HomeMy WebLinkAboutResolution No. 2019-06thee1"1y~f KENAI, ALASKA "V/ Sponsored by: Mayor Gabriel, Vice Mayor Navarre Council Members Molloy, Glendening , Pettey, Knackstedt, Peterkin CITY OF KENAI RESOLUTION NO. 2019 • 06 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AUTHORIZING THE EXPENDITURE OF UP TO $1,000,000 IN SUPPORT OF THE PRE-CONSTRUCTION ENGINEERING AND DESIGN PHASE OF THE KENAI BLUFFS BANK STABILIZATION PROJECT AND AUTHORIZING THE CITY MANAGER TO ENTER INTO A MEMORANDUM OF AGREEMENT WITH THE U.S. ARMY CORPS OF ENGINEERS FOR THE ACCEPTANCE OF CONTRIBUTED FUNDS . WHEREAS, the City has designated the Kenai River Bluff Erosion Project its number one federal and state funding priority for a number of years; and, WHEREAS, the Final Integrated Feasibility Report and Environmental Assessment, and Finding of No Significant Impact was provided by the U.S. Army Corps of Engineers (USACE) in November, 2018; and, WHEREAS, the City share of the project, which may be comprised of City, State, or eligible Federal funds , is 35% of project costs associated with design and construction of the project; and, WHEREAS, the estimated cost of the pre-construction engineering and design (PED) phase of the project is $1,000,000, and the City will be covering all of those costs; and, WHEREAS , if the project goes through to construction it is anticipated that the City's full funding of the PED phase would be credited towards our ultimate cost share of 35% for the total project; and , WHEREAS, the City has received $4,000,000 in grants from the State of Alaska Department of Commerce, Community and Economic Development for the Kenai Bluff Stabilization Project of which approximately $3,400,000 is unspent to date and available to fund the PED phase of the project; and, WHEREAS, the USACE may accept contributed funds from political subdivisions on authorized projects and the USACE is considering the City's request. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA: Sect ion 1. That the City Manager is authorized to provide funding to the U.S . Army Corps of Engineers up to $1 ,000,000 in support of the pre-construction engineering and design phase of the Kenai Bluffs Bank Stabilization Project. Section 2. That the City Manager is authorized to enter into a memorandum of agreement with the U.S. Army Corps of Engineers for the acceptance of contributed funds . If the project goes through to construction, the PED phase contribution would be credited towards the City's 35% matching requirement. The Director's Report, the final step in the completion of the Feasibility Report, must be signed by the United States Assistant Secretary of the Army -Civil Works prior to the commencement of the PED Phase. U.S. Army Corps of Engineers Headquarters staff indicate that the Director's Report is scheduled for signature prior to the end of January 2019. Due to the continuing erosion of the Kenai bluff and construction cost inflationary pressures, it is imperative that the PED Phase begin as quickly as possible after signature, without unnecessary delays.
