Suggested by; Administration CITY OF KENAI N0..1414-91 AN ORDINANCE OF THE COUNCIL, OF THE CITY Off' KFNAI, AI~ASI6A FINDING THAT CERTAIN FORECLOSED PROPERTIES ARE NOT NEEDED FOR PUBLIC PURPOSE AND MAY BE SOLD. WHEREAS, the Gity of Kenai has acquired numerous parcels of land through taM and special assessment foreclosures, and WHEREAS, the City administration has selected the parcels that appear on Exhibit A, which is attached to this ordinance, as those that should be sold pursuant to local ordinances and State statutes. NOW, THEREFORE, BE IT ORDAINED BY TfIE COUNCIL OF THE CITY OF KENAI, ALASKA that all of the parcels that are listed on Exhibit A, which is a part of this ordinance, are not needed for public purpose and may be sold. Lands The Kenai Planning and Zoning Commission and the Kenai Parks and Recreation Commission have reviewed Exhibit A attached to the referenced ordinance. They recommended a minimum of five acres be retained for public purpose from the first parcel on the list which contains approximately 77 acres. Attached is a map which indicates the five acre portion. Also attached are portions of the minutes for the referenced commission meetings. • If Council chooses to retain for public purpose a portion of the first parcel, the entire parcel should be pulled from the sale. There may not be adequate time prior to the proposed May 14 sale date to subdivide the property. If Council chooses to retain a portion of the parcel, several problems or questions come to mind regarding the future sale of the remaining portion of the parcel. KMC 22.05.030(c) says proceeds of the sale are subject to the rights of the former owner and the Borough. For the portion retained for public purpose the City would have to pay the Borough taxes and City assessments which would have to be prorated. KMC 22.05.100 says the former owner may repurchase up to the time of sale. If the parcel is subdivided, the rights of the former owner to repurchase need to be investigated. Council may wish to: 1. Approve the ordinance, including the current Exhibit A. In this case, the third "Whereas" should be deleted since it will not be a true statement, or 2. After discussion it was felt a portion of Tract 1, Parcel No. X39-101-18, which is a portion of SE 1/4 lying east of Mommsen Subdivision, Addition No. 2, Sec. 25, TbN, R12W, next to Xenai Chiropractic, should be retained. All bids must be submitted in writing on the bid form included in this bid package. Bidders may copy the blank form for the purpose of bidding on several parcels. All bid forms must be signed and completely filled out. Bidders must be at least eighteen years ~f age at the date of the bid opening. Any irregularities on the bid form, such as incomplete information, insufficient or inconsistent identification of the property, or lack of signature may invalidate the bid. The City of Kenai will pay or satisfy all City special assessments (including deferred assessments) from the proceeds of the sale. In addition, the City of Kenai will pay or satisfy all City and Kenai Peninsula Borough property taxes through and including the 2991 tax year. The buyer will take the property with no amounts due for City or Borough property taxes or City special assessments. All property is to be sold subject to any and all restrictions, easements, or reservations of record, zoning ordinances, and any and all plat requirements and covenants. The City does not warrant that the parcels are suited for any particular use whatsoever. There may be major geophysical hazards, access problems, prior use commitments or easements, difficult soils or wetlands, or other problems that might make any of these parcels difficult or impossible to use. Because of these possible problems all prospective bidders are urged to examine carefully any parcels they are interested in prior to the sale. Prospective buyers are advised that the City does not warrant for its right, title, or interest in any of the properties. Conveyance will be made by quitclaim deed. No subsurface interest will be conveyed to the buyer.
