5. CONSIDERATION OF PLATS
a. Resolution PZ2018-30 - Original Preliminary Plat of Thompson Park Donaghe Replat
submitted by McLane Consulting, Inc., P.O. Box 468, Soldotna, Alaska 99669, on behalf
of the Thomas Donaghe, 3305 Togiak Street, Kenai, Alaska 99611
The City Planner reviewed the staff report as provided in the meeting packet and specifically
noted the property owner wanted to eliminate the lot lines between Lots 1 and 2 to create a larger
lot for future development.
The City Planner reported that staff recommended approval of this preliminary plat, subject to the
following conditions:
x Further development of the property shall conform to all federal, State of Alaska, and local
regulations.

Commissioner Halstead MOVED to approve Resolution No. PZ2018-30 with staff
recommendations and Commissioner Springer SECONDED the motion.

10. REPORTS
a. City Council – Council Member Peterkin reviewed the action agenda from the
December 19 City Council Meeting.
b. Borough Planning – Vice-Chair Fikes reported the Commission met on December 7
and over 20 plats were reviewed and approved. She specifically noted the
manufacturing permit was approved to a current Marijuana Facility in Kasilof; an
anadromous water habitat protection permit in Anchor Point was approved; and an
announcement was provided by the Gravel Commission Representative, Robert
Ruffner, on gravel pit operations, discussing how best to move forward with
amendments to Borough Code. The Gravel Commission planned to meet again this
summer. Lastly, Fikes noted that the Kenai Peninsula Borough was able to obtain grant
funds for Agriculture on the Peninsula and would be creating a Committee, while seeking
input from the Kenai Peninsula community on use of funds.
c. Administration – City Planner Appleby reported on the following:
x She attended the Industry Outlook Forum by the Kenai Peninsula Economic
Development District (KPEDD) in Homer today – themes presented were local
businesses, bigger projects focused on oil, gas or mining, and natural amenities and
quality of life living here;
x The American Planning Association (APA) Alaska State Planning Conference
begins this weekend on January 13;
x She would develop a resolution of support for the Kenai City Council to support a
pedestrian pathway along Bridge Access Road from its intersection with Beaver
Loop Road to its intersection with the Kenai Spur Highway. The deadline for the
Alaska Transportation Alternatives Program (ATAP) grant application is January 31;
x The Alaska LNG Project Draft Environmental Impact Statement (EIS) was expected
to be released next month; and
x Updates to the Kenai Sign Code would still be coming in 2019.

Jim Glendenning thanked the City Planner for the City of Kenai Bicycle Friendly Community
Bronze Award information and commented on the City of Kenai and the Kenai Peninsula
Borough’s plans to move forward with pathway development.

ANALYSIS
The applicant submitted an application for an encroachment permit because an as-built survey
prepared on January 19, 2019, discloses that the attached garage for the single-family residence
located on the premises encroaches into the side yard setback. The Rural Residential (RR) Zone
requires a fifteen foot (15’) side yard setback, as set forth in Kenai Municipal Code (KMC) 14.24
Development Requirements Tables. The as-built survey shows the garage to be located 10.3 feet
from the property line. The garage encroaches into the side yard setback on the southern
boundary of the property.
A single-family residence, including a carport, was constructed in 1977 on the property. The
carport was enclosed in 2008. On May 26, 2009, a building permit was issued to the applicant for
an addition to the carport. The site plan submitted with the application for the building permit
indicated that the carport met the side yard setback requirement for the Rural Residential Zone.
It appears that there was an error in measuring the distance from the property line during
construction of the addition to the carport.

