HomeMy WebLinkAboutOrdinance No. 3047-2018Sponsored by: Admin istration C ITY OF KENAI ORDI NANCE NO. 3047-2018 SUBSTITU TE AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI , ALASKA, INCREASING ESTIMATED REVENUES AND APPROPRIATIONS IN THE GENERAL FUND, NON- DEPARTMENTAL, DEPARTMENT AND THE WATER & SEWER FUND, WATER DEPARTMENT FOR PAYMENT OF A PROPERTY INSURANCE DEDUCTIBLE FOR DAMAGE TO CITY FACILITIES CAUSED BY THE NOVEMBER 30, 2018 SOUTHCENTRAL ALASKA MAGNITUDE 7 .0 EARTHQUAKE. WHEREAS , a magnitude 7 .0 earthquake struck Southcentral Alaska, just north of Anchorage on November 30, 2018; and , WHEREAS, to date, City personnel have identified moderate damage at two City facilities , the City Dock and Water Production Well House #1, and minor damage at other City facilities; and , WHEREAS, the City did purchase an earthquake rider to its property insurance which will cover the repai r cost for most items less the policy's $25,000 deductible. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, as follows : Section 1. That the estimated revenues and appropriations be increased as follows : General Fund: Increase Estimated Revenues - Appropriation of Fund Balance Increase Appropriations - Non-Departmental -Insurance $12,500 $12 ,500 Section 2 . That the estimated revenues and appropriations be increased as follows: Water & Sewer Fund: Increase Estimated Revenues - Appropriation of Fund Balance Increase Appropriations - Water -Insurance $12,500 $12,500 Sectio n 3. Severability: That if any part or provision of this ord inance or application thereof to any person or circumstances is adjudged invalid by any court of competent jurisdiction , such judgment shall be confined in its operation to the part, provision, or application directly involved in all controversy in which this judgment shall have been rendered, and shall not affect or impair the validity of the remainder of th is title or application thereof to other persons or circumstances. Section 4 . Effective Date: That pursuant to KMC 1 .15.0?0(f), this ordinance shall take effect immediately upon enactment. The purpose of this memo is to recommend passage of Substitute Ordinance No . 3047-2018 to provide funding for payment of the City's insurance deductible resulting from damage caused by the November 30, 2018 7 .0 magnitude earthquake . Two facilities in particular experienced fairly costly damages. The building structure housing the wellhead at Well House #1 has subsided several inches and at the City Dock, several structural concrete cracks have been identified. The Public Works and Finance Department met with an insurance adjuster on December 1 O, 2018. An Engineer's assessment of the damages will assist the City in filing and obtaining an insurance claim for the damages, as well as provide for a path forward in repairing the facilities. Both facilities are in stable condition and pose no immediate threat to the public. Well House #1 is not the City's primary source of water, and the City Dock remains closed as it has been throughout much of this year. As originally introduced, Ordinance 3047-2018 would have required the City to procure and contract for engineering services for the damage assessment and repair design . Substitute Ordinance 3047-2018 will provide funding for payment of the City's deductible for this claim and our insurer will procure the needed engineering services. The City will be involved with selection of the engineer but cost will be paid directly by our insurer. The Administration is in support of this Substitute Ordinance.
