HomeMy WebLinkAboutORDINANCE 1127-1986Suggested byi Planning b Zoning Commission CITY OF KENAI ORDINANCE NO. 11127-96 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI' ALASKA, AMENDING THE OFFICIAL KENAI ZONING MAP BY REZONING LOT 69 BLOCK 29 AND LOT 1, BLOCK 1, SPRUCEWOOD GLEN SUBDIVISION FROM URBAN RESIDENTIAL (RU) DISTRICT TO GENERAL COMMERCIAL (CG) DISTRICT AND REQUESTING THE KENAI PENINSULA BOROUGH TO AMEND THE LAND USE PLAN. WHEREAS, KMC 14.20.270 establishes a procedure to emend the Official Zoning Map of the City of Kenai; and, WHEREAS, rezoning petition has been received by Edwin R. Lowry, bearing the signatures of a majority of the property owners within the designated area to rezone the referenced lands (per Exhibit "A") from Urban Residential (RU) to General Commercial (CG) District; end, WHEREAS, the Kenai Advisory Planning do Zoning Commission hoe conducted the required public hearing on April 23, 1906; and, WHEREAS, the Planning A Zoning Commission recommends approval of the amendment to the Official Zoning Map to General Commercial (CG) District and recommends the Kenai Peninsula Borough amend the Land Use Plan. Lowry has submitted a petition to rezone properties currently designated by the Land Use Plan as medium density residential to a general conic;al district to accomodate the construction of a health club on one of the two lots proposed for rezoning. " —.ice_ r„ s FL REZONEt Sprucewood Glen •2 Page 2 M LVSIS Upon researching files of rezonings on Sprucewood Glen S/D it is found that on September 269 19849 a public hearing was held concerning the rezoning Of Tract F-19 Sprucewood Glen #29 directly adjacent and originally a part of development. Many the overall tract intended for medium density residential persona spoke on the subject including Mayor Wagoner. Public sentiment at the time appeared to be against any further rezoninge in the area. Mr. Lowry was asked prior to this meeting to prepare a detailed site plan of s"h his mall. This site plan was approved in conjunction with the rezoning of_, that parcel. The lots requested for rezoning are currently residential in use and are surrounded on three sides by General Commercial (CG) and on the south side by Suburban Residential (RS). The granting of the rezoning to CC would be contiguous on two sides, however, would oleo effectively enclose the UR parcel and create a spot zone. The Land Use Plan currently in effect designates that area as medium density residential, the Plan being updated speaks to preserving residential neighborhoods. Nam. •. The current zoning code does not clearly establish buffers for residential ..- ' y and caomercial properties which abut as it does for industrial uses. The ' ,- health club would be on one of these two late directly adjacent to -- - , proposed a 4-plex.
