery Road to the public beach; and, WHEREAS, Royal Street has been constructed and provides better access to the beach than the public access via the section line easement , with improvements including a turnaround area and during the dipnetting season portable bathrooms, waste removal, and fee shacks; and , WHEREAS, nearby Dunes Road also provides access to the public beach and includes a small parking lot; and, WHEREAS, the City of Kenai and the Kenai Peninsula Borough maintain roads on Royal Street and Dunes Road and do not maintain the road on the section line easement; and, WHEREAS, access to adjacent parcels would not be impacted by the vacation of the section line easement and the vacation would limit illegal trespassing on adjacent parcels ; and , WHEREAS , on August 23, 2017 , by Resolution PZ2017-28 the Planning and Zoning Commission of the City of Kenai recommended that the Kenai Peninsula Borough Planning Commission approve the Preliminary Plat of COOK INLET SHORES -2017 ADDITION AND SECTION LINE EASEMENT VACATION ; and , WHEREAS , on October 8, 2018, the Kenai Peninsula Borough Planning Commission met and approved the Preliminary Plat COOK INLET SHORES -2017 ADDITION AND SECTION LINE EASEMENT VACATION , consistent with the recommendation of the Planning and Zoning Commission for the City of Kenai; and , WHEREAS , on October 22 , 2018, the Kenai Peninsula Borough Plat Committee met and approved the Preliminary Plat COOK INLET SHORES -2017 ADDITION AND SECTION LINE EASEMENT VACATION, consistent with the recommendation of the Planning and Zoning Commission for the City of Kenai ; and , Resolution No. 2018-60 Page 2 of 2 WHEREAS , the Council for the City of Kenai may declare an easement not needed for a public purpose by resolution , pursuant to Kenai Municipal Code Section 22 .05 .11 O(b) -Determination as to Need for Public Use states, "Whether land previously dedicated to a public use should be dedicated to a different public use or should no longer be needed for public use shall be determined by the City Council by ordinance , except in cases of vacation of rights-of-way or easements which may be determined by resolution , either of which shall contain the new public use for which the property is to be dedicated or the reason the land is no longer needed for public use, the legal description of the property, and the address or a general description of the property sufficient to provide the public with notice of its location". NOW, THEREFORE , BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI , ALASKA: Section 1. That the thirty-three foot (33 ') wide Section Line Easement, along the southern boundary of Lot Two (2), Waterfront Estates , within the City of Kenai is no longer needed for a public purpose and that the Council of the City of Kenai consents to the vacation. The section line easement is located along the southern boundary of the property described as Lot Two (2), Waterfront Estates . The total width of the section line easement vacation is sixty-six feet, with the northern 33 feet being within the City of Kenai and the southern 33 feet being within the Kalifornsky a rea of the Kenai Peninsula Borough. Vacation of the section line easement would remove public access to the beach by continuing straight on Old Cannery Road. Access to the public beach via the section line easement continuing on Old Cannery Road is problematic because vehicles often get stuck and require assistance to be removed and it causes trespass issues with adjacent privately-owned parcels. The road within the section line easement is not maintained by the City of Kenai or the Kenai Peninsula Borough. Royal Street and Dunes Road provide superior access to the public beach . Royal Street is approximately 400 feet to the north of the section line easement and contains a turnaround , flat access with gravel to the beach , and is without visual obstructions . The Royal Street right-of-way e xpands from 60 feet to 85 feet just before reach ing the public beach. During dipnetting season, there are portable bathrooms , waste removal , and fee shacks at the Royal Street beach access. Dunes Road is approx imately 1,300 feet south of the section line easement proposed to be vacated and has a small parking lot. The City of Kena i maintains Old Cannery Road and the portion of Royal Street that heads north to the public beach . The Kenai Peninsula Boroug h maintains Dunes Road . Access to parcels adjacent to the vacated section line easement would not be impacted . Page 2 of 2 Resolution 2018-60 The preliminary plat was submitted to the City of Kenai in August 2017 by Integrity Surveys , Incorporated. It was approved by the City of Kena i Planning & Zoning Commission on August 23, 2017 with Reso lution PZ17-28 . On October 8, 2018, the Kenai Pen insula Borough Planning Commission approved the plat and on October 22, 2018 the Kenai Peninsula Borough Plat Committee approved the plat. The approvals were made with an exception to the block length requirement. The two blocks affected by the platting action are both longer than allowed , but the Borough agreed to the exception request for longer block lengths. In addition, the Borough stated a condition of approval would be to grant utility easements as requested by utility providers, including a request for an easement centered on their existing facilities from Alaska Communications (ACS). The section line easement vacation must also be approved by the State of Alaska Department of Natural Resources. The State has expressed verbal support, but not yet issued a written preliminary finding. The State assigned EV-3-278 to this section line easement vacation plat. The Borough normally limits vacation approval to one year from the request , but grants a four-year approval time period for any plat requiring approval from the State of Alaska . Plat area is zoned Rural Residential and therefore subject to said zone conditions. 2. Plat does not subdivide property within a public improvement district subject to special assessments. Status of surrounding land is shown . 5. Utility easements, if required, shall be shown . 6 . Surveyor shall verify that no encroachments ex ist.
