5. CONSIDERATION OF PLATS:
a. Resolution PZ2018-26 - Original Preliminary Plat of Anglers Acres Subdivision Shuey
Addition, submitted by McLane Consulting, Inc., P.O. Box 468, Soldotna, Alaska 99669,
on behalf of Curtis C. and Debra L. Shuey, 1530 Angler Drive, Kenai, Alaska 99611
The City Planner reviewed the staff report as provided in the meeting packet and specifically
noted the reason for the subdividing of Tract 3, Anglers Acres Subdivision Lowe Subdivision into
Tract 3A and Tract 3B was to allow the property owners to sell Tract 3B to the State of Alaska for
habitat protection. It was further noted on September 19, Kenai City Council approved the City
Manager to sign a letter of support for this purchase.The City Planner clarified that if Tract 3A
would be developed, the property owners would be required to obtain additional permits form the
City.
The City Planner reported that staff recommended approval of this preliminary plat, subject to the
following conditions:
x Further development of the property shall conform to all federal, State of Alaska, and local
regulations; and
x That the word “Owners” be changed to “Owner” below the signature line for property
owner, Curtis C. Shuey.
MOTION:
Commissioner Askin MOVED to approve Resolution No. PZ2018-26 with staff recommendations
and Commissioner Halstead SECONDED the motion.
Chair Twait opened the floor for public testimony.
Owner, Curt Shuey clarified the pedestrian access easement was a public access easement. He
added that Tract 3A was not planned for development and he intended to conserve the wetlands.
Mr. Shuey noted he did not expect any change to the neighborhood except possibly preserving
the natural setting around the other properties. He clarified that the dock was not suitable for boat
launch and not highly desired for public access shore fishing.
Mr. Shuey expressed appreciation for the attention by the City Planner and other Administration
that visited the property, noting the thoroughness and professionalism.
There being no one else wishing to be heard, public comment was closed.
Additionally, it was clarified it was designated as a pedestrian access to deter off-road vehicles
for habitat conservation and road access to the property would be via Angler Drive, a paved and
City-maintained road.

a. City Council – Council Member Knackstedt reviewed the action agenda from the
October 17 City Council Meeting. He specifically noted the elections were certified,
recognized the new Council Member, Robert Peterkin II, as well as the appointment of
Jennifer Dennis to the Parks and Recreation Commission and Mary Rhyner to the
Beautification Committee.
b. Borough Planning – Fikes reported the Commission met on October 22 for a plat
meeting only and reviewed nine plats but due to a lack of agenda items, the meeting
was canceled; the next meeting was scheduled for November 13.
c. Administration – City Planner Appleby reported on the following:
x A reminder that the early registration deadline for the Alaska Chapter of the
American Planning Association (APA) Conference was October 31, if any
members were interested in attending let staff know;
x A reminder to complete the survey that was emailed to determine potential
businesses and industries that were suitable and desirable in the City of Kenai, the
deadline is October 31;
x There was a recent article in the Peninsula Clarion of the Kenai Area Coordinated
Transportation Plan, regarding public transportation in the Kenai; if interested,
contact the City Planner for additional information; and
x A flyer was posted for Start-Up Week happening on November 11 - 16, and the
events specifically in Kenai were on November 13, a morning event at Veronica’s
Café while the Policy with a Pint event with City Administration would be in the
evening at Main Street Tap & Grill to discuss recent change to the airport land use
and answer questions.

14. COMMISSION COMMENTS & QUESTIONS
Commissioner Halstead noted concern that was brought to him regarding the marijuana shop,
East Rip regarding the fragrance and loitering occurring to nearby businesses.
Commissioner Fikes noted caution, suggesting loitering may be due to homelessness versus a
new business social situation.

ANALYSIS
The subject property is within the Suburban Residential zone. Pursuant to Kenai Municipal
Code 14.24.010, the minimum lot size is 7,200 square feet. The proposed Lot 4, Block 1,
is approximately 2.52 acres (109,744 square feet) and the proposed Lot 5, Block 1 is
approximately 0.78 acres (33,818 square feet), both of which meet the required minimum
lot size requirements. The proposed lots also both meet the minimum lot width of sixty
(60) feet, as specified by Kenai Municipal Code 14.24.020.
There are two single family dwellings located on the current parcel. Each structure is
serviced by City water and a private septic system.
The sixty (60) foot right-of-way for Fourth Street was dedicated through the plat of
Mommsen’s Additions No. 1 and 2; however, the road has not been developed. When the
initial residence was constructed in 2009, the City of Kenai and the property owners
entered into a Single Family Dwelling Access Right-of-Way Permit to Construct and
Maintain Driveway on Public Right-of-Way to provide access to the subject parcel. The
property owner constructed a gravel driveway and Johnson Engineering inspected the
driveway to verify that the driveway was constructed to the standards of the City of Kenai
Typical Section for a Single Family Dwelling Access Permit. The Public Works Director
reviewed the proposed plat and determined that it is not necessary for the property owners
to do any additional work to upgrade the driveway located in the right-of-way for Fourth
Street at this time. The property owners have expressed an interest in purchasing the City-
owned parcel to the north of the proposed Lots 4 and 5. In the event that this purchase is

