Airport Manager – Bondurant reported on the following:  An update was provided of the Terminal Rehabilitation Project;  On December 5th she attended an after-earthquake meeting at the Kenai Peninsula Borough Office of Emergency Management;  The Airport would not be decorating for the holidays due to the Terminal Rehabilitation Project; and  On December 19th at 3 p.m. there would be an after-earthquake meeting at the Kenai Airport Operations Facility. b. City Council Liaison – Knackstedt reported on the October 17, November 7 and December 5 City Council meetings actions. 8. NEXT MEETING ATTENDANCE NOTIFICATION – January 10, 2019 9. This kiosk has been in the terminal building since January 2002 . The special use permit will be effective from January 10, 2019 to June 30 , 2019. Attachment www .K enaiAirp ort .co m Page 5 of 21 SPECIAL USE PERMIT THE CITY OF KENA I (CITY) for the considerations and pursuant to the conditions and requirements set forth below, hereby grants to ALASKA CHALLENGER CENT ER FOR SPACE SCIENCE TECHNOLOGY, I NC. (PERMITTEE), whose address is 9711 Kenai Spur Highway, Kenai, AK 99611, the non-exclusive right to use that area described below: A small area in the Kenai Airport Tenninal approximately 3.5 feet by 1.5 feet in size and located as further shown in Attachment A (the Premises). 1. TERM. This special use permit shall commence and be effective on the January I 0, 2019 , and shall extend through June 30, 2019. 2. PERMIT FEES. The fee for this pe1mit is waived. 3. USE. The use of the Premises by Permittee is for the purpose placing a small container or kiosk for the collection of donations to support the activities of Permittee (fundraising). The kiosk will not have any staff monjtoring the Premises on a regular basis. Permittee will periodically collect the funds deposited therein when Pem1ittee deems, in its discretion , to be appropriate. 4. LICENSES AND P E RMI TS; LAWS. Permittee shall adhere to all federal , state, and local laws , ordinances , and regulations while conducting its activities on the Premises. Permittee shall obtain and maintain all required federal, state, and local licenses, permits, certificates, and other documents required for Permittee's operations under the Permit. Permittee shall provide proof of compliance to the City upon request by the City. 5. NO EXCLUSIVI TY. This Permit is not intended to grant any exclusive use to the described Premises. 6. INSURANCE. Permittee shall provide proof of insurance cov erage, including worker 's compensation , if necessary, in an amount satisfactory to the City Manager, and listing the City as an additional insured. 7. INDEMNITY, DE F END, AND HOLD HARMLESS AGREEMENT. Permittee agrees to indemnify, defend, and hold the City, its agents, and employees hannless from and against any and all liability, loss, suit, claim, judgment, fine, demand, damage, penalty, property damage, or personal injury of whatever kind, including sums paid in settlements of claims , attorney fees, consultant fees, expert fees , or costs incmTed arising from or Special Use Permit-Challenger Center Page I of 4 Page 6 of 21 connected with the Permittee's use or occupation of the Premises. Permittee shall give the City of Kenai reasonable notice of any such claims or actions. However, Permittee shall not be responsible for any damage or claims from the sole negligence, activities, or omission of the City or its agents or employees. 8. PERSONALITY. Pennittee is solely responsible for the maintenance of the kiosk. Permittee must keep the kiosk and all other materials on the Premises clean and in good condition. Pennittee shall remove any and all personal property from the Premises at the termination of this Pem1it (or any renewal thereof). Personal property placed or used upon the Premises will be removed and/or impounded by the City, if not removed upon termination of this Permit and when so removed and/or impounded, such property may be redeemed by the owner thereof only upon the payment to the City of the costs of removal plus storage charges of $25.00 per day. The C ity of Kenai is not responsible for any damage to or theft of any personalty of Permittee at or from the Premises. 9. NO WAIVER. Failure to insist upon a strict compliance with the tenns , conditions, and/or any requ irement herein contained, or referred to, shall not constitute or be construed as a waiver or relinquishment of the right to exercise such terms , conditions or requirements. 