SCHEDULED PUBLIC COMMENT – (10 minutes) None scheduled. 4. UNSCHEDULED PUBLIC COMMENT – (3 minutes) None. 5. CONSIDERATION OF PLATS a. Resolution PZ2018-27 – Original Preliminary Plat of Mommsen’s Subdivision McDonald Addition, submitted by Edge Survey and Design, 43335 K-Beach Rd., Suite 16B, Soldotna, AK 99669, on behalf of Bret and Kimberly McDonald, P.O. Box 971, Drive, Kenai, Alaska 99611 The City Planner reviewed the staff report as provided in the meeting packet and specifically noted the Public Works Director reviewed the proposed plat and determined that it was not necessary for the property owners to do any additional work to upgrade the driveway located in the right-of-way for Fourth Street at this time. The City Planner reported that staff recommended approval of this subdivision plat, subject to the following conditions: x Further development of the property shall conform to all federal, State of Alaska, and local regulations; and x This plat is a subdivision of Tract A, Block 1, Mommsen’s Subdivision 1988 Addition; therefore, Block One (1) should be noted on the face of the plat. MOTION: Commissioner Peterson MOVED to approve Resolution No. PZ2018-27 with staff recommendations and Commissioner Askin SECONDED the motion. Chair Twait opened the floor for public testimony. Jason Young, Surveyor, clarified that the driveway could be gated, noting it was more of a path than a driveway. There being no one else wishing to be heard, public comment was closed. Clarification was provided that if there was further development in the future, the City would likely require additional improvements to the right-of-way for Fourth Street. VOTE: YEA: Springer, Halstead, Peterson, Fikes, Askin, Greenberg, Twait NAY: MOTION PASSED UNANIMOUSLY. 6. UNFINISHED BUSINESS – None. NEW BUSINESS a. Discussion/Recommendation – Authorizing the City Planner to draft and send a letter to the Kenai Peninsula Borough supporting a request by the developer of The Lake at Kenai for a two-year time extension to finalize the plat. The City Planner clarified the Kenai Peninsula Borough required that the surveyor obtain concurrence from the City of Kenai Planning and Zoning Commission for the two-year time extension to be granted. It was noted City staff had no concerns with the time extension request and recommended approval. MOTION: Commissioner Peterson MOVED to approve the two-year time extension and Commissioner Fikes SECONDED the motion. VOTE: YEA: Halstead, Peterson, Fikes, Askin, Greenberg, Twait, Springer NAY: MOTION PASSED UNANIMOUSLY. 8. PENDING ITEMS – None. 9. REPORTS a. City Council – Council Member Molloy reviewed the action agenda from the November 7 City Council Meeting. He specifically noted he was designated as the liaison for the Planning and Zoning Commission for the next year. He further noted a new student representative, Tristan Summers, was inducted to the Kenai City Council, and Tim Navarre was re-elected as Vice-Mayor and would soon be sworn in as the President of the Alaska Municipal League. b. Borough Planning – Fikes reported the Commission met on November 13 and reviewed and approved six plats and conducted two hearings on marijuana licenses, one in Homer and one in Nikiski, both approved and recommended to the Borough Assembly for review It was also reported a town hall meeting occurred in Anchor Point to discuss Hilcorp Alaska’s request for an oil and gas lease which was passed by majority vote. c. Administration – City Planner Appleby reported on the following: x She attended an Alaska LNG Project meeting and the draft Environmental Impact Statement (EIS) was expected in February 2019; the main concerns of the project included water supply, road re-routes, Payments in Lieu of Taxes (PILT) and the potential significant increase of people in the area; x Staff continues to review data and update the land management database; x She coordinated a meeting with other department leads to discuss long-term technology updates that would be useful to the City of Kenai and for better efficiency; Page 3 of 28 December 12, 2018 City of Kenai Planning and Zoning Commission ___________________________________________________________________________________ Planning and Zoning Commission Meeting Page 4 of 4 November 14, 2018 x In preparation for snow removal, the Planning Department worked with the Streets Department to clear items in the Right-of-Way; x The Start-Up Week events were in progress; she attended a business session with panelists reflecting on the City of Soldotna’s recent sign code update as being the one thing the City could do better to support businesses, and noted this would be useful when updating the City of Kenai sign code; and the City of Kenai held an event called Policy with a Pint, and a write-up would be provided at the next meeting; x The American Planning Association (APA) Conference is January 13 – 19, 2019; and x This week the Alaska Municipal League (AML) Conference was happening in Anchorage. The City Planner noted the upcoming Commission meetings and a request to cancel the December 26 meeting. Hearing no objections, the meeting was canceled and notice would be published. 