HomeMy WebLinkAboutResolution No. 2019-07Sponsored by: Mayor Gabriel CITY OF KENAI RESOLUTION NO. 2019 -07 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING THE PAYMENT SCHEDULE FOR CITY RESIDENTIAL WATER AND SEWER CUSTOMERS IMPACTED BY THE PARTIAL FEDERAL GOVERNMENT SHUTDOWN TO ALLOW FOR DEFERRED PAYMENTS. WHEREAS , certain federal employees are not receiving paychecks from the federal government due to the ongoing partial federal government shutdown; and , WHEREAS, it is anticipated that those federal employees not currently receiving paychecks will be paid once the partial federal government shutdown is resolved, which based on previous similar federal budget impasses, should be in the near future; and WHEREAS, the City recognizes the short term economic impact on those federal employees not receiving pay; and, WHEREAS, the City would like to help those affected by allowing for delayed payments of residential water and sewer bills without incurring penalty or interest; and, WHEREAS, while the City's fee schedule and administrative application provide for a monthly payment, waiving the monthly payment requirement so penalty and interest payments are not accrued for those customers impacted by the ongoing partial federal government shutdown is in the best interest of the residents of the City of Kenai. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI , ALASKA: Section 1. That residential City water and sewer utility customers that can show they did not receive pay from their federal government employer due to the ongoing partial federal government shutdown may make payments for residential water and sewer accounts beginning for the month of December 2018, throughout the term of the partial government shutdown, within 25 days of the end of the shutdown, for the full amount due, without incurring any penalty or interest. Section 2. That this resolution takes effect immediately upon adoption . ADOPTED BY THE COUNCIL OF THE CITY OF KENAI , ALASKA, this 16 day of January, 2019. The purpose of this memo is to recommend approval of Resolution 2019-07 to assist those impacted by the current and ongoing partial federal shutdown which commenced at midnight EST on Saturday, December 22, 2018. As a result of the partial federal shutdown , impacted federal employees, some of which continue working, are not receiving a paycheck and payment of norma l monthly bills may not be possible and/or cause undue stress. In preparing Resolution 2019-07 the administration and I recognized the unique circumstances inflicted upon impacted federal employees by the partial federal shutdown. These employees, based on past federal budget impasses, will likely receive compensation for all hours worked and for hours while on furlough once federal funding is restored . This in all likelihood , is a temporary situation for which the employees will receive full compensation upon resolution of the budget impasse. Resolution 2019-07 recognizes the temporary nature of this situation and will allow those impacted by the partial government shutdown to defer payment of their water and sewer utility bills, beginning with bills issued for the month of December 2018 which become due on January 20, 2019 , until such time as the partial shutdown ends . Deferral of such payments will eliminate the assessment of penalty and interest on impacted accounts during the partial federal shutdown and for a period of twenty-five (25) days after the shutdown provided the account is paid in full. KMC 1. 75 .010 requires the assessment of penalty on amounts unpaid to the City twenty-five (25) days after their due date and this Resolution effectively changes the due date.
