HomeMy WebLinkAboutORDINANCE 1650-1995Suggested by: Council CITY OF KENAI ORDINANCE NO. 1650-95 • AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA AMENDING THE METHOD FOR CALCULATING THE TIME PERIOD IN WHICH TO SCHEDULE BOARD OF ADJUSTMENT HEARINGS UNDER KMC 14.20.290. WHEREAS, KMC 14.20.290(b)(1)stites that a hearing on an appeal to the Board of Adjustment shall be heard within thirty (30) days of the filing of the appeal; and WHEREAS, because of time constraints hearings may have to be set on weekends to avoid expiration of the thirty-day period; and WHEREAS, scheduling appeal hearings on the weekend makes it mare difficult for the public to attend and participate in such hearings; and WHEREAS, allowing a hearing to be held on the following Monday if the end of the thirty day period should fall on a weekend or a municipal holiday would increase public participation; NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA THAT KMC 14.20.290(b)(1) is amended as follows: (b) Procedure: (i) The Board of Adjustment shall set a date for and hold a hearing on all appeals within thirty (30) days of the filling of the appeal. Notice of the time and place of such hearing shall be mailed to all parties interested and to all property owners within 300 feet of the property involved at least ten (10) days prior to the hearing.
