Suggested By: City Council CITY OF xzNAi ORDINANCE 1257-48 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING RENAI MUNICIPAL CODE, SECTION 1.55.030(e), BY INCREASING THE AMOUNT OF TIME AN ACTING CITY ATTORNEY MUST SERVE PRIOR TO BEING ENTITLED TO THE MINIMUM SALARY RATE FOR CITY ATTORNEY_ AS PROVIDED BY KMC 33.50.010. WHEREAS, a Deputy City Attorney will be paid at a higher rate of Pay than a Legal Assistants and, WHEREAS, it is the desire of the Council that the Deputy City Attorney not be paid additional monies while serving as Acting City Attorney for brief periods of time; and, WHEREAS, the class title and pay range for a Deputy City Attorney is appropriate and sufficient to require a Deputy City Attorney to serve a$ Acting City Attorney for brief periods without additional compensation; and, WHEREAS, the addition of a class title and pay range for a Deputy City Attorney can be created at little or no cost to the City by requiring him to serve as Acting City Attorney for brief periods of time without additional compensation. NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF RENAI, ALASKA, that KMC 1.55.030(e) is amended as follows: 1,55.030 Acting City_tto_ rney: (a) In the event the City Attorney is not available to perform the duties of the office for five (5) or more days because of illness, incapacity, annual leave, official leave for City business, or any other reason, the City Attorney may appoint -an Acting City Attorney to perform the duties of the City Attorney during such absence, incapacity, or unavailability. (b) In the event of a vacancy in the office of City Attorney, the City Manager may appoint an Acting -City Attorney, which appointment shall be subject to confirmation by a City Council vote in the manner provided for ordinances. (c) Any person appointed Acting City Attorney under these provisions shall be a member in good standing of the Alaska Bar Association and duly licensed to practice law in Alaska. "7 �r i., (4) The appointment of an Acting City Attorney shall be C-11 made in writing and copies of the appointment shall be distriouted to all Councilmembers, Department Heads, and Commission Chairpersons, and a copy thereof shall be placed in the personnel file of the employee so appointed.
