ORDINANCE NO. 1645.95
AN ORDINANCE OF TH$ COUI~TCIL OF THE CITY OF KENAI, ALASKA, AMENDING
TITLE 4 OF THE KENAI MUNICIPAL, CODE, ENTITLED "LIIVIFORIVi BUILDING
CODES," TO ADOPT AND INCORPORATE BY REFERENCE THEREIN THE 1993 AND
1994 EDITION OF CERTAIN CODES.
WHEREAS, the City of Kenai has been operating on 1991 Uniform Building Codes; and
WHEREAS, the International Conference of Building Officials, the International Association of
Plumbing and Mechanical Officials, and the National Fire Protection Association have updated
the codes promulgated by them; and
WHEREAS, the content of the Uniform Building Codes have not changed but the format has
changed to a common code format with the ultimate goal of the code format becoming common
throughout the United States;
NOW THEREFORE BE IT ORDAINED BY TLIE COUNCIL OF THE CITY OF KENAI,
ALASKA THAT the 1994 editions of the Uniform Building Code, the Uniform Building Security
Code, the Uniform Code for Abatement of Dangerous Buildings, the Uniform Sign Code, the
Uniform Mechanical Code, the Uniform Plumbing Code, and the 1993 National Electrical Code
as amended by the City of Kenai, Alaska, are adopted by reference and incorporated in the
Kenai Municipal Code, Title 4, as stated in Attachment "A."

4.05.010 A o ion: There is hereby adopted for the purpose of establishing rules and
regulations for the construction, alteration, removal, demolition, equipment, use and occupancy,
location, and maintenance of buildings and structures, including permits and penalties, [THA1~.
os certain bound volumeg known as the "Uniform Building Code", [i991] l~ EditYOn, of
the International Conference of Building Officials, including the appendices, except for such
portions as are herein deleted, modified, or amended, and the same is hereby adopted and
incorporated as fully as if set out verbatim herein.
4.05.025 Application for Permit:
Section [302(b)] 1 .3 2 of the Uniform Building Code as adopted by this chapter is
amended by adding the following:
"As a requirement for obtaining a building permit for a new or enlarged structure
the property owner is required to submit a site plan stamped by a state registered
land surveyor which accurately shows by dimensions and to scale the location and
outline of the proposed structure in relationship to the property lines, setbacks,
and easements."
4.05.27 Permits Issuance: Section [303(c)] 106.4,E Validity of Permit of the Unifornn
Building Code as adopted by the chapter is amended by adding the following:
"It is the property owner's responsibility to have the property corners physically
located and marked by a state registered land surveyor and to make sure that the
structure is accurately placed on the site as per the submitted site plan."

4.05.030 Permit Fees: The first paragraph of Section [304(a)] 107.2 of the Building
Code adopted by this chapter is amended to read as follows:
"Sec. [304(a)] 107.2 Buildin Permit Fees. The fee for each building permit shall
be paid to the City as set forth in Table No. [3-A] 1-A of the Uniform Building
Code, except that fees for new construction of Group R-3 and Group [M-1] U-1
occupancies, or portions thereof as follows:
(1) Group R-3--------$0.14 per square fool
(2) Group [M-1] U-1--------$0.07 per square foot"
4.05.145 Group R Division 3 Occu ties: Section [1201] ~i of the Uniform
Building Code as adopted by this Chapter is amended by deleting the last paragraph.
4.05.150 Appendix Grou~R Division 3 Occupancies: Chapter [12] ~ of the
Appendix of the Uniform Building Code as adopted by this Chapter is amended by deleting
Division [1] 111.
4.06.010 do lion: There is hereby adopted for the purpose of establishing rules and
regulations for building security that certain code known as the "Uniform Building Security
Code," [1991] ,J9~4 Edition, of the International Conference of Building Officials, except for
such portions as are hereinafter deleted, modified, or amended, and the same is hereby adopted
and incorporated as fully as if set out verbatim herein.

property, and public safety, that certain code known as the "Uniform Code for the Abatement
of Dangerous Buildings," [1991] 1~4 Edition, of the International Conference of Building
Officials, except for such portions as are hereinafter deleted, modified, or amended, and the
same is hereby adopted and incorporated as fully as if set out verbatim herein.
4.15.010 Ado~t~o~: There is hereby adopted for the purpose of establishing rules and
regulations to promote the development of better sign construction and to provide minimum
standards to safeguard life, health, property, and public welfare, by regulating structural
requirements for all signs and sign structures located outside of buildings, that certain code
known as the "Uniform Sign Code," [1991] ~9 Edition, of the International Conference of
Building Officials, except for such portions as are hereinafter deleted, modified, or amended;
and the same is hereby adopted and incorporated as fully as if set out verbatim herein.
4.20.010 d ti :There is hereby adopted for the purpose of establishing rules and
regulations for the installation and maintenance of heating, ventilating, cooling, and refrigeration
systems, that certain code known as the "Uniform Mechanical Code," [ 1991 ] 1 4 Edition, of
the international Conference of Building Officials, including the appendices, except for such
portions as are hereafter deleted, mod~ed, or amended; and the same is hereby adopted and
incorporated as fully as if set out verbatim herein.
4.20.030 Fps: Sec. [304] 115.2 of the Mechanical Code adopted by this chapter is
• amended to [ADD THE FOLLOWING] read:
"If a building permit is issued, these fees shall be considered as paid as a part of
such permit fee. If no such building permit is issued, [THEN SEC. 304 SHALL
APFLY] th~fee shall. be com up ted a rding to Section 107.2 of the 1994 Edition
of the Uniform Building code."
4.25.010 Ado ion; There is hereby adopted for the purpose of establishing rules and
regulations for the qualification of persons engaged in the business of plumbing and the
installation, alteration, or repair of plumbing systems, that certain bound volume known as the
"Uniform Plumbing Code", [1991] ~4 Edition, of the International Association of Plumbing
and Mechanical Officials, including the appendices, except for such portions as are hereinafter
deleted, modified, or amended; and the same is hereby adopted and incorporated as fully as if
set out verbatim herein.
4.25.020 Fem.: Sec. [30.4(x)] 0 4 1 Permit Fees of the Plumbing Code adopted by
this chapter is amended to [ADD THE FOLLOWING] rte:
"If a building permit is issued, these fees shall be considered as paid as a part of
such permit fee. If no such building permit is issued, then the fee schedule [SET
FORTH HEREIN SHALL APPLY] shall be computed accordin tg o Section X07.2
of _the 1994 Edition of the Uniform Building Cade."

including the Uniform Administrative Code Provisions, except for such portions as ate
hereinafter deleted, modified, or amended; and the same is hereby adopted and incorporated as
fully as if set out verbatim herein.

[THIS CHAPTER] TITLE 4 shall be guilty of a violation, and each such person shall be deemed
guilty of a separate offense for each and every day or portion thereof during which any violation
of any of the provisions of this chapter is committe4, continued, or permitted; and upon
conviction of any such violation, such person shall be subject to punishment as provided for
violations in KMC 13.05.010.
