WHEREAS, KNC 14.20.270 establishes a procedure to amend the Official Zoning -2- L Hop of the City of Kenai, and WHEREAS, a rezoning petition hoe been received from Shiele Phillips beating the signatures of a mojorlty of the property owners within the designated ores to rezone the referenced lands (per Exhibit "A") to Suburban Residential (RS) District, and WHEREAS, the Kenai Advisory Planning & Zoning Commission has conducted the required public hearing on April 239 1966 and as a result of that public hearing recommend the rezoning as stated with the exclusion of lots 69 7, A B# Block 3, Thompson Park S/D. BIk9Lo�1 v CITY OF KENAI TLL/wlol m-nu MEMORANDUM TOe Councilmembers City of Kenai FRCAs m Rogere, City Attorney y of Kenai DATE: May 29, 1986 RE: Ordinance 1128-86, Thompson Park and Valhalla Rezoning The Council has before it Ordinance 1128-86 as a result of a petition initiat'ed'.bv Spencer DeVito, Judith DeVito, Shiela M. Phillips, J. VonBergen Phillipa, Clancy Johnson, and Alyce Johnson. The purpose of the efforts of petitioning and gett!oj the present ordinance in.front of the Council for passage was not so much to have their'ledd rezoned at residential but rather, as stated by Mr. Clancy Johnson at the May 21, 1906 Council Meeting, to insure that another's property that had been zoned for twenty years as commercial, could not be developed adjacent to the Spur Highway as commercial property. Having failed to accom'0iso this, petitioners Spencer and Judith DeVito and Mr. Clancy..3ohnsan have specifically requested that their property be excluded•.from top--Ardinance. Mr. Johnson further states that he has e'"plaXyl" of his wife, however no such provision exists in our Code for such a "proxy." While it hoe been pointed out that at least one of the other petitioners wee in the audience, the desires of the Phillips' was not expressed on the record. Concern was expressed by the City Attorney as to whether or not it would be appropriate for the Council to act on the ordinance before it and the Council acquiesced to tabling the matter pending recommendation from the City Attorney. 1 rµ, The Council has heard a great deal of public teetimonyt much of It clothed in terms of public heelth, safety and welfare by the petitioners as ostensible reasons for wanting the rezone. it now becomes patently obvious that the Bole real purpose of the rezone was to preclude the appropriate use of commercial property owned by another. Should any of the Council desire to review any of the prior proceedings, transcripts have been made and are availablet along with other documentation. The procedures in the instant case are set forth in KMC 14.20.270. No provision is provided for withdrawal of a name from a petitions and while the Planning A Zoning Commission recommendation is for the ordinance# the Council should act pursuant to KMC 14.20.270(c)(4), which states "The Kenai City Council# in accordance with the provisions of the Kenai Municipal Codep may or may not adopt the amendment as a City ordinance. (Ord. 925)" At this juncture, it is appropriate for the Council to proceed in the manner that they would with any other ordinance before it and exercise their prerogative se elected officials and either pees or fail this ordinance.