KMC 14.20.185(a)(b)(c) details the definition, intent, and permit application process for
encroachment permits. City staff deemed the application to be complete and the City is in receipt
of the application fee. Pursuant to KMC 14.20.280, Public hearing and notifications, City staff
published notice of the public hearing twice in the Peninsula Clarion, sent notification to real
property owners within three-hundred-feet (300’) of the affected parcel, and the applicant posted
notice of the application for an encroachment permit on the parcel.
The intent of an encroachment permit is to relax development requirements to remedy
encroachments and nonconforming uses which satisfy the requirements of financial institutions
and which do not fall under KMC 14.20.050, Nonconforming lots, structures, and uses. KMC
14.20.185(d) Encroachment Permits Review Criteria states four conditions that the Planning and
Zoning Commission must deem to exist when establishing findings prior to issuing an
encroachment permit:
x KMC 14.20.185(d)(1) An encroachment as defined in subsection (a) exists.
Condition Exists: Subsection (a) defines an encroachment as any object or structure
above or below ground and constructed or located in a manner other than set forth in the
Development Requirements Table. The garage was constructed above ground and into
the side yard setback as set forth in KMC 14.24 Development Requirements Table and
an encroachment exists.
x KMC 14.20.185(d)(2) The encroachment does not encroach upon a Federal, State or
City right-of-way or utility easement.
Condition Exists: The structure faces VIP Drive, a City-maintained road. The utility
easements are located within the front ten feet (10’) of the property line adjacent to the
right-of-way for VIP Drive. Therefore, the structure does not encroach onto a right-of-way
or utility easement.
x KMC 14.20.185(d)(3) The issuance of the encroachment permit will not authorize a use
which is a not a principal permitted use in the zoning district in which the property is
located.
Condition Exists: A single-family dwelling, defined as a building or any portion thereof
designed for residential occupancy with one dwelling unit, is a principal permitted use in
the Rural Residential Zone. Accessory buildings are considered part of the main building
when connected by a common wall, as is the case with the attached garage.
x KMC 14.20.185(d)(4) The encroachment is not located across a platted lot line.
Condition Exists: The encroachment does not cross a platted lot line.
Building Official Comments: There is sufficient separation from the property line and no changes
in construction will be required.
RECOMMENDATIONS
City staff find that the applicant meets the criteria for issuance of an Encroachment Permit as set
forth in subsections (d)(1) through (d)(4) of Kenai Municipal Code 14.20.185, and hereby
recommends that the Planning and Zoning Commission approve the encroachment permit
application, subject to the following conditions:

1. Applicant must comply with all federal, State of Alaska, and local regulations.
2. Pursuant to KMC 14.20.185(g), this permit shall expire automatically upon termination or
interruption of the use; damage to the building, structure, or object which makes it
uneconomic to repair the building, structure, or object; or, the expiration of the useful life
of the building, structure, or object, whichever comes first.

house located at 160 Phillips Drive.
Please also consider the statistics and information from Kenai Police Dispatch pertaining to
Agenda Item 6b:
Kenai Police Dispatch call record for 160 Phillips Drive (subject property)
Kenai Police Dispatch call record for 135 Phillips Drive (neighboring property)
A neighbor reported observations of increased police activity at 160 Phillips Drive and attached
is a report of calls fielded by Kenai Police Dispatch. I confirmed with the applicants that they
purchased the property in late 2011 and started using the property as a boarding house in early
2012.
The applicants stated their observations of increased police activity across the street from them
at 135 Phillips Drive. I have also attached a call record from Kenai Police Dispatch for that
residence.
Kenai Police Dispatch stated anecdotally they did not view the subject residence as a hot spot of
crime and did not believe the residence was tied to illegal activity occurring in a wooded area with
gravel roads adjacent to North Dogwood Road.

community
Without places such as these we could have an increase in homelessness and an increase in recidivism
The Alpha House is a faith based,safe living residence that provides an anchor to men who have been recently
released into the community. Rent is whatever they can affford.
Bible studies are held weekly.
Without programs like this crime and redivision would increase in our community
As a Chaplain, I refer men that are due to be released to Perry and Sheryl.
Thank God for their dedication for without them these men would have no options