10. MUTUAL CANCELLATION. This Pemut may be cancelled in whole or in pa1i with one month written notice by Permittee or the City. 11. NO DISCRIMINATION. Pennittee will not discriminate on the grounds of race, color, religion, national origin, ancestry, age, or sex against any patron, employee, applicant for emp loyment, or other person or group of persons in any manner prohibited by federal or State law. Pe1mittee recognizes the right of the City to take any action necessary to enforce this requirement. 12 . ASSUl\1PTION OF RISK. Pennittee shall provide all proper safeguards and shall assume all risks incu1Ted in its use of the Premises. 13. NO JOINT VENTURE. In March 1, 2016 the City of Kenai entered into an Agreement for Airport Security Guard Services with Guardian Security Systems, Inc. for the Airport terminal building, vehicle parking lots, aircraft tie down areas, float plane basin, ski strip areas, the airport perimeter fence, the Airport Operations Facility, and the Air Traffic Control Tower for a period of three years with the option to extend for an additional two (2) years if the City and contractor mutually agree in writing. The Contractor requests to renew under the same terms and conditions . The Airport has a current Certificate of Insurance on file. Attached for your review and recommendation is the First Amendment to Agreement for Airport Security Services which shall be effective March 1, 2019. Attachment www.KenaiAirport.com Page 11 of 21 FIRST EXTENSION TO KEN AI MUNICIPAL AIRPORT AGREEMENT FOR AIRPORT SECURITY GUARD SERVICES Th is First Extension to the Kenai Municipal Airport Agreement for Airport Security Guard Services is made as of March 1, 2019, by and between the City of Kenai (Owner), a municipal corporation whose address is 210 Fidalgo Avenue , Kenai, Alaska 996 1 1, and Guardian Security Systems, Inc. (Contractor), an Alaska corporati on whose address is 2600 Seward Highway, Anchorage, A laska, 99503. RECITALS Effective March 1, 2016, the City entered into an Agreement for Airport Security Guard Services with Guardian Security Systems, Inc., of Anchorage for Airport Security Guard Services for the facilities at the Kenai Municipal Airp01i terminal building, vehicle parking lots, a ircraft tie down areas, float plane basin, ski strip areas, the air port perimeter fence, the Airpmi Operations Faci li ty, and the Air Traffic Control Tower. The City and Guardian Security Systems, Inc. wish to extend the Agreement to extend under the same terms and conditions. The City and Guardian Security Systems, Inc. agree as follows : 1. Pursuant to Section II, of the Agreement, Tem1, providing the option of the parties to extend the Agreement by mutual written consent, the Agreement tem1 is extended so that the Agreement will end on February 28 , 2020. 2. In-house Activities - Snow and ice control activities consist mainly of ice control with sanding ; all operations are going well . Airfield operations staff have kept the runway open and available; any cancelled flights were due to fog/freezing fog either in Kenai or Anchorage. Airport Administration continues to work with City Administration on the revision to the land leasing policy; specifically lands outside of the airport reserve. The Airport is also preparing for the FY2020 budget session . The Airport will not be putting up holiday lights, window painting , or having the Annual Christmas Tree contest due to the terminal rehabilitation project. This will all be back in 2019 when the project is complete. November 26, 2018 -Airport Manager and Public Works Director attended an FAA meeting with small Airport Sponsors in Anchorage . Topics of discussion included ACIP polices and best practices , environmental clearance changes , supplemental $1 B status , Page 19 of 21 Page 2 of 2 December 2018 compliance, and Part 139 updates. Four applications were submitted in October for consideration in the $1 B supplemental project; however, there probably will not be an announcement of successful projects until February 2019. December 5, 2018 -Airport Manager attended an Earthquake after Action/Lessons Learned Meeting at the OEM office . The major topics of discussion were the communications flow during and after the event and the tsunami warnings. Recommendations were to continue with assessments and notify OEM of any issues . An assessment team will be in town the week of December 10, 2018. December 12, 2018 -The Airport will also be having an After Earthquake meeting with tenants, AFSS , and Tower personnel at 1 :30pm at the Kenai Airport Operations Facility .
