HomeMy WebLinkAboutORDINANCE 1011-1985Suggested by: Administration CITY OF KENAI ORDINANCE NO. 1011-85 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, FINDING THAT CERTAIN CITY -OWNED LANDS ARE NOT REQUIRFD FOR A PUBLIC PURPOSE. WHEREAS, KMC 22.05.010, .030, and .050 requires that the Council shall determine whether certain City -owned properties are needed for a public purpose, and WHEREAS, the disposition of such lands shall be made only upon finding that said property is not needed for a public purpose, and WHEREAS, Lot 11A, Richka Creek Subdivision consists of 1.197 acres of upland property adjacent to the Richka Creek drainage and Fifth Avenue, and WHEREAS, the Kenai Advisory Planning & Zoning Commission lot/ recommended disposition of the property subject to its use for single and duplex residential development, and WHEREAS, there is interest in purchasing this property for private development purposes, and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, as follows: Section 1: The described City -owned land is not needed for a public —purpose and shall be made available for sale: Lot 11A, Richka Creek Subdivision Section 2: The described City -owned land shall be conveyed with the res riction of use for single and duplex family residential dwellings and the development regjirements of the Suburban Residential (RS) District. Section 3: The described City -owned land shall be disposed of by comps tive sealed bid sale as provided for in XMC 22.05.040.
