RESOLUTION NO. PZ2019-06
A RESOLUTION OF THE PLANNING AND ZONING ADMINISTRATION OF THE CITY OF
KENAI APPROVING THE ATTACHED LANDSCAPING/SITE PLAN :
WHEREAS, the attached Landscaping/Site Plan Review was:

WHEREAS , the City of Kena i Planning and Zoning Administration finds this plan provides for
orderly and safe development within the City commensurate with protecting the health, safety,
and welfare of its citizens, and provides adequate and convenient open spaces, light and air in
order to avoid congestion of commercial and industrial areas ; and,
WHEREAS , the plan appears to provide for landscaping and/or the retention of natural
vegetation in conjunction with commercial and industrial development within the City; and,
WHEREAS, the purpose of landscaping is to visually enhance the City's appearance and
reduce erosion and stormwater runoff, and the plan appears to meet these criteria .
NOW, THEREFORE, BE IT RESOLVED , BY THE PLANNING AND ZONING
ADMINISTRATION OF THE CITY OF KENAI:
Section 1. That the applicant meets the conditions required for a landscap ing/site plan permit,
including :
a) A variety of techniques to address perimeter/buffer/interior/street right-of-way/parking lot
landscaping
The renovation of the existing building will not impact the parking lot or parking lot
landscaping . Native Woods w ill be kept along the property line facing 2 nd Avenue and
the existing landscape bed will be kept along the property line facing the Kenai Spur
Highway.
b) A use compatible with surrounding properties;

This property is adjacent to the Kenai Spur Highway and lies within the General
Commercial (CG) Zone . The land use plan category within the 2016 Envision Kenai
2030 Comprehensive Plan for this area is Mixed Use, which allows for commercial and
residential uses. The properties to the east and west of the subject parcel are
commercial enterprises . The parcels lying north of the subject parcel are zoned
Suburban Residential (RS). Resolution PZ2017-20 granting the conditional use permit
for the property reviewed that the facility would be fully enclosed and it met buffer
requirement for commercial marijuana establishments .
c) Applicant has obtained additional permits or approvals, including a building permit and a
conditional use permit approved by the City of Kenai Planning and Zoning Commission
through Resolution PZ2017-20 .
d) Parking lots comply with KMC 14.20.250;
This existing parking lot is paved. The site plan designates twenty (20) parking spaces,
wh ich meets the parking requirements (8 spaces for the marijuana product
manufacturing facility and 10 spaces for the retail business).
e) Snow storage and drainage are referenced on the site plan;
Snow storage will be at the rear of the lot on the east side of the parcel , which will not
block the required parking spaces or visibility of ingress or egress.
f) The dumpster will be located at the rear of the building and screened by a wooden
fence .
g) Ingress and egress routes traffic away from residential streets;
Access to subject parcel shall be via the Kenai Spur Highway. The Kenai Spur Highway
is a major collector street. The residential properties in the vicinity front 2nd Avenue,
which is accessed by either McKinley Street or Haller Street.
h) Trees, shrubs, and plants should be appropriate for the climate and not invasive ;
There is natural vegetation at the rear of the lot that will be left in place and the existing
landscape beds along the south side of the building will be maintained with appropriate
vegetation.
Section 2. That the landscaping/site plan permit is subject to the following conditions :
a) Development of the property shall conform to all federal, State of Alaska, and local
regulations.
b) No snow may be stored in such a manner that would block visibility for ingress and
egress to the parcel.
c) If construction of the project has not started within one year of the approval of the
landscaping/site plan (March 15, 2020), the approval may be revoked by the
Administrative Official after providing at least thirty (30) Day notice unless extended for
good cause .
d) Any plants used for landscaping will be appropriate for the climate and not invasive per
the Alaska Cooperative Extension Service.

e) All required landscaping as presented in the approved landscaping plan shall be
installed within two (2) years of the approved landscaping plan (by March 15, 2021 ).