ever completed, the City would require additional improvements to the right-of-way for
Fourth Avenue.
An installation is not required because the parcels are currently serviced by City water and
onsite septic systems. In addition, access is provided by the driveway located in the right-
of-way for Fourth Street.
The preliminary plat indicates that the driveway servicing the two residences is circular in
shape and connects the proposed Lots 4 and 5. If at some point the parcels are in
separate ownership, it may be necessary for the owners of each parcel to enter into an
easement allowing the owners to cross the property line between Lots 4 and 5 or to
redesign the driveways.
The preliminary plat will not affect the ten (10)-foot utility easement depicted on the
preliminary plat. The plat notes that no permanent structure shall be constructed within
the utility easement that would interfere with the ability of a utility to use the easement.
RECOMMENDATIONS
City staff recommends approval of the preliminary plat of Mommsen’s Subdivision
McDonald Addition, subject to the following condition:
1. Further development of the property shall conform to all federal, State of Alaska, and
local regulations.
2. This plat is a subdivision of Tract A, Block 1, Mommsen’s Subdivision 1988 Addition;
therefore, Block One (1) should be noted on the face of the plat.

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI RECOMMENDING THAT THE SUBDIVISION PLAT OF MOMMSEN’S
SUBDIVISION MCDONALD ADDITION ATTACHED HERETO AS EXHIBIT “A” BE
APPROVED SUBJECT TO THE CONDITIONS OUTLINED BELOW.
WHEREAS, the City of Kenai received the plat attached as Exhibit A from Edge Survey and
Design; and,
WHEREAS, the plat meets City requirements of the Suburban Residential Zone; and
WHEREAS, the plat accurately represents street names and surrounding properties; and,
WHEREAS, the City of Kenai and the property owner entered into a Single Family Dwelling
Access Right-of-Way Permit to Construct and Maintain Driveway on Public Right-of-Way to
provide access to the subject parcels and the gravel driveway was constructed to the standards
of the City of Kenai Typical Section for a Single Family Dwelling Access Permit; and
WHEREAS, the parcels are each serviced by City water and an onsite septic system, with access
provided by the driveway located in the Right-of-Way for Fourth Street, and an installation
agreement is not required; and
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING COMMISSION OF
THE CITY OF KENAI, ALASKA TO RECOMMEND APPROVAL OF THE SUBDIVISION PLAT
ATTACHED AS EXHIBIT “A”, SUBJECT TO THE FOLLOWING CONDITIONS:
1. Further development of the property shall conform to all federal, State of Alaska, and local
regulations.
2. The proposed plat is a subdivision of Tract A, Block 1, Mommsen’s Subdivision 1988
Addition; therefore, Block One should be noted on the face of the plat.

SUBJECT: Plat for The Lake at Kenai 2016 Addition – Time Extension

On October 23, 2018, the surveyor for The Lake at Kenai 2016 Addition requested a two-year
time extension for the finalization of the plat of The Lake at Kenai 2016 Addition. The Planning
and Zoning Commission recommended approval of the preliminary plat on August 24, 2016
(PZ16-20). The City of Kenai is in the process of preparing an installation agreement for the
development of the right-of-way for Peace of Mind Drive. When Phase Two is developed, the
City of Kenai will enter into another installation agreement for the development of the right-of-
way for Anglers Cove Court.
The Kenai Peninsula Borough Plat Committee granted conditional approval of the preliminary
plat on September 26, 2016. On November 14, 2016, the Kenai Peninsula Borough Planning
Commission held a reconsideration review of the preliminary approval and voted by majority
consent to uphold the September 26, 2016 Plat Committee decision to grant conditional
preliminary approval of the Lake at Kenai 2016 Addition.
The Kenai Peninsula Borough requires that the surveyor obtain concurrence from the City of
Kenai Planning and Zoning Commission for the two-year time extension to be granted. If the
Planning and Zoning Commission concurs, City staff would sign the attached letter of non-
objection to the time extension. City staff have no issues with the time extension request and
recommend approval. Please note that the same conditions from PZ16-20 would still apply to
the approval of the plat with the time extension. A copy of PZ16-20 and the plat are attached for
reference.
