HomeMy WebLinkAboutORDINANCE 1134-1986Suggested by: Administration CITY OF KENAI ORDINANCE NO* 1134-66 T' AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENA19 ALASKA9 AMENDING KMC 22.OS.040(c) BY REQUIRING THAT A LESSEE OF AIRPORT LANDS MUST HAVE EITHER LEASED FOR A PERIOD OF TWO YEARS OR COMPLETED DEVELOPMENT IN CONFORMITY WITH A DEVELOPMENT SCHEDULE BEFORE HE HAS A RIGHT TO NEGOTIATE A PURCHASE AT FAIR MARKET VALUE, WHEREAS, the federal Aviation Administration (FAA) is concerned that lessees of Airport Lands may be loading property with the Intention of subsequently purchasing the property by negotiations and thereby avoiding competitive bidding; and, WHEREAS, the City and FAA have agreed that a two-year waiting period will reduce the number of occurrences of such leaseal and, WHEREAS, delaying purchases until development is completed or two years have passed is in the best financial interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENA19 ALASKA9 that KMC 22.05.040(c) be amended as follows: 22.OS.040(c) If the tract of land (airport or otherwise) proposed to be sold is leased land where the lease sets forth a develogment schedule (UPON WHICH SUBSTANIIAL INFROVEHENT5 HAVE 11W HAVEqj WIMSee may, at his request, negotiate the sale of said land at not lose then fair market value.
