WHEREAS, KMC 22.05.010 states "Disposal or sale of lands shall be made only when, in the judgment of the City Council, such lands are not required for a public purpose.", and WHEREAS, the City Administration has received a request by the adjacent property owner asking that the referenced property be made available for sale, and WHEREAS, it is the recommendation of the City Administration, the Planning and Zoning Commission and the Parks and Recreation Co~aamission that the property be made available for sale. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that proposed Tract B, Peterson Subdivision, City- owned Lands, is not required for public use. Williams and the Kenai City Council FROM: Kim Howard, Administrative Assistant,-- DATE: November 15, 1990 RBs James Arnesa - Request to Purabase Proposed Traat B, Peterson Subdivision, Addition No. i KMC 22.05.010 states "Disposal of sale of lands shall be made only when, in the judgment of the City Council, such lands are not required for public purpose." It is the recommendation of the City Administration, the Parks and Recreation Commission and the Planning and Zoning Commission that the above referenced property be sold. Therefore, Ordinance No. 1406-90 has been prepared for introduction at the November 21, 1990 City Council meeting. A public hearing is scheduled far December 5, and the effective date, if passed, will be January 5, 1991. Mr. Arness is the adjoining landowner of the referenced property and has requested to purchase the property. Attached are maps of the area. KMC 22.05.075 Prooerty Sale to Adiacent Owners states: The Council may approve, by resolution, after public notice and an opportunity for public hearing, the sale and conveyance of a parcel of City property at its appraised value to the owner of the adjacent land whenever, in the judgment of the City Council, the parcel of land is of such small size, shape, or location that it could not be put to practical use by any other party and, in addition thereto, where there is no foreseeable need of the land for any future use by the City. Mr. Arness submitted an appraisal which has been reviewed by an appraiser the City selected. The review appraiser concurred in the value of $10,000. It is estimated the usable portion of the 1.063 acre site at 4,000 to 5,000 square feet. The site has no physical access, although the Spruce Street Road right-of-way is platted along the northwest corner. There are no public utilities. The property is zoned Conservation.
