HomeMy WebLinkAboutORDINANCE 1447-1991.~ .. suggested bys City Council CITX OF KENAI ORDINANCE 3~~7-9i AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA AMENDING THE K;ENAI MUNICIPAL CODE, TITLE 7, CHAPTER 15, SECTION 080 ENTITLED "TELEPHONE POLLS - AUTHORITX, PROCEDURE, RECORDATION:" WHEREAS, KMC 7.15.080 does not set forth a requirement for a minimum number of council members to be polled by telephone in order for the poll to be valid; and WHEREAS, it is in the best interest of the City of Kenai to have a minimum of four (4) council members vote in a telephone poll in order for it be effective. NOW, THEREFORE, BE IT ORDAINED SY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that the Kenai Municipal Code, Title 7, Chapter 15, Section 080, entitled "Telephone Polls-Authority, Procedures, Recordation:" be amended as set forth below. 7.15.080 ;~gieDhone Polls-Authority. Procedure. RecordatioH: The Cit Mana*er ma obtain authorization (a) Authority: y g y from Council by telephone poll to: (1) Purchase budgeted supplies, materials, or services in excess of $1,000 if the need is critical in his estimation, and (2) Execute grant applications, accept bids and transfer funds for the budgeted items to accomplish the foregoing. (b) Procedure: All questions for telephone polls shall be in writing and approved by the City Manager or his designee for submittal to the City Clerk. These polls will be approved by the Finance Director to determine whether the proper appropriation is made by ordinance. The City Clerk may designate which City employees shall conduct the poll. No more than one question shall be conducted per telephone poll except in cases of extreme emergency where more than one question may be presented and except that the question concerning transference of funds may be presented along with the main question. Whenever possible, the question shall elicit a "yes" or "no" response. In all cases the designated employees shall make a reasonable attempt to contact all council members. If the telephone poll fails, the matter shall be considered as an agenda item at the next regular council meeting.