10. Four parcels will be divided into two lots (creating eight lots), with the four new separate lots below the bluff to be purchased by the City and the four new separate lots above the bluff to be retained in the same private ownership. Lot 5A will remain unchanged, with the exception of a temporary work easement to provide access for construction and maintenance of the Bluff Erosion Stabilization Project. All of the proposed lots are within the Central Commercial (CC) Zone. The CC Zone has a minimum lot size of 7,200 square feet and a minimum lot width of sixty (60) feet, pursuant Page 6 of 28 December 12, 2018 City of Kenai Planning and Zoning Commission PZ2018-29 Staff Report Page 3 to Kenai Municipal Code 14.24.010 and 14.24.020. The proposed parcels all meet the minimum requirements for lots sizes and widths. An installation agreement is not required because the developed lots are connected to City water and sewer service. The parcel owned by the Vann Revocable Trust is a vacant lot; however, water and sewer lines are located within Peninsula Avenue. The proposed plat will not change the existing access or existing utility easements. A short summary of the particulars for each parcel follows: Lofstedt Parcel – Lots 6A and 6B, Block 19, Kenai Townsite 2018 Addition: The proposed Lots 6A and 6B, Block 19, Kenai Townsite 2018 Addition would be approximately 15,846 square feet and 10,563 square feet. These lot sizes meets the minimum requirement of the CC Zone. The proposed lots also meet the minimum lot width for the CC Zone. Access to the property is provided by Riverview Drive, a City-maintained gravel road. The City plans to purchase the proposed Lot 6B (below the bluff) as part of the Bluff Erosion Stabilization Project. The proposed Lot 6A (above the bluff) would remain in ownership of Diana Lofstedt. Lofstedt Parcel – Lots 10B1 and 10B2, Block 19, Kenai Townsite 2018 Addition: The proposed Lots 10B1 and 10B2, Block 19, Kenai Townsite 2018 Addition would be approximately 10,404 square feet and 12,883 square feet. These lot sizes meets the minimum requirement of the CC Zone. The proposed lots also meet the minimum lot width for the CC Zone. Access to the property is provided a private driveway located on the adjacent Lot 10A, Block 19, Original Townsite of Kenai. This private driveway is not maintained by the City. The City plans to purchase the proposed Lot 10B2 (below the bluff) as part of the Bluff Erosion Stabilization Project. The proposed Lot 10B1 (above the bluff) would remain in ownership of Diana Lofstedt. A fifteen foot (15’) Electrical Distribution Line Easement is shown along the west boundary of Lot 10B on the Miller House Subdivision, Plat Number 95-37. City staff recommends this easement also be delineated on the preliminary plat for Kenai Townsite 2018 Addition and it is included as a condition of approval. Dunn Parcel – Lot 5A, Block 19, Kenai Townsite 2018 Addition: The proposed Lot 5A Kenai Townsite 2018 Addition would be approximately 20,077 square feet. This lot size meets the minimum requirement of the CC Zone. The proposed lots also meet the minimum lot width for the CC Zone. Access to the property is provided by Riverview Drive, a City-maintained gravel road. The property would remain in the ownership of Michael D. and Linda E. Dunn. The owners have agreed to grant a Temporary Work Easement and Bank Protection Easement along the southern boundary of Lot 5A to the City of Kenai as part of the Bluff Erosion Stabilization Project. The owners do not wish to sell any portion of their property to the City. A public right-of-way easement is shown along the northern boundary of Lot 5A on the Original Townsite of Kenai Laddville Replat, Plat Number 94-91 as recorded in Book 29 at Page 128. This right-of-way easement should also be delineated on the preliminary plat for Kenai Townsite 2018 Addition and it is included as a condition of approval. A ten foot (10’) utility easement is shown along the northern boundary of Lot 5A on the Original Townsite of Kenai Laddville Replat, Plat Number 94-91 as recorded in Book 29 at Page 128. The City plans to purchase the proposed Lot 7D (below the bluff) as part of the Bluff Erosion Stabilization Project. The proposed Lot 7B (above the bluff) would remain in ownership of the Vann Revocable Trust. Karaffa and Consiel Parcel – Lot 7A and 7C, Kenai Townsite 2018 Addition: The proposed Lots 7A and 7C, Block 19, Kenai Townsite 2018 Addition would be approximately 41,987 square feet and 19,855 square feet. These lot sizes meet the minimum requirement of the CC Zone. The proposed lots also meet the minimum lot width for the CC Zone. Access to the property is provided by Broad Street, a City-maintained paved road. The City plans to purchase the proposed Lot 7C (below the bluff) as part of the Bluff Erosion Stabilization Project. The proposed Lot 7A (above the bluff) would remain in ownership of Crystal Consiel and Paul P. Karaffa. RECOMMENDATIONS City staff recommends approval of the preliminary plat of Kenai Townsite 2018 Addition, subject to the following conditions: 1. Further development of the property shall conform to all federal, State of Alaska, and local regulations. 2. The ten foot (10’) utility easement located along the northern boundary of Lot 5A designated on the Original Townsite of Kenai Laddville Replat, Plat Number 94-91 should be delineated on the preliminary plat. 3.