I have known Perry Neel for 30 years and his wife for at nearly 20 years. Perry, Sheryl, and I are volunteers in
the Kairos Prison Ministry on the Kenai Peninsula and we serve at the Wildwood Correctional Facility. Perry
and Sheryl have vounteered for 13 years and I have been involved for 6 years.
I understand there are issues and concerns with the Neel's Alpha House in Kenai.
I want to urge you to resist shutting down this very important part of the outreach and support for recently
realeased Wildwood residents.
I completely understand the community's concerns and fears. I want you to consider the broader implications of
this situation. When the Wildwood residents are released back into our community, the majority of them have
no support from their families or anyone else. They have no money, no vehicle, no place to sleep, and no
prospects of employment.
Perry and Sheryl have provided a place to sleep and call home for these men over the past several years. I assure
you they have done so at personal financial lost to themselves. Many residents can't pay the low rent on a
regular basis as they are struggling to find work.
I'm certain that some of the residents are still struggling with addictions and have other social problems to
wrestle with as well. Some of them will struggle through and come out truly rehabilitated and some will most
likely return to prison eventually.
For every man that manages to break the chain of dependance and the related criminal live style, our
community benefits greatly. Not only do we gain a productive citizen, but the crime associated with
unrehabilitated individuals is reduced as well.
To be absolutely honest, I myself would be concerned if I lived next to a place like Alpha house, but I earnestly
believe that Alpha house is having a much more positive effect on our community than we would otherwise be
seeing without it.
I applaud Perry and Sheryl for their efforts to support these men and try to make a difference in our community
and I ask you to please thoughtfully consider the impact to our community as a whole with regard to closing
Alpha House.

to improve the residence from the time they had purchased it. I hope they are allowed to continue their mission and

My name is Alex Zerbinos and I have been involved with Kairos Prison Ministry and the ALPHA reentry
program out at Wildwood Correctional Facility for 12 years now. One of the most distressing things that I often
see with guys getting out of prison is the lack of housing and jobs. The general public has a preconceived notion
that these guys are not to be trusted or allowed to be given a second chance. And for some guys getting out that
is the case and I agree with them. However Perry has screened these guys, and provide a home for those who
have gone through the Kairos program. We have found that these guys have the lowest rate of returning back to
Wildwood prison. Giving them affordable housing and having a live in mentor has helped these guys get back
on their feet and become contributing citizens to our community. Please help us help those who have paid their
price to society and give them a chance to succeed. Affordable housing and jobs will keep these guys off the
streets and out of trouble. They made changes to their lives and we can help them get on with their lives. Thank
You for your time.

that need a place to live while trying to establish a better life. These men have acknowledged their mistakes and have

entry residences on the Kenai Peninsula. Perry and Sheryl Neel have tried to fill that void with safe and secure housing
for releasing offenders. I was at this residence just this last summer. It is clean and well kept and they had done much
to improve the residence from the time they had purchased it. I hope they are allowed to continue their mission and
help offenders return to society and become productive citizens once again.

My name is Alex Zerbinos and I have been involved with Kairos Prison Ministry and the ALPHA reentry
program out at Wildwood Correctional Facility for 12 years now. One of the most distressing things that I often
see with guys getting out of prison is the lack of housing and jobs. The general public has a preconceived notion
that these guys are not to be trusted or allowed to be given a second chance. And for some guys getting out that
is the case and I agree with them. However Perry has screened these guys, and provide a home for those who
have gone through the Kairos program. We have found that these guys have the lowest rate of returning back to
Wildwood prison. Giving them affordable housing and having a live in mentor has helped these guys get back
on their feet and become contributing citizens to our community. Please help us help those who have paid their
price to society and give them a chance to succeed. Affordable housing and jobs will keep these guys off the
streets and out of trouble. They made changes to their lives and we can help them get on with their lives. Thank

I would like to make it known that Perry and Sheryl Neal have established this residence for the sole reason to help men
that need a place to live while trying to establish a better life. These men have acknowledged their mistakes and have
accepted God into their lives. Perry and Sheryl have undertaken this house and obligations it requires to help this
community give these men a chance to re‐enter society and become productive. I know of several men who have
benefited by the Alpha House and now live successful lives. I ask that the Alpha House be continued to operate because
it is doing a valuable service for this community.

Dear Ms. Appleby & the Kenai Planning and Zoning Commission,
I am writing in support of Perry and Sheryl Neel’s application for a boarding house. I have
served as a Religious Volunteer at Wildwood Correctional Complex for the last 13 years. The
Neels have provided transitional housing for men who are being released into our
community. Before the Neels opened this house, there was only one place that men could find
housing upon their release. They have a house manager and there are strict guidelines for the
residents. Any violation and they lose the privilege of staying there. Department of Corrections
have come by to inspect the facility and its operation. I am sure that if the Commission
members had the time, the Neels would welcome an onsite visit.
